Under section 129 of India’s Central Goods and Services Tax Act, 2017 (CGST Act), GST officers may detain or seize goods in transit, the vehicle carrying them, and related documents when transportation or storage contravenes the Act or Rules. Release is not an informal roadside settlement: the owner may use the statutory payment route, furnish prescribed security, or contest the proposed penalty through notice, hearing and a reasoned order.
The practical rules depend on the current consolidated Act, GST Rules, the documents carried with the consignment and the facts of the alleged breach. The figures most often relevant are a general ₹50,000 e-way-bill threshold, seven days to issue a detention notice, seven days from service of that notice to pass the order, and 15 days after receipt of the order before the goods or conveyance may become liable to sale or other disposal under the prescribed procedure.

What section 129 covers
Section 129 applies when goods are transported or stored in transit in contravention of the CGST Act or Rules. The power extends to the goods, the conveyance used to transport them and the related documents. The current text reproduced by the Central Board of Indirect Taxes and Customs (CBIC) sets out alternative release routes and procedural safeguards: read the current section 129 text on the CBIC Tax Information Portal.
A document mismatch can therefore become important, but it is not accurate to say that every clerical error automatically authorises detention. The officer’s action must be connected to a contravention of the Act or Rules, and the person concerned must receive the statutory notice and an opportunity to be heard before the penalty is determined.

Detention is different from final confiscation
Section 129 is the detention-and-release mechanism for goods and conveyances in transit. A detention order is not, by itself, a final confiscation order. If an officer proposes a different consequence under another provision, the taxpayer should identify the exact section, notice and remedy involved rather than treating all seizure language as interchangeable.
How release works under section 129
The statute provides alternative routes based on whether the owner comes forward. The amount is calculated under the applicable version of section 129(1); exempt goods have separate percentage and cap rules. Because the section has been amended, including changes effective 1 January 2022, use the current consolidated text and verify the calculation for the particular goods instead of relying on a shorthand percentage.

Payment or security addresses release; it does not necessarily resolve whether the alleged contravention occurred. Keep the detention order, notice, invoices, transport records, e-way-bill data, proof of payment or security, and every written objection together. Those records matter if the final order is challenged.

The mandatory notice, hearing and order timeline
Section 129 contains deadlines that constrain the officer’s process. The order of events matters:
- Service of the detention or seizure order: the current statutory text says goods or a conveyance cannot be detained or seized without serving an order on the person transporting the goods.
- Notice within seven days: the proper officer must issue a notice specifying the penalty payable within seven days of the detention or seizure.
- Opportunity to be heard: the person concerned must be allowed to present its explanation before the penalty is determined. Submit a factual reply with supporting records and preserve proof of submission.
- Order within seven days from service of notice: the proper officer must pass the section 129 order within seven days from service of the notice.
- Fifteen-day post-order period: if the amount under section 129(1) is not paid within 15 days from receipt of the section 129(3) order, the goods or conveyance may be sold or otherwise disposed of as prescribed to recover the penalty.
The 15-day consequence is not an automatic roadside sale. It operates subject to the prescribed manner and timing. If an order is missing, late, unclear or unsupported, record the defect promptly and obtain advice on the available statutory or judicial remedy.
E-way bills and documents a vehicle should carry
Section 68 of the CGST Act and rule 138 provide the statutory context for e-way bills. The Government of India’s E-Way Bill System FAQ describes a general requirement for an applicable consignment exceeding ₹50,000. The person in charge may carry the e-way-bill number electronically, rather than relying only on a printed copy.

Before movement begins
The FAQ describes the e-way bill as generated before commencement of movement by the registered person or transporter who causes the movement. It also states that the consignor, consignee or transporter may generate it, subject to enrolment and portal prerequisites. In practice, confirm that the bill is active, the vehicle or transport document details are correct, the validity period covers the route and the invoice or delivery document matches the consignment.
Do not treat ₹50,000 as a universal rule
₹50,000 is the general figure stated in the FAQ, not a substitute for reading the current Rules. The Rules contain exceptions and special cases for particular movements, goods and documents, and states may impose conditions within their legal authority. Check the current central and relevant state provisions before dispatching a consignment.
Reporting a prolonged detention
The FAQ describes portal reporting when goods or the vehicle have been detained for more than 30 minutes. The person responsible for the movement should record the time, location, officer details, reason given and the time the vehicle is released, then use the reporting facility described in the current portal instructions.

