GST Registration for E-Commerce Sellers vs. Regular GST Registration: Key Differences

By TheFinanceBase Team 12 min read

Short answer: Listing products online does not by itself make a business an e-commerce operator (ECO), and using a marketplace does not always produce the same GST result as selling on your own website. The key questions are who operates the platform, who makes the underlying supply, whether the platform must collect tax at source (TCS) under section 52 of the CGST Act, what is being supplied, where the supplier is located, and whether a current notification provides an exception.

An ECO and a seller using an ECO are separate legal categories. A regular GST registration is the ordinary registration of a business whose liability arises under the general rules or another compulsory-registration category. Because turnover thresholds and notification-based exemptions vary by facts and can change, no single statement such as “every marketplace seller must register” or “online sellers below ₹20 lakh never register” is safe without checking the current law.

What the comparison actually means

There are three different roles that are often blurred together:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • E-commerce operator (ECO): the person who owns, operates or manages the electronic platform through which supplies are facilitated. Section 24 of the CGST Act separately addresses registration of an ECO.
  • Seller or supplier using an ECO: the business that owns the goods or provides the service and makes the underlying supply to the customer. Section 24(ix) addresses certain suppliers making supplies through an ECO that is required to collect TCS under section 52.
  • Regular seller: a business supplying on its own account, without the relevant marketplace-TCS relationship. It is assessed under the ordinary registration-liability rules and any other compulsory-registration provisions that apply to its facts.

Therefore, a seller does not become the ECO merely by opening a marketplace account. Conversely, the operator can have registration and TCS obligations even though it never owns the inventory sold by marketplace merchants.

The official Act places the distinction in context. Section 24(ix) refers to “persons who supply goods or services or both, other than supplies specified under sub-section (5) of section 9, through such electronic commerce operator who is required to collect tax at source under section 52.” That wording connects the seller’s compulsory-registration category to the ECO’s TCS obligation and expressly leaves room for notified exceptions. Read the complete provisions in the CGST Act published by CBIC, rather than relying on a sentence detached from the section.

Side-by-side: ECO, marketplace seller and regular seller

Issue E-commerce operator Seller using an ECO Regular seller outside the relevant ECO arrangement
Legal role Owns, operates or manages the electronic platform. Section 24(x) addresses ECO registration. Makes the underlying supply through an ECO. Section 24(ix) addresses qualifying suppliers where the ECO must collect TCS. Makes supplies on its own account and is tested under ordinary liability rules and any other compulsory category.
Who receives the customer order or consideration May facilitate or collect consideration for supplies made by other suppliers, depending on the platform model. Supplies the goods or services; the platform’s collection arrangement affects the TCS analysis. Collects payment itself or through an ordinary payment channel, without the marketplace-TCS relationship described in section 52.
TCS Section 52 collection duties can apply when it collects consideration for taxable supplies made by other suppliers through the platform. The ECO may collect TCS from qualifying marketplace transactions. TCS is a collection mechanism, not the seller’s output-tax liability. No marketplace TCS arises merely because a sale is made online. Other GST obligations can still apply.
Own-account website sales A person selling its own products through its own website can fall within the ECO definition, but that does not automatically create section 52 TCS on its own-account sales. A seller’s own-account sales are not the same as supplies made by unrelated suppliers through a marketplace. CBIC states that own-account website sales do not require section 52 TCS collection on those sales, although GST at the applicable rate may still be payable.
Exceptions Separate treatment can apply where the ECO is required to pay tax under notified section 9(5) services. Notification-based exceptions may apply. Current eligibility for a particular unregistered goods seller must be confirmed from the operative notification and portal process. Threshold, state, supply-type and other compulsory-registration rules apply according to the business facts.
Registration route Use the GST system’s applicable ECO category and comply with the associated returns and TCS requirements. Apply when actual liability exists after checking the ECO, supply, state, turnover and notification questions. Use the normal taxpayer registration route when the ordinary rules make registration compulsory or when the business elects voluntary registration.

This table is a decision framework, not an eligibility ruling. The answer can change with the state or Union territory, the goods or services, inter-State activity, aggregate turnover, the party collecting consideration and the wording of a current notification.

When a marketplace seller can face compulsory registration

The TCS link in section 24(ix)

Section 24(ix) is not written as a blanket rule for every online merchant. It covers persons supplying goods or services through an ECO that is required to collect TCS under section 52, subject to the statutory exclusions and notifications. The practical sequence is:

Free tools Windows power users keep installed

  1. Identify whether the website or app is an ECO for the transaction.
  2. Determine whether that ECO is required to collect section 52 TCS for the supplies in question.
  3. Check whether the seller’s goods or services fall within the statutory wording and whether a later notification exempts the category.
  4. Apply the remaining compulsory-registration rules, including state, supply and turnover conditions.

