GST Refund Limitation Periods: How to Calculate the Deadline for Each Claim Type

For most GST refunds under section 54 of India’s Central Goods and Services Tax Act, 2017 (CGST Act), the application must be filed before two years expire from the legally defined relevant date. That date depends on the type of refund: an export may be tied to a ship’s departure, a service payment or invoice, communication of a court order, or another event. It is not automatically the date you paid tax or discovered an error.

Specified claimants covered by section 55 follow a separate six-month period measured from the end of the quarter in which inward supplies were received. The statutory wording and portal procedure can change, so verify the current consolidated Act, rules, notifications and case law before relying on a particular filing date.

How long do I have to claim a GST refund?

Section 54(1) states the general limitation rule:

“Any person claiming refund of any tax and interest, if any, paid on such tax or any other amount paid by him, may make an application before the expiry of two years from the relevant date in such form and manner as may be prescribed.”

This is a statutory period, not a service-level promise from the tax department. It limits when the claimant may apply. The department’s time for examining, sanctioning, withholding or paying a refund is a separate procedural matter.

The main exception in the section 54(1) proviso concerns a registered person seeking repayment of a balance in the electronic cash ledger through the return in the prescribed manner. That route is different from a normal refund application and should not be treated as a generic two-year calculation without checking the current rules and portal workflow.

What is the “relevant date” for a GST refund?

Section 54(2) assigns a starting event to each major category. Identify the legal basis of the claim first, document the event that the clause uses, and only then count the limitation period. The following map reflects the statutory categories described in the CGST Act and the procedural material issued by the Central Board of Indirect Taxes and Customs (CBIC).

Refund category Relevant-date event Records that normally establish the event Limitation and route
Export of goods by sea or air Departure of the ship or aircraft from India Shipping bill, export manifest or report, transport documents and customs departure evidence Generally two years from the applicable departure event; file through the prescribed electronic refund process
Export of goods by land Passage of the goods across the frontier Land-export customs records, transport documentation and proof of frontier crossing Generally two years from the frontier-crossing event; electronic filing is normally required
Export of goods by post Dispatch of the goods by the post office Postal receipt, export documentation and dispatch evidence Generally two years from postal dispatch; use the prescribed refund process
Deemed exports Date on which the return relating to the deemed exports is furnished Relevant return, deemed-export invoices, recipient and supplier records, and proof of receipt or payment as required Generally two years, but confirm which return date applies under the complete current CBIC guidance
Export of services Receipt of payment in convertible foreign exchange where service completion precedes payment; issue of the invoice where payment precedes the invoice Service agreement, invoice, bank realisation or foreign-inward-remittance evidence, and completion records Generally two years from the clause-specific event; check current wording on permitted Indian-rupee receipts
Refund after an appellate, tribunal or court decision Communication of the judgment, decree, order or direction Certified or authenticated decision, communication proof, and the resulting tax or credit records Generally two years from communication of the decision
Unutilised input tax credit (ITC) The end of the financial year in which the claim arises under the applicable statutory clause; some subcategories have had different wording Returns, electronic credit-ledger history, invoices, turnover calculations and category-specific statements Verify the live wording for the exact ITC category before counting; the accessible CBIC versions are not a current consolidated Act
Refund of provisional tax Adjustment of tax after final assessment Provisional-assessment order, final-assessment order, adjustment calculation and payment records Generally two years from the adjustment event
Claim by a person other than the supplier Receipt of the goods or services Delivery, receipt, contract and payment records identifying the claimant Generally two years from receipt
Residual cases Payment of the tax Challan, return, ledger and payment evidence Generally two years from payment
Specified section 55 claimants Last day of the quarter in which inward supplies were received Notification establishing eligibility, purchase invoices, proof of receipt and prescribed certification Six months from the quarter-end date, subject to the relevant notification and procedure

When does the two-year GST refund period start?

It starts with the event named in the applicable relevant-date clause, not with a default date chosen by the claimant. For example, an export-of-goods claim is linked to the transport event, while an export-of-services claim may be linked to payment or invoice issuance. A claim based on a judicial or appellate decision is linked to communication of that decision.

Exported goods

Use the mode of transport to select the trigger. For a sea or air shipment, establish the ship or aircraft departure date from India. For land exports, establish when the goods crossed the frontier. For postal exports, use the date of dispatch by the post office. Keep the customs, carrier and postal records that prove the chosen date; a commercial invoice date alone does not replace the statutory event.

