GST registration in India: who needs it, how to apply and when to cancel

Who needs to register for GST, and how do I apply or cancel my GST registration? The answer depends on your aggregate turnover across the same PAN, the state or union territory in which you supply, what you supply, and whether a compulsory-registration rule applies. There is no single threshold that safely covers every business.

Use the decision sequence in this guide: establish whether section 22 or section 24 of the Central Goods and Services Tax Act, 2017 makes registration compulsory; identify the correct application deadline and form; then, if the business stops or no longer needs registration under an available legal ground, file the cancellation application and settle stock-related and other outstanding liabilities.

First decide whether registration is compulsory

GST registration is generally state- or union-territory-specific. A business may therefore need a registration in each state or union territory where it is liable, rather than relying on one registration for all of India. Start with four questions:

What’s actually slowing this PC down?

  1. What is the business’s aggregate turnover for the financial year, calculated across supplies linked to the same PAN?
  2. Where are the supplies made, and does the applicable state or union territory have a different threshold or notification?
  3. Are the supplies goods, services, exempt supplies, inter-State supplies, or another category that changes the analysis?
  4. Does a compulsory-registration provision apply even if turnover is below the ordinary threshold?

The controlling provisions are sections 22 and 24 of the CGST Act, together with amendments, notifications and applicable exceptions. The CBIC text of section 22 and the CBIC FAQ material are useful starting points, but a notification issued after an older FAQ can change the result.

Threshold-based liability under section 22

Section 22 contains monetary thresholds, but they are not a universal safe harbour. The Act states a general threshold of ₹20 lakh and a ₹10 lakh threshold for specified special-category-state circumstances. It also permits the government, on the GST Council’s recommendation, to notify a threshold of up to ₹40 lakh for a supplier engaged exclusively in goods, subject to conditions and limitations.

Section 22 figure What the figure represents Qualification
₹20 lakh General threshold stated in the Act Apply only after checking the business’s state or union territory, supply mix, notifications and current amended text
₹10 lakh Lower threshold stated for specified special-category-state circumstances The relevant state or union territory and current statutory conditions must be confirmed
Up to ₹40 lakh Maximum threshold the government may notify for an eligible supplier engaged exclusively in goods A notification, conditions and limitations determine whether a particular supplier qualifies

“Aggregate turnover” is not simply the sales shown in one shop or one state. Assess the turnover covered by the statutory definition across the PAN, then apply the relevant exclusions and inclusions under GST law. Separate registrations, branches and business lines do not automatically create separate threshold calculations.

Compulsory registration can apply below the ordinary threshold

Section 24 identifies categories for which registration is compulsory, subject to statutory exceptions and notifications. Transaction patterns involving inter-State supplies, cross-border activity, e-commerce, reverse charge and other specified situations can therefore require a closer review even when turnover is modest. Do not conclude that a small business is exempt solely because it has not crossed the general threshold.

The exact treatment of each category can change through amendments and notifications. Check the current CBIC FAQ and sectoral FAQ material against the present Act before relying on an example. The FAQ is explanatory; the Act, rules and notifications control the legal result.

Exempt activities and agriculturists

A person dealing exclusively in exempt supplies is generally not liable to register, according to CBIC FAQ guidance, and an agriculturist is not liable to the extent of produce supplied from cultivation of land. Those statements do not decide mixed activities. If even one line of business is taxable or falls within a compulsory-registration category, assess the whole fact pattern rather than applying the exemption to the enterprise automatically.

Application deadlines and separate registrations

Ordinary applicants: 30 days after liability arises

A person liable under section 22 or section 24 generally must apply in every state or union territory in which the liability arises within 30 days from the date on which the person becomes liable. Section 25(1) states:

The Psychology of Money: Timeless lessons on wealth, greed, and happiness

“Every person who is liable to be registered under section 22 or section 24 shall apply for registration in every such State or Union territory in which he is so liable within thirty days from the date on which he becomes liable to registration, in such manner and subject to such conditions as may be prescribed”.

Read the current wording in the CBIC-hosted section 25 text when fixing the trigger date. The 30-day period is not a general annual deadline; it runs from the event that makes the person liable.

Casual and non-resident taxable persons: apply before starting

A casual taxable person and a non-resident taxable person must generally apply at least five days before commencing business. These applicants have distinct procedural requirements and may need advance tax deposits. Do not use the ordinary 30-day assumption for either category.

