Under the Finance (No. 2) Act, 2024, sections 73 and 74 continue to govern determinations for periods up to FY 2023-24, while newly inserted section 74A applies to matters pertaining to FY 2024-25 onward. For the earlier periods, section 73 is the route for tax not paid or short paid, erroneous refunds, or wrongly availed or utilised input tax credit where the allegation is not fraud, wilful misstatement, or suppression of facts to evade tax. Section 74 covers the same types of demand when those fraud or evasion-related grounds are alleged. The detailed operative mechanics of section 74A should be checked in the current consolidated CGST Act before relying on a deadline, penalty rate, or payment option.
The first question: which financial year does the demand concern?
GST demand provisions are not selected solely by the date on which a notice arrives. First identify the financial year to which the disputed tax period, refund, or input tax credit issue belongs.

- FY 2023-24 and earlier: the 2024 amendment preserves sections 73 and 74 for determination of matters relating to these periods.
- FY 2024-25 onward: the amendment inserts section 74A for matters pertaining to those financial years. Do not assume that the old section 73 or section 74 procedure automatically applies to a later year.
Check the exact tax period rather than relying on the assessment year, the date of an audit, or the date printed on a notice. A notice issued after the transition can still concern an earlier financial year and therefore require analysis under sections 73 or 74. Conversely, a notice about FY 2024-25 or a later year requires the current section 74A text to be read as it stands when the notice is reviewed.
What section 73 covers
The factual situations
Section 73 addresses tax that was not paid or was short paid, an erroneous refund, or input tax credit that was wrongly availed or utilised, for any reason other than fraud, wilful misstatement, or suppression of facts to evade tax. The statutory heading uses the phrase “for any reason other than fraud or any wilful-misstatement or suppression of facts.” In practical terms, this is the non-fraud route for periods to which section 73 applies.

A classification under section 73 does not mean that the amount is automatically payable. The proper tax period, the underlying transaction, the credit or refund calculation, and any explanation or records supplied by the taxpayer still have to be examined.
Order period and payment after notice
The official section 73 text provides a three-year period for making the order, calculated from the applicable statutory trigger. The trigger can depend on the financial year’s annual-return due date or, for an erroneous refund, the date relevant to that refund. A taxpayer should calculate the deadline from the Act and the facts, not from the date on which an internal query or audit began.
Section 73 also states that paying the tax and interest within 30 days of the show-cause notice generally concludes proceedings without a penalty under this section, subject to the section’s conditions and exceptions. The payment record, the date on which the notice was received, and the amounts actually paid therefore matter. “Generally” is important: a taxpayer must check the statutory conditions and whether the notice covers more than one issue before treating payment as a complete closure.
Penalty basis
The section 73 penalty is 10% of the tax or ₹10,000, whichever is higher, according to the official text. That figure is a penalty calculation under section 73; it is not a substitute for the tax or interest that may also be in dispute.

What section 74 covers
The factual situations
Section 74 applies to the same broad categories of demand—tax not paid or short paid, erroneous refund, and wrongly availed or utilised input tax credit—when the department alleges that the result occurred by reason of fraud, wilful misstatement, or suppression of facts to evade tax. Its statutory heading uses the phrase “by reason of fraud or any wilful-misstatement or suppression of facts.”
The words in the notice are critical. A section number alone does not prove that the legal grounds for section 74 are established. Read the factual particulars: what information is said to have been misstated or withheld, how the department connects that conduct to the tax shortfall or credit, and which records are relied on.
Longer order period
The official section 74 text provides a five-year period for making the order, again using the applicable statutory trigger. Depending on the issue, that calculation may refer to the due date for the relevant financial year’s annual return or to the date of an erroneous refund. Calculate the date against the exact period and event described in the Act; do not simply add five years to the notice date.

| Payment stage described in section 74 | Penalty stated in the official text | What must be checked |
|---|---|---|
| Before service of the show-cause notice | 15% of the tax | Whether tax and interest were paid and the statutory pre-notice conditions were met. |
| Within 30 days of the show-cause notice | 25% of the tax | The notice date, the 30-day period, full tax and interest payment, and other section 74 conditions. |
| Within 30 days of communication of the order | 50% of the tax | The order-communication date, the 30-day period, and the conditions for that reduced outcome. |
These percentages do not erase the underlying allegation or replace the need to reconcile tax, interest, and credit or refund figures. Preserve proof of the payment date and the calculation used.
What changed with section 74A
The transition established by the 2024 amendment
The Finance (No. 2) Act, 2024 amendment text confines sections 73 and 74 to determination for periods up to FY 2023-24 and inserts section 74A for matters pertaining to FY 2024-25 onward. That is the reliable high-level transition point.
Why the full current wording matters
The detailed current section 74A procedure is not set out in the material available for this article. Accordingly, no precise section 74A limitation period, notice lead time, penalty percentage, or pre-notice settlement mechanism should be assumed from section 73 or section 74. Those details can differ, and the controlling text is the consolidated CGST Act and any applicable rules or later amendments in force for the relevant notice.