An FAQ answer that says all marketplace sellers must register can be overbroad if it ignores a later notification. Conversely, the existence of a possible exemption does not prove that every low-turnover seller is exempt. The operative notification and the live GST Portal process must be checked for the exact category.

Section 9(5) services are a specific carve-out

Some services are taxed by the ECO under section 9(5). CBIC’s sectoral FAQ says suppliers of services covered by that mechanism can be entitled to threshold exemption, subject to the applicable conditions. That answer is specific to the notified section 9(5) service treatment. It should not be extended automatically to other services or to goods sold through a marketplace.

Why a turnover number cannot answer every case

Readers often ask whether a trader with turnover below ₹20 lakh must register when selling through an e-commerce website. CBIC’s FAQ frames the answer around whether the ECO is required to collect TCS, but portions of that FAQ may predate later notification-based relief. The ₹20 lakh figure should therefore not be presented as a current universal threshold for every state, category or seller.

Aggregate turnover, the nature of supplies, the state or Union territory, inter-State activity and notification conditions all matter. An exempt-only business may have a different result from a business making taxable supplies. A seller can also become liable under another compulsory-registration provision even when the marketplace rule is not decisive. Confirm the current threshold and exception applicable to the seller’s facts before invoicing or advertising a “no registration required” position.

Own website versus a marketplace

Own-account sales on your own website

CBIC explains that a person selling its own products through its own website can meet the definition of an ECO, yet does not have to collect section 52 TCS on those own-account supplies. The reason is that the TCS provision concerns consideration collected for taxable supplies made by other suppliers through the operator. The business still has to determine whether GST is chargeable on its products and whether ordinary registration liability arises.

For example, a manufacturer that owns its domain, accepts orders, receives payment and ships its own stock is not transformed into a marketplace seller merely because the transaction is digital. Its registration analysis follows its own taxable supplies, location, turnover and other compulsory categories.

Marketplace sales involving other suppliers

A marketplace that brings independent sellers and buyers together can be an ECO collecting consideration for suppliers. The seller’s registration question then turns on the section 24(ix) and section 52 relationship, as modified by any notification. The marketplace’s TCS, if applicable, does not replace the seller’s responsibility to account for output tax, invoices, returns and records once registered.

Mixed business models

Many businesses do both: they sell their own inventory on a website and also allow third-party suppliers to sell through the same interface. Analyze each stream separately. The own-account stream and the facilitated-supplier stream can have different TCS and registration consequences, even when customers see one brand or checkout screen.

Registration timing and where to register

Section 25(1) states: “Every person who is liable to be registered under this Act shall apply for registration in every such State or Union territory in which he is so liable within thirty days from the date on which he becomes liable to registration.” The 30-day period runs from the date liability arises, not automatically from the date a seller first creates an online account.

Registration is state- and Union-territory-based. A seller must identify every jurisdiction in which the Act makes it liable, rather than assuming that one registration covers all operations. The Act specifies different advance-application timing for casual taxable persons and non-resident taxable persons, so those applicants should not use the ordinary 30-day rule as a substitute for the specific provision.

Voluntary registration is also possible under the Act. Choosing it can create ongoing compliance duties, so it should be a deliberate decision rather than a way to avoid resolving whether a notification exemption applies.

How to decide whether your e-commerce business needs registration

Use this sequence for each business model and supply stream:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Map the transaction. Write down who owns the goods or service, who contracts with the customer, who collects payment, who issues the invoice and who controls the platform.
  2. Classify the platform. Decide whether the transaction uses an ECO, your own website for your own supplies, or an ordinary online sales channel that does not involve supplies by other sellers.
  3. Check TCS status. Establish whether the ECO is required to collect tax at source under section 52 for this type of transaction. Do not infer the answer solely from the fact that the sale occurred online.
  4. Classify the supply. Separate goods, ordinary services and services taxed by the ECO under section 9(5). The specific service treatment cannot be generalized to goods.
  5. Calculate aggregate turnover correctly. Include the supplies and locations required by the GST rules, and distinguish taxable, exempt and other components rather than relying on a single marketplace payout figure.
  6. Check geography and other compulsory categories. Review the state or Union territory, inter-State activity and any additional category that independently triggers registration.
  7. Verify the current notification. If relying on an exemption for an unregistered goods seller using an ECO, read the current notification, its effective date, conditions and any portal-enrolment requirement. The broad FAQ wording is not enough.
  8. Document the conclusion. Keep the platform agreement, payment-flow description, turnover computation, notification relied on and the date of the check. Revisit the conclusion when the law, platform model or product range changes.

