GST late fee and GST interest are different liabilities. A late fee is generally linked to filing a specified return or furnishing required details after the due date under section 47 of the CGST Act. Interest under section 50 is linked to paying tax late. If both the return and the tax payment are delayed, both liabilities may need to be examined separately.

This India-GST guide reflects the statutory framework and GST Portal guidance available through October 2026. Your amount depends on the return type, tax period, applicable notifications, filing and payment dates, tax liability, and payment history.

The difference in one minute

Question Late fee Interest
What triggers it? Filing a specified return or required detail after its due date Discharging GST tax after the payment became due
Main statutory provision Section 47 of the CGST Act Section 50 of the CGST Act
What usually determines the amount? Return or detail involved, days late, and any applicable statutory cap, notification, waiver or concession Tax unpaid, period of delay, applicable subsection and rules, payment dates, and relevant ledger facts
Can it apply without the other? Yes. A return can be filed late even when no tax was paid late. Yes. Tax can be paid late even when the return was filed on time or a separate payment correction is involved.
Where do you verify it? Review the liability generated in the relevant return-filing workflow and the applicable law or notification. Review the system-generated GSTR-3B PDF and use RE-COMPUTE INTEREST if the displayed calculation appears wrong.

The practical test is simple: ask two separate questions—Was the filing late? and Was the tax payment late? Do not call both amounts a single “late payment penalty.”

What GST late fee covers

Late filing of specified returns or details

Section 47 establishes a fee when specified returns or details are furnished after the prescribed date. The statutory structure is based on a per-day amount and a stated maximum, but the amount actually payable can be affected by the return involved, the tax period, later notifications, waivers, or special caps. That is why one universal rupee figure is unsafe.

For example, the late-fee question for a delayed periodic return is not automatically answered by the amount that applied to a different return, a different year, or a temporary government concession. Identify the exact form first, then check the law and any period-specific relief.

Annual returns are treated separately

Section 47(2) separately addresses delay in furnishing an annual return. Its treatment is not interchangeable with the rule for other specified filings. A taxpayer who misses an annual-return deadline should therefore verify the annual-return provision and the notifications applicable to that financial year rather than applying a daily amount remembered from a monthly or quarterly form.

Late fee is about the filing event

Late fee can arise even where the return shows no tax payable. Filing compliance and tax payment are separate obligations. Conversely, paying tax before the filing deadline does not necessarily eliminate a late fee if the required return itself is submitted after its due date.

What GST interest covers

Delayed payment of tax

Section 50 is the statutory basis for interest when GST tax is paid after it became due. The trigger is payment delay—not merely the fact that a return was filed late. A return filed after its due date may have no interest if the relevant tax was already discharged on time, while a late tax payment can create interest even when a return was filed promptly.

Why there is no single interest answer

An individual computation can depend on the applicable subsection of section 50, current rules and notifications, the tax liability, the dates on which cash or credit was used, and the taxpayer’s electronic liability and cash-ledger history. The statutory rate or calculation treatment should therefore be checked for the exact period and circumstances. Do not rely on a generic online percentage without confirming that it applies to your case.

Can a small taxpayer owe both?

Yes, potentially. The two liabilities follow different compliance events. If a taxpayer submits a return after its due date and also leaves tax unpaid until a later date, the filing delay and payment delay must be determined independently under the current rules.

Example: late return, tax paid on time

A business pays the tax by the required date but submits the return several days later. The late-filing rules may produce a late fee. Because the tax was not paid late, the interest question may have a different answer. The taxpayer should still check the relevant return type and any concession for that period.

Example: return filed on time, tax paid late

A taxpayer files the return by the deadline but the payment is completed afterward. The filing may be timely, yet section 50 interest can still need to be calculated for the delayed tax payment.

Example: both events are late

A taxpayer files after the due date and pays the tax after the payment deadline. The applicable late fee and interest should each be identified, calculated under their respective rules, and reconciled with the Portal’s displayed figures. One amount does not cancel the other.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Example: no tax liability

If a return has no tax to pay, interest on delayed payment may not arise because there is no delayed tax amount. A late fee can still be relevant if the return was filed late. Whether a nil, zero, or otherwise non-taxable filing receives a particular concession depends on the return, period, and notification in force.

How to check interest in GSTR-3B

GSTN says the Portal auto-calculates GSTR-3B interest from the tax liability and the liability breakup entered in the return. Its March 2026 advisory describes the system-generated PDF as the place to inspect the detailed calculation and provides a recomputation option.

  1. Open the relevant GSTR-3B filing on the GST Portal for the tax period in question.
  2. Enter or review the tax liability breakup in the table labelled Tax Liability Breakup, As Applicable. Confirm that the figures reflect the transaction and payment records for that period.
  3. Use the Portal’s preview or system-generated GSTR-3B PDF to inspect the interest calculation and the underlying breakup.
  4. Compare the displayed tax, payment dates, and ledger entries with your books and challans. Check whether the Portal has treated the relevant amount as paid through the electronic cash ledger, electronic credit ledger, or another permitted route.
  5. If the displayed amount does not match the facts, select RE-COMPUTE INTEREST, where the option is available, and review the regenerated calculation before filing or paying.
  6. Save the PDF, recomputation result, payment reference, and a short reconciliation note with the return records.

GSTN’s advisory states: “As a facilitation measure for assisting the taxpayers in doing a correct self-assessment, GST Portal auto-calculates interest on delayed filing of GSTR-3B based on the tax liability discharged and tax liability breakup provided in ‘Tax Liability Breakup, As Applicable’ table.” Read the complete GSTN advisory on re-computation of interest under Table 5.1 of GSTR-3B.

