GST on freight in India: when a transporter is a GTA and when reverse charge applies

Freight is not automatically subject to reverse charge. Under GST, a road transporter is a goods transport agency (GTA) when it provides a service connected with transporting goods by road and issues a consignment note, whatever that document is called. If the customer belongs to a class listed in the reverse-charge notification, the customer normally pays GST—unless the registered GTA has validly chosen forward charge and has issued an invoice charging GST with the required declaration.

Start with the service contract and the consignment note, then check the recipient’s legal status, the GTA’s tax option and the invoice. The word “freight” by itself does not decide who must pay.

What GST means by “goods transport agency”

The central GST rules use a document-based definition. Notification No. 03/2022-Central Tax (Rate), effective 18 July 2022, defines a GTA as any person who provides a service in relation to transport of goods by road and issues a consignment note, “by whatever name called.” Read the notification at Notification No. 03/2022-Central Tax (Rate).

The service and the document must be considered together

A truck carrying your goods does not, by itself, establish GTA status. Determine what the supplier agreed to do and what it documented. A transport service accompanied by a consignment note generally falls within the GTA definition. A supplier merely making a vehicle available for use may instead be providing vehicle rental, leasing or another service. Those categories must be analysed under their own GST entries.

What a consignment note does

A consignment note records the carrier’s acceptance of goods and identifies the consignment for transport. The legal definition is deliberately broad about its name: a document called a lorry receipt, goods receipt or another equivalent name can qualify if it performs that function. Conversely, do not label every freight bill a consignment note without examining the underlying arrangement.

CBIC’s Sectoral FAQs distinguish a GTA from transport generally and separately discuss hiring or leasing a vehicle. That distinction matters when a contract combines a vehicle, driver and transport work, or when the customer has control over the vehicle for a period rather than buying carriage of identified goods.

When the GTA reverse-charge rule applies

Notification No. 13/2017-Central Tax (Rate) places specified GTA services under reverse charge. The notified entry covers a GTA service supplied to a recipient in one of the following classes, located in the taxable territory. See the original table in Notification No. 13/2017-Central Tax (Rate).

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Recipient class named in the notification What to verify
Factory registered under or governed by the Factories Act Whether the recipient is the factory or an entity covered by the statutory description.
Society The recipient’s legal form and location in the taxable territory.
Co-operative society Its co-operative status and the identity of the contracting recipient.
Person registered under GST The recipient’s GST registration and the GSTIN used for the transaction.
Body corporate Whether the recipient is a body corporate, rather than assuming this from a trading name.
Partnership firm, whether registered or not, including an association of persons The legal constitution of the customer, including an unregistered partnership or AOP.
Casual taxable person The recipient’s casual-taxable-person status and taxable-territory location.

If the service is a GTA service, the recipient is in one of these classes and the forward-charge exception does not apply, the recipient is ordinarily liable under the notified reverse-charge entry. The recipient may be the consignor or consignee, depending on who contracted for and received the service. CBIC’s FAQ puts the general point this way: “Reverse charge mechanism has been provided in GST law for GTA and the recipient of GTA service ( he may be consignor or consignee) is required to pay GST.” This wording appears in Q21 of the CBIC Sectoral FAQs; it must be read with the later 2022 forward-charge amendment.

“Located in the taxable territory” is a separate check

Do not stop after identifying the customer’s legal form. Confirm where the recipient is located for the supply and whether the transaction is within the central GST framework. State and central tax treatment must match the place and nature of supply. Inter-State and intra-State supplies can have different tax components even when the total percentage is the same.

When the GTA can charge GST itself

The 2022 amendments created a practical exception to the GTA reverse-charge entry. Under Notification No. 05/2022-Central Tax (Rate), the entry does not apply when all prescribed conditions are met:

  1. The GTA has taken registration under the CGST Act.
  2. The GTA has exercised the option to pay tax under forward charge.
  3. The GTA issues a tax invoice charging central tax at the applicable rate and includes the prescribed declaration.

Read the amendment at Notification No. 05/2022-Central Tax (Rate). A customer should not infer that the option was exercised merely because a transporter is registered, or because the supplier verbally says that it charges GST. Check the invoice for the tax charge and declaration and retain evidence of the option and registration.

Why the invoice controls the practical answer

The same transport relationship can produce a different compliance result depending on the GTA’s valid election. If the supplier has not met the registration, option and invoice requirements, the recipient cannot simply treat an ordinary freight bill as forward charge. Conversely, if the requirements are met, applying recipient reverse charge to the same supply would duplicate the tax mechanism.

Rates: always read the percentage with its condition

CBIC’s current GST Goods and Services Rates table lists the following GTA outcomes. The percentages are total GST rates; for an intra-State supply, the total is divided between CGST and SGST or UTGST.

GTA position Total rate shown in the CBIC table Condition to carry with the rate Who accounts for the tax
GTA does not exercise the option to pay tax itself 5% (2.5% CGST + 2.5% SGST/UTGST for an intra-State supply) The table states that input tax charged on goods and services used in supplying the service has not been taken. The listed recipient under the RCM entry, unless the forward-charge exception applies.
GTA exercises forward-charge option 5% or 12% (5% + 5% or 6% + 6% for an intra-State supply) The 5% option carries the stated input-credit restriction. Apply the current table’s conditions to the selected rate. The GTA, through its tax invoice.

