Short answer: An AI agent does not create a special refund or chargeback system. A refund is money the merchant voluntarily sends back; a chargeback is a formal dispute handled by your card issuer or bank. If an agent used your account outside the authority you gave it, notify the seller and your financial institution immediately, use the procedure for your payment rail, and keep the agent’s instructions and logs. Do not seek both remedies for the same amount: once a bank dispute returns the money, the merchant generally cannot issue a second refund.

The practical issue is proving what the agent was allowed to do. As Federal Reserve Governor Christopher Waller put it, the question is shifting from whether a buyer is an authorized payer to whether “an agent has the authority to pay on the buyer’s behalf.”

What is the difference between a refund and a chargeback?

A refund is a voluntary merchant credit. A chargeback is an issuer- or bank-managed reversal after you dispute a transaction. They can lead to the same money coming back, but they use different evidence, deadlines and decision-makers.

Remedy Who starts it Who decides Best first use Important limitation
Refund You ask the merchant Merchant under its policy and legal duties The order is canceled, unwanted, defective or not delivered and the seller will cooperate A promise to refund is not the same as a completed credit; obtain a written record and watch the account
Chargeback You notify your card issuer or bank Issuer or bank under the applicable card-network and consumer-protection rules The merchant will not resolve an unauthorized, duplicate, incorrect or undelivered charge You must meet the relevant notice deadline and cannot recover twice

For an AI-generated purchase, tell both parties what has happened. If you have already opened a dispute, tell the merchant; if the merchant has credited you, tell the issuer. OpenAI’s consumer guidance says it cannot issue a separate refund while a bank dispute is active or after the bank has returned the funds.

What should I do if an AI agent bought something without my permission?

Move quickly, but first establish whether the transaction was truly outside your authorization. A family member with access, a shared account, a forgotten subscription or an agent operating under a setting you enabled can look like fraud.

  1. Verify the charge. Match the amount and date with invoices, subscription pages, order confirmations and family or shared-account activity. Check whether you gave the agent a recurring-payment permission or a broad spending instruction.
  2. Contact the seller. Ask for cancellation or a refund as soon as possible and request a written case number, promised amount and expected credit date. For an unordered or undelivered product, the Federal Trade Commission advises contacting the seller before disputing the charge.
  3. Notify the bank or card issuer. Call promptly, explain that an automated agent made or initiated the transaction, and ask which dispute channel applies. Keep the representative’s name, call date and reference number.
  4. Use the correct written process. Credit-card billing errors normally require a written notice to the billing-inquiries address, not merely a phone call. Debit-card and bank-account electronic-fund-transfer errors follow a different investigation framework.
  5. Preserve evidence. Save receipts, invoices, agent prompts, confirmation screens, authorization settings, spending limits, delivery records, cancellation requests, emails, dispute letters and every relevant date. These records help an issuer determine what the agent did and what you authorized.
  6. Prevent a repeat. Revoke the agent’s payment token or account access, cancel recurring instructions, change credentials and remove saved payment methods until the scope is clear.

Describe the facts accurately. “I did not authorize this transaction” is different from “I authorized the agent to spend up to $100, but it charged $1,000” or “the seller never delivered.” The distinction affects the evidence and the legal rule applied.

What are the U.S. credit-card chargeback deadlines?

For a U.S. credit-card billing error, the Federal Trade Commission says to send a written dispute within 60 days after the statement containing the error was sent. Send it to the billing-inquiries address shown on the statement, include the account information, amount and reason, and use a method that gives you proof of delivery.

What happens after the issuer receives it?

The issuer generally must acknowledge the dispute within 30 days. It normally must resolve the investigation within two billing cycles, and in any event no more than 90 days under the FTC guidance cited here. Continue paying undisputed portions of the bill while the investigation is pending; ask the issuer how it wants disputed amounts handled so you do not accidentally miss a payment.

What evidence matters when an agent was involved?

  • The exact agent instruction and the permissions in force when it acted.
  • Whether you approved a merchant, category, amount, currency or recurring charge.
  • Authentication records, one-time codes and account-access history.
  • The merchant’s order, fulfillment and refund records.
  • Your prompt cancellation, refund request and written dispute timeline.

An issuer may ask whether the transaction was entirely unauthorized or whether the agent exceeded a defined authority. Do not describe a mistaken purchase as a stolen card if you intentionally gave the agent authority to buy within limits.

How do debit-card and bank-transfer disputes differ?

Debit-card purchases and other electronic fund transfers are generally handled under Regulation E-style procedures rather than the credit-card billing-error process. The Consumer Financial Protection Bureau says a bank generally has 10 business days to investigate after receiving notice of an unauthorized electronic-fund-transfer error.

Depending on the circumstances, the bank may provide temporary credit while it investigates. The CFPB guidance describes final-resolution periods of 45 days or, for certain situations such as newer accounts, foreign transactions or point-of-sale transfers, up to 90 days. Ask the bank which period applies to your account and transaction, and report the error as soon as you detect it rather than waiting for a statement.

Use the bank’s stated fraud or electronic-transfer channel, meet any written-confirmation requirement, and keep copies of your notice. A debit dispute can affect cash immediately, so monitor the account for additional agent activity and consider replacing the card or access credentials.

Can I get a refund and file a chargeback?

You can ask the merchant for a refund and, if it refuses or does not correct the problem, notify your issuer. You should not obtain two recoveries for one charge. Tell the issuer that a merchant credit is pending or has posted, and tell the merchant that a dispute is open.

