A GST fraud demand is not correct merely because it appears in a portal summary. To check it, identify the tax period and legal provision, rebuild the principal tax from your records, recalculate interest from the legally relevant dates, and test whether the notice actually explains fraud, wilful misstatement or suppression to evade tax. If an amount is wrong, answer the show-cause notice point by point, request a hearing in writing, preserve proof of service and filing, and prepare for an appeal immediately if an order is passed.
The exact penalty and payment route depend on the law in force for the relevant period. Older CBIC materials describe sections 73 and 74, while the retrieved sources do not establish the operative text, commencement or transition rules for section 74A. Check the current official law and obtain qualified Indian GST advice for a live dispute.

What a GST fraud demand contains
A demand normally has three separate components: principal tax, interest and penalty. They can arise from alleged non-payment or short payment of tax, an erroneous refund, or input tax credit (ITC) that was wrongly availed or utilised. The notice may also include more than one tax head or tax period. Do not treat the total as one indivisible number: an error in one invoice, month or tax head can change the entire calculation.
Identify the document before calculating anything
- Pre-notice communication: a request for clarification or a proposed discrepancy. It is not the same as a formal show-cause notice.
- Show-cause notice: the document that sets out the proposed tax, interest, penalty, facts and legal grounds and invites a representation.
- Adjudication order: the officer’s decision after considering the response and, where applicable, a hearing. It creates the immediate appeal question.
- Electronic summary: the GST portal may show a DRC-01 summary accompanying a notice or a DRC-02 summary accompanying a statement. The summary is not a substitute for the full notice and annexures. The CBIC Rules compilation describes these forms at the CBIC CGST Rules compilation.
Record the notice or order number, issuing officer, jurisdiction, date, date of service, tax periods, tax heads, sections cited and the response or appeal deadline. Keep the portal service record and the downloaded PDF, not just a screenshot of the summary.

Which GST provision is being used?
The legal classification controls the penalty and the opportunities to pay at a reduced stage. The older CBIC-hosted Act text distinguishes:
- Section 73: tax not paid, short paid, an erroneous refund, or wrongly availed or utilised ITC for reasons other than fraud, wilful misstatement or suppression of facts to evade tax.
- Section 74: the same categories where fraud, wilful misstatement or suppression to evade tax is alleged.
This distinction is not cosmetic. A tax disagreement or accounting mistake does not automatically establish the fraud elements. The notice should connect the alleged conduct to the statutory basis and identify the evidence relied on. The version of the Act available at CBIC’s CGST Act text is an older rendering for this purpose; do not assume its section numbers, rates or transition rules apply to every financial year.
Check for section 74A and transition rules
The retrieved materials do not establish the currently operative section 74A text, its commencement date or how it transitions from sections 73 and 74. Before accepting a section number or penalty schedule, check the current official statute, notifications and rules for the tax period in the notice. A notice can be vulnerable if it applies a provision that was not in force for the relevant period or overlooks a prescribed transition rule.
Historical penalty figures: use them only after confirming the governing law
The following figures appear in older CBIC materials. They are useful for spotting what the officer may be relying on, but they are not a universal current tariff. Confirm the operative provision, tax period, timing trigger and payment conditions first.
| Route described in older CBIC material | Penalty or payment amount described | Important qualification |
|---|---|---|
| Section 73, adjudication | 10% of tax or ₹10,000, whichever is higher | The retrieved text also described no penalty where tax and interest were paid within 30 days of the show-cause notice. Verify the current section and conditions. |
| Section 74, before notice | Tax plus interest plus 15% of tax | Described in the older CBIC FAQ as a pre-notice route, subject to statutory conditions. |
| Section 74, within 30 days of notice | Tax plus interest plus 25% of tax | The 30-day trigger and conclusion effect must be checked against the law for the relevant period. |
| Section 74, within 30 days of order communication | Tax plus interest plus 50% of tax | Do not treat this as an automatic election in a current case. |
| Section 74, adjudication in the older text | Penalty equivalent to the tax | The older Act and FAQ describe reduced-penalty conclusion routes at earlier stages. |
The older FAQ is available at CBIC’s GST FAQ. It states that proceedings are deemed concluded in the circumstances it describes. That consequence depends on satisfying the statutory payment and timing requirements; a voluntary payment form alone does not prove that every issue is closed.

