How a Reverse Mortgage Lien Can Affect a Home Sale or Refinance

For the common FHA-insured Home Equity Conversion Mortgage (HECM), selling the home normally requires paying the reverse-mortgage balance from the sale proceeds. You keep any amount left after the payoff. Refinancing is also possible, but the new loan must pay the HECM in full and the replacement lender must approve the transaction. The reverse-mortgage lender has a lien, not ownership: title remains with you. Exact payoff instructions, lien-release documents and closing steps depend on your loan, servicer, new lender and local law.

What the reverse-mortgage lien actually means

A reverse mortgage is debt secured by your home. The lender records a lien so it can be repaid if the loan becomes due, but it does not own the property. The Consumer Financial Protection Bureau (CFPB) states that title remains with the homeowner. You can generally sell, transfer, or refinance only if the outstanding debt is addressed as part of that transaction.

With a HECM, the balance can grow over time rather than shrink. It may include cash advances, financed closing costs and fees, and interest charged to date. HUD’s HECM Handbook 7610.1 (April 2024) describes payoff as including all of those components. Because interest and advances continue to accrue, an old monthly statement is not a reliable closing figure.

The guidance summarized here is primarily about HECMs, which CFPB identifies as the most common reverse mortgage. Proprietary (non-HECM) products can use different contracts, limits and remedies. Check your closing documents or ask the servicer which type you have before relying on HECM rules.

What happens when you sell the home

1. The sale makes the loan due

CFPB consumer guidance, last reviewed September 11, 2024, says: “When you sell your home your reverse mortgage loan will need to be paid back.” A normal voluntary sale therefore requires a payoff at or before closing. The servicer supplies the amount due and instructions for sending the funds; the closing professionals coordinate payment and the release of the lien under the procedures applicable to that property.

2. The sale price is compared with the HECM balance

Sale situation What generally happens with a HECM
Sale price is higher than the current payoff The payoff is made from the transaction, and the seller receives the remaining proceeds after other closing costs and obligations.
Sale price is close to the payoff Most or all gross proceeds may be used to satisfy the HECM, leaving only the amount remaining after the payoff and other transaction costs.
Payoff exceeds the home’s value HECM mortgage-insurance and non-recourse rules may limit the amount required, subject to the program’s conditions, appraisal and sale requirements. Do not assume the same protection applies to every proprietary reverse mortgage.

The “difference” is not simply sale price minus the amount you originally borrowed. It is sale proceeds minus the current payoff and the other costs charged in the transaction. Ask for a payoff good through the expected closing date so the amount reflects continuing interest and any additional advances.

3. Underwater and below-market resolutions are conditional

HUD identifies due-and-payable options that can include satisfying the debt, selling for at least 95 percent of the current appraised value in applicable circumstances, or another permitted resolution. The 95-percent figure is a conditional program rule, not a universal discount for every ordinary sale. Whether it applies can depend on why the loan became due, the appraisal, the parties involved and the documents governing the HECM.

For a voluntary sale, do not reduce the asking price to 95 percent on the assumption that the servicer must accept it. Have the servicer explain in writing which rule applies and what appraisal or approval is required.

How to prepare a reverse-mortgage sale

  1. Confirm the loan type and servicer. Review the note, mortgage and latest servicing statement. Verify whether the loan is a HECM or a proprietary product and identify the current servicer’s payoff department.
  2. Request a written payoff statement. Ask for the total amount due through the anticipated closing date, per-diem interest, payment instructions, expiration date and any requirements for releasing the lien. Request an updated statement if the closing date moves.
  3. Tell the real-estate and closing professionals early. Provide the lien information to the title or escrow company and closing attorney, as applicable. They can determine how the payoff will appear on the settlement statement and what local recording documents are needed.
  4. Compare the expected net proceeds. Use the likely sale price, the current payoff, commissions, taxes, insurance, repairs and other closing charges. A high listing price does not guarantee cash to you if the growing balance and sale expenses consume the proceeds.
  5. Resolve appraisal or shortfall questions before accepting an offer. If the expected price is below the payoff, ask whether a HECM mortgage-insurance or 95-percent rule is available and what evidence the servicer requires.
  6. Verify lien release at closing. The closing agent should confirm that the payoff is sent as instructed and that the release or satisfaction document will be handled under the applicable state and county process. National HECM sources do not prescribe one universal recording sequence.

Do not send funds to a new account supplied only by an email. Independently verify wiring instructions with the servicer and the closing professional using known contact information.

Can you refinance a home with a reverse mortgage?

Yes, a borrower can refinance by paying the total HECM balance, according to CFPB examination procedures. In practical terms, the replacement mortgage supplies enough money to satisfy the reverse mortgage, after which the old lien is released and the new lender’s lien is recorded if the refinance closes.

This possibility is not a promise of approval. The prospective lender still applies its own underwriting, income, credit, property and appraisal standards. The cited federal sources do not establish one universal interest rate, fee schedule, title process, escrow arrangement or closing timetable for a reverse-mortgage refinance.

