A Microsoft layoff does not automatically cancel an employment-based green-card case. It can end the job offer supporting the case, prompt the employer to withdraw or stop pursuing a petition, and separately put your temporary immigration status and work authorization on a deadline. The outcome depends on whether you are at the PERM, I-140, or I-485 stage; whether the I-140 is approved and still valid; how long an I-485 has been pending; when employment actually ends; and whether a new job qualifies for portability.
There is no publicly established Microsoft-wide rule that determines what happens in every employee’s case. Use your termination notice, USCIS notices, I-94, and any EAD or advance-parole document to establish the facts, then have an employment-based immigration attorney apply the rules to your case.

First, identify which part of the green-card process you are in
Employment-based permanent residence is a sequence of separate steps, not one application. A layoff has a different effect at each stage.
| Case stage | What a layoff can change | What to verify promptly |
|---|---|---|
| PERM not filed or still pending | The employer’s labor-certification process is tied to its specific job opportunity. Losing that job can disrupt the sponsorship plan, and a new employer generally requires its own sponsorship assessment. | Whether a PERM application was filed, its status, and whether the employer will continue the process. |
| PERM certified; I-140 not filed or pending | PERM is not an immigrant petition and does not by itself provide permanent residence, an independent work right, or a transferable green-card case. If employment ends before I-140 approval, do not assume the filing can continue unchanged. | PERM certification date, I-140 filing or receipt, and the employer’s written plan. |
| I-140 approved; I-485 not filed | An approved I-140 can have priority-date-retention value, but it does not itself grant permanent residence, work authorization, or job portability. A new employer may need to file a new employment-based petition. | Approval date, preference category, priority date, and any withdrawal or revocation notice. |
| I-485 pending less than 180 days | The INA 204(j) portability threshold has not been reached. A withdrawal or loss of the underlying job offer can therefore threaten the adjustment case, even if an I-140 was approved. | The USCIS receipt date for the I-485, I-140 validity, and whether the petitioner has withdrawn the case. |
| I-485 pending at least 180 days | If the I-140 is approved and valid and the case is in an eligible category, you may be able to move to a new job in the same or a similar occupational classification. | Exact 180-day calculation, preference category, new duties, location, compensation, and the required portability filing or evidence. |
The U.S. Department of Labor describes PERM as an employer labor-certification process for a particular permanent job opportunity. Its overview is available through the Permanent Labor Certification Employment Law Advisor.

What happens at each stage
PERM has not been filed or is pending
PERM belongs to the sponsoring employer and the specific position for which it tested the labor market. A layoff before certification can cause the employer to stop the process or leave you without the job offer needed for the next step. The reviewed federal guidance does not support a general promise that a PERM case can simply be transferred to another employer. A new employer must evaluate its own sponsorship strategy, including whether a new labor-certification process is required.
PERM is certified, but the I-140 is not approved
A certified PERM supports the employer’s I-140 filing; it is not an approved immigrant petition. If the employment relationship ends before approval, do not assume the old employer can continue without change. USCIS explains that an I-140 may fail if it is not approvable or if the employer’s business terminates before approval, subject to the policy rules that apply to the particular filing. The practical question is whether the petitioner still has a valid job offer and can support approval at the time USCIS adjudicates the petition.
The I-140 is approved, but no I-485 has been filed
An approved I-140 may let you retain its priority date under USCIS rules, but it is not a green card and does not provide an independent right to work. It also does not create AC21 portability before an eligible adjustment application is pending. If you cannot use INA 204(j), pursuing adjustment through a new employer may require a new employment-based petition. USCIS discusses these distinctions in Chapter 5, Job Portability after Adjustment Filing and Other AC21 Provisions.

The I-485 has been pending fewer than 180 days
The 180-day rule is not a universal protection that begins when an I-140 is filed or approved. Before the adjustment application reaches 180 days, an approved I-140 generally does not remain valid for a different job offer if the petitioner withdraws it, although separate rules can preserve the petition’s priority date after sufficient approval time. A pending application and the passage of time alone do not make an unapproved petition portable.
The I-485 has been pending at least 180 days
Certain employment-based adjustment applicants with an approved, valid I-140 may qualify to change jobs under INA 204(j). The new permanent job must be in the same or a similar occupational classification. USCIS evaluates the occupation and the circumstances, including the actual position and duties; a matching job title is not enough.
The portability provision is not available to every immigrant category. USCIS identifies exclusions, including extraordinary-ability and national-interest-waiver cases, on its Chapter 8, Transfer of Underlying Basis policy page. A large salary difference is not an automatic disqualifier or a formal salary-matching requirement. The central inquiry is the occupational classification and the total facts of the jobs. Preserve the new offer letter, detailed duties, organizational information, worksite, compensation, and start date so your attorney can assess the comparison.

