A GST demand notice and GST recovery proceedings are different steps. A demand notice starts (or records) the process of deciding whether tax, interest, or penalty is payable. Recovery proceedings are collection measures used after an amount has become payable and remains unpaid. The document’s section number, legal allegations, service date, and whether it is a notice or an order determine what you must do next.
This guide explains the central GST framework in India. State GST laws generally track the central provisions, but state enactments, later amendments, commencement notifications, tax-period transition rules, and case-specific facts can change the result.

Demand notice and recovery action: the practical difference
| Question | Demand stage | Recovery stage |
|---|---|---|
| Primary purpose | To determine whether a liability exists and how much is payable. | To collect an amount that is payable but has not been paid. |
| Typical legal provisions | Sections 73 or 74 of the Central Goods and Services Tax Act, 2017; amendments may also refer to section 74A. | Section 79 of the CGST Act, usually after an order has created an unpaid amount. |
| What you receive | A pre-notice intimation, show-cause notice, statement, adjudication order, and/or an electronic summary. | A communication implementing a statutory recovery method, such as a third-party payment notice or action against goods. |
| What you should check first | The alleged contravention, tax period, computation, interest, penalty basis, and response deadline. | The underlying order, service date, unpaid balance, statutory authority for the method, and any written reasons for accelerated action. |
Do not treat a notice, an adjudication order, a demand summary, and a recovery communication as interchangeable. A notice normally gives you an opportunity to respond before liability is determined. An order records the department’s determination. Recovery addresses non-payment of that determined amount, subject to the Act, Rules, and any applicable appeal or court directions.
What a GST demand notice is designed to do
Section 73: non-fraud demand allegations
Section 73 applies where tax was not paid or was short paid, an erroneous refund was made, or input tax credit was wrongly availed or utilised for a reason other than fraud, wilful misstatement, or suppression of facts to evade tax. The notice should identify the transaction or return position in question, the relevant period, the proposed tax, interest, and any penalty, and the facts on which the officer relies.
#1 Best Overall
Read the factual allegation rather than relying only on the heading. For example, a notice may allege a mismatch, an ineligible credit category, a classification error, or a calculation issue. Your response should reconcile the allegation with invoices, returns, ledgers, payment records, credit reversals, and correspondence for the exact period cited.
Section 74: allegations involving fraud or deliberate evasion
Section 74 concerns the same broad types of tax, refund, or input-tax-credit demand where the stated grounds include fraud, wilful misstatement, or suppression of facts to evade tax. Those allegations affect the legal basis, penalty exposure, and the way you should prepare a response. Address each alleged act or omission separately and preserve evidence showing what was reported, when it was reported, and why your treatment was adopted.
The section cited is not a formality. A response that merely disputes the amount but does not answer the culpability allegation may leave an important issue unanswered. Conversely, an assertion that a mistake automatically proves fraud is not a substitute for the department establishing the statutory basis in the proceeding.
Section 74A references and the importance of the tax period
Rules and forms were amended in 2024 to include references to section 74A, with the cited amendments effective from 1 November 2024. That effective date for rules or forms does not, by itself, answer which demand regime applies to every tax period or existing proceeding. Check the relevant Finance Act commencement notification, transition provisions, the period under examination, and the law in force for that proceeding before drawing a conclusion.
How the demand process usually unfolds
- Identify the first communication. Determine whether it is a pre-notice intimation, a show-cause notice, a statement, an order, or only an electronic summary. Note the issuing authority, document number, date, and the method and date of service.
- Read the statutory basis. Record every section and rule cited, including whether the communication relies on section 73, section 74, section 74A, interest provisions, or a penalty provision. The legal ground should match the facts alleged.
- Reconcile the numbers. Break the amount into tax, interest, penalty, cess, and any other component shown. Compare the calculation with returns, invoices, electronic liability ledgers, credit records, refunds, and payments for the stated tax period.
- Prepare an evidence-linked response. Answer allegation by allegation. Explain the legal position, show the numerical reconciliation, identify documents by date or transaction, and state clearly whether any amount is admitted, already paid, or disputed.
- Use the prescribed portal function and retain proof. Submit the response or payment intimation through the applicable GST portal workflow, save the acknowledgement, and retain the uploaded files in their original form.
- Track the resulting order. A notice is not the same as a final determination. If an order is issued, save the complete order and its service record, then calculate the payment period and evaluate available procedural remedies.
A voluntary payment or payment intimation may resolve some or all of an issue, but do not assume that uploading a payment form by itself closes every legal or accounting consequence. Confirm what the communication says has been paid, which period it covers, and whether any balance or further order remains.
What the GST forms mean
FORM GST DRC-01
Rule 142 provides for an electronic summary in FORM GST DRC-01 with specified demand notices. It is a summary and procedural record, not a replacement for reading the underlying notice. Compare the tax period, legal section, tax, interest, and penalty shown in DRC-01 with the full show-cause notice and with the portal’s service information.