The February 2026 calculation issue

GSTN reported in March 2026 that a technical glitch caused interest for the February 2026 period to be calculated incorrectly for some taxpayers when it appeared in March 2026 GSTR-3B. The advisory specifically referred to the minimum electronic cash-ledger balance benefit under Rule 88B(1). If your February 2026 interest display is inconsistent with your records, use the Portal’s recomputation option as directed in the advisory and retain the resulting evidence.

This was a dated, limited system issue. It is not evidence that every Portal calculation is unreliable. Treat the Portal result as a calculation to review against your records and the applicable law.

What determines the amount you actually owe?

Before trying to calculate either liability, assemble the facts below. Missing one date or using the wrong form can change the result.

  • Return or form: identify the exact filing, including whether it is a periodic return, annual return, or another specified statement.
  • Tax period and financial year: note the month, quarter, or year because notifications and concessions can be period-specific.
  • Statutory due date: use the due date applicable to your registration, state, filing category, and any extension.
  • Actual filing date: keep the acknowledgement or ARN showing when the return was submitted.
  • Tax payment dates: record when each relevant liability was discharged and through which ledger or payment instrument.
  • Tax liability: separate tax, interest, late fee, and any other amount shown by the filing system.
  • Applicable notifications: check for waivers, reduced caps, extensions, or other relief for that form and period.
  • Ledger history: retain electronic cash-ledger and credit-ledger balances, including any balance that may affect the legally prescribed calculation.
  • Taxpayer status: confirm whether the registration, return frequency, or scheme status changes the relevant filing obligation.

For a personalized amount, these facts should be checked against current law and the Portal calculation. A calculator that does not ask for the form, period, dates, tax amount, and payment history cannot reliably determine your liability.

Small taxpayers and the composition levy

Composition is optional and restricted

Composition levy is an optional simplified tax-payment regime described by CBIC for eligible small taxpayers. Being “small” in ordinary business language does not automatically make a business eligible. Eligibility can depend on the nature of supplies, registration and operational conditions, and the law applicable in the relevant financial year.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not reuse old threshold figures

CBIC’s sectoral FAQ displays composition thresholds and eligibility conditions, but those figures may have changed since the FAQ was published. Do not present an old threshold as current. Confirm the applicable financial year’s Act, rules, notifications, and Portal requirements before opting in or deciding that a business qualifies. The CBIC sectoral FAQ is useful background, not a substitute for checking current provisions.

Composition does not erase filing discipline

A composition taxpayer still has prescribed returns or statements and deadlines. If a filing is late, the relevant late-fee rule must be checked. If tax that was due is paid late, the interest question remains separate. Scheme status can change which form and deadline apply; it does not turn late fee and interest into one charge.

Common mistakes that increase the bill

Using “late payment penalty” for everything

This label hides the issue that must be solved. Start by classifying the event as late filing, late payment, or both. Then apply section 47 or section 50 as appropriate.

Applying one remembered late-fee cap

Late-fee provisions differ between specified filings and annual returns, and notifications can modify the amount for a particular period. Verify the exact return and period instead of copying a figure from an older article or a different form.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Using one universal interest rate

Section 50 is the statutory starting point, but the applicable subsection, rules, notifications, and facts matter. A percentage copied without its date and conditions can produce a wrong payment.

Ignoring the tax-liability breakup

GSTR-3B interest is generated from the liability information entered in the return. An incorrect breakup can create an incorrect displayed amount. Reconcile the entries before accepting the result.

Assuming the Portal display is self-explanatory

Download the system-generated PDF and examine the dates, liability, and ledger treatment. If the figure conflicts with your records, use RE-COMPUTE INTEREST and preserve the outcome.

Treating a composition FAQ as current law

Thresholds and conditions can change. Confirm current eligibility for the relevant year before making a scheme decision.

Paying an unexplained amount without records

Keep the return acknowledgement, challan, ledger extracts, Portal PDF, recomputation output, and your calculation worksheet together. These records make it possible to correct an entry or explain the payment later.

A practical workflow for a late GST return

  1. Identify the filing: write down the exact return or detail, tax period, registration, and applicable due date.
  2. Measure the filing delay: compare the statutory due date with the actual submission date shown on the acknowledgement.
  3. Check late-fee rules: read section 47 for the relevant filing and verify period-specific notifications, waivers, or caps.
  4. Separate payment timing: list when each tax amount became due and when it was discharged.
  5. Check interest: review section 50 and the applicable rules, then inspect the GSTR-3B PDF where relevant.
  6. Recompute discrepancies: use the Portal’s RE-COMPUTE INTEREST function if the displayed GSTR-3B interest does not match the underlying facts.
  7. Reconcile and retain evidence: match the final amount to the ledger and payment reference, and save the supporting documents.
  8. Escalate unusual cases: obtain qualified GST advice when there are amendments, disputed liability, multiple registrations, delayed credit, scheme changes, or a material difference between statutory and Portal calculations.

When professional review is worthwhile

Consider a qualified GST professional when the return covers several tax rates or registrations, tax was paid in instalments, an amendment changes an earlier liability, a notification or waiver may apply, or the Portal calculation remains inconsistent after recomputation. Provide the professional with the form, tax period, due date, filing date, payment dates, liability breakup, ledger extracts, and Portal PDFs. Those details allow the review to address the actual facts instead of relying on a generic late-fee or interest estimate.

For routine cases, the most reliable habit is to separate filing compliance from payment compliance, verify the exact period’s rules, and keep the Portal’s calculation evidence with the return records.
