Neither visa is automatically better. H-1B eligibility is primarily about the U.S. job: the position must qualify as a specialty occupation, the employer must meet petition and Department of Labor requirements, and a qualifying, non-speculative role must exist when the petition is filed. O-1A eligibility is primarily about the person: the technology professional must document extraordinary ability, sustained national or international acclaim, and continued work in the area of that ability.
That difference should drive your decision. A computer-science degree does not by itself guarantee H-1B approval, and an impressive résumé does not automatically satisfy O-1A. Start with the offered role, your evidence, the identity of the petitioner, and whether your proposed work fits the classification. Treat caps, filing windows, validity, fees, processing times and dependent rules as changeable details that require a current check of official U.S. Citizenship and Immigration Services (USCIS), Department of Labor and Department of State guidance.

H-1B asks whether the job is a specialty occupation
H-1B is an employment-based category built around a specific position. The petition must show that the offered job meets the regulatory definition of a specialty occupation. Evidence commonly focuses on the duties, the employer’s normal hiring requirements and the relationship between the required degree and the work.
The regulatory routes described by USCIS include showing that a normally required degree is directly related to the position, that the employer normally requires such a degree for comparable roles, or that the duties are so specialized or complex that they are normally associated with a degree in a relevant specialty. The analysis is about the actual job, not merely a title such as software engineer, data scientist or product manager.

The employer also has to establish a qualifying position that is real and sufficiently defined at the time of filing. A résumé, offer letter or projected business plan cannot substitute for evidence that the position and its duties exist in a non-speculative form.
O-1A asks whether the person has extraordinary ability
O-1A is available for extraordinary ability in the sciences, education, business or athletics. USCIS describes the standard as having “extraordinary ability in the sciences, education, business, or athletics, which has been demonstrated by sustained national or international acclaim.” The petition must document that acclaim, provide extensive evidence, and show that the beneficiary will continue work in the area of extraordinary ability.
One route is a major, internationally recognized award. Otherwise, the petition generally must present evidence satisfying at least three of the listed regulatory categories, followed by USCIS review of the record as a whole. Meeting a numerical threshold is not an automatic approval; the quality, relevance and context of the evidence matter.

How to test an H-1B case
1. Define the position’s actual duties
Write the work as a list of concrete functions rather than relying on a broad occupational label. Describe the systems, methods, tools, decisions and level of responsibility involved. The more specialized or complex the duties, the more important it is to explain why they require knowledge normally associated with a particular specialty.
2. Identify the degree relationship
Map the position’s required knowledge to a directly related degree field. “Any bachelor’s degree” is a weaker explanation than a requirement tied to the technical work. If the employer uses an equivalent combination of education and experience, the petition still needs a coherent explanation of how the worker meets the stated requirement.
3. Compare the requirement with the employer’s normal practice
Evidence can include the employer’s hiring criteria for similar jobs and the qualifications of people performing comparable work. The point is not to create a preferred résumé after the fact; it is to show that the degree requirement is genuinely part of the role and consistent with the employer’s practice.

