GST Detention Order Appeal vs Writ Petition: Which Remedy to Consider

For a reasoned GST detention demand order under Section 129, the ordinary remedy is a statutory appeal under Section 107—not an original writ petition. Section 107 ordinarily gives three months from communication of the order to appeal, with a possible further one-month condonation period for sufficient cause. A writ petition under Article 226 is generally considered only when the statutory route is not an effective or timely answer to the particular defect, and the exact position depends on the facts, the applicable Central and State or Union Territory GST laws, amendments and binding local precedent.

The Supreme Court’s decision dated 24 July 2025 in M/s ASP Traders v State of Uttar Pradesh & Others is important for taxpayers who paid to obtain release of detained goods. Payment alone did not waive the challenge where the taxpayer had objected and the officer had not passed the reasoned order required by Section 129(3). The court required a formal order so that the taxpayer could use the Section 107 appeal.

The short answer: appeal the order; reserve a writ for a genuine procedural or urgent problem

Start by identifying exactly what you are challenging. If the proper officer has issued and communicated a reasoned order determining tax and penalty under Section 129 of the Central Goods and Services Tax Act, 2017 (CGST Act), file the prescribed appeal to the Appellate Authority under Section 107, subject to the current limitation rules and the corresponding State or Union Territory GST enactment. The appeal is the legislature’s ordinary review mechanism for the adjudicated demand.

An Article 226 writ petition is not a parallel, routine alternative. High Courts commonly decline to exercise writ jurisdiction when an effective statutory remedy exists. A writ may still require consideration where the complaint concerns an absent or fundamentally defective order, a jurisdictional or constitutional issue, a serious denial of natural justice, or an urgent act for which the statutory process cannot provide meaningful relief. Whether an exception applies is fact-specific; payment of a disputed amount, inconvenience, or a disagreement with the officer’s factual findings does not automatically make a writ appropriate.

Do not confuse an original writ petition with a statutory appeal to the High Court under Section 117. The latter is a later appellate proceeding governed by its own conditions and form; it is not a substitute name for Article 226 proceedings.

What a Section 129 detention case is supposed to produce

Detention, notice and adjudication

Section 129 addresses detention, seizure and release of goods or the conveyance carrying them while in transit. Under Section 129(3), the proper officer must issue a notice specifying the tax and penalty proposed and then pass an order. The taxpayer’s response and hearing opportunity are part of the adjudication record. Rule 142 and the movement-document forms (commonly called MOV forms) operate alongside the Act.

The release of the vehicle or goods and the final adjudication are related but distinct events. A payment or security arrangement may secure provisional release, yet the department still has to complete the statutory adjudication where the demand is disputed. The reasoned final order is what ordinarily makes the Section 107 appeal workable.

MOV-09 and DRC-07 are not the appeal form

In the Supreme Court’s discussion in ASP Traders, Form GST MOV-09 represented the reasoned final Section 129 order. The order summary was to be uploaded in Form GST DRC-07. These forms should not be conflated with Form GST APL-01, which the CBIC appeal rules identify for an appeal to the Appellate Authority under Section 107. Preserve each document and its date; the movement, release and summary records can affect both the merits and the limitation analysis.

How to use the Section 107 appeal route

1. Locate the appealable order and its communication date

Obtain the complete order, not merely a payment receipt, detention memo or portal summary. Record when the order was legally communicated to the taxpayer. The three-month period is ordinarily measured from communication of the order, and a limitation calculation can change if the document, communication method, amendment or applicable enactment differs. Treat the portal date, email date, physical service date and the date on which an authorised person actually received the order as evidence to be checked, not assumptions to be blended together.

2. Confirm the correct appellate authority

Section 107 provides an appeal to the Appellate Authority against a decision or order of an adjudicating authority. Identify the officer’s designation, the jurisdiction, the relevant State or Union Territory GST legislation and the currently notified appellate office or portal workflow. A detention involving the CGST Act generally also engages the matching State or Union Territory GST law, so the applicable provisions should be verified for the place and transaction.

3. Prepare Form GST APL-01 and the record

The CBIC rules identify Form GST APL-01 for an appeal to the Appellate Authority. The rules describe filing the certified copy of the order and supporting documents, followed by an acknowledgement process. Check the live rules and portal instructions when filing because form fields, upload limits, electronic signatures and acknowledgement steps can change.

A complete record commonly includes:

  • the detention notice and relied-on documents;
  • the taxpayer’s written reply, objections and request for hearing;
  • the MOV forms, inspection reports and e-way bill or invoice material relevant to the dispute;
  • the final order, its communication evidence and the DRC-07 summary;
  • payment challans, guarantees or other security and the release document;
  • correspondence showing any protest, reservation of rights or request for a reasoned order; and
  • documents proving the factual ground of challenge, such as vehicle, consignment, registration or transport records.

4. State each ground and the relief sought

Separate jurisdictional objections, breach of hearing rights, errors in applying Section 129, factual explanations for the alleged movement or documentation defect, computation errors and challenges to penalty. Explain why each ground is supported by a document or entry in the adjudication record. Ask for the demand to be set aside or modified and for consequential relief permitted by the statute and rules.

