How Crypto-to-Crypto Swaps Are Taxed in France (2026 Rules)

For a French tax resident investing privately, swapping one qualifying digital asset for another is generally not taxed immediately when no cash adjustment (soulte) is involved. The exchange is treated as an interim transaction, with taxation deferred until a later taxable disposal. Selling for euros, paying with crypto for goods or services, or completing a swap with a cash adjustment can trigger tax.

The basic French rule for crypto-to-crypto swaps

Article 150 VH bis of the French General Tax Code provides a deferral for exchanges without a cash adjustment between qualifying digital assets, or rights relating to them. The Direction générale des Finances publiques (DGFiP) describes these transactions as opérations intercalaires: the exchange changes the asset held but is not treated as a taxable disposal at that moment. The current official explanation is available in the DGFiP guidance on disposals of movable property.

In practical terms, exchanging Bitcoin for Ether, or one token for another, normally does not create an immediate income-tax bill if you receive only digital assets and no cash adjustment. The latent gain remains embedded in your portfolio. A taxable event can occur later when you sell an asset for legal tender, exchange it for a non-digital asset, use it to buy a service, or make another transaction that does not qualify for the deferral.

The result applies to individuals managing digital assets as personal wealth. Your tax status, the exact transaction mechanics and the tax year must be established before applying the rule.

How common transactions are treated

Transaction Immediate treatment for a private investor Reason
Digital asset A exchanged for digital asset B, with no cash adjustment Tax deferred Interim exchange under Article 150 VH bis
Digital asset exchanged with a cash adjustment (soulte) Taxable disposal treatment The official guidance distinguishes exchanges that include a cash adjustment
Digital asset sold for euros or another legal tender Potentially taxable Proceeds are received in fiat currency
Digital asset exchanged for goods or services Potentially taxable The transaction is not an asset-for-asset digital exchange
Liquidity-pool deposit, wrapped-token conversion or bridge transaction Not specifically settled by the cited guidance Classification depends on the legal and technical facts

When a “swap” becomes a taxable disposal

No-soulte asset-for-asset exchange

A direct exchange of one qualifying digital asset for another, without receiving money or another non-digital benefit, is the clearest case for deferral. You do not report that deferred exchange as a taxable disposal at the time it occurs. Keep the transaction records because the later calculation must account for the portfolio’s acquisition cost and value.

Cash adjustments

A soulte is a cash adjustment paid or received to balance an exchange. The official disposal guidance treats exchanges with a soulte as taxable disposals. Do not assume that calling a transaction a “swap” makes it tax-deferred: the presence of a cash component changes the analysis.

Fiat sales, purchases and services

Converting crypto into euros, dollars or another legal tender is a taxable-disposal event when the other conditions for taxation are met. The same applies when crypto is used to acquire a non-digital good or a service. The taxable proceeds are measured for the disposal, even if the asset was originally acquired through a tax-deferred crypto-to-crypto exchange.

Complex DeFi mechanics

The official materials do not specifically resolve how the deferral applies to liquidity-pool deposits, wrapped-token conversions or blockchain bridges. The general question is whether the transaction is genuinely an exchange without a cash adjustment between qualifying digital assets. Smart-contract steps may instead involve transfers, the creation or destruction of tokens, fees, or receipt of a different legal instrument. Because the cited guidance does not settle those boundaries, obtain transaction-specific professional advice rather than treating every DeFi operation as automatically tax-free or automatically taxable.

Which French tax regime applies?

Private asset management

Article 150 VH bis is the regime for an individual managing digital assets as personal wealth. Taxable disposals are calculated under the portfolio method described below, and the annual result is reported with Form 2086. The current DGFiP FAQ, modified 17 July 2026, explains this regime and the filing process: “Comment déclarer les plus ou moins-values sur cessions d’actifs numériques”.

Commercial purchase-and-resale activity

Repeated commercial purchase and resale activity can be classified as business income (bénéfices industriels et commerciaux, or BIC), rather than private-investor capital gains. That classification is fact-dependent and is not determined simply by the number of trades or by using an exchange platform.

Professional-like trading outside a business

Trading that is carried out on a professional-like basis outside a commercial business can fall under non-commercial profits (BNC). The DGFiP FAQ cites a 34% micro-BNC allowance for the professional-like BNC case. That allowance does not apply to an ordinary private investor and should not be used to calculate a private portfolio’s gain.

The classification guidance is discussed by BOFiP at this page on digital-asset activity. If your activity resembles an organized trading business, obtain advice before using the private-investor form or rate.

How the taxable gain or loss is calculated

France uses a portfolio-wide calculation for each taxable disposal. The gain is not simply the difference between what you paid for the particular coin sold and what you received for it. The official formula is:

Gain or loss = disposal proceeds − [total acquisition cost of the digital-asset portfolio × disposal proceeds ÷ total portfolio value]

The portfolio value is measured at the time of the taxable disposal and includes your digital assets held across storage locations. The total acquisition cost is the cost basis of the portfolio, not merely the historical cost of the asset selected for sale. Documented expenses directly connected with the disposal may reduce the disposal proceeds. The formula and reporting fields are set out in the Form 2086 notice and the DGFiP disposal guidance.