Exported services

There are two timing patterns. If the service was completed before the consideration was received, the receipt of payment in convertible foreign exchange is the trigger. If payment was received before the invoice was issued, invoice issuance is the trigger. The 2021 consolidated PDF records wording allowing Indian-rupee receipts where the Reserve Bank of India permits them; confirm the current consolidated text before applying that detail to a live claim.

Deemed exports

The statutory trigger is the date the return relating to the deemed exports is furnished. CBIC Circular No. 166/22/2021-GST discusses the issue, including whether the supplier’s or recipient’s return date should be used in a particular situation. Because that finer distinction must be checked against the complete, current circular and the facts of the transaction, do not calculate from invoice date or payment date by default.

Orders, judgments and directions

For a refund that follows an appellate, tribunal or court outcome, retain proof of when the decision was communicated. The date printed on the order and the date it was communicated may differ; the statutory wording uses communication. Preserve the electronic transmission, covering letter, portal acknowledgement or other reliable evidence that establishes receipt.

Unutilised ITC and inverted-duty claims

Do not use a generic ITC deadline without identifying the exact subsection and category. One accessible CBIC Act page states an end-of-financial-year trigger for claims under subsection (3), while a consolidated PDF updated through 31 August 2021 shows amended wording for the inverted-duty clause. Those versions are materially different and are not proof of the law in force in 2026. Check the latest consolidated Act, rules, notifications and relevant decisions for the period and ITC category concerned.

Provisional assessments and residual claims

Where tax was paid provisionally, the trigger is adjustment after final assessment. In a residual case that does not fit a specific clause, the trigger is payment of tax. A claimant other than the supplier uses receipt of the goods or services instead. Match the facts to the clause before treating a payment date as the start.

Is the GST refund deadline different for exports, inverted duty, and excess cash balance?

Yes. The limitation period and the filing route both vary.

  • Exports: the relevant date is a shipping, frontier-crossing, postal, payment or invoice event, depending on goods or services.
  • Inverted-duty or other unutilised-ITC claims: the trigger depends on the exact statutory subcategory, and current wording must be verified before a deadline is stated.
  • Excess electronic cash-ledger balance: CBIC guidance recognises that an unused balance remaining after discharge of tax and other dues may be refundable. A registered person may claim a cash-ledger balance through the return in the prescribed manner, so this should not automatically be filed as an ordinary RFD-01 claim.
  • Section 55 claimants: specified notified agencies, diplomatic bodies and other notified persons use a six-month period from the last day of the relevant quarter, provided they meet the applicable notification.

The two-year rule is therefore a broad starting point, not a universal answer for every refund or every claimant.

How do I calculate my GST refund application deadline?

  1. Classify the claim. State the legal basis in your working papers: export of goods, export of services, deemed export, unutilised ITC, order-based refund, provisional assessment, cash-ledger balance, section 55 claim or another category.
  2. Locate the current relevant-date clause. Read the live section 54(2) provision and any applicable rule, notification, circular or judicial interpretation. This step is essential for ITC claims and for deemed exports.
  3. Prove the trigger date. Use the record named by the law: departure, frontier crossing, postal dispatch, payment receipt, invoice issue, communication of an order, return filing, quarter end or another specified event.
  4. Confirm the claimant’s status. Check whether section 55 or another special provision applies. A diplomatic or notified organisation cannot assume that the ordinary two-year period governs its claim.
  5. Count the statutory period from that event. Apply the two-year or six-month period to the legally established trigger, following the applicable computation and filing rules. Do not silently substitute the payment date, invoice date or date of discovery.
  6. Allow time for portal and document issues. File before the calculated expiry, not on the last possible day. Resolve digital-signature, bank-account validation, return-filing or document-upload problems while time remains.
  7. Have the result reviewed for a live claim. A GST professional should verify the current law, date arithmetic, eligibility and filing acknowledgement, especially where an amendment, exclusion, extension or court decision may affect limitation.

Illustrative calculation

Assume the applicable clause uses a two-year period and the legally proven relevant date is 15 March 2025. The ordinary calculation points to filing before the two-year period expires in March 2027, subject to the current computation rules and any special order affecting the period. If the relevant date is instead the last day of a quarter under section 55, the six-month calculation begins from that quarter-end date, not from each invoice date.

What documents establish the relevant date?

Build the evidence file around the trigger, not merely around the amount claimed.

