GST Refund Fraud Red Flags: Answers to Common Questions for Indian Businesses

A mismatch in a GST refund file is a reason to investigate and reconcile records, not proof of fraud. Start by confirming that the claimant, refund category and filing route fit the transaction. Then match invoices and supplier details to purchase orders, delivery or service evidence, payments, returns and, where relevant, export, shipping-bill, SEZ-endorsement or remittance records.

Indian tax authorities use data analytics and risk parameters to select suspicious GSTINs, and enforcement materials describe fake invoicing and shell entities. The public instructions do not publish a universal red-flag score. Treat every indicator as a prompt for evidence-based review, correction and qualified advice rather than as a conclusion that an offence occurred.

What a GST refund red flag means

A red flag is an inconsistency or missing link in the evidence trail supporting a refund claim. It can result from a clerical error, a data-entry mismatch, a supplier correction, a misunderstood category rule or a transaction that needs deeper examination. None of those possibilities can be resolved by looking at one field in isolation.

The correct question is whether the claimed refund is supported by the transaction that actually occurred and by the documents required for that category. Keep legitimate documentation errors separate from evidence suggesting that no goods or services were supplied, that invoices were fabricated or that tax-credit records do not reflect real business activity.

CBIC’s GST refund rules govern the electronic application process and category-specific evidence. The tax-invoice rules set out the particulars an invoice is expected to contain. Together, they provide a starting point for a defensible review, but they do not turn a complete-looking invoice into proof that a supply happened.

How the refund claim and evidence trail fit together

Refund applications are filed electronically in FORM GST RFD-01. The supporting material changes with the reason for the refund, so a generic document checklist is unsafe. Use the current rule and portal instruction for the exact category before filing or responding to a query.

Refund situation Evidence identified in CBIC rules What to reconcile
Export of goods Shipping-bill or bill-of-export and invoice details Match invoice numbers, dates, values and tax with export reports, shipping documents and the goods that left India.
Export of services Invoice details and bank-realisation or foreign-inward-remittance evidence Match the service contract and deliverables with the invoice, foreign customer, receipt and the export conditions applicable to the claim.
Supplies to a special economic zone Invoice and prescribed endorsement evidence Confirm the recipient’s SEZ status, the supply, endorsement and tax treatment all describe the same transaction.
Refund of unutilised input tax credit Invoice-level statement details for applicable claims Trace each included purchase invoice to the supplier, eligible credit, return data and the calculation submitted with RFD-01.

Refund rules also contain declarations or certificates about whether the tax incidence has been passed on in cases where that requirement applies. A claim can therefore fail even when invoices exist if the category, calculation, declaration or underlying transaction is not supported.

Red flags businesses should investigate

The category, claimant or filing route does not fit

Check that the legal entity claiming the refund is the entity that made the relevant supply or incurred the relevant input tax. A claim may warrant review when the applicant, GSTIN, period, refund reason or filing route does not match the transaction. For example, an export-of-services claim should not be supported only by domestic-sale records, and an unutilised-ITC claim should not include purchases outside the eligible period or category.

Confirm the applicable rule before labelling the problem. A claim may have been filed under the wrong reason and still be a correctable procedural error rather than fraud.

Invoice particulars are missing, inconsistent or implausible

Compare the supplier’s legal name and GSTIN, invoice number and date, recipient details where required, description, taxable value, tax amount and place of supply for an inter-State supply. Look for duplicate numbers, unexplained gaps, dates that do not fit delivery, values inconsistent with contracts, or a place of supply that conflicts with the actual movement or service.

Use the invoice as an index to the transaction, not as its only proof. The input-tax-credit rules and invoice rules should be read with purchase orders, goods-receipt notes, transport records, work products, timesheets and payment evidence.

An invoice has no credible proof of supply

An invoice included in a refund or credit calculation deserves investigation when there is no purchase order, delivery or receipt record, service deliverable, acceptance record, payment trail or business purpose. Missing paperwork may reflect poor controls, but a pattern of invoices without operational evidence is materially more serious.

Ask the business team that ordered the goods or services to identify what was received, when it was used and who approved it. Preserve the records as they existed; do not create backdated documents to fill a gap.

Export records do not reconcile

For goods, compare invoices with shipping bills or bills of export, export reports and the actual consignment. For services, compare the invoice with the foreign customer, contract, service output and bank-realisation or foreign-inward-remittance evidence required for the category. Differences in currency, dates, values or customer identity need an explanation that can be supported by records.

A shipping document or remittance entry that cannot be tied to the invoice claimed in RFD-01 is a review trigger. It is not, by itself, proof that the export or service was fictitious.

Supplier or recipient behaviour suggests a non-operating business

Review whether the counterparty appears capable of the activity shown on its invoices. Warning signs can include repeated invoices unsupported by goods or services, a sudden cluster of high-value transactions, addresses or contacts that do not work, or records indicating that the business has no genuine operations. These observations should be corroborated with transaction evidence and official records rather than treated as a conclusion from appearance alone.

CBIC’s 2024 instruction discusses verification of suspicious or fake GSTINs and recovery action in cases involving invoices without underlying supply. That language supports enhanced due diligence; it does not make every transaction with a later-defaulting supplier fraudulent.

