GST Treatment of Petrol and Diesel Compared With Lubricants and Other Add-On Sales in India

Petrol and high-speed diesel are not currently charged under the ordinary GST levy in India. Section 9(2) of the Central Goods and Services Tax (CGST) Act makes GST on these fuels dependent on a future notification following a GST Council recommendation. Until that commencement date is notified, the existing VAT and Central Excise framework continues. A qualifying lubricant covered by heading 2710 of the CBIC goods-rate schedule is different: the listed entry shows 9% CGST plus 9% SGST or UTGST, an 18% combined GST rate, while expressly excluding petrol and diesel.

The exact treatment of an engine oil, car wash, repair, convenience item or fuel-station bundle depends on its tariff classification, the state or Union Territory, whether the supply is intra-state or inter-state, and whether separate items form a composite or mixed supply.

Petrol, diesel and lubricants: the direct comparison

Sale or product Current national GST position What determines the amount actually charged
Petrol (motor spirit) GST commencement is pending under the statutory notification mechanism; it is not treated like an ordinary GST-rated good merely because GST exists. State or Union Territory VAT and applicable Central Excise treatment, using the rate and effective date in force for that jurisdiction.
High-speed diesel The same pending-commencement mechanism applies. State or Union Territory VAT and applicable Central Excise treatment; there is no single all-India VAT percentage established here.
Qualifying petroleum oils and preparations under CBIC heading 2710 The listed schedule entry shows 18% total GST: 9% CGST plus 9% SGST or UTGST. Correct tariff classification, the entry’s conditions and exclusions, and whether the supply is intra-state or inter-state.
Engine oil or another named lubricant Not automatically 18% just because it is called a lubricant. The product’s precise classification, composition, applicable notification and transaction type.
Fuel sold with a wash, repair, convenience item or other service No universal rate can be assigned from the description alone. Whether the facts create separate supplies, a composite supply or a mixed supply under section 8 of the CGST Act.

This distinction is the key to reading a fuel-station bill. “Petrol is outside GST” does not mean every product or service sold at a petrol pump is outside GST, and “lubricants are 18%” is too broad without checking the item’s classification.

Why GST is not yet charged on petrol and diesel

Section 9(2) of the CGST Act does not set a calendar date by itself. It creates a mechanism under which the central tax starts only on a date notified by the Government on the GST Council’s recommendation. The provision states:

“The central tax on the supply of petroleum crude, high speed diesel, motor spirit (commonly known as petrol), natural gas and aviation turbine fuel shall be levied with effect from such date as may be notified by the Government on the recommendations of the Council.”

The listed products include crude petroleum, high-speed diesel, motor spirit (petrol), natural gas and aviation turbine fuel (ATF). Their appearance in the CGST Act is therefore not the same as an effective 18% or 28% GST rate. The commencement notification is the missing legal step.

CBIC’s sectoral explanation likewise treats the GST start date for these petroleum products as a matter for the GST Council and subsequent notification. Until that occurs, a petrol or diesel sale should not be described as a normal GST supply simply because the transaction happens at a GST-registered station.

What the interim VAT and Central Excise framework means

CBIC’s FAQ describes VAT and Central Excise as continuing for crude, petrol, high-speed diesel, ATF and natural gas while GST commencement is pending. That is a description of the tax framework, not a nationwide price table.

Petrol and diesel rates can vary by state or Union Territory and by the effective date of the relevant notification. A rate quoted for one state, one city or one date cannot safely be presented as India’s current VAT rate. The title of a bill or a pump display may also combine the base price with several levies, so a percentage printed in a news article is not necessarily the rate applicable to your purchase.

To give a numeric VAT or other non-GST levy figure, you must identify at least:

  • the state or Union Territory where the supply is made;
  • the fuel (petrol, high-speed diesel or another petroleum product);
  • the effective date of the rate notification; and
  • whether the figure refers to VAT, a surcharge, Central Excise or the final tax-inclusive price.

No current all-India petrol or diesel VAT figure follows from the central framework alone. Check the applicable state or Union Territory notification before relying on a number.

How heading 2710 treats lubricants and other petroleum oils

The CBIC goods-rate schedule for heading 2710 covers specified petroleum oils other than petroleum crude and specified preparations containing at least 70% petroleum oils as basic constituents. The schedule shows 9% CGST and 9% SGST or UTGST, producing an 18% combined rate for the qualifying entry.

The same entry expressly excludes several products, including kerosene supplied through the public distribution system, petrol, diesel and ATF. Those exclusions prevent a reader from taking the 18% figure and applying it to every petroleum product sold at a station.

Why a product name is not enough

“Engine oil,” “gear oil,” “hydraulic oil” and similar retail descriptions identify a use, not necessarily the legal tariff line. Composition, intended use, packaging, technical specifications and the wording of the schedule can affect classification. A particular lubricant can therefore require a classification check even when it appears to be the kind of petroleum preparation contemplated by heading 2710.

The safe statement is conditional: a lubricant that falls within the qualifying heading 2710 entry and none of its exclusions is shown at 18% total GST in the CBIC schedule. Do not state that all lubricants are 18% without verifying the specific product and any later notification.

CGST, SGST, UTGST and IGST on a qualifying lubricant

The 18% figure is a combined rate, not “18% CGST.” For an intra-state supply, the schedule’s structure is 9% CGST plus 9% SGST. In a Union Territory supply, the state component is generally UTGST instead of SGST. For an inter-state supply, the applicable tax is IGST rather than separately charging CGST and SGST.