A practical method for reviewing a GST notice
- Identify the disputed year and tax period. Write down the month or quarter, the financial year, and whether the issue concerns output tax, an erroneous refund, or input tax credit. Confirm whether it falls on or before FY 2023-24 or from FY 2024-25 onward.
- Read the provision cited and the factual grounds together. For an earlier period, determine whether the notice relies on a non-fraud explanation under section 73 or alleges fraud, wilful misstatement, or suppression of facts to evade tax under section 74. Do not treat the cited section as conclusive proof.
- Extract every date. Record the annual-return due date used for the relevant financial year, the date of any erroneous refund, the show-cause notice date, the date of service or receipt, and the date on which an order was communicated. These dates can produce different limitation or payment calculations.
- Recalculate the demand. Match the department’s tax figure to invoices, returns, electronic-credit-ledger entries, refund applications, assessment workings, and prior payments. Separate tax, interest, penalty, and any credit or refund reversal so that one disputed component does not conceal an error in another.
- Map the payment options to the correct section. Under section 73, test the 30-day post-notice rule and its conditions. Under section 74, test the relevant 15%, 25%, or 50% stage and the associated payment deadline. For section 74A, use only the current operative text.
- Preserve evidence of service and payment. Save the notice as received, portal acknowledgements, email or physical-delivery records, challans, payment references, return filings, reconciliations, and correspondence. A payment made on time but unsupported by a reliable date record can create a separate dispute.
- Obtain professional review for a live dispute. A qualified Indian GST adviser or chartered accountant should check the notice, limitation computation, evidence, and response strategy. State GST legislation, procedural rules, and later amendments may require a separate verification.
How to analyse the allegations, not just the section number
Look for the alleged act
In a section 74 notice, identify the specific invoice, return entry, refund claim, credit ledger movement, statement, or omission said to constitute fraud, wilful misstatement, or suppression. A broad assertion without a clear connection to the short payment or credit issue should be addressed directly in the reply, with the supporting records.
Test causation
The allegation should explain how the asserted conduct caused the tax not to be paid, the refund to be erroneous, or the input tax credit to be wrongly availed or utilised. Reconcile the chronology: when the transaction occurred, when it was reported, when a correction was made, and when the department says it discovered the issue.
Keep classification separate from arithmetic
Two questions must be answered independently: whether the facts meet the statutory route and whether the amount demanded is correct. A taxpayer may challenge the fraud-related classification, the tax computation, or both. The response should show the calculation rather than relying on a general denial.

Worked year-based examples
Earlier year with an apparent reporting error
Assume a supplier’s FY 2022-23 return omitted a taxable invoice because of a reconciliation mistake, with no allegation that information was deliberately withheld to evade tax. The period is within the section 73/74 regime, and the non-fraud facts point toward section 73. The supplier would still need to verify the tax and interest, the applicable three-year order period and trigger, and whether payment within 30 days of the show-cause notice satisfies section 73’s conditions.

Earlier year with an evasion allegation
Assume the department says that the same type of short payment resulted from fabricated records and deliberate suppression. The year is still governed by sections 73 and 74, but the stated factual basis points toward section 74. The supplier should test the particulars and causation, calculate the five-year period from the correct statutory trigger, and evaluate the 15%, 25%, or 50% payment-stage provisions only after confirming the relevant dates and conditions.
FY 2024-25 issue
Assume an input tax credit dispute relates to FY 2024-25. The amendment’s transition points to section 74A rather than sections 73 or 74. The taxpayer should obtain the current consolidated section 74A wording and check its limitation, notice, payment, interest, and penalty rules instead of importing the earlier section’s figures.
Frequent mistakes to avoid
- Using the notice date as the limitation start: the statutory trigger may be the annual-return due date or an erroneous-refund date.
- Assuming section 74 is valid because it is printed on the notice: the department still has to connect the alleged fraud, wilful misstatement, or suppression to the demand.
- Applying section 73 or 74 to FY 2024-25 by habit: the 2024 amendment establishes section 74A for matters pertaining to that year onward.
- Counting 30 days informally: identify the legally relevant notice or order communication date and retain proof of receipt.
- Paying only the tax: the payment-stage provisions refer to tax and interest, and section-specific conditions may also apply.
- Mixing tax, interest, penalty, and credit reversal: keep separate schedules so that the reply can identify exactly what is accepted and what is disputed.
- Quoting an old summary of section 74A: use the current consolidated Act and applicable rules before relying on any detailed rate or deadline.
- Ignoring state-specific issues: a state enactment, notification, or procedural development may require additional checking beyond the central provision discussed here.
What taxpayers should have ready before responding
- A year-by-year schedule showing the disputed tax period and the provision that appears applicable.
- Return filings, invoices, credit-ledger records, refund applications, reconciliations, and correction entries.
- The notice, annexures, relied-upon documents, service proof, and every subsequent communication.
- A limitation worksheet showing the statutory trigger and the calculated order deadline.
- A payment worksheet separating tax, interest, and penalty, with challan numbers and payment timestamps.
- A factual chronology explaining when the transaction occurred, when it was reported, and when any correction or disclosure was made.
- Questions for the adviser: whether the alleged conduct meets the section 74 grounds, whether the demand is within time, whether the calculation is accurate, and what section 73, 74, or 74A payment consequence is legally available.
Bottom line for a notice received today
Anchor the review to the financial year, then test the factual allegation and the statutory dates. For FY 2023-24 and earlier, section 73 is the non-fraud route and section 74 is the fraud, wilful-misstatement, or suppression route, with materially different order periods and payment-stage penalties. For FY 2024-25 onward, start with section 74A and verify its complete current wording before calculating any deadline or reduced-payment option. A section number, by itself, is not a substitute for checking the facts, limitation trigger, tax and interest computation, payment timing, and evidence.