4. Prove that the role is available and non-speculative
The filing should identify where and for whom the work will be performed, the expected duties and the employer’s need for the position. A role that depends entirely on an unexecuted contract, an uncertain project or a hoped-for future client can create a problem because the petition must establish a qualifying position when filed.
5. Account for the employer’s labor obligations
H-1B employment includes Department of Labor labor-condition obligations. The sponsoring employer, not the worker alone, is responsible for meeting those requirements and maintaining the supporting records. A candidate should understand which employer is petitioning and whether the proposed assignment matches the role described in the filing.
What the FY 2024 number does—and does not—tell you
USCIS reported 141,205 approved H-1B petitions for initial employment in fiscal year 2024. The report separates consular-processing cases from in-country change-of-status, amendment and/or extension categories. This is a count of approved petitions, not a worker’s probability of selection, a lottery statistic or a guarantee that a particular filing will be approved.
How to test an O-1A case
Start with the required standard
O-1A requires more than seniority, a high salary or employment at a well-known company. The record must show extraordinary ability demonstrated by sustained national or international acclaim and must connect the proposed work to that area of ability. USCIS considers the evidence in context rather than approving a case solely because a petitioner can check three boxes.
The eight evidence categories
- Recognized prizes or awards: Documentation of nationally or internationally recognized prizes or awards for excellence in the field.
- Qualifying memberships: Membership in associations that require outstanding achievements, as judged by recognized experts, for admission.
- Published material about the beneficiary: Articles or other qualifying coverage about the person and the work, with the publication and authorship documented.
- Judging the work of others: Participation as a judge of others’ work in the same or an allied field, such as reviewing submissions or serving on an evaluation panel.
- Original contributions of major significance: Evidence that the person’s technical, scientific, business or other contributions had major significance, not merely that they were novel or useful inside one employer.
- Scholarly authorship: Authorship of scholarly articles in professional or major trade publications or other qualifying media.
- Critical or essential role: A critical or essential role for organizations or establishments with a distinguished reputation, supported by evidence of both the role and the organization’s standing.
- High salary or remuneration: Compensation that is high in relation to others in the field, with reliable evidence of the comparison.
A major internationally recognized award can provide an alternative route to the three-category showing. For other cases, satisfying at least three categories is only the beginning: USCIS evaluates the totality of the record to determine whether it actually demonstrates extraordinary ability.
Build an evidence map, not a pile of documents
For each category, identify the claim, the document that proves it, the date and source of the document, and why it demonstrates recognition beyond ordinary competence. A conference badge, a company announcement or a list of media links may establish participation but not necessarily acclaim. Explain the significance of the achievement and the reach of the organization, publication, award or judging activity.
Connect the evidence to the proposed work
The petition should make clear that the future work is in the same area in which the beneficiary has extraordinary ability. A strong record in one technical specialty does not automatically support a petition for an unrelated role. Describe the continuity between prior achievements and the work the petitioner proposes.

Founder and startup situations
What O-1A permits
USCIS allows a U.S. employer or agent to file an O-1 petition. Its guidance also says that a separate legal entity owned by the beneficiary may petition. That structure can be important for a founder who controls a company, but it does not turn the individual into a self-petitioner. The legal entity must be the petitioner and must support the proposed work and evidence.

Scan for outdated or missing drivers - takes under a minuteDriver Scan →Clear out junk files and repair common Windows errorsFree Scan →Questions a founder should answer
- What legal entity will sign and file the petition?
- What work will the founder perform, and how does it match the area of extraordinary ability?
- What independent evidence shows that the company or venture is distinguished, if the petition relies on a critical-role category?
- Are the role, compensation and work arrangements documented rather than dependent on an informal founder title?
An H-1B founder case requires the same job-centered analysis as any other H-1B case: an eligible employer must petition for a specialty-occupation position with defined duties and degree requirements. A founder’s ownership or technical reputation does not replace that analysis.
A practical decision framework
Use the following sequence before choosing a category.
- Describe the work first. Write the duties, location, employer or agent, expected start and the technical specialty involved.
- Run the H-1B job test. Ask whether the position normally requires a directly related specialty degree, whether the employer can show that requirement in practice, and whether the position is sufficiently real and defined at filing.
- Run the O-1A evidence test. List your achievements against the eight categories, identify independent corroboration, and assess whether the complete record shows sustained acclaim rather than isolated success.
- Check petitioner authority. Confirm which U.S. employer, agent or separate legal entity will file and whether that petitioner can document the proposed relationship.
- Check work continuity. H-1B evidence must match the specialty occupation; O-1A evidence and the proposed role must remain in the area of extraordinary ability.
- Separate known facts from volatile rules. Before committing money or a start date, verify the current cap and registration rules, filing windows, validity and extension rules, government fees, premium or expedited options, visa appointment procedures and dependent consequences on the applicable official pages.
- Choose the category that the evidence can actually prove. Do not select O-1A merely to avoid an H-1B cap, and do not select H-1B merely because you hold a degree.
Financial planning implications
Income depends on the petition structure
With H-1B, the employer’s petition and labor-condition obligations are central to the authorized employment arrangement. A change in duties, worksite or employer can therefore have immigration and financial consequences that should be reviewed before you rely on a new role or compensation package.
With O-1A, the financial question is often whether the petitioner can sustain the proposed work and document the beneficiary’s compensation and role. A high salary can be one evidence category, but salary alone does not establish extraordinary ability. Founders should model both company cash flow and the cost of maintaining a well-documented employment relationship.

