How Capital Gains Tax Works When You Sell Art, Antiques, or Collectibles

For U.S. federal income-tax purposes, you generally calculate the gain on art, antiques, or collectibles by subtracting the item’s adjusted basis from its amount realized—not by applying a tax rate to the sale price. A long-term gain on a qualifying collectible falls into the IRS “28% rate gain” category, but 28% is a maximum rate category used in the Schedule D computation, not an automatic 28% tax on gross proceeds.

Your result depends on how you acquired the property, how long you held it, whether it was personal-use or business property, and your overall tax return. This guide covers federal rules for individuals; state and local taxes can differ. Use the IRS forms and instructions for the tax year in which you sell.

As an Amazon Associate I earn from qualifying purchases.

Start with the gain calculation, not the sale price

The basic federal calculation is:

Amount realized − adjusted basis = gain or loss

The IRS describes basis as “the amount of your investment in property for tax purposes.” For property you buy, basis is usually its cost. Your adjusted basis is that starting amount plus or minus any tax-recognized adjustments documented over the period you owned the item.

For example, if you sell a painting for an amount realized of $6,000 and its adjusted basis is $2,000, the preliminary gain is $4,000. That arithmetic is an illustration of gain computation, not a prediction of the tax bill. The tax depends on the holding period, whether the item is a collectible, your other gains and losses, and your complete federal return.

What counts as the amount realized?

Use the transaction’s amount realized as shown by your sale records. Keep the contract, auction statement, dealer settlement, payment records, and documentation of transaction adjustments. Do not treat the buyer’s headline price as automatically equal to the taxable gain: the tax calculation still requires a defensible basis and the amount realized reported for the transaction.

What belongs in adjusted basis?

Start with the purchase price or the special basis assigned under an inheritance or gift rule. Then preserve records for any adjustments permitted under the tax rules, such as documented capitalized costs or other basis items recognized for the property. Do not add an expense merely because it was related to ownership; the adjustment must be one the applicable IRS rules allow.

Why collectibles have a special “28% rate gain” category

Publication 550 and the Schedule D instructions place long-term gain from specified collectibles in the “28% rate gain” category. Examples include artworks, rugs, antiques, certain metals, gems, stamps, coins, and alcoholic beverages. The statutory category is broader than any one list of examples, so classification depends on the property and the applicable tax rules.

  • 28% of the gross sale proceeds;
  • 28% of every collectible sale, regardless of how long you owned it;
  • that every seller’s marginal or effective federal rate will be 28%; or
  • that you can skip the rest of Schedule D.

Instead, the IRS uses a special maximum-rate computation for qualifying long-term collectibles gain. The Schedule D Tax Worksheet applies the required netting and rate rules in the context of your return. Other capital gains and losses can affect the result. A seller whose applicable rate is below the maximum will not necessarily pay 28% on the collectible gain.

When the 28% worksheet is relevant

The 2025 Schedule D instructions direct taxpayers to complete the 28% Rate Gain Worksheet when the listed conditions apply, including reporting collectibles gain or loss on Form 8949, Part II. The worksheet result is carried to Schedule D line 18 under those instructions. Form layouts and line references can change, so use the version for your sale year rather than relying on an older form.

Holding period: short-term versus long-term

Holding period determines which capital-gain rules apply:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Holding period General rule Why it matters
Short-term One year or less It is not treated as long-term collectible gain for the special 28% rate-category computation.
Long-term More than one year A qualifying collectible gain enters the special 28% rate-gain calculation.

Under the Form 8949 instructions, start counting on the day after you receive the property and include the date you dispose of it. Keep acquisition and sale dates precise; being one day short of the long-term threshold can change the treatment.

Inherited property is generally long-term

An inherited capital asset is generally treated as long-term regardless of how long the heir actually held it. That rule can apply even when the heir sells soon after receiving the item. You still need the date-of-death or other permitted basis information and the sale records to calculate the gain.

How basis changes with the way you acquired the item

Acquisition Typical federal basis rule Records to locate
Purchased Usually the purchase cost, plus or minus allowed adjustments. Receipt, invoice, auction record, payment proof, and adjustment documentation.
Inherited Generally fair market value at the decedent’s date of death. An estate may elect an alternate valuation date when permitted. Executor or estate valuation, appraisal or comparable valuation records, estate inventory, and transfer documents.
Received as a gift Generally the donor’s adjusted basis for determining gain. If fair market value on the gift date was below donor basis, a separate fair-market-value basis can apply for determining loss. Donor’s basis records, gift-date valuation, gift-tax information, and transfer paperwork.

Inherited art or antiques

For inherited property, the starting point is generally fair market value on the decedent’s date of death. If the estate made a permitted alternate-valuation-date election, that information may control instead. Certain property is subject to consistent-basis requirements. The IRS directs heirs to the estate’s records or the executor for the valuation information.

Do not assume the amount written on an old insurance schedule, a family estimate, or a later auction result is automatically the tax basis. Gather the valuation evidence used by the estate and keep it with the sale file. An appraisal is not required for every sale, but reliable valuation records can be important when the basis must be established.

Gifted art or collectibles

Gift basis is not simply the item’s value on the day of the gift. For a later gain, the donor’s adjusted basis generally carries over. When the gift’s fair market value was lower than the donor’s basis, the IRS uses a separate fair-market-value basis for determining a later loss.