Illustrative calculation

Assume, solely as an illustration, that immediately before a taxable sale your entire digital-asset portfolio has a total acquisition cost of €40,000 and a market value of €100,000. You sell assets for €15,000. The portfolio allocation in the formula is €40,000 × (€15,000 ÷ €100,000), or €6,000. The resulting gross gain is €9,000 before any allowable documented disposal expenses. The calculation is based on the portfolio proportions at the sale date, not on a separate “gain” figure supplied by an exchange.

Why complete records matter

You need reliable acquisition costs, dates, quantities, sale proceeds, fees and valuations for every taxable disposal. Include assets held in different wallets and platforms when determining the portfolio value. Missing transfers or duplicate deposits can materially distort the result, so reconcile exchange statements with wallet histories before completing Form 2086.

The €305 annual exemption

The current DGFiP FAQ states that the annual exemption applies when the sum of your gross proceeds from taxable digital-asset disposals does not exceed €305. This is a proceeds threshold, not a net-profit threshold. It excludes exchanges that are deferred under the no-soulte rule.

For example, a year in which taxable disposals produce €250 of gross proceeds can fall within the threshold even if the underlying gain is different. Conversely, €400 of gross proceeds can remove the exemption for the year even if the net gain is small or there is an overall loss. Measure the threshold using the year’s gross taxable disposal proceeds and do not count a deferred no-soulte exchange.

Rates for private investors and the tax-year issue

For the rate published in the DGFiP FAQ modified 17 July 2026, the prélèvement forfaitaire unique (PFU) is 31.4%: 12.8% income tax plus 18.6% social levies. The FAQ also states that an individual may opt for the progressive income-tax scale instead of the flat income-tax component, subject to the rules for that tax year. Confirm the rate and election available for the year you are filing.

How to declare taxable disposals

  1. Separate deferred swaps from taxable disposals. Identify crypto-to-crypto exchanges with no cash adjustment and keep them out of the taxable-disposal total. Flag any transaction involving euros, goods, services or a soulte for calculation.
  2. Assemble portfolio data. Export statements from exchanges, wallet histories and records of transfers, acquisition costs, disposal proceeds, dates, quantities and documented fees. Include assets held across all storage locations.
  3. Calculate each taxable disposal and the annual result. Apply the portfolio formula at each disposal, then determine the annual net gain or loss using the official Form 2086 method.
  4. Complete annex 2086 online. The annual result flows to line 3AN when it is a gain or line 3BN when it is a loss. The official form page is Form 2086 – Declaration of gains or losses on disposals of digital assets.
  5. If filing on paper, use 2042 C and attach the detail. The DGFiP FAQ instructs paper filers to report the net result on Form 2042 C and provide transaction details in annex 2086.
  6. Declare foreign digital-asset platform accounts separately. The DGFiP FAQ states that foreign platform accounts have their own declaration obligation. Check the current return instructions for the applicable account declaration and do not assume that reporting the gain on Form 2086 satisfies it.

Edition year versus income year

The DGFiP page lists a 2026 edition of Form 2086, while the linked notice is specifically titled for income 2025. A form’s edition year is therefore not automatically the year in which the income arose. Match the form and instructions to the income year shown on your tax return.

Records to retain

  • Trade confirmations showing the asset, quantity, date, valuation and proceeds.
  • Wallet addresses and transaction hashes for transfers and on-chain activity.
  • Acquisition invoices, deposits, withdrawals and records of fees.
  • Evidence supporting the value of the full portfolio at each taxable disposal.
  • A classification log identifying deferred no-soulte exchanges, taxable disposals and transactions requiring professional review.
  • Copies of Form 2086 calculations and submitted returns, together with foreign-account declarations where applicable.

Retain records long enough to substantiate the figures in your French tax return. A spreadsheet can work for a simple history; a long or multi-wallet history requires reconciliation that captures transfers without treating them as sales.

Common mistakes and how to avoid them

  • Using the old 30% rate: apply the rate published for the relevant tax year; the current 2026 DGFiP FAQ states 31.4%.
  • Counting a deferred swap as a sale: an asset-for-asset exchange without a soulte is an interim transaction under the stated rule.
  • Using net profit for the €305 test: the threshold measures gross taxable disposal proceeds.
  • Calculating only the coin sold: the official method allocates the total portfolio acquisition cost using the portfolio value at disposal.
  • Ignoring assets in other wallets: the portfolio calculation covers digital assets across storage locations.
  • Assuming every DeFi “swap” qualifies: liquidity pools, wrapped tokens and bridges are not specifically resolved by the cited materials.
  • Filing only the capital-gain form: foreign platform accounts may require a separate declaration.
  • Confusing form edition and income year: verify that the Form 2086 notice corresponds to the year being reported.

Bottom line

For a French private investor, a crypto-to-crypto exchange with no cash adjustment generally defers taxation rather than triggering tax immediately. Tax normally arises when you make a taxable disposal, and the gain is calculated from the value and acquisition cost of your entire digital-asset portfolio. Track every transaction, apply the €305 gross-proceeds test, use the current year’s rate and Form 2086 instructions, and obtain transaction-specific advice for DeFi activity or professional-like trading.
