GST Invoice Fraud in India: How to Tell Fake Invoices From Genuine Billing Errors (2026 Guide)

A wrong GST invoice field is a reason to investigate, not proof of fraud. The decisive question is whether the invoice represents a real supply of goods or services. A genuine purchase with a typing, timing or calculation mistake is different from a document created or used to claim input tax credit (ITC) when nothing was supplied.

That distinction matters because Section 16 of the Central Goods and Services Tax (CGST) Act makes actual receipt of goods or services one of the conditions for ITC, while the Act’s offence provisions address false invoices and ITC taken without actual receipt. Use the workflow below to reconcile an error, preserve evidence and escalate a transaction that cannot be supported.

Start with the three possible explanations

When an invoice does not match your books, the GST portal or a delivery record, classify the situation provisionally. Do not label it fraud until the underlying facts and intent have been examined.

1. Real supply, administrative or arithmetic error

The goods were delivered or the service was performed, the parties are genuine and the commercial purpose is clear, but a field is wrong. Examples include a transposed invoice number, an incorrect GSTIN digit, a duplicate upload, a tax calculation mistake, a date entered in the wrong period or a description that does not match the purchase order. These problems require correction and reconciliation; they do not, by themselves, show that anyone fabricated a transaction.

2. Inaccurate or invalid document with the cause still unknown

An invoice may fail a portal validation or conflict with a return while the business has not yet established why. The supplier may have reported a different number, used an incorrect classification or missed a filing window. Treat this as an unresolved exception. Gather source records before deciding whether it is an error or something more serious.

3. Fabricated or knowingly misused invoice

This is the high-risk case: the purported supplier, goods or services cannot be substantiated, or an otherwise genuine document is used to claim ITC without the required supply. Repeated contradictions, missing delivery or performance evidence and unexplained payment flows increase concern, but a red flag is not a legal finding. The statutory elements and the facts of the particular transaction control.

Why the distinction affects GST and ITC

Section 16 requires more than a piece of paper

Section 16 of the CGST Act sets conditions for taking ITC, including possession of a qualifying tax invoice or other prescribed document, receipt of the goods or services, supplier reporting and tax-payment conditions, and filing the relevant return. The current text and amendments are displayed by the Central Board of Indirect Taxes and Customs (CBIC) at CGST Act, Section 16. The Act’s wording includes the short requirement: “he has received the goods or services or both.”

Accordingly, an invoice that looks complete cannot establish ITC eligibility if the underlying supply never happened. Conversely, a real supply is not automatically disqualified because a clerical field needs correction; the records must be reconciled and the statutory conditions still satisfied.

Section 31 governs when and how invoices are issued

Section 31 addresses the time for issuing tax invoices and the particulars to be shown as prescribed. Consult the current CBIC text at CGST Act, Section 31. A mismatch in the invoice number, date, taxable value, tax amount, party details or other particulars should therefore be checked against the transaction records and applicable rules rather than treated as conclusive evidence of a fictitious supply.

False-invoice conduct is dealt with separately

The CGST Act contains offence provisions covering specified false-invoice conduct and taking or using ITC without actual receipt. The current CBIC offence provisions are available at CGST Act offence provisions. This article does not assign a penalty, demand or criminal outcome to a particular taxpayer; those consequences depend on the facts, the current law and qualified Indian GST advice.

What an e-invoice, IRN and QR code do—and do not do

GSTN defines e-invoicing as reporting specified GST document details to an Invoice Registration Portal (IRP) and obtaining an Invoice Reference Number (IRN). Its glossary, dated 17 August 2023, is at GSTN’s e-invoicing glossary. An IRP can validate reported data, generate an IRN and support cancellation or related functions for documents within the applicable e-invoicing framework.

An IRN or a scannable QR code is evidence that specified data was reported through the applicable system. It is not independent proof that a truck arrived, that inventory was received or that a service was actually performed. Actual receipt remains a separate ITC condition under Section 16.

Portal outcomes also need context. GSTN and IRIS IRP guidance says invoice and credit/debit-note numbers must be unique within a financial year; duplicate records can be rejected. A rejection or mismatch can therefore be a filing or data problem rather than proof of a sham transaction. Review the applicable help document at GSTN/IRIS IRP Help Document for the landing page.

Validation rules can change. IRIS IRP lists a production release dated 1 February 2026 that relaxed certain total-item-value validations for a defined class of RSP-based invoices dated on or after that date. Check the current portal message, the document date and the invoice category before inferring intent from a validation result; the release information is at IRIS IRP for E-Invoicing.