SEZ units and developers

An SEZ unit or developer needs a registration separate from the entity’s other place of business in the same state or union territory. Treat the SEZ registration as a separate compliance task, even where the legal entity already has a regular registration in that state.

How to apply through FORM GST REG-01

The registration rules prescribe an electronic process through the GST Common Portal. The standard application is FORM GST REG-01, completed in two parts. Keep the PAN, contact details, authorised signatory information and supporting records ready before beginning.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Open Part A of REG-01. Enter the PAN, mobile number, email address and state or union territory. These details are verified electronically.
  2. Complete the verification. After PAN and contact verification, the portal generates a temporary reference number (TRN). Save the TRN and the communication details used for the application.
  3. Use the TRN to access Part B. Enter the business, promoter or partner, principal-place-of-business, additional-place-of-business, bank and authorised-signatory information requested by the form.
  4. Upload the required supporting documents. The precise document set depends on the constitution of the business and the facts declared. Use the current form checklist rather than an old downloaded list.
  5. Sign and submit electronically. Complete the prescribed electronic authentication or signature step for the applicant and authorised signatory, then submit Part B.
  6. Record the acknowledgement. Keep the acknowledgement reference and a copy of the submitted form. Use the portal’s current status facility for notices, clarifications or approval decisions.

The CBIC registration rules set out the application framework. Applicants in special classes may have a different form or additional steps. For example, the rules describe advance tax deposits for casual taxable persons and a separate application and advance-deposit requirements for non-resident taxable persons.

What to expect after submission

Do not promise yourself approval within a fixed number of days based on an older FAQ. Processing timelines, document scrutiny and risk-based verification can change. Monitor the live application status and respond to any clarification request within the period shown on the portal. A mismatch in PAN, legal name, address, authorised-signatory details or uploaded evidence can delay processing or lead to rejection.

Voluntary registration: useful, but not a short-term workaround

A person who is not otherwise liable may apply voluntarily under section 25(3). Once granted, the person is treated as a normal taxable person, not as a special reduced-obligation registrant. That can be useful where customers require a GSTIN or where the business wants the legal and commercial consequences of regular registration, but it also creates ongoing filing and record-keeping responsibilities.

Voluntary registration is not a convenient trial period. The registration rules state that an application to cancel a voluntary registration is not considered before one year from the effective registration date. The CBIC FAQ explains the normal-taxable-person treatment, while the registration rules contain the cancellation restriction. Factor that one-year minimum into the decision before applying.

When cancellation may be appropriate

Cancellation is an exit from the registration, not a deletion of the business’s tax history. Section 29 recognises circumstances such as discontinuance of business, transfer of the business, or a change that leaves the person no longer liable in circumstances permitted by law. Where a registered person dies, legal heirs can apply. The proper officer can also initiate cancellation on specified grounds.

The effective date is fact-dependent. It may be the date requested, the date an event occurred, or another date determined in the officer’s order. Do not treat the filing date as automatically being the cancellation date. Review the current section 29 text and the registration rules for the ground that fits your case.

Common situations to examine

  • The business has permanently discontinued its taxable activity.
  • The business has been transferred, merged or otherwise changed in a way recognised by section 29.
  • Turnover or activity has changed and the person is no longer liable, with no compulsory-registration rule continuing to apply.
  • A registered person has died and the legal heirs are handling the closure.
  • The registration was voluntary and at least one year has elapsed since its effective date.

These are decision categories, not automatic approvals. A sale of one division, a temporary pause, a change of premises or a seasonal reduction may require an amendment, suspension or another response rather than cancellation.

How to file cancellation in FORM GST REG-16

An eligible registered person generally files FORM GST REG-16 electronically within 30 days of the event warranting cancellation. The GST Portal’s cancellation manual describes the operational workflow; use the live portal labels because screens can be updated.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Confirm the legal ground and date. Identify the event that supports cancellation and the proposed effective date. Check that a voluntary registration has completed the one-year restriction.
  2. Reconcile the registration. Bring returns, tax payments, amendments and correspondence up to date as far as the law and portal permit. Resolve obvious mismatches before filing.
  3. Open the cancellation service. In the GST Portal registration area, choose the cancellation application and start FORM GST REG-16.
  4. Enter the event details. State the reason, requested effective date and the facts supporting the selected ground.
  5. Declare stock and capital goods. Report inputs, semi-finished goods, finished goods and capital goods held on the effective cancellation date, along with the related liability and any payment made.
  6. Attach supporting evidence. Add documents that establish discontinuance, transfer, death or another relevant event when the form or officer requires them.
  7. Authenticate and submit. Complete the prescribed verification, submit the application and save the acknowledgement reference.
  8. Monitor the officer’s review. Cancellation is subject to tax-official review. Respond to a notice or request for clarification through the portal and retain the final order.

