GST Tax Practitioner vs Chartered Accountant: Who Should Handle a GST Notice?

Short answer: neither designation is automatically better. Under section 116 of India’s Central Goods and Services Tax (CGST) Act, an enrolled GST Practitioner authorized for the taxpayer and a Chartered Accountant (CA) who holds a certificate of practice and is not debarred can generally act as an authorized representative in GST proceedings. Choose according to the notice, the procedural stage, the person’s recent experience with that type of matter, and the authority you give in writing. A summons under section 70 requires separate care because the law and official GST Council records have raised a specific question about whether the summoned person must attend personally.

What the law actually permits

Section 116 allows a person who is entitled or required to appear before a GST officer, an Appellate Authority, or an Appellate Tribunal in connection with proceedings to appear through an authorized representative. The provision lists several possible representatives, including an eligible advocate; a Chartered Accountant, cost accountant, or company secretary who has a certificate of practice and has not been debarred; certain retired tax officers; and “any person who has been authorised to act as a GST Practitioner on behalf of the concerned registered person.”

This is an eligibility rule, not a ranking system. It does not say that every notice should go to a CA or that a GST Practitioner is limited to routine filings. Your decision still depends on the substance of the notice and whether the chosen professional has the authority and competence to perform the particular task.

The personal-examination exception

The general right to use a representative does not override a requirement that the taxpayer appear personally for examination on oath or affirmation. If the officer requires the taxpayer’s own evidence, a representative cannot simply replace that appearance. The professional may still help prepare the taxpayer, organize documents, make legal submissions, and attend where the law and the officer permit, but the taxpayer must comply with a valid personal-appearance direction.

Professional standing must be current

For a CA, confirm both a current certificate of practice and the absence of a disqualification or debarment. For a GST Practitioner (GSTP), confirm enrolment and that the practitioner is authorized to act for the particular registered person. An old GST Council FAQ describes categories of disqualification for authorized representatives, including dismissal or removal from government service, certain convictions connected with tax proceedings, findings of misconduct, and insolvency with consequences that can differ by category. Because that FAQ is older, check the current CGST Act and any applicable state GST provision before relying on its wording in a live case.

GST Practitioner and CA: role-by-role comparison

Question GST Practitioner Chartered Accountant
Can the person represent a taxpayer? Yes, when enrolled, authorized to act for that registered person, and otherwise qualified under the applicable law. Yes, when the CA holds a certificate of practice and is not debarred from practice, subject to the section 116 exceptions.
What must be shown? Enrolment and, when requested, a copy of the taxpayer’s authorization. Current certificate-of-practice status and eligibility under section 116.
Work expressly described in the cited GST rules Furnishing outward and inward supply details; periodic, annual, or final returns; deposits to the electronic cash ledger; refund claims; and applications to amend or cancel registration, when authorized. The cited material establishes eligibility to represent but does not provide an exhaustive, separate list of CA services.
Who remains responsible for factual confirmation? The registered person must ensure that facts in a return prepared by the GSTP are true and correct before confirming submission. The GSTP must prepare statements with due diligence. Engagement of a CA does not remove the taxpayer’s duty to provide accurate facts and review submissions.
Does the designation alone decide suitability? No. Match experience to the notice and stage. No. CA status alone does not establish superiority for a particular dispute.
Summons or personal examination The same section 116 personal-examination exception applies. Section 70 treatment must be checked separately. The same exception applies. A CA’s status does not resolve the section 70 attendance question.

Match the professional to the notice and procedural stage

Routine return, reconciliation, or portal work

A GSTP with proper enrolment, authorization, and experience in the relevant return or reconciliation issue may be a practical choice for portal-heavy work. The rules material specifically describes help with supply details, returns, cash-ledger deposits, refunds, and registration amendments or cancellation. Ask what the notice is actually alleging: a simple data mismatch may be routine, while a mismatch that has become a proposed tax demand may require deeper legal and evidentiary work.

  • Examples include a request to explain a return discrepancy, an input-tax-credit reconciliation issue, a refund clarification, or a registration amendment query.
  • Confirm that the professional will read the notice, identify the legal provision cited, prepare the reply, upload it correctly, and monitor any follow-up rather than merely forwarding a portal message.
  • Have the taxpayer review invoices, ledgers, e-way bills, bank records, and reconciliations before confirming factual statements.

Show-cause notice, proposed demand, or adjudication

When a notice proposes tax, interest, penalty, or reversal of credit, the key issue is not who can fill a form but who can analyze the allegations and build a defensible record. A CA may be suitable if the person regularly handles GST adjudication and has the required practice status. An experienced GSTP may also be suitable where the issue is within the practitioner’s competence and the person can represent the taxpayer at the relevant stage. The cited law does not assign disputed demands exclusively to either profession.

Before appointing anyone, ask for examples of comparable matters handled recently: the same tax period, credit issue, valuation question, classification dispute, place-of-supply problem, or penalty allegation. Experience with accounting compliance alone does not prove experience with contested proceedings, and a professional’s title does not prove familiarity with your industry’s evidence.

Appeal before an Appellate Authority or Tribunal

An appeal adds procedural requirements: limitation dates, grounds of appeal, statement of facts, supporting evidence, payment or pre-deposit questions where applicable, and hearing preparation. Select a representative who routinely works at the specific appellate forum named in your documents. Confirm who will draft the grounds, file the appeal, respond to defects, attend the hearing, and inform you of the order. If the professional will coordinate with an advocate or another specialist, put that division of work in the engagement letter.

Investigation, inspection, or a section 70 summons

Treat a summons differently from an ordinary notice. Section 70 empowers the Commissioner or a central tax officer to summon a person whose attendance is considered necessary to give evidence or produce documents. GST Council agenda records document a live interpretive concern about how that power operates alongside section 116, including whether the person may attend through an authorized representative or must attend personally for examination.