Step-by-step verification workflow

Run these checks in sequence. Keep an audit trail showing what you checked, when, the result and who supplied an explanation.

  1. Lock down the original document. Save the PDF or paper image, the structured data file if one exists, email headers and the date received. Do not overwrite the original when a corrected invoice arrives. Record the invoice number, date, supplier GSTIN, recipient GSTIN, taxable value, tax amounts and total.
  2. Confirm both parties. Compare the supplier’s legal name, GSTIN, address and authorised contact with the counterparty in your vendor master, contract and official GST records. Check the recipient details in the same way. An unexplained change in bank account or an email domain that does not match the established supplier is a reason for independent confirmation, not a conclusion of fraud.
  3. Check mandatory commercial and tax particulars. Compare description, quantity or service scope, unit price, taxable value, CGST/SGST/IGST amounts, place-of-supply information where relevant, reverse-charge indication and other prescribed fields with the applicable invoice requirements. The IRP’s IRN guidance describes invoice fields and validation; see IRIS IRP’s IRN page and release notes. Use the Act and Rules as the primary legal references.
  4. Trace the purchase order or contract. Match the invoice to the purchase order, statement of work, rate card, milestone schedule or other agreement. For a service, identify what was promised, the period covered and the person who accepted completion. For goods, match item codes, quantities and prices.
  5. Prove receipt or performance independently. For goods, look for a delivery challan, goods-receipt note, warehouse entry, transport document, e-way-bill record where applicable and inspection record. For services, retain acceptance emails, work products, timesheets, project sign-off or other evidence showing that the contracted work was delivered. This is an operational evidence checklist derived from the actual-receipt condition; it is not an exhaustive statutory list.
  6. Follow the payment trail. Match the invoice to the purchase ledger, bank statement, payment approval and any withholding or adjustment. Confirm that the beneficiary is the supplier or an authorised payee and that the amount and timing fit the contract. A payment alone does not prove supply, but an unexplained circular payment or a complete absence of payment needs an explanation.
  7. Reconcile GST reporting. Compare the supplier’s reported document details with your purchase register and GST records. Investigate period differences, omitted documents, amended invoices, tax-rate or classification differences and duplicate invoice numbers. GSTN’s guidance on HSN and GSTR-1 filing is available at GSTN’s HSN and GSTR-1 advisory.
  8. For covered documents, verify the IRN and QR. Use the applicable official IRP to check that the IRN belongs to the same supplier, recipient, document number, date and values shown on the invoice. Confirm that the document was not cancelled and that the portal used is applicable to the transaction. IRIS IRP states that its service is GSTN-authorized; coverage and portal functions can change, so rely on current official guidance.
  9. Ask for a written correction or explanation. If the supply is supported but a field is wrong, ask the supplier to explain the cause and issue the permitted correction, amendment, credit note or replacement document. Preserve the original, the corrected document, the correspondence and the accounting entry. Never silently edit a source invoice.
  10. Assess the complete pattern. Decide whether the mismatch is isolated and traceable or part of repeated contradictions across invoices, transport, payment, inventory and GST reporting. Escalate when evidence is missing or materially inconsistent, rather than because one field failed validation.

How the two explanations compare

Investigation axis More consistent with a genuine billing or reporting error More concerning for a false or misused invoice
Supply evidence Delivery or service records independently match the order and invoice. No credible proof of receipt or performance exists despite the claimed supply.
Supplier identity GSTIN, legal name, address and authority reconcile to the known counterparty. Identity, address or authority cannot be reconciled with the purported supplier.
Record consistency An isolated mismatch has a documented correction, amendment or duplicate-upload explanation. Material contradictions recur across invoice, transport, inventory, payment and GST records.
Commercial trail Payment, business purpose and pricing fit the contract and ordinary operations. ITC is claimed without supply evidence, or payment patterns are unexplained or circular.
Portal status Rejection or mismatch has a plausible data, timing or duplicate-number cause that can be reconciled. Portal data conflicts with the claimed transaction and no credible explanation is supplied.

These are investigative prompts, not legal presumptions. Intent, knowledge and the statutory elements must be evaluated on the full record.

Common mismatch scenarios and the right response

Duplicate invoice number

A duplicate number within the same financial year may be rejected by the filing system. First check whether the supplier accidentally uploaded the same document twice, used the number for two different customers or corrected a prior upload. Compare dates, recipients, amounts and IRNs, then obtain a written correction. Do not infer a fictitious supply from the duplicate flag alone.

