The GST Appellate Tribunal (GSTAT), Ernakulam Bench, has allowed eight Singapore Airlines refund claims totalling ₹45,92,528. The tribunal held that GST paid to the department on passenger tickets could be refunded to the airline after it returned the entire fare, including GST, to passengers whose flights were cancelled during the COVID-19 restrictions. The airline’s records linked tickets, credit notes and direct passenger refunds, addressing the GST rule against unjust enrichment.
What did GSTAT Ernakulam decide?
In Singapore Airlines Ltd. v. Commissioner of CGST & CE, Kochi (appeals APL/3/ERN/2026 through APL/9/ERN/2026 and APL/30/ERN/2026; reported as 2026 LLBiz GSTAT(ERN) 61), the tribunal set aside the original rejection orders and the Joint Commissioner (Appeals) order. It directed the department to process the refunds within two weeks and pay applicable interest from the dates of the original refund applications until payment.

The ruling is based on the facts and documents in these eight claims. It does not establish that every airline, travel agent or GST-registered business with excess credit notes automatically qualifies for a refund.
Why could the airline not adjust the GST through its returns?
Singapore Airlines had issued credit notes for cancelled tickets and reported them in GSTR-1. Because cancellations exceeded new ticket sales in the relevant periods, the credit notes could not be fully set off against output GST in GSTR-3B, which does not permit a negative tax liability.

The airline therefore applied for a refund under the excess-payment-of-tax route. The tribunal relied on an April 2020 CBIC clarification that permits this route where a registered person has no output liability against which properly reported credit notes can be absorbed.
Claims and periods covered
| Appeal group | Claim period | Amount |
|---|---|---|
| APL/3/ERN/2026 through APL/9/ERN/2026 and APL/30/ERN/2026 | October 2019–March 2020; January 2021; March 2021 | ₹45,92,528 in total; individual claim amounts not stated in the reported decision |
The total represents eight applications. The reported materials do not state a separate amount for each appeal.
How did Singapore Airlines prove that the tax was actually returned?
The central issue was whether the tax burden had been passed on to passengers or returned to the people who paid it. GSTAT accepted a traceable documentary chain rather than treating the airline’s accounting entries in isolation.

Records accepted by the tribunal
- Sample air tickets and tax invoices identifying the original passenger transaction.
- Credit notes issued for the cancelled tickets.
- Refund vouchers and evidence of the payment made to the passenger.
- Passenger names and ticket numbers matching the underlying documents.
- Corresponding IATA Billing Settlement Plan records, where the ticket had moved through the industry settlement system.
Taken together, those records showed that the airline returned the fare, including GST, directly to passengers. That evidence defeated the department’s unjust-enrichment objection: the airline had not retained the tax collected from customers.
What did the authorities reject before GSTAT?
The initial rejection orders, dated 5 January 2022, treated the excess-tax-payment claim and the proof of passenger refunds as inadequate. The appellate authority’s order of 8 December 2022 also questioned the link between cancelled tickets and refunds and regarded the credit notes as time-barred.
GSTAT criticised the approach as an inadequate examination of the records. It set both levels of orders aside after finding that the documents, considered collectively, established the cancelled supplies and the corresponding refunds.

Does the input-tax-credit objection change the result?
No, on the facts of these appeals. The tribunal noted that the passenger tickets were business-to-consumer supplies, so an input-tax-credit reversal objection did not disqualify the claims. It also considered one business-to-business transaction involving Balmer Lawrie & Co Ltd.
GSTAT held that a later ITC-reversal requirement introduced from 1 October 2025 could not govern these earlier-period claims. The relevant transaction type and the law in force for the claim period therefore mattered.
What should another airline or GST-registered supplier check?
A business seeking a similar refund needs more than a credit note total. It should be able to connect each cancelled supply to the customer repayment and show why the credit notes could not be absorbed in the returns.

Refund-trail checklist
- Match the original invoice or ticket to the credit note.
- Identify the customer by name and retain the ticket or invoice number.
- Keep the refund voucher and bank, card or settlement evidence showing that the customer received the money.
- Reconcile agent or intermediary settlement records with the passenger and ticket data.
Return and timing checks
- Verify that the credit notes were reported correctly in GSTR-1.
- Document the output-tax position in GSTR-3B and explain why the notes could not be fully adjusted.
- Check the statutory time limit applicable to the period and the refund category before filing.
- Separate B2C and B2B transactions and apply the law that was in force during the claim period.
The Ernakulam decision shows why a department should assess these documents together. It does not remove the need to prove that the customer, rather than the claimant, bore and then received back the tax.

What remains uncertain after the ruling?
The decision concerns the evidence and legal periods in Singapore Airlines’ eight appeals. The available reports do not confirm whether the revenue department has filed a further appeal or whether the two-week processing direction and interest payment have been completed. Those matters remain unresolved in the reported record.
For other businesses, the practical takeaway is conditional: excess credit notes may support an excess-tax refund when return mechanics prevent adjustment, but eligibility still turns on timely filing, correct reporting and a verifiable repayment trail.

Frequently Asked Questions
When does interest on the allowed refund start under this order?
GSTAT directed interest to run from the dates on which the original refund applications were filed until the department pays. The reported decision does not specify a separate interest rate in the materials available here.
Can an airline rely only on its accounting ledger to prove a passenger refund?
The accepted record was transaction-specific: tickets and tax invoices were matched to credit notes, refund vouchers, passenger details and settlement records. A ledger without evidence connecting the money to the identified passenger would not reproduce the documentary chain described in the ruling.

Are tickets sold through an agent treated differently?
Agent involvement makes settlement documentation important. The IATA Billing Settlement Plan records helped connect the airline, ticket, passenger and refund, but the decisive point remained proof that the passenger received the refunded fare and GST.
Does the ruling decide whether every COVID-era ticket refund is within time?
No. The tribunal rejected the time-bar objection on the record before it and for the periods in these appeals. A different claimant must still apply the limitation rule applicable to its own transaction dates and refund category.