There can be a “no gain, no loss” gap: if the eventual selling price falls between the donor-basis amount and the gift-date fair market value, neither basis produces a gain or a loss under the applicable rule. Gift-tax adjustments and other details can change the computation, so retain the donor’s records and the gift documentation.

Personal-use losses are usually not deductible

A personal-use painting, antique, coin collection, or similar item can produce a taxable gain when sold for more than its adjusted basis. The reverse is not generally symmetrical: losses on property held for personal use are generally not deductible.

Do not report a personal-use loss as though it were an investment loss simply because the item declined in value. Business, investment, casualty, and other special facts can lead to different treatment. Determine the property’s actual use and purpose before claiming any loss.

How to report the sale on your federal return

  1. Classify the property and activity. Decide whether you sold a capital asset held personally or an item connected with a business, investment activity, or dealer operation. Business inventory and frequent sales conducted as a trade can follow different rules.
  2. Assemble the transaction file. Record the item, amount realized, sale date, buyer or auction statement, selling documentation, and whether a Form 1099-B, 1099-DA, or 1099-S was issued. Form 8949 instructions address reporting even when none of those forms was received.
  3. Establish basis. For a purchase, locate the original cost and allowed adjustments. For inherited property, obtain the estate’s valuation and transfer records. For a gift, obtain the donor’s adjusted basis, gift-date value, and any gift-tax information.
  4. Determine the holding period. Count from the day after receipt through the disposal date. Apply the inherited-property rule when relevant.
  5. Compute gain or loss. Subtract adjusted basis from the amount realized. Keep the calculation for each item rather than combining undocumented figures.
  6. Apply the collectibles rules. If the item is a qualifying collectible and the gain is long-term, follow the applicable Schedule D Tax Worksheet instructions for the 28% rate-gain category. Do not multiply the sale price by 28%.
  7. Complete the year-specific forms. Individuals generally use Form 8949 and Schedule D, following the instructions for the tax year of the sale. Under the 2025 instructions, long-term collectibles entries are reported on Form 8949, Part II, when applicable, and the worksheet amount flows to Schedule D line 18.
  8. Retain support. Keep purchase, inheritance, gift, valuation, adjustment, sale, and filing records for the period required by the IRS and applicable state law.

  • Donor basis statement, gift documentation, and gift-date valuation for a gift;
  • Invoices and records for tax-recognized basis adjustments;
  • Dealer, gallery, auction-house, or marketplace settlement statements;
  • Copies of Forms 1099-B, 1099-DA, or 1099-S, when issued; and
  • Your Form 8949 and Schedule D workpapers showing how each figure was derived.

When no single document proves value, preserve several independent records made near the relevant date. A qualified appraiser may be useful when an inherited item’s value is material or disputed, but an appraisal is not automatically mandatory for every sale.

Common situations and the questions they raise

“How do I calculate capital gains tax on art I sell?”

Calculate the amount realized minus adjusted basis, determine whether the gain is short-term or long-term, identify whether the property is a qualifying collectible, and then apply the applicable Schedule D computation. Your tax bill cannot be determined from the sale price alone.

“Do I have to pay tax when I sell inherited antiques?”

A sale can create taxable gain if the amount realized exceeds the inherited property’s adjusted basis. Inherited property is generally long-term, but the basis must be established from the estate’s valuation rules and records. Selling soon after inheritance does not by itself eliminate a gain.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“Is the tax rate on collectibles really 28%?”

Twenty-eight percent is the maximum rate category for qualifying long-term collectibles gain. It is not a flat tax on gross proceeds and not an automatic rate for every taxpayer. The Schedule D worksheet applies the category after the required gain-and-loss calculations.

“What is my cost basis if I inherited a painting?”

It is generally the painting’s fair market value at the decedent’s date of death, subject to a permitted alternate valuation date and other estate rules. Obtain the executor’s records and preserve the valuation support used to establish that amount.

Errors to avoid

  • Using the sale price as taxable income. Gain is based on amount realized compared with adjusted basis.
  • Applying 28% to proceeds. The 28% label describes a maximum rate category and worksheet computation.
  • Assuming every inherited item has the seller’s estimate as basis. Estate valuation rules control, not an unsupported guess.
  • Using the donor’s gift-date value automatically. Gift basis generally follows the donor’s adjusted basis for gain, with separate loss-basis rules when value was lower.
  • Deducting a personal-use loss. Personal-use losses are generally not deductible.
  • Ignoring a missing information return. A sale may still need Form 8949 and Schedule D reporting even when no Form 1099 was received.
  • Relying on an old form. Use the IRS forms and instructions for the year in which the sale occurred.

When professional help is sensible

Consider a qualified tax adviser when the item has a high value, the basis history is incomplete, the sale involves a business or investment activity, several owners share the property, or the transaction includes unusual terms. A qualified appraiser can help when reliable fair-market-value evidence is needed, particularly for inherited property. Professional advice does not replace the need to preserve original records and explain how each number was determined.

This article addresses U.S. federal income-tax principles for individuals and is general information, not individualized tax advice. State and local tax rules, estate administration, dealer activity, charitable transfers, and other facts may change the result.