If the bank has already returned the funds through a dispute, a second merchant refund would overcompensate you. The merchant or issuer may reverse the duplicate credit, and concealing it can undermine your credibility. Keep the refund confirmation and compare the final account balance before closing the dispute.

Who is liable when an AI agent buys the wrong thing?

Liability depends on authority, the payment rail, the merchant’s conduct and the contracts among you, the merchant and the payment processor. The mere fact that software made the decision does not automatically transfer responsibility to the consumer or excuse the business.

The U.K. Competition and Markets Authority’s AI-agent consumer-law guidance, published 9 March 2026, states: “It does not matter whether they interact with (or get information produced by) a person or an AI agent.” It also says businesses remain responsible for agent actions, including providing refunds, and warns that businesses are ultimately responsible if an AI agent does something illegal. Those statements describe U.K. consumer-law guidance; U.S. outcomes still turn on applicable federal and state law, card-network rules and contracts.

For an individual dispute, the key questions are:

  • What exact authority did you grant, and was the transaction inside its amount, merchant, category and recurrence limits?
  • Was the charge made by credit card, debit card, bank transfer or another rail?
  • Did the merchant deliver what was ordered and honor cancellation or refund rights?
  • What authentication, consent and audit records exist?
  • What do the merchant and processor terms say about agentic transactions and disputes?

If you authorized a purchase within clear limits and simply regret the agent’s choice, a fraud-based chargeback may be weak; a merchant return policy or another billing-error reason may be more appropriate. If the agent exceeded a stated limit or acted after you revoked access, preserve proof of that boundary and explain it precisely.

How should merchants control AI-agent payments?

Merchants and platforms should treat an agent as a delegated actor with bounded authority, not as an unreviewed human customer. The controls below reduce mistaken orders, fraud and avoidable chargebacks.

Define authority before accepting payment

  • Allow-list merchants, products, categories and geographic regions where appropriate.
  • Set per-transaction, daily and lifetime dollar limits.
  • Require separate consent for recurring payments, tips, subscriptions and donations.
  • Require human confirmation for high-value, unusual or irreversible transactions.
  • Record when permission was granted, changed or revoked.

Make consent and disclosures understandable

Obtain and retain consent in a form the customer can understand. Explain what the agent can buy, when it may act without another prompt and how to stop it. The CMA says agents should respect statutory rights, contract terms and required consents, and should not overstate their capabilities. Disclose AI use when it could affect a customer’s decision.

Test, monitor and escalate

Run unit and scenario tests before deployment, including boundary amounts, ambiguous instructions, duplicate orders, canceled subscriptions and failed deliveries. The CMA calls testing crucial to training. After launch, monitor authorization failures, returns, complaints and chargebacks; the Federal Deposit Insurance Corporation identifies rising returns, chargebacks and complaints as warning indicators warranting enhanced due diligence and monitoring. Provide a human escalation path for disputed, high-value or ambiguous transactions.

Review processor and platform contracts

Read the clauses that assign losses for agentic transactions, authentication failures and disputes. Stripe’s terms, for example, state under specified conditions that the user is responsible for unauthorized agentic transactions and certain agentic disputes. The exact allocation depends on the contract and jurisdiction, so do not assume a processor will absorb every loss.

How should you compare a shopping agent with a refund or dispute agent?

Both may act for a consumer, but their risk profiles differ. A shopping agent creates a payment obligation; a refund or dispute agent makes representations that can affect an existing claim. Evaluate them using the same documented controls.

What mistakes make an AI-agent dispute harder?

  • Waiting for a statement or a merchant reply: credit-card and electronic-transfer clocks can run from the transaction or statement date.
  • Relying only on a chat message: save formal written notices and delivery proof where the issuer requires them.
  • Calling every unwanted result “unauthorized”: distinguish an agent acting within permission from one exceeding or losing permission.
  • Deleting logs: prompts, settings and timestamps may show the boundary of authority.
  • Ignoring recurring access: cancel tokens, subscriptions and connected accounts after a suspicious event.
  • Accepting a partial credit without checking: verify the amount, currency and whether the credit is pending or final.

What is not yet known about AI-agent chargebacks?

Official sources currently provide deadlines, legal principles and operational controls, not a single comparable statistic for how often AI agents cause chargebacks or unauthorized transactions. Rates vary by payment rail, merchant design, authentication and the definition of “agent.” Treat any claimed universal percentage with caution unless it identifies its population, geography, date and methodology.

Frequently Asked Questions

Does an AI agent make a purchase legally unauthorized by default?

No. Authorization depends on the permission you granted and how the agent acted within it. A transaction can be disputable because the agent exceeded a limit, used revoked access or misrepresented the order, but an unwanted result alone does not prove zero authorization.

What if the merchant says the agent accepted its terms?

Ask for the order record, consent language and the authority the merchant relied on. The merchant’s terms may matter, but they do not automatically eliminate statutory cancellation, billing-error or electronic-transfer rights that apply to your transaction.

Should I replace my card after an agent error?

Replace or lock it when you cannot identify or revoke the agent’s access, when credentials may be exposed, or when additional attempts appear. If the problem is only a bounded instruction error and no credentials were compromised, revoking tokens and recurring permissions may be sufficient; ask your issuer for its security recommendation.

Can a bank deny a dispute because I used an AI service?

Use of an AI service is not, by itself, a reason to deny a valid claim. The issuer will assess the payment rail, notice timing, authentication, your authority instructions and the merchant’s evidence; give it the complete record rather than describing the event only as an AI malfunction.