What to do when a vehicle is detained
- Ask for the written order and reason. Obtain the detention or seizure order and note the time and method of service. Do not rely on a verbal explanation alone.
- Secure the evidence. Preserve the invoice, bill of supply, e-way-bill number, transport document, vehicle registration and driver’s records, along with portal screenshots showing the bill’s status.
- Check the alleged contravention. Compare every field in the notice with the invoice, e-way bill, vehicle details, tax registration and physical goods. Identify whether the issue concerns identity, quantity, validity, route, documentation or another rule.
- Decide between release and contesting. Calculate the statutory amount under the current section 129 text. If immediate release is commercially necessary, ask whether security is available and state in writing any payment made under protest or compulsion.
- File a reasoned reply. Address each allegation, attach documentary proof and request a hearing. Keep an acknowledgement or other evidence that the reply was filed.
- Track the deadlines. Calendar the seven-day notice deadline, the seven-day period for the order after notice service and the 15-day period following receipt of the order.
- Escalate quickly if the process fails. A tax professional or lawyer can assess a representation, statutory appeal or writ remedy, especially where no notice is served, the hearing is denied, the order is unreasoned or disposal is threatened.
Inspection forms and the limits of older circular guidance
A CBIC circular reproduced in the Supreme Court record, Circular No. 41/15/2018-GST dated 13 April 2018, described forms used in the then inspection workflow: MOV-01 (statement), MOV-02 (physical-verification order), MOV-04 (inspection report), MOV-05 (release), MOV-06 (detention order), MOV-07 (notice), MOV-09 (order) and DRC-07 (order summary).
Those descriptions are useful for identifying paperwork, but the circular also reflects the law and timelines in force at that time. Parts of it quote pre-amendment section 129 language. Do not use an old form description or an old penalty calculation as proof of the current legal position without reconciling it with the amended Act and current Rules.

Supreme Court guidance: payment does not eliminate adjudication
In M/s ASP Traders v. State of Uttar Pradesh & Ors., Civil Appeal No. 9764 of 2025, decided on 24 July 2025, the Supreme Court considered arecanut detained after an alleged discrepancy. The taxpayer paid to secure release, filed objections and said the payment was under protest; the officer did not pass a final order. The Court directed the proper officer to provide a hearing, pass a reasoned order under section 129(3) and upload its summary in Form GST DRC-07. The Court’s concise statement is: “Where objections are filed or payment is made under protest or compulsion, adjudication is indispensable.” The decision arose from its particular facts; it does not mean that every payment guarantees a favourable result. It does mean that release payment should not be treated as a replacement for the statutory decision on objections where the taxpayer has properly raised them.
October 2026 interception proposals: not yet a current-law shortcut
A Press Information Bureau FAQ posted on 9 October 2026 describes proposed GST reforms. It says the proposal would not permit random interception and would require authorisation by a proper officer not below Joint Commissioner rank, with written reasons to believe that goods are being transported in contravention. It also describes a proposed jurisdiction rule: inspection, detention or seizure would generally be handled in the State or Union territory where the supplier or recipient is located.
The same FAQ describes an exception for a transit state where no electronic consignment information, such as an e-way bill, was furnished or prescribed documents were not carried. In ordinary proposed-rule cases, a transit-state officer would allow movement and pass information to the supplier’s or recipient’s jurisdiction. Read the FAQ at the Press Information Bureau.

It does not establish that an amendment has been enacted or commenced. Before relying on the restrictions in a live dispute, check the official Gazette, the consolidated current CGST Act and the updated Rules for an enacted text and commencement date. Until then, do not tell a carrier that a transit-state officer lacks power solely because the proposal describes a different allocation of jurisdiction.

State-law and fact-specific checks
GST is administered through central and state authorities, and movement patterns can involve more than one jurisdiction. Verify the current law applicable to the supplier, recipient, route, goods, conveyance and tax authority involved. The e-way-bill threshold and detention-reporting guidance are general statements from the official FAQ; exceptions, special movement rules and state-specific conditions can change the analysis.
For an active detention, the safest record is chronological: dispatch time, e-way-bill generation, vehicle changes, inspection, order service, notice service, reply, hearing, payment or security, release and any subsequent order. That chronology lets an adviser test both the alleged contravention and whether the statutory safeguards were followed.