  • Goods exports: shipping bill, export manifest or report, bill of lading or airway bill, customs departure record, land-frontier evidence or postal dispatch receipt, as applicable.
  • Service exports: contract, invoice, proof of service completion, bank realisation or inward-remittance evidence, and evidence supporting any permitted rupee receipt.
  • Deemed exports: the relevant supplier or recipient return, invoices, recipient declarations and records proving the transaction satisfies the deemed-export conditions.
  • Order-based claims: the judgment, decree, appellate or tribunal order, proof of communication and a calculation showing how the order changes the tax position.
  • Unutilised ITC: electronic credit-ledger extracts, returns, purchase invoices, turnover and tax calculations, and the statements required for the particular refund category.
  • Provisional tax: provisional and final assessment orders, adjustment entries and proof of payment.
  • Section 55 claims: the notification or status document establishing eligibility, inward-supply invoices, proof of receipt and prescribed certification.

Keep the original electronic acknowledgements and a dated copy of every upload. If a portal timestamp, return-filing date or communication date is disputed, those records may determine whether the application was timely.

How is the refund filed?

The GST Refund Rules generally provide for electronic filing of FORM GST RFD-01 through the Common Portal or a notified facilitation centre for most categories. The rules also prescribe a return route for certain electronic cash-ledger balances and category-specific supporting documents. Portal labels and enabled workflows can change, and some rule pages retain legacy form references, so follow the currently enabled process rather than an old checklist.

Before opening RFD-01

  • Ensure the relevant GST returns have been filed and the tax position supporting the claim is reflected consistently.
  • Reconcile invoices, shipping or service records, payment evidence and ledger balances.
  • Check that the claimant’s bank account is validated on the portal.
  • Separate the amount claimed as refund from credits or cash already used to discharge other dues.
  • Prepare the statement, declaration, certificate and undertaking required for the category and amount.

Goods-export prerequisites

For export-of-goods claims, the rules refer to export-manifest or report delivery and related customs evidence. A shipping bill by itself may not establish every prerequisite. Confirm that the export data has reached the required system and that invoice, shipping-bill and return values reconcile.

SEZ service prerequisites

Refunds connected with authorised operations for a Special Economic Zone require evidence of admission or receipt of services and the certifications prescribed for the transaction. Obtain the authorised-officer or recipient documentation before filing; an invoice alone may not prove the required SEZ condition.

Confusing application limitation with departmental processing time

File within the claimant’s limitation period first. Processing, deficiency memos, sanction and payment operate under separate provisions and timelines.

Ignoring section 55 status

Check the notification that covers the claimant. If section 55 applies, the six-month quarter-end rule may govern instead of the general period.

Relying on an unproven communication date

For an order-based refund, retain evidence of communication. If the record shows only the order date, obtain the transmission or acknowledgement needed to establish when it was communicated.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Waiting until the final day to upload

Portal outages, validation failures, missing customs data or bank-account errors can prevent submission. Submit with a documented buffer and preserve the acknowledgement number and timestamp.

What the law does not let you assume

  • You cannot assume every GST refund has exactly two years.
  • You cannot assume the tax-payment date is the relevant date.
  • You cannot assume an invoice date proves the trigger for an export-of-services claim.
  • You cannot assume a cash-ledger balance must follow the same route as an RFD-01 refund.
  • You cannot assume an older CBIC Act page or 2021 PDF captures every later amendment, exclusion or extension.
  • You cannot assume eligibility from the existence of excess tax or ITC; category conditions and unjust-enrichment or documentary requirements may still apply.

Practical deadline checklist

  • Write the refund category and statutory subsection at the top of the file.
  • Record the relevant-date event and the exact date proved by documents.
  • Check the latest consolidated Act, rules, notifications, circulars and decisions applicable to the tax period.
  • Confirm whether a special section 55, cash-ledger or category-specific route applies.
  • Reconcile returns, invoices, ledgers, customs or banking records.
  • Prepare the required statements, declarations, certificates and undertakings.
  • File through the currently enabled portal route before the calculated expiry.
  • Save the acknowledgement, upload set, payment or ledger records and all communications.
  • Obtain professional confirmation where the claim involves amended ITC wording, deemed exports, litigation, extensions or a close deadline.

Key takeaways

The reliable way to calculate a GST refund deadline is to identify the claim category, find its current relevant-date clause, prove the triggering event and then count the applicable period. Export goods, export services, deemed exports, unutilised ITC, order-based refunds, cash-ledger balances and section 55 claims do not share one interchangeable timeline. Current-law verification is particularly important for ITC subcategories and any claim affected by later amendments or judicial decisions.