Refinance steps

  1. Ask the new lender whether it will refinance a property encumbered by a reverse mortgage. Disclose the HECM immediately; hiding the lien can derail underwriting and closing.
  2. Obtain the servicer’s current payoff. Give the new lender the payoff amount and expiration date, then update it if underwriting or closing takes longer.
  3. Compare the new loan with the existing obligation. Consider the amount needed to pay the HECM, the new loan’s principal and interest, fees, required payments, term, and whether the new payment is affordable after the reverse mortgage’s payment-free structure ends.
  4. Confirm title and lien-release instructions. The new lender, title company and HECM servicer must agree on payoff timing and document delivery. Requirements vary by transaction and jurisdiction.
  5. Review the final disclosure before signing. Confirm that the HECM payoff is listed, that cash-to-close is accurate and that no advance or fee has been added since the last estimate.

A refinance can make sense when the borrower needs to remove the lien, change loan terms or preserve the home without selling. It can also create a new required monthly payment and new closing costs. Compare the complete obligations rather than focusing only on the interest rate.

Sale versus refinance: the decision points

Question Sale Refinance
How is the HECM paid? From sale proceeds at closing. From proceeds of the replacement loan, subject to approval.
What happens to ownership? Ownership transfers to the buyer; the HECM lien is paid and released. You retain the home if the new financing closes; the HECM lien is replaced by the new lender’s lien.
Main financial test Expected net sale proceeds after the payoff and selling costs. Amount of new borrowing and the resulting payment and fees.
Key uncertainty Whether the price, appraisal and applicable HECM rules cover the balance. Whether the new lender approves the borrower and property on acceptable terms.

Use the anticipated closing date in both calculations. The payoff changes with interest and advances, so a comparison made months before closing can become inaccurate.

Events that can make the loan due even without a sale

CFPB says a HECM is generally due when the last surviving borrower dies, sells the home or no longer occupies it as a principal residence. Other defaults can accelerate the process, including failure to pay required property charges or failure to maintain the home. Extended absence for medical care can matter when no co-borrower remains, depending on the loan’s rules and circumstances.

  • Death of the last surviving borrower: The estate or successors must address the debt through an allowed payoff, sale or other resolution.
  • Loss of principal-residence status: Moving permanently or otherwise ceasing to use the property as the principal residence can trigger due-and-payable treatment.
  • Unpaid property obligations: Property taxes, hazard insurance and required maintenance remain the borrower’s responsibility; failure can create default issues.
  • Extended medical absence: The effect depends on the occupancy facts and whether an eligible co-borrower remains.

A due-and-payable notice is not the same as a routine sale payoff. Contact the servicer promptly, request the deadline and available options in writing, and obtain qualified housing, legal or financial advice for the specific loan.

What death means for co-borrowers, spouses and heirs

Co-borrowers

If one borrower dies, a surviving co-borrower may generally remain in the home as long as the HECM’s occupancy and other obligations continue to be met. The exact result depends on who is named as a borrower and the loan documents.

Eligible non-borrowing spouses

A non-borrowing spouse may have protections if HUD conditions are satisfied. Relevant facts can include when the loan began, whether the spouse was identified in the loan records, marital status, continued occupancy and continued performance of required obligations. Protection is not automatic merely because the person is married to the borrower.

Heirs and successors

Heirs who do not have a qualifying right to remain generally must pay off the debt to keep the home or sell it. CFPB’s July 2026 examination procedures describe, for the covered HECM situation after the last borrower’s death, up to six months from death to sell or refinance under the described rules. CFPB consumer guidance last reviewed August 28, 2026, describes a 30-day response period after a due-and-payable notice and a possible extension of up to six months. These are program-specific timelines with conditions, not an unconditional promise that every heir receives the same period.

Notify the servicer as soon as possible after a death. Ask for the due-and-payable notice, the date used to calculate deadlines, the appraisal requirements and the documents needed to establish successor or spouse status. Missing a deadline can remove options that might otherwise have been available.

Common mistakes and how to avoid them

  • Using the original loan amount as the payoff: Request a current demand that includes advances, financed fees and interest through a stated date.
  • Assuming the lender owns the home: The lien secures repayment, but title remains with the homeowner until a transfer occurs.
  • Treating the 95-percent figure as a blanket rule: Confirm that the specific due-and-payable circumstance and appraisal satisfy HUD’s conditions.
  • Assuming all reverse mortgages are HECMs: Proprietary contracts may not have identical non-recourse or heir provisions.
  • Waiting until closing to disclose the lien: Give the servicer, title company and prospective lender time to coordinate documents and funds.
  • Ignoring taxes, insurance and maintenance: Those obligations continue during a sale or refinance and can independently create default problems.
  • Relying on a verbal deadline: Keep the notice, payoff statement and written extensions, and calendar every date.

Questions to ask before signing a sale or refinance

  • What is the exact payoff amount through the planned closing date, and what is the daily interest after that date?
  • Which HECM or proprietary-loan rule governs this payoff, appraisal or shortfall?
  • What documents will prove that the lien has been satisfied and released?
  • Who is responsible for recording the release, and how will I receive confirmation?
  • If refinancing, what new monthly payment, fees, reserves and insurance requirements apply?
  • If a borrower has died, what deadline applies and what evidence is required for a spouse, heir or successor?
  • What happens if the sale price, appraisal or closing date changes?

Federal guidance explains the core HECM obligations, but it does not set one nationwide payoff form, escrow workflow, lien-recording sequence or closing timeline. Those details must be confirmed with the current servicer and the professionals handling the particular transaction.