Supply type Typical presentation for the 18% heading 2710 entry Important qualification
Intra-state in a state 9% CGST + 9% SGST Only if the product qualifies for that entry and the place-of-supply rules make it intra-state.
Intra-state in a Union Territory 9% CGST + 9% UTGST The same classification and place-of-supply qualifications apply.
Inter-state 18% IGST Do not split an inter-state supply into CGST and SGST on the invoice.

For a normal retail purchase at a station, the transaction is often intra-state, but the invoice and place-of-supply facts control. The presence of a GSTIN on a receipt does not, by itself, convert petrol into a GST-rated product or determine the rate of an add-on.

When a fuel-station bundle changes the analysis

A station may sell fuel alongside an engine oil, a vehicle wash, a repair, a convenience item or another service. Section 8 of the CGST Act provides the rule for supplies that are properly characterized as composite or mixed:

“The tax liability on a composite or a mixed supply shall be determined in the following manner, namely:— (a) a composite supply comprising two or more supplies, one of which is a principal supply, shall be treated as a supply of such principal supply; and (b) a mixed supply comprising two or more supplies shall be treated as a supply of that particular supply which attracts the highest rate of tax.”

Composite supply

A composite supply contains two or more supplies that are naturally bundled and provided together in the ordinary course of business, with one principal supply. Section 8(a) says the tax treatment follows that principal supply. Whether a particular fuel-and-service arrangement meets that test depends on how it is offered, priced, required and used—not merely on the fact that the items appear on one receipt.

Mixed supply

A mixed supply combines two or more individual supplies for a single price, without the characteristics of a composite supply. Under section 8(b), the bundle is treated as the supply attracting the highest rate. That rule can produce a different result from taxing each item as though it had been bought separately.

Why a single “fuel plus add-on” rate is unsafe

Petrol and diesel have a pending GST commencement mechanism, while a qualifying lubricant may be an 18% GST item and a service may have its own classification and rate. Without the actual contract, invoice lines, pricing and predominant purpose, it is not possible to decide whether the transaction is separate, composite or mixed. The title of a promotional package is not enough evidence.

How to read your petrol-pump invoice

  1. Separate the fuel from other lines. Identify litres and the price of petrol or high-speed diesel separately from oil, washing, repair, accessories or convenience goods.
  2. Check whether GST is shown on the fuel line. The continuing VAT and Central Excise framework means a fuel line should not be assumed to carry ordinary GST merely because other lines do.
  3. Identify the add-on product or service. Look for a product description, HSN or service classification, quantity, taxable value and the tax components shown.
  4. Verify the lubricant classification. If an oil is claimed to be under heading 2710, confirm that it fits the qualifying description and none of the listed exclusions.
  5. Determine the supply type. For a qualifying GST item, check whether the invoice uses CGST plus SGST/UTGST or IGST, consistent with the place of supply.
  6. Examine a package price. If several items are sold for one amount, ask whether they are naturally bundled with a principal supply or are a mixed supply. The statutory section 8 rule then determines the treatment.
  7. Check the date and jurisdiction. For fuel VAT and related levies, match the invoice date and station location to the current state or Union Territory notification.

Common mistakes and the correct fix

  • Mistake: quoting one “India petrol GST rate.” Fix: explain that GST commencement for petrol and diesel awaits notification and that VAT and Central Excise continue under the interim framework.
  • Mistake: calling 18% “CGST.” Fix: describe the heading 2710 entry as 9% CGST plus 9% SGST or UTGST, or 18% IGST when the supply is inter-state.
  • Mistake: saying every lubricant is 18%. Fix: verify the product’s tariff classification, composition and exclusions.
  • Mistake: assuming one receipt means one tax rate. Fix: analyze separate lines and, if bundled, apply the composite-versus-mixed rules to the actual arrangement.
  • Mistake: using a state VAT figure without naming the date and jurisdiction. Fix: identify the state or Union Territory and the effective notification before quoting a number.
  • Mistake: treating a station’s GST registration as proof that fuel is under GST. Fix: classify each supply independently; registration status does not remove the statutory commencement condition for petrol and diesel.

What information is needed for a transaction-specific answer

A national explanation can establish the legal distinction, but a precise invoice review needs more facts. Provide the state or Union Territory, transaction date, exact fuel or product description, whether the seller supplied goods or services, the invoice’s HSN or service code, and whether a package price was charged. For lubricants, the manufacturer’s classification information and product composition may be necessary to test heading 2710.

With those details, the analysis can separate the non-GST fuel framework from the GST treatment of the add-on, apply the correct CGST/SGST/UTGST or IGST structure, and determine whether section 8 changes the result for a bundle.

The practical answer for buyers and station operators

For petrol and high-speed diesel, do not expect an ordinary GST rate until the Government issues the notification contemplated by section 9(2). The interim system remains VAT and Central Excise, with the amount dependent on the relevant state or Union Territory and date. For a qualifying lubricant under the listed heading 2710 entry, the CBIC schedule shows 18% total GST, but classification and exclusions must be checked first. For every wash, repair, convenience item or package sale, use the actual invoice and contractual facts to decide whether the supplies are separate, composite or mixed rather than assigning the fuel rate to the entire transaction.