How an I-140 withdrawal or Microsoft business closure affects the case
USCIS separates three dates that are often confused: the I-140 approval date, the date the I-485 was filed, and the date the I-485 reached 180 days of pending time.
Recommended Free Tools
- If an approved I-140 has been approved for at least 180 days, USCIS policy generally allows the petition to remain valid for priority-date retention even if the employer withdraws it.
- If the associated I-485 has been pending for at least 180 days, the petition may also remain valid for priority-date-retention purposes when the employer withdraws it or the employer’s business terminates.
- When INA 204(j) requirements are met, the applicant may continue adjustment based on a qualifying new, same-or-similar job offer.
These protections do not make every approved petition permanently safe. USCIS can still revoke approval on substantive grounds, such as a finding that the petition was never valid or that a required condition was not met. “Approved for six months” is therefore not a complete answer: approval timing, I-485 timing, petition validity, preference category, and the new job all matter. Ask Microsoft’s immigration team or outside counsel whether it plans to withdraw the petition, and obtain any action in writing.
Your temporary immigration status is a separate clock
A green-card case and nonimmigrant work status are different legal tracks. USCIS says certain nonimmigrant workers whose employment ends may receive a discretionary grace period of up to 60 consecutive calendar days, or until the end of the authorized validity period if that occurs sooner. The policy is described in the USCIS notice on Options for Nonimmigrant Workers Following Termination of Employment.

The grace period is not an automatic extension of an H-1B petition, a green-card extension, or blanket permission to work for a new employer. Your classification, the employment end date, the I-94 validity date, any pending filing, and a possible change or transfer petition must be reviewed together. A new employer may need to file before you can begin work, and the filing strategy can affect your authorized stay.
If you have an employment authorization document based on a pending I-485, your work authorization analysis may differ from your former employer-sponsored status. Check the EAD category and expiration date, and consider travel consequences before using advance parole or leaving the United States. The existence of an EAD does not by itself answer every status or adjustment question.

Do not confuse WARN notice with immigration deadlines
The federal WARN Act generally requires a covered employer with 100 or more employees to give at least 60 calendar days of written notice for a qualifying plant closing or mass layoff affecting 50 or more employees at a single site. The U.S. Department of Labor explains the coverage, exceptions, and state-law differences on its Plant Closings and Layoffs page.
WARN is an employment-law notice framework. It does not establish the date your immigration employment ends, extend an I-94, create work authorization, or replace the USCIS grace-period rules. Use the official termination date in the employer notice and payroll records, and have counsel determine which date controls each immigration filing.

Records to gather immediately
Put the following in one secure folder before relying on an informal statement or a calendar estimate:
- Microsoft’s official termination notice, severance or transition documents, and final payroll record showing the employment end date.
- Your current immigration classification, most recent I-94, petition approval notice, and authorized validity end date.
- PERM filing and certification records, if a PERM was filed.
- I-140 receipt and approval notices, including the exact approval date, plus any withdrawal, revocation, or intent-to-revoke notice.
- I-485 receipt notice and the USCIS received date. Count 180 days from that date, not from the layoff announcement or I-140 approval.
- Current EAD and advance-parole documents, with category and expiration dates.
- Any new-job offer showing actual duties, occupational classification, compensation, location, and intended start date.
- Written confirmation from Microsoft or its immigration counsel about whether it will maintain the job offer, withdraw a petition, or provide a transition period.
Questions to take to an immigration attorney
- Is the I-140 approved, and does USCIS still treat it as valid?
- What are the exact I-140 approval date and I-485 receipt date?
- Has the I-485 been pending for 180 days, and is the preference category eligible for INA 204(j) portability?
- Has Microsoft withdrawn the I-140 or job offer, or merely announced a future layoff?
- Does the proposed new position have the same or a similar occupational classification based on duties, not just title or salary?
- What is the last day of authorized stay and the earliest date a new employer can file and you can lawfully begin work?
- Will travel, an EAD, advance parole, or a pending change-of-status filing alter the recommended strategy?
Bring the actual notices rather than relying on a manager’s description of the layoff. Small differences in dates and wording can change the analysis.

When considering a transfer, a new employer, a period without work, or another immigration filing, compare the options on these axes:
- Case stage: PERM, I-140, or I-485.
- Petition status: approved or unapproved, valid or withdrawn, and the relevant approval date.
- Adjustment timing: I-485 receipt date and whether 180 days have elapsed.
- Job fit: duties and occupational classification of the new permanent role.
- Temporary status: I-94 end date, grace-period eligibility, and any pending petition.
- Work authorization: EAD category and validity, or the date a new employer’s authorization would begin.
Salary, employer reputation, and job title can be relevant facts, but none alone answers the portability or status question.
Key numbers to keep straight
| Number | What it means | Authority |
|---|---|---|
| 180 days | Pending-I-485 threshold used in certain employment-based portability and petition-retention rules; it is not a guarantee for every category. | USCIS policy guidance |
| Up to 60 consecutive calendar days | Maximum discretionary grace period described for certain terminated nonimmigrant workers, limited by the authorized validity period if sooner. | USCIS, 2022 |
| 60 calendar days | General federal WARN advance-notice period for covered qualifying plant closings or mass layoffs; exceptions and state laws apply. | U.S. Department of Labor |
The Bottom Line
A Microsoft layoff may interrupt sponsorship, but it does not automatically erase every employment-based green-card case. Determine your PERM, I-140, and I-485 stage; calculate the correct 180-day and status deadlines; document any withdrawal; and have counsel evaluate portability and your next work authorization before you act.