FORM GST DRC-02
FORM GST DRC-02 is used for electronic summaries of specified statements under Rule 142. A statement may relate to a set of facts or persons described in the underlying proceeding. Obtain and read the complete statement before deciding what records or explanations are required.

FORM GST DRC-03 is used to intimate payment in the circumstances described by Rule 142. Treat the acknowledgement as evidence of the intimation and payment details, not as a universal declaration that every related dispute has ended. Match the amount, tax head, period, and reason for payment with your books and the department’s communication.
When a summary and the underlying document differ
Preserve both records. A short summary can omit factual detail, annexures, calculation notes, or the exact relief requested. If an amount or section in a summary does not match the notice or order, record the discrepancy promptly and raise it through the available response or representation channel. Do not silently amend your records to match a summary that appears incorrect.
From an order to payment: the section 78 rule
Section 78 sets the ordinary payment period after an order. The statutory sentence reproduced in CBIC Instruction 01/2024-GST states: “Any amount payable by a taxable person in pursuance of an order passed under this Act shall be paid by such person within a period of three months from the date of service of such order failing which recovery proceedings shall be initiated:”
For planning purposes, calculate the three-month period from the date the order was served, not merely the date printed on the order. Keep the portal delivery record, email or other service evidence, and any acknowledgement used to establish that date. The order may contain separate directions, so read it in full.

Can GST recovery start before three months?
The proviso to section 78 allows a proper officer to require payment within a shorter period when the officer considers it expedient in the interest of revenue. The reasons for using that exception must be recorded in writing. CBIC Instruction 01/2024-GST, dated 30 May 2024, gives guidance on applying this early-recovery provision and directs field formations to follow the statutory requirement and the instruction’s guidelines.

Early recovery is therefore not automatic merely because a notice has been issued, and it is not the normal consequence of every demand. If a communication seeks payment before the ordinary period, identify the written reasons, the officer issuing it, the amount covered, and the legal provision relied on. Preserve the communication and obtain professional advice promptly if the reasons are missing, unclear, or inconsistent with the order.
What recovery proceedings are under section 79
Recovery begins when an amount payable under the GST law remains unpaid and the department invokes a statutory collection mechanism. Section 79 contains several methods. The exact method used depends on the unpaid amount, the taxpayer’s circumstances, and the action described in the communication.
| Recovery method | What it can involve | Records to examine |
|---|---|---|
| Deduction from money under official control | An officer may deduct the amount due from money belonging to the taxpayer that is under the officer’s control. | The order, the amount credited or held, the deduction calculation, and the ledger entry showing how it was applied. |
| Detention and sale of goods | Goods under official control may be detained and sold in the manner authorised by the Act and Rules. | Inventory, detention or seizure documents, valuation, sale notice, sale proceeds, and adjustment of the outstanding amount. |
| Notice to a third party | A written notice may require a person who owes money to, or holds money for, the taxpayer to pay the Government up to the amount due. | The third-party notice, amount specified, service proof, payment made by the third party, and any objection or response available under the law. |
A recovery notice should be read with the order that created the liability. Check whether the amount demanded includes later interest, whether payments or credits have been omitted, and whether the recovery step is directed to the correct legal person, bankable asset, goods, or third-party debtor.

Appeal and recovery questions depend on the order, service date, statutory section, tax period, and the procedural posture of the case. Before taking filing or stay advice, verify the current consolidated text of sections 107 and 112, the applicable rules, the operational status of the Appellate Tribunal, and any later circular or judicial direction.
CBIC Notification No. 20/2024-Central Tax amended appeal forms to provide for a 10% pre-deposit of disputed tax or cess, subject to the caps and effective-date language stated in that notification. The figure is a procedural requirement in the circumstances covered by the notification; it is not a universal answer for every appeal, period, or category of amount. Confirm the current form, cap, and computation before filing.
Circular 224/18/2024-GST addressed recovery during a specific period in which a first appeal had been decided but the Appellate Tribunal was not yet operational. That circular does not, by itself, establish the current position for every taxpayer. Determine whether it applies to the relevant dates and procedural posture, and check for later instructions or court orders.