Applying through the GST Portal

The GST Portal’s guide for a normal taxpayer describes the New Registration application and asks for information such as taxpayer type, state or Union territory, PAN, contact details and the reason for registration. Start with the official GST Portal guide for “Apply for Registration: Normal Taxpayer”, then follow the labels displayed in the live portal because screens, fields and validation rules can change.

  1. Select the registration application for a normal taxpayer and identify the relevant state or Union territory.
  2. Enter the legal name and PAN details exactly as recorded in the income-tax records, together with the authorized contact information.
  3. Choose the reason for registration that matches the actual liability, such as compulsory liability or voluntary registration; do not select a marketplace category merely because sales are online.
  4. Describe the business activities and additional places of business accurately, including warehouses or fulfilment locations where the rules require them.
  5. Provide the requested identity, address and bank information, upload supporting documents in the portal’s current format and complete the verification step.
  6. Save the application reference number and monitor portal notices. A clarification request or document mismatch can delay approval, so answer within the time shown in the notice.

The portal workflow is procedural; it does not decide whether the underlying exemption applies. Resolve the legal classification first and retain evidence supporting the selected reason for registration.

What TCS does—and does not—mean for the seller

TCS is collected by the ECO in the circumstances covered by section 52. It is not the same as the seller’s output GST charged on a taxable supply. A marketplace deduction can appear in the seller’s settlement statement while the seller still has to determine taxable value, tax rate, invoice requirements, input-tax-credit eligibility and return reporting after registration.

Do not quote a TCS rate from an old FAQ as if it were current. Rates and mechanics can change by law or notification, and the available FAQ figure has not been independently confirmed here against a current notification. Obtain the rate and reporting instructions applicable to the transaction date from current official material before configuring accounting software or reconciling settlements.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For reconciliation, compare marketplace orders, cancellations, returns, fees, TCS credits, customer refunds and bank settlements. A net payout is not automatically the taxable value of supplies. Keep the platform’s statements and the seller’s own invoices aligned so that TCS credits are not mistaken for final tax payment.

Common mistakes and how to correct them

“Every marketplace seller must register.”

This ignores the statutory authority for notification-based exceptions and the specific section 9(5) treatment. Recheck the current notification, TCS status and seller category before reaching that conclusion.

“Below ₹20 lakh means no GST registration.”

A historical FAQ threshold cannot be used as a universal answer. Test the state, supply type, inter-State activity, aggregate turnover and other compulsory categories, and verify whether the relevant threshold is currently in force for the seller.

“The marketplace’s TCS is my GST payment.”

TCS is a collection and credit mechanism. It does not by itself calculate the seller’s output tax or complete the seller’s compliance obligations.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“My own website is automatically exempt because no marketplace is involved.”

Own-account sales avoid the section 52 TCS scenario described by CBIC, but GST can still apply at the relevant rate and ordinary registration rules can still make registration compulsory.

“One registration covers every state.”

Section 25 generally requires registration in each state or Union territory where liability arises. Review warehouses, fulfilment operations and other places of business rather than relying on the address used for the online account.

“The portal accepted my application, so the exemption is confirmed.”

Portal acceptance is not a legal opinion on a notification. Preserve the analysis and supporting documents that establish why registration was or was not required.

Practical examples

Small goods seller on a marketplace

A sole proprietor lists taxable goods on a marketplace that collects customer consideration. The seller must first establish whether that ECO is required to collect section 52 TCS and whether a current notification exempts the seller’s exact goods category. Turnover below a commonly quoted figure is not enough to decide the case. The seller should document the notification check and any state or inter-State issues before treating the account as unregistered.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Service provider covered by section 9(5)

A service supplier provides a service for which the ECO is the person liable to pay tax under section 9(5). CBIC’s sectoral FAQ describes threshold relief for qualifying suppliers, subject to conditions. The supplier should verify that the service actually falls within the notified section 9(5) class; a different service or a goods transaction may not receive the same treatment.

Manufacturer selling only its own products online

A manufacturer sells its own stock through its own website, receives the payment and ships to customers. CBIC says section 52 TCS is not required on those own-account sales. The manufacturer must nevertheless apply the ordinary GST liability tests, charge GST where applicable and register in each jurisdiction in which liability arises.

Business with both website and marketplace sales

The business should maintain separate transaction mapping for own-account website sales and marketplace supplies by other sellers. The platform’s TCS statements relate to the facilitated stream, while the website stream follows the ordinary rules. A combined turnover report that hides the two models can lead to the wrong registration conclusion.