The 30-day period is measured from the event warranting cancellation, not from the date on which the owner first thinks about closing. If the business is transferred or discontinued in stages, document the facts so the requested date can be supported.

Tax and stock consequences do not disappear

Cancellation ends the registration prospectively or from the effective date determined under the law; it does not erase tax obligations created before that date. Section 29(5) requires the prescribed amount relating to input tax credit on stock and capital goods or the output tax on those goods, whichever is higher, calculated as prescribed. The cancellation work therefore needs a stock calculation, not just a form submission.

Outstanding tax, interest and penalties may also remain payable. A cancellation application should be coordinated with the final returns, unpaid assessments, notices, tax invoices, credit notes and books of account. Keep evidence of the quantities, values, dates and payments used in the stock calculation so the figures can be explained if the officer asks.

Cancellation preparation checklist

  • Identify the legal event and proposed effective date.
  • Check whether any compulsory-registration category still applies after the change.
  • Confirm that a voluntary registration has passed its one-year minimum.
  • Prepare the stock and capital-goods list as of the proposed effective date.
  • Calculate the prescribed amount comparing the relevant input-tax-credit and output-tax measures.
  • List unpaid tax, interest, penalties and open notices.
  • Collect transfer, closure, death or other supporting documents.
  • Save the REG-16 acknowledgement, responses and final order.

Registration versus cancellation: the decisions side by side

Decision point Registration Cancellation
Primary trigger Liability under section 22 or 24, or a voluntary choice under section 25(3) Discontinuance, transfer, permitted end of liability, death or an officer-initiated ground
Main form FORM GST REG-01 for the ordinary applicant FORM GST REG-16 for an eligible registered person seeking cancellation
General timing Within 30 days after liability arises Generally within 30 days of the event warranting cancellation
Special timing Casual and non-resident taxable persons: at least five days before commencing business Voluntary registration: cancellation application is not considered before one year from the effective registration date
Separate-location issue Apply in every state or union territory where liable; SEZ units and developers register separately from the entity’s other place of business in that state or union territory Effective date and outcome depend on the facts and the officer’s order
Financial consequence Creates the normal taxable-person compliance framework, including the obligations that accompany the registration Stock, capital-goods, tax, interest and penalty liabilities can remain after the application

Common mistakes and how to avoid them

Using one threshold for every business

Applying ₹20 lakh, ₹10 lakh or ₹40 lakh without checking the state, supply mix and current notification is the most common analytical error. Treat the figures as statutory baselines with conditions, not as a universal answer.

Counting turnover only in the registration state

Aggregate turnover is assessed across the PAN as required by GST law. Gather the figures for all relevant registrations and business lines before deciding that the threshold has not been crossed.

Ignoring compulsory-registration categories

A low turnover does not by itself defeat section 24. Review inter-State, cross-border, e-commerce, reverse-charge and other specified transactions, then check the applicable exceptions and notifications.

Missing the trigger date

The ordinary deadline runs from the date liability arises. Casual and non-resident applicants have a pre-commencement requirement. Record the event date in the compliance calendar rather than waiting for a month-end sales report.

Treating old FAQ timelines as guarantees

Portal processing and verification practices can change. Submit complete information, monitor the current status and answer notices instead of relying on a fixed approval promise copied from an older page.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Filing cancellation without a stock calculation

REG-16 asks for stock and capital-goods information because cancellation can trigger a prescribed tax amount. Reconcile quantities and values before submission and budget for unpaid tax, interest or penalties.

Assuming cancellation is immediate

The officer reviews the application and determines the effective outcome under the law. Continue meeting applicable obligations until the order and effective date are clear.

Where to verify a fact-specific case

Use the controlling primary materials for the final decision: section 22 for threshold liability, section 25 for application and voluntary registration, section 29 for cancellation and its consequences, and the registration rules for forms and procedure. The CBIC FAQs can clarify terminology and examples, while the GST Portal cancellation manual explains the current operational flow.

Because notifications, amendments and portal requirements can change, confirm the position for the relevant financial year and state or union territory. If the business has mixed supplies, related entities, cross-border transactions, an SEZ operation or material stock at closure, obtain advice from a qualified Indian tax professional before filing.