A document-by-document checklist
- Service record: Save the complete communication, attachments, portal entry, email, and acknowledgement. Note the date and method of service.
- Authority: Identify the commissionerate, proper officer, office address, designation, and document reference.
- Legal section: Record the exact section and rule cited and whether the allegation is non-fraud or fraud-related.
- Tax period: Confirm the financial year, return period, invoice dates, and whether the period predates or follows a legislative change.
- Computation: Reconcile tax, interest, penalty, cess, payments, credit reversals, refunds, and any adjustments.
- Underlying document: Obtain the full notice, statement, order, annexures, and relied-upon data; do not work from a summary alone.
- Response status: Check whether a reply, hearing request, payment intimation, or order has already been filed or issued.
- Order deadline: If an order has been served, calculate the ordinary section 78 period and check for a shorter period supported by written reasons.
- Recovery method: If collection has started, identify whether it concerns money under official control, goods, or a third party holding or owing money.
- Appeal posture: Before relying on an appeal, pre-deposit, stay, or tribunal remedy, verify the current law and whether any order or direction actually affects recovery.
Illustrative situations
A mismatch notice before an order
A business receives a DRC-01 summary alleging excess input tax credit for a stated quarter. At this stage, the business should retrieve the full notice, identify the invoices and returns in dispute, reconcile the credit register, and file a reasoned response. The summary itself is not a section 79 recovery action.
An order with the ordinary payment period
An adjudication order is served after the response and hearing process. The taxpayer records the service date, reads the final computation, and plans payment within the ordinary section 78 period unless an applicable appeal or other lawful step changes the position. The taxpayer should not assume that the notice date starts this period.
An early-recovery communication
An officer demands payment shortly after service of an order and cites the interest-of-revenue proviso. The taxpayer should request or identify the written reasons, compare the amount with the order and payments already made, and obtain advice on any available procedural response. The existence of an early deadline does not convert every earlier notice into an immediately recoverable debt.
A third-party payment notice
A person who owes money to the taxpayer receives a written direction to pay the Government. The taxpayer should obtain a copy of that direction, verify the amount and underlying order, and coordinate with the third party without asking it to ignore a statutory notice. Any challenge or clarification should use the channel and time limit stated in the applicable law or communication.
Common mistakes and how to correct them
Calling every DRC-01 a recovery notice
DRC-01 is an electronic summary associated with specified demand notices. Correct the classification by checking whether the communication proposes liability, records an adjudication order, acknowledges payment, or invokes a section 79 mechanism.

Ignoring the legal ground
A response that addresses only arithmetic may fail to answer a section 74 allegation. Correct it by separating the facts, documents, legal position, and penalty response for each allegation.
Paying without allocating the payment
A payment may be posted to an incorrect tax head, period, or component. Correct the accounting trail by matching the DRC-03 intimation, challan, electronic liability ledger, and departmental acknowledgement, then raise a correction request where necessary.
Assuming an appeal automatically stops collection
The effect of an appeal, pre-deposit, stay, or tribunal-related direction depends on current law and the case’s posture. Correct the assumption by checking the applicable provisions, filing status, orders, and current departmental or judicial directions.

Central and state GST, amendments, and professional help
This explanation uses the central CGST framework. SGST provisions generally operate alongside it, but a state’s enactment, administrative practice, notification, or court order may affect the document you receive and the available procedure. IGST, compensation cess, special sectors, and taxpayers in different registration jurisdictions can add further rules.
Consider professional tax or legal advice when the notice alleges fraud-related conduct, covers several years, involves substantial input-tax credit, proposes an early recovery deadline, targets goods or a third party, or arrives while an appeal or court proceeding is pending. Provide the adviser with the complete notice or order, service evidence, portal acknowledgements, returns, ledgers, invoices, payment records, and prior correspondence.
Keep a chronological file from the first intimation through any order, payment, appeal, and recovery communication. That file is often as important as the substantive explanation because service, dates, calculations, and the identity of the document determine which procedural step is available.