5. File within three months, or explain the delay

The ordinary statutory period is three months from communication of the order. The Appellate Authority may allow a further period of up to one month when sufficient cause for the delay is shown. The extra month is a limited condonation window, not an automatic extension. Attach a precise chronology and evidence of the cause; do not assume that a payment date, release date or later portal upload restarts limitation.

6. Track acknowledgement and hearing communications

Keep the acknowledgement number, filed PDF or electronic package, upload receipt and every subsequent notice. A defective upload or missing certified order can create an avoidable objection. Respond to hearing notices and preserve proof of attendance, written submissions and any request for additional time.

What ASP Traders says about payment made for release

Payment did not automatically extinguish the dispute

In M/s ASP Traders v State of Uttar Pradesh & Others, Civil Appeal No. 9764 of 2025, decided on 24 July 2025, the taxpayer disputed the detention demand, filed objections and paid in order to obtain release in the context of business exigency. The department treated the payment and release documentation as ending the matter without issuing a reasoned final order.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Supreme Court rejected the proposition that payment alone waived the challenge in those circumstances. Its judgment states: “The payment, by itself, cannot be treated as a waiver or abandonment, especially when the appellant has clearly objected to the demand and when there is a statutory mandate to pass an order and a corresponding right to appeal.” The court also stated: “The right to appeal under Section 107 of the CGST Act, 2017, is predicated upon the existence of a formal adjudication.”

The court directed the proper officer to provide an opportunity of hearing, pass a reasoned final order in Form GST MOV-09 and upload the summary. The decision supports a narrow but practical proposition: when a taxpayer has objected and paid to free detained goods, payment by itself does not necessarily end the statutory challenge. It does not establish that every payment preserves an appeal, or that every detention case must follow the same outcome. The actual notice, objections, payment record, release paperwork and later order remain decisive.

What to do if no reasoned final order was issued

First request the proper officer to complete the Section 129(3) adjudication and issue the reasoned order, referring to the objections already filed and attaching proof of payment and release. Ask that the order and summary be uploaded through the prescribed system. Do not treat a receipt, a release authorisation or a bare DRC entry as interchangeable with a reasoned order.

If the department refuses to issue the order or an imminent consequence cannot be addressed through the statutory process, legal advice may be needed on whether a narrowly framed Article 226 petition is justified. The petition should identify the statutory duty left undone and the practical relief sought, rather than asking the High Court to re-try the entire demand as a first resort.

When a writ petition may be considered

The ordinary alternative-remedy rule

In Podaran Foods India Pvt Ltd v State of Kerala, decided by the Kerala High Court on 12 January 2021, the court observed that detention cases ordinarily should use the statutory arrangements for provisional clearance and then appeal. After examining the adjudication orders, it relegated the petitioner to the statutory appellate authority and left the factual and legal contentions open for that appeal. The court described the principle this way: “the writ court is not to ordinarily be approached in detention cases where effective alternate remedies by way of provisional clearance, and appeal thereafter, are provided”.

This is a strong practical warning against filing a writ merely because the taxpayer believes the officer reached the wrong conclusion. The High Court may require the taxpayer to use Section 107, particularly where the order is reasoned, the goods have been released or can be released through the statutory mechanism, and the appeal can grant effective relief.

Questions that can make writ analysis different

A writ analysis can be materially different when one or more of these features is present:

  • there is no formal, reasoned order despite a statutory requirement to issue one;
  • the challenged act is jurisdictionally unauthorized rather than a normal error within the officer’s authority;
  • the procedure denied a meaningful notice or hearing and the defect cannot realistically be cured in the ordinary appeal;
  • an immediate, exceptional consequence requires supervisory relief before the statutory appeal can operate; or
  • a constitutional challenge or a controlling jurisdictional issue is directly presented.

These are analytical factors, not automatic exceptions. The material available on the cited cases does not establish an exhaustive test for every recognized exception. A court will consider the challenged act, procedural posture, urgency, available statutory relief and controlling precedent in that jurisdiction. A taxpayer should therefore explain why the appeal is ineffective for the specific relief sought, not simply assert that a writ is available under Article 226.

Appeal versus writ: a practical comparison

Question Section 107 statutory appeal Article 226 writ petition
What is normally challenged? A communicated, reasoned adjudication order determining the Section 129 demand. A specific public-law defect, such as failure to issue a required order, jurisdictional action, serious procedural denial or urgent act needing supervisory relief.
Ordinary status in detention cases Primary route where an appealable order and effective appellate remedy exist. Exceptional or fact-dependent route; the High Court may decline it because Section 107 and statutory release arrangements are available.
Time reference Ordinarily three months from communication, with up to one further month of condonation for sufficient cause. No single Section 107 limitation period governs; prompt filing and the relevant High Court’s practice matter.
Record required Order, communication proof, notice, reply, hearing material, MOV and DRC records, payment and release documents, and grounds of appeal. The impugned act or omission, proof of the procedural defect or urgency, the statutory framework, and an explanation of why the alternative remedy is inadequate for the relief requested.
High Court proceeding Section 107 is before the Appellate Authority. A later statutory appeal to the High Court under Section 117 is a separate proceeding with its own requirements. Original supervisory jurisdiction under Article 226; it is not a renamed Section 117 appeal.