The Law Committee recommended an express section 70(1A) provision addressing attendance in person or through an authorized representative, with the officer able to direct the mode. The 54th GST Council meeting record says the Council agreed with that recommendation. Those records establish a recommendation and a Council decision, not that an amendment was enacted and commenced. Check the current consolidated section 70, related rules, the exact summons wording, and any direction from the issuing officer before telling a taxpayer that a GSTP or CA can attend alone.

A practical decision framework

Use these five screening axes for either professional. They are sensible selection criteria, not a statutory ranking.

  1. Standing and eligibility: verify GSTP enrolment and taxpayer authorization, or the CA’s certificate of practice and non-debarment. Ask for documentary confirmation rather than relying on a business card.
  2. Issue experience: identify the exact subject—input-tax credit, classification, valuation, exports, refunds, registration, e-commerce supplies, interest, or penalty—and ask how many comparable matters the person has handled.
  3. Procedural-stage experience: distinguish a portal clarification from adjudication, an appeal, an investigation, or a summons. Ask whether the person has appeared before the authority named in your notice.
  4. Scope of authority: write down whether the engagement covers only drafting, portal filing, correspondence, hearings, document production, appeal, or all of these. For a GSTP, complete the portal authorization and retain a copy.
  5. Evidence and deadlines: agree who will create the document list, verify facts, prepare a chronology, track the response date, and alert you to hearings or orders.

How to appoint and brief the representative

Step 1: Read the notice before choosing a person

Record the issuing authority, section cited, tax period, allegations, amount proposed or documents requested, response deadline, hearing date, and the exact mode of response. A “notice” may be a discrepancy communication, a show-cause notice, an order, an appeal-related communication, or a summons; each calls for a different plan.

Step 2: Verify credentials and conflicts

Ask the GSTP for enrolment details and the CA for certificate-of-practice details. Confirm that the person is not debarred and disclose connected entities, suppliers, customers, or prior advisers that could create a conflict. If the matter involves several registrations, state clearly which GSTINs and jurisdictions are included.

Step 3: Sign a written scope

The scope should identify the notice number, GSTIN, tax period, services, responsible contact, fees, out-of-pocket expenses, hearing attendance, and what happens if an appeal or investigation begins. State who signs factual confirmations and who may communicate with the officer. A broad authorization should not be assumed to cover every future proceeding.

Step 4: Build an evidence file

  • Keep the notice, envelope or portal receipt, and every annexure.
  • Prepare a chronology of transactions, filings, payments, correspondence, audits, and earlier notices.
  • Collect invoices, contracts, purchase and sales registers, ledgers, e-way bills, transport records, bank evidence, reconciliations, and relevant returns.
  • Separate original records from explanations prepared for the reply, and preserve a searchable copy of every upload.
  • Mark facts that are uncertain so the professional can verify them before making a representation.

Step 5: Review before submission

Read the final reply, annexure index, calculations, and prayer or requested relief. The registered person remains responsible for confirming that factual statements are true and correct, including statements prepared by a GSTP. Correct an error before filing; do not assume that professional submission transfers responsibility for inaccurate facts.

Step 6: Track the matter after filing

Obtain the acknowledgement, filing reference, and a copy of the submitted package. Calendar the next hearing, any direction to produce documents, and the date by which an appeal may be filed if an adverse order follows. Decide in advance who will monitor the GST portal and official communications.

Common mistakes and how to prevent them

Choosing by title or lowest fee

A low-cost filing service may be adequate for a straightforward correction but inadequate for a contested demand. Conversely, hiring a specialist for a simple portal task may add cost without improving the outcome. Compare the notice’s complexity with the person’s demonstrated experience and the work actually included.

Assuming portal authorization equals full representation

GSTP authorization supports the tasks permitted through the common portal, but it does not eliminate the need to check whether the practitioner is enrolled to attend proceedings or whether the taxpayer must appear personally. Keep the authorization aligned with the actual engagement.

Missing the response date while negotiating

Discussions with a professional do not extend a statutory deadline unless the authority grants an extension. Send the notice and deadline on the day you receive it, obtain a written action plan, and document any extension request and its result.

Sending unsupported explanations

A narrative without invoices, reconciliations, contracts, or payment evidence may leave the officer unable to verify the defence. Conversely, uploading unindexed records can obscure the relevant proof. Use an indexed bundle that connects each factual assertion to a document.

Treating a summons as an ordinary reply

Do not rely only on the general section 116 representation rule. Confirm whether the summons requires the named person to attend, whether documents must be produced in original, and whether the officer has directed attendance in person. Obtain advice before the date fixed in the summons.

Questions to ask before signing

  • Are you currently eligible to represent me for this proceeding?
  • Have you handled notices involving this issue and this authority recently?
  • Will you draft the legal response, prepare calculations, attend the hearing, or only upload documents?
  • Who will review the underlying records and identify gaps?
  • Who will communicate with the officer, and will I review every factual statement before filing?
  • What deadlines, future hearings, or appeal steps will you monitor?
  • If the matter becomes an investigation or summons, what changes in scope and who will advise on personal attendance?

Bottom-line choice

Choose a GST Practitioner when the person is properly enrolled and authorized, and has the right experience for the notice—particularly where the work is return, reconciliation, refund, registration, or portal-focused. Choose a CA when the person meets the certificate-of-practice and non-debarment conditions and has relevant experience with the accounting, legal, adjudication, or appellate issues involved. For a complex dispute, the deciding evidence should be comparable case experience and a clearly defined scope, not the title alone. For a section 70 summons or any direction involving examination, verify the current law and the officer’s instructions before deciding that a representative can attend in place of the taxpayer.