The communication demanding action cannot be authenticated

A suspicious notice, summons, letter or electronic message may use an unusual channel, pressure the recipient to pay immediately or omit a verifiable identifier. Before sharing records or sending money, use the official DGGI verification service. Depending on the issuing platform and communication type, verify the DIN, eOffice Issue Number or GSTN RFN No.

Reach the service through the official DGGI site, not through a telephone number, email address or payment link supplied only in the questionable message. The DGGI home page and its news and enforcement updates provide the official starting points.

A step-by-step review before filing or responding

  1. Identify the legal basis. Record the refund reason, claimant GSTIN, tax period, amount and the rule or portal category used. Confirm that the entity and period are eligible.
  2. Build an invoice register. List every invoice included in the calculation, including supplier GSTIN, number, date, taxable value, tax, place of supply and the amount of credit or refund attributed to it.
  3. Validate the counterparty. Compare the supplier or recipient identity in the invoice with contracts, purchase orders, registration records and internal vendor-master data. Escalate unexplained name or GSTIN changes.
  4. Prove receipt or performance. For goods, assemble orders, transport documents, goods-receipt notes, stock or consumption records and payment entries. For services, retain the statement of work, deliverables, acceptance, correspondence and timesheets where relevant.
  5. Reconcile tax and returns. Match invoice-level figures to purchase registers, GST returns, eligible input-tax-credit workings and the refund statement. Investigate duplicates, reversals, amendments and timing differences.
  6. Complete category-specific checks. Add shipping bills and export reports for goods, remittance evidence for services, SEZ endorsements where applicable and any declarations or certificates required by the refund rule.
  7. Resolve exceptions transparently. Correct an arithmetic or data error through the permitted process, document the reason and retain the original and corrected records. Do not alter evidence to make a transaction appear compliant.
  8. Obtain specialist advice when risk remains. A tax professional should assess potential interest, reversal, recovery, disclosure or response obligations before the business makes an admission or files a revised position.

How official risk selection works

CBIC Instruction No. 02/2024-GST described a second Special All-India Drive that ran from 16 August 2024 to 15 October 2024. For that historical drive, GSTN, in coordination with DGARM, was to use detailed data analytics and risk parameters to identify suspicious or high-risk GSTINs for jurisdiction-wise verification.

The instruction describes the use of analytics and follow-up verification, not a public checklist or universal score. It therefore cannot be used to assign a percentage risk to a business or to claim that a particular mismatch automatically triggers enforcement. The dates belong to that 2024 drive and are not a current filing deadline or evidence of a new drive.

What enforcement examples show—and what they do not

DGGI describes fake invoicing and fraudulent input tax credit among GST evasion patterns. A DGGI enforcement report also describes shell entities with no genuine business operations and the use of fake invoices and e-way bills. Such reports illustrate behaviours authorities investigate; they are individual cases, not a representative prevalence rate for all refund claims or suppliers.

No comparable official statistic establishing the prevalence of GST refund fraud or total losses is identified in the cited materials. Do not turn a single enforcement figure into a market-wide rate, and do not describe a counterparty as fraudulent unless the facts and applicable legal process support that statement.

What to do when a mismatch is found

If it is an administrative error

Document the discrepancy, identify the source record, correct the return or refund information through the permitted route and keep an audit trail. Explain timing, amendments and accounting treatment consistently across the ledger, returns and supporting schedules.

If evidence of supply is incomplete

Pause the affected claim while the business locates legitimate records. Ask the supplier or operational team for contemporaneous documents, but do not accept a newly created document without checking it against independent evidence such as bank entries, transport data, inventory or customer correspondence.

If the transaction may be unsupported

Separate the affected invoices, preserve electronic and paper records, restrict further credit or refund claims based on them and obtain qualified advice promptly. Consider whether disclosure, reversal, payment or a response to the department is required under the facts; the correct action depends on the rule, period and procedural stage.

If a notice may be genuine

Verify its identifier through DGGI, note the statutory deadline stated in the authenticated communication and coordinate one complete response. Send only the records requested through the authorised channel, maintain a submission receipt and keep a copy of everything filed.

Controls that reduce refund risk

  • Require a category-specific checklist before RFD-01 is submitted.
  • Use maker-checker approval for invoice selection, calculations and declarations.
  • Block duplicate invoice numbers and flag unusual supplier GSTIN, value, date or place-of-supply combinations.
  • Connect purchase, warehouse, service-delivery, bank and return records so an invoice cannot be approved without an owner and evidence.
  • Reconcile export and remittance data before claiming a refund rather than after a query arrives.
  • Review new and high-value suppliers using independent business and operational checks.
  • Train staff to authenticate DIN, eOffice Issue Number and GSTN RFN No. before responding to electronic communications.
  • Keep a dated explanation for every exception, amendment and manual adjustment.

Keeping the rules current

GST forms, rules and portal procedures can change. The CBIC refund and invoice pages should be checked for the version applicable to the claim. The Telangana Commercial Taxes Department’s Handbook on Refunds under GST, January (3rd) 2026 Edition is a useful government reference, but it does not replace the current law, a specific departmental notice or advice on a live dispute.

Before filing, verify the latest category requirements, declarations, calculation method and portal fields. Before responding to enforcement, verify the communication and obtain advice suited to the facts. That process protects a business from both unsupported claims and the opposite mistake: treating an innocent documentation mismatch as proof of fraud.