How interest is calculated
Interest must be recomputed independently. Section 50 in the retrieved Act text provides for interest when tax remains unpaid beyond its due date and caps the notified rate by statute, but the retrieved material does not establish one current rate for every tax period or fact pattern. Check the applicable notification and rules rather than copying a percentage from a summary.
Build an interest schedule for each component
- Identify the tax head and liability: separate IGST, CGST, SGST or cess and identify whether the amount is output tax, an erroneous refund or ITC alleged to have been wrongly availed or utilised.
- Determine the legal start date: use the due date or other statutory start date applicable to that liability, not automatically the date printed in the notice.
- Break the outstanding amount into periods: record changes caused by partial payments, credits, reversals, refunds or adjustments. Interest on a declining balance should not be calculated as if the full amount remained unpaid throughout.
- Apply the rate in force for each period: retain the notification or rule supporting the rate and explain any change during the calculation period.
- Set the end date: use the legally relevant payment or credit date and reconcile it with challans and electronic ledgers.
- Ask for the officer’s worksheet: where the notice gives only a lump sum, request the dates, amounts, rates and formula used.
A transparent working paper should show, for every line item, the principal, start date, end date, days, applicable rate, payments or credits and resulting interest. If the officer’s total cannot be reproduced from the notice, say so specifically rather than disputing the number in general terms.
Step-by-step check of a DRC-01 or other demand
1. Create a notice control sheet
Make a one-page index containing the notice number, date and service date, officer and jurisdiction, periods, sections, tax heads, amounts, annexures, portal reference and deadline. Mark whether the document is a pre-notice communication, formal show-cause notice or order. This prevents a response to a draft communication from being mistaken for a reply to the statutory notice.
2. Read the full notice and annexures
Use the DRC-01 summary as an index only. Read every allegation, table, invoice list, third-party comparison and calculation annexure. Check whether the summary omits a period, tax head, credit note or factual qualification that appears in the full notice.
3. Rebuild the principal tax issue by issue
For each proposed addition, tie the amount to the underlying transaction or record: return period, invoice number, taxable value, rate, tax head, credit entry, refund or ITC ledger. Reconcile it to filed returns, sales and purchase registers, e-invoices where relevant, bank or payment records, electronic credit and cash ledgers, and prior correspondence.

- Mark amounts already paid with the challan number and date.
- Mark ITC already reversed or reclaimed and show the return in which the adjustment occurred.
- Remove duplicate invoices, repeated periods and amounts counted under two allegations.
- Separate a valuation or classification disagreement from an allegation that a transaction was fictitious.
- Reconcile credits, debit notes, amendments and refunds to the period used by the officer.
4. Test the fraud allegation
List each fact said to establish fraud, wilful misstatement or suppression to evade tax. Then answer each fact with the contemporaneous record: what was disclosed in returns, what was communicated to the department, how invoices were recorded, whether the issue was a classification or interpretation question, and whether the notice relies on a third party without giving a usable opportunity to address it. State where the evidence is missing or inconsistent. Do not claim that fraud is impossible; show why the pleaded facts do not satisfy the cited provision on this record.
5. Check procedural consistency
Compare the notice, your reply, the hearing record and any proposed order. The older section 75 text hosted by CBIC states: “The amount of tax, interest and penalty demanded in the order shall not be in excess of the amount specified in the notice and no demand shall be confirmed on the grounds other than the grounds specified in the notice.” That wording is from an older rendering, so verify the current text before relying on it, but use the comparison to identify a new ground, a higher amount or an ignored submission.
6. Preserve a dated case file
Save the original notice, portal service record, downloaded annexures, reply, upload acknowledgement, email or hearing communications, returns, invoices, ledgers, challans, reconciliations and calculations. Use stable file names and an index that links every factual assertion in the reply to an attachment.
How to challenge an incorrect show-cause notice
Use a point-by-point reply
Organise the response so the officer can match every allegation to an answer:
- State the notice number, periods and provisions, and identify the amount admitted and disputed.
- Quote or precisely identify each allegation and proposed amount.
- Give the factual correction and a short reconciliation to the relevant return, invoice, ledger or challan.
- Explain why the cited provision applies or does not apply, including the separate issue of fraud, wilful misstatement or suppression.
- Provide an indexed evidence schedule. Put the period, document description and page reference beside each attachment.
- Show your independent tax and interest calculation and identify any amount already paid.
- Request a personal hearing in writing if facts, evidence or legal submissions need to be explained.
- Ask for the demand to be dropped, corrected or confined to the amount and grounds legally supportable, and request a reasoned order.
The retrieved Act provisions provide for consideration of a representation and an opportunity of hearing in the stated circumstances. A hearing request should be explicit and retained with the filing acknowledgement; do not assume that uploading a spreadsheet silently requests one.

What to do if the portal will not accept the reply
Capture the error, date and time, keep the attempted file and contact details for the relevant jurisdiction. Submit through the prescribed electronic route when available and preserve any permitted alternative submission or acknowledgement. A technical difficulty does not remove the need to protect the deadline.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. If an order has already been issued
Compare the order with four documents
Read the order alongside the notice, your reply and the evidence index. Check whether it:
- confirms a higher tax, interest or penalty than proposed;
- introduces a factual or legal ground absent from the notice;
- ignores a payment, reversal, reconciliation or hearing request;
- uses a different tax period, tax head, rate or interest start date; or
- fails to explain the findings and calculation.
These comparisons identify both amount errors and procedural grounds for appeal. The CBIC material does not make every defect automatically fatal, so frame the effect of each defect on the liability and your opportunity to respond.
First appeal and deadlines
The older Act rendering describes an ordinary first-appeal period of three months after communication of the decision or order. The CBIC Appeal Rules identify Form GST APL-01 for an appeal to the Appellate Authority and APL-04 as the appellate order summary; see the CBIC Appeal Rules page. Current condonation rules, electronic filing instructions, pre-deposit requirements and amendments can be decisive. Verify them immediately for the tax period and order, and obtain qualified advice if the deadline is near.