A decision framework for common fact patterns

A reasoned MOV-09 order has been communicated

Prepare APL-01 and file the Section 107 appeal within the ordinary period. Build the grounds from the notice, reply and order. A writ that merely repeats the merits is vulnerable to an alternative-remedy objection.

Goods were released after payment and objections were filed, but no final order followed

Preserve the objections and payment evidence, request the Section 129(3) order and hearing, and assess whether a narrowly targeted writ is needed to compel performance of that statutory duty. ASP Traders indicates that payment alone does not remove the right to insist on formal adjudication in comparable circumstances.

Only a detention notice or provisional release demand exists

Determine whether the notice is still at the proposal stage and respond within the stated time. An appeal under Section 107 ordinarily lies against the decision or order of the adjudicating authority, so filing before an appealable order exists can create a maintainability problem. Urgent release should be analysed under the statutory provisional-release mechanism before seeking extraordinary relief.

The order was never effectively communicated

Collect portal logs, emails, service reports and internal receipt records. Communication affects both the ability to appeal and the limitation calculation. Ask the authority for a copy and clarification while avoiding an assumption that an unverified date starts or ends the statutory period.

The taxpayer alleges a pure jurisdictional or constitutional defect

Identify the exact legal source of the alleged lack of authority and the relief that only the High Court can realistically grant. The existence of a legal label does not itself guarantee writ intervention; the court will examine the substance and the statutory remedy.

Documents and chronology to assemble before choosing a remedy

Create one indexed file, in date order, containing:

  1. the invoice, e-way bill, transport contract, delivery records and registration details;
  2. the detention or seizure document and every MOV form issued;
  3. the Section 129 notice, written reply, annexures and hearing request;
  4. inspection photographs, statements, correspondence and the officer’s relied-on material;
  5. the payment challan, guarantee or security instrument and release authorisation;
  6. the MOV-09 order, DRC-07 summary and proof of communication or portal upload;
  7. any written protest, reservation, email or letter stating that payment was made to secure release without accepting the demand; and
  8. a one-page timeline showing each event, document date, communication date, payment date and proposed filing deadline.

This file helps counsel distinguish a merits appeal from a challenge to the absence or legality of the process. It also prevents a taxpayer from relying on a later release date when the relevant limitation event is communication of the adjudication order.

Frequent mistakes and how to avoid them

  • Treating payment as either an automatic waiver or an automatic preservation. The effect depends on the surrounding record. ASP Traders rejected waiver by payment alone in the circumstances before it; it did not create a universal rule for every transaction.
  • Using a writ to bypass an ordinary appeal. Explain a concrete public-law defect or urgent inability to obtain relief, rather than restating factual grounds that the Appellate Authority can examine.
  • Filing without the final order. A receipt, release form or summary is not necessarily the reasoned Section 129(3) adjudication needed for an appeal. Seek the formal order and preserve proof of the request.
  • Missing the communication date. Calculate the Section 107 period from the legally relevant communication and document why that date is used.
  • Confusing appellate levels. APL-01 is associated with the Section 107 appeal to the Appellate Authority. A statutory High Court appeal under Section 117, including the form identified in the CBIC rules as APL-08, is distinct from an Article 226 writ.
  • Ignoring the State or Union Territory enactment. The CGST Act operates with the corresponding local GST law, and amendments or local precedent can affect the analysis.
  • Assuming release resolves adjudication. Physical release ends the immediate custody issue; it does not by itself answer whether the demand was lawfully determined.

Jurisdiction, amendments and professional review

The three-month period, the condonation window, form requirements and portal procedure should be checked against the current text of the applicable Central and State or Union Territory provisions on the filing date. Detention litigation is highly document-sensitive: the same payment may be described differently depending on whether the taxpayer filed objections, signed an unconditional statement, sought release under protest or received a later reasoned order.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before filing, have a GST professional or litigation lawyer review the detention notice, reply, payment and release records, MOV forms, DRC-07, final order and communication evidence. The review should answer four separate questions: what act is being challenged, whether an appealable order exists, when the limitation clock began, and what relief the chosen forum can actually grant.

Action checklist

  1. Obtain and authenticate the complete Section 129 record.
  2. Mark the date and method of communication of any final order.
  3. Record every objection, protest and reason payment was made.
  4. Check whether MOV-09 and DRC-07 were issued and uploaded.
  5. Calculate the Section 107 deadline under the current applicable law.
  6. Prepare APL-01 with the certified order and indexed evidence if an appealable order exists.
  7. Use the provisional-release and appeal mechanisms where they provide effective relief.
  8. If considering Article 226, identify the precise procedural, jurisdictional, constitutional or urgent defect and explain why the statutory route is inadequate for that relief.
  9. Keep acknowledgements, hearing notices, submissions and service proof in one file.