These are statutory rate choices, not a market average or a negotiated freight percentage. The 5% rate must not be quoted without its input-tax-credit condition. If a supplier chooses 12% forward charge, verify the applicable entry and the invoice for the period in question rather than assuming that every GTA may freely switch rates.

A six-step test for each freight invoice

  1. Identify the contracted service. Read the purchase order, transport agreement and invoice. Decide whether the customer bought carriage of goods by road, vehicle rental, leasing, courier work or a mixed service. CBIC’s FAQ distinguishes these categories; do not classify by the word “freight” alone.
  2. Find the consignment note. Look for the carrier’s consignment document, whatever its title. If no document performing that function exists, do not automatically call the supplier a GTA. Examine the complete arrangement and any other applicable exemption or tax entry.
  3. Classify the recipient. Check whether the customer is a factory covered by the notification, society, co-operative society, GST-registered person, body corporate, partnership firm or AOP, or casual taxable person. Confirm the taxable-territory condition and the actual entity receiving the service.
  4. Check the GTA’s election. Confirm CGST registration, a valid forward-charge option and the required invoice declaration. A supplier’s registration number alone is not proof that forward charge applies.
  5. Match the rate and credit restriction. Use the CBIC rate table for the relevant period. Record whether the 5% input-credit restriction applies and whether the supply is intra-State or inter-State.
  6. Reconcile the invoice. Ensure the invoice identifies the person liable for GST and contains the transport particulars required for a GTA invoice. Resolve inconsistencies before booking tax or claiming credit.

Invoice particulars that support the GST decision

The CBIC Tax Invoice, Credit and Debit Notes rules page lists additional particulars for a GTA invoice. Check for:

  • the gross weight of the consignment;
  • the consignor’s and consignee’s names;
  • the vehicle registration number;
  • details of the goods;
  • the origin and destination of the goods; and
  • the GSTIN of the person liable to pay tax, where applicable, along with the other prescribed invoice particulars.

These fields help connect the invoice to the actual movement of goods and to the party responsible for GST. A mismatch—such as a different vehicle, route, consignee or liable-person GSTIN—should be investigated and corrected rather than ignored as clerical noise.

How common arrangements should be treated

Road carrier issues a consignment note to a GST-registered buyer

This is the standard GTA fact pattern. Confirm that the buyer is a listed recipient and then check whether the carrier has validly elected forward charge. Without that election and compliant invoice, the recipient generally accounts for GST under reverse charge.

Carrier issues a forward-charge invoice

Do not apply RCM automatically. Verify the carrier’s CGST registration, its forward-charge option and the prescribed declaration, then apply the rate and credit condition shown for that option in the current CBIC table. Retain the invoice as evidence of why the supplier, rather than the recipient, accounted for GST.

Transporter supplies a vehicle for use or hire

A vehicle-rental or leasing contract is not interchangeable with a GTA carriage service. Determine who controls the vehicle, what service is promised and which service heading applies. CBIC’s FAQ expressly treats vehicle rent or lease separately from GTA transport.

Road transport without a qualifying consignment note

Absence of a qualifying document means the GTA definition has not been established on the facts available. That does not automatically make the service exempt or taxable under a different entry. Review the contract, invoices and any applicable exemption or classification rule before deciding the tax treatment.

Frequent errors and how to correct them

  • Calling every truck movement a GTA: Correct the classification by testing the service and consignment note together.
  • Putting all freight under RCM: First test the recipient classes and taxable-territory condition in Notification No. 13/2017.
  • Assuming registration equals forward charge: Require evidence of the option and the prescribed invoice declaration under Notification No. 05/2022.
  • Quoting “5%” without the ITC restriction: State the rate and its condition in the same accounting note and invoice review.
  • Using a generic freight bill: Reconcile weight, parties, vehicle, goods, route and liable-person GSTIN with the invoice rules.
  • Relying on an old FAQ sentence: The CBIC FAQ predates the 2022 amendment. Use it for the GTA-versus-transport distinction, but apply the later forward-charge rule.

Records to retain for an audit trail

Keep the transport contract or purchase order, consignment note, tax invoice, recipient’s GSTIN and legal-status evidence, the GTA’s registration and forward-charge declaration where relevant, and calculations showing the rate and credit condition. For recurring carriers, review the election and invoice format when the tax period or contract changes; do not assume that a prior invoice proves the treatment for every later supply.

Limits of the basic decision rule

The central rule above does not resolve every exemption or unusual arrangement. Obtain transaction-specific advice and check the consolidated, current notifications for exempt goods or services, unusual recipient structures, vehicle hire, mixed or multimodal contracts, cross-border facts and other arrangements that do not fit a simple road-carriage invoice. Align the central-tax analysis with the transaction’s place and nature of supply.

Practical conclusion

For each freight bill, document five answers: what service was supplied, whether a consignment note was issued, whether the recipient is in the notified class, whether the GTA validly chose forward charge, and which rate-and-credit condition applies. That sequence prevents both common errors—charging GST to the wrong party and applying a percentage without its legal condition.