Both categories can require organized records, employer documents, translations where applicable and legal assistance. The available official material does not establish a single current fee total or processing-time promise. Build a budget that distinguishes government filing charges, professional fees, document preparation and any travel or appointment costs, then confirm each amount before filing.
Protect against an all-or-nothing plan
Keep copies of employment records, award notices, publications, judging invitations, compensation records and organizational evidence in a secure, dated archive. Maintain a financial reserve for delays or a request for additional evidence. Do not make an irreversible move, resign from existing employment or sign a lease solely on an assumed approval date.

Filing preparation: a document checklist
For an H-1B petition
- Detailed position description tied to day-to-day duties.
- Explanation of the specialty degree and why it is directly related to the work.
- Evidence of the employer’s normal degree requirements for comparable roles.
- Worker’s degree, transcripts and evidence of any claimed equivalent qualification.
- Contracts, project descriptions or other records supporting a real, non-speculative position.
- Department of Labor labor-condition documentation maintained by the employer.
- Petitioner and worksite information consistent across all forms and supporting letters.
For an O-1A petition
- Evidence of a major internationally recognized award, or documentation for at least three listed categories.
- Independent explanations of the significance of awards, publications, judging, contributions and roles.
- Proof that organizations, publications and awards have the claimed reputation or reach.
- Compensation evidence with a reliable comparison to others in the field.
- A detailed description of the proposed work and its connection to the area of extraordinary ability.
- Evidence identifying the U.S. employer, agent or beneficiary-owned separate legal entity that will petition.
- A coherent narrative showing sustained acclaim and continued work, rather than an unconnected collection of achievements.
Common failure points and how to correct them
Relying on the job title
Problem: Treating “engineer” or “developer” as proof of specialty occupation.
Correction: Analyze the duties, degree relationship and employer’s normal requirements. A title is only a starting label.
Free tools Windows power users keep installed

Assuming any degree works for H-1B
Problem: Presenting a degree that is unrelated to the position’s specialized knowledge.
Correction: Explain the technical connection between the curriculum and the duties, or address the applicable equivalent-qualification evidence without overstating it.
Counting O-1A categories mechanically
Problem: Assuming three documents or three superficial category matches guarantee approval.
Correction: Show the quality, independence and significance of the evidence, then explain how the total record demonstrates sustained acclaim.
Using company publicity as independent recognition
Problem: Treating an employer’s own announcement as equivalent to respected outside coverage or objective recognition.

Confusing a founder-owned entity with self-petitioning
Problem: Assuming the founder can file personally without a separate petitioner.
Correction: Use the legally separate U.S. entity, employer or agent as the petitioner and document the relationship and proposed work.
Promising a result based on timing alone
Problem: Choosing a category because someone described it as faster, easier or a guaranteed alternative to another route.
Correction: Verify current processing information and evaluate the evidence first. Neither category is universally easier or faster for every technology professional.
Is O-1A simply a no-lottery H-1B alternative?
No. The two categories solve different legal problems. O-1A does not become appropriate merely because an applicant wants to avoid an H-1B selection process; it requires a demanding, documented extraordinary-ability case. H-1B does not become certain merely because an applicant has a technical degree; the offered position and employer evidence must satisfy the specialty-occupation requirements.
The better fit is the category whose required facts are true and documentable. Someone with a conventional technical role and a strong employer job description may begin with the H-1B analysis. Someone with sustained, independently recognized achievements and a role that continues that work may have an O-1A path. Some people may plausibly analyze both, but the final choice should follow the evidence and petitioner structure, not a slogan about speed or convenience.

Consider consulting a qualified employment-based immigration attorney when the degree relationship is unusual, the position depends on third-party projects, the petitioner is founder-owned, the evidence spans several O-1A categories, or a filing decision would affect a major job move or financial commitment. Counsel can test the facts against the current regulations and agency guidance, identify missing corroboration and distinguish a promising record from one that only appears strong on paper. No attorney can guarantee approval, and professional review does not replace checking the current official rules.
Bottom line
Choose H-1B when the strongest case is the job: a clearly defined specialty occupation, a directly related degree requirement, a real position and an employer prepared to meet its obligations. Choose O-1A when the strongest case is the person: sustained national or international acclaim, evidence fitting the listed criteria, and continuing work in the same area through a qualifying U.S. petitioner. If neither description is supported by documents, changing visa labels will not fix the underlying problem. Verify volatile rules immediately before filing and make the decision with the facts of the particular role, record and petitioner in view.