Payments and DRC forms
The Rules materials describe DRC-03 as a payment intimation, DRC-04 as an acknowledgement in specified payment routes and DRC-05 as a conclusion form where the stated statutory conditions are met. These forms record a route or acknowledgement; they do not, by themselves, prove that every liability, penalty or appeal issue has been resolved. Match the payment to the provision, tax period, tax head and statutory consequence before relying on it.

Should you pay, reply or appeal?
| Your position | Questions to answer | Practical next step |
|---|---|---|
| Liability substantially admitted | Is a valid payment-at-stage route available, and what are its exact timing and conclusion conditions? | Confirm the current provision and calculation, pay through the prescribed route if appropriate, and retain proof. |
| Tax base or ITC disputed | Can each disputed line be disproved with returns, invoices, ledgers or payment records? | File a quantified reconciliation and request a hearing; do not concede an unsupported total. |
| Interest disputed | Are the start date, rate, outstanding balance and payment credits traceable? | Attach an independent schedule and request the officer’s worksheet. |
| Fraud characterization disputed | Does the notice explain the factual elements and evidence, or simply label the case “fraud”? | Answer the elements separately and address disclosure, conduct and documentary evidence. |
| Order already issued | What is the current appeal deadline, pre-deposit and filing route? | Calendar the deadline immediately, obtain the current rules and prepare APL-01 or the applicable form. |
| Cash-flow pressure | Will payment affect an appeal, and what statutory amount must be deposited? | Get advice on payment, pre-deposit and stay consequences before transferring funds. |
No single option is correct without the notice and taxpayer records. Compare the admitted or disputed liability, the nature of the error, documentary strength, available statutory window, cash-flow effect, pre-deposit and cost of representation.
When a section 74 fraud finding can change
CBIC Circular 185/17/2022-GST addresses cases in which an appellate authority, tribunal or court finds that fraud, wilful misstatement or suppression has not been established and the demand must be determined under section 73. The circular illustrates why the fraud characterization matters: it can change the applicable route and penalty consequences. Read Circular 185/17/2022-GST, then apply its reasoning only after checking the governing law and facts of the case. A taxpayer should challenge the characterization with evidence rather than assume that every section 74 notice will automatically convert.
Section 128A and other relief references
The current CBIC landing page includes a procedure concerning appeals for interest and/or penalty connected with section 128A. The page alone does not establish that a particular fraud demand qualifies for waiver or relief. Check the precise statutory scope, tax period, payment status, forms and deadlines before mentioning section 128A in a reply or deciding not to appeal. The relevant landing page is CBIC’s GST website.

Common mistakes that make a challenge weaker
- Replying to the DRC-01 summary without reading the notice and annexures.
- Arguing that the total is “wrong” without a line-by-line alternative calculation.
- Using the current interest rate or penalty schedule without checking the tax period and notification.
- Conflating a tax, valuation or ITC disagreement with proof that fraud was committed.
- Submitting documents without an index, period labels or a link to the allegation they answer.
- Failing to request a hearing in writing.
- Paying through DRC-03 without confirming whether the payment satisfies the relevant statutory route.
- Waiting for a corrected portal summary instead of calendaring the appeal deadline when an order is communicated.
- Assuming that a payment acknowledgement closes an appeal, penalty or interest issue automatically.
A practical calculation worksheet
Create one row for each allegation and period with these columns: tax period; tax head; allegation reference; invoice or ledger reference; principal proposed; principal accepted; principal disputed; payment or reversal date; interest start date; interest end date; rate source; interest proposed; interest recalculated; penalty provision; penalty proposed; evidence page; and response paragraph. Total the accepted, disputed and unsupported amounts separately. This format lets the officer—and an appellate authority—see exactly what remains in issue.
Where the notice combines several periods or tax heads, produce subtotals before a grand total. If a payment was credited to a different head or period, show the electronic ledger entry and explain the legal basis for applying it. If the notice uses a different date from your records, identify the date conflict and attach the service, payment or return evidence.
Bottom line
Check a GST fraud demand as a controlled reconciliation, not as a portal-total exercise: classify the document, verify the law for the tax period, rebuild tax, independently compute interest, test every fraud element, and compare the order with the notice and your evidence. A quantified written reply and hearing request protect the record before adjudication; once an order is served, verify the current appeal route and deadline immediately. Because the retrieved CBIC sections and penalty figures include older material and do not settle section 74A’s operation, current official law and case-specific professional advice are essential before choosing payment or appeal.