GSTIN or legal-name typo

A single transposed character can send a document to the wrong registration or prevent matching. Verify the counterparty independently, ask the supplier to follow the permitted correction process and ensure the purchase and tax records reflect the same legal entity. If the GSTIN belongs to an unrelated entity or cannot be validated, pause ITC treatment until qualified advice is obtained.

Tax amount or rate does not calculate

Recompute taxable value multiplied by the applicable rate, taking rounding and line-level calculations into account. Check whether the transaction is intra-state or inter-state, whether a credit note or advance is involved and whether a rate changed between supply and invoice dates. Preserve the calculation and the supplier’s explanation; a mathematical error is not the same as a supply that never occurred.

Invoice appears in a different return period

Document date, reporting date and the period in which the recipient records ITC can differ under the applicable rules. Reconcile the invoice, supplier filing and your return rather than treating a timing difference as fabrication. If the supplier has not reported the document or tax-payment conditions are otherwise unmet, obtain current GST advice before claiming or retaining ITC.

IRN exists but no delivery can be found

Treat the IRN as a data-reporting result, then test the physical or service evidence separately. Search warehouse, transport, acceptance and payment records; contact the operational owner who ordered the goods or service. If no credible supply evidence exists, preserve the records and escalate the potential ITC issue.

What to do when the transaction is genuine

  • Keep the original invoice and every corrected version, with a clear reason for the change.
  • Record the reconciliation in your accounting or controls system, including the person who approved it.
  • Ask the supplier to correct or amend GST reporting through the permitted process; do not create a substitute document yourself.
  • Update purchase, inventory, payable and tax records consistently after the correction.
  • Recheck the next return or matching report to confirm that the correction resolved the exception.

GST-enabled invoicing or accounting software can help enforce numbering, calculate tax and reconcile reported data, but it is a recordkeeping aid, not a fraud detector. Controls still depend on contracts, receipt evidence, approvals and human review.

What to do when the evidence points to a false or misused invoice

  1. Preserve evidence. Retain invoices, IRNs, emails, contracts, delivery and service records, ledger entries, bank statements, return data and system logs in their original form. Limit edits and document every later action.
  2. Stop unsupported ITC processing. Do not claim or continue to rely on credit when the actual supply cannot be established. If credit has already been taken, obtain prompt advice on the applicable correction and disclosure steps.
  3. Separate facts from assumptions. Write a chronology of what was ordered, received, paid, reported and questioned. Identify missing records without asserting criminal intent.
  4. Use qualified Indian GST advice. Demand, penalty and criminal exposure can depend on the taxpayer’s role, knowledge, documents and current provisions. This article does not provide a recipient-specific conclusion, and a complete current complaint route for every fact pattern should not be assumed.
  5. Protect the control environment. Restrict vendor-master changes, independently verify bank-account changes and require receipt or service approval before ITC enters the return workflow.

Controls that reduce both errors and fraud risk

At onboarding

  • Verify the supplier’s legal name, GSTIN, address, authorised contacts and bank details through independent channels.
  • Define required invoice fields, purchase-order references and service-acceptance evidence in the contract.
  • Assign one owner for GST reconciliation and another for payment approval where practical.

At receipt and booking

  • Match purchase order, receipt or service acceptance and invoice before posting.
  • Use sequential numbering controls and flag duplicate document numbers within each financial year.
  • Record quantity, condition, location or service milestone so an audit can reconstruct what happened.

Before the return

  • Review unmatched invoices, amended documents, credit notes, period differences and unusual tax rates.
  • For e-invoice-covered documents, check IRN and QR details against the accounting record and the applicable IRP.
  • Escalate unresolved exceptions with a written owner and deadline; do not clear them merely because a document has an IRN.

Limits of portal checks and legal conclusions

GSTN and IRP systems improve structured reporting and reconciliation, but they do not observe the movement of goods or the performance of a service. A portal acceptance, IRN or QR therefore answers a data-validation question, not the complete factual question required for ITC.

Likewise, a mismatch, rejection or duplicate warning does not establish intent. Conversely, a polished invoice and a valid IRN do not cure a transaction for which there is no actual receipt. Where the records materially conflict, preserve them and obtain current professional advice under Indian GST law before deciding how to amend returns, reverse credit or respond to authorities.
