GST Composition Scheme vs. Regular GST for Online Sellers in India: Eligibility, Marketplace Rules and Costs

Short answer: An online seller in India can potentially use the GST Composition Scheme even when selling goods through an e-commerce operator (ECO), because the 2023 law change removed the earlier blanket bar. However, the seller must still satisfy turnover, business-activity, PAN-wide and geographic conditions. The special ECO procedure is for permitted intra-State goods supplies; it does not make inter-State marketplace sales eligible. Composition also blocks input tax credit (ITC) and separate GST collection from customers, so a low headline rate is not automatically the cheaper option.

Choose composition only after comparing the levy with unrecoverable GST on purchases, customer expectations, sales locations, marketplace capability and the cost of staying compliant. The controlling sources are the current CGST Act, rules and notifications; older FAQs and explanatory flyers may describe the law before the 2023 amendment.

What changed for sellers using marketplaces?

Older CBIC FAQs and government flyers said a person supplying goods through an e-commerce operator required to collect tax at source could not choose composition. That reflected the former wording of section 10. The 2023 Finance Bill material explains the change: “To remove the condition restricting registered persons engaged in supplying through electronic commerce operators from opting for the Composition Levy, the condition that he should not be make supply of goods through ECO is being omitted.” See the Goods and Services Tax Council’s Finance Bill 2023 material.

Notification 36/2023-Central Tax prescribed a special procedure for ECOs handling goods supplied by composition taxpayers. The GST Council’s summary says it took effect on 1 October 2023 and requires, among other things, reporting by the operator in GSTR-8. The procedure does not override the composition scheme’s other restrictions. In particular, the Council summary describes the ECO route for intra-State goods supplies; a seller cannot use the marketplace amendment to make inter-State outward supplies eligible. Check the notification and the marketplace’s live onboarding instructions before listing products under composition.

The relevant official records are the Notification 36/2023 record and the GST Council newsletter summary.

How the special marketplace route works in practice

  1. Confirm status: The seller must actually be an eligible composition taxpayer, not merely an unregistered seller using a separate 2023 ECO facility.
  2. Confirm the order is permitted: The seller and platform should be able to identify the registration State, dispatch State and delivery State so that an inter-State order is not processed as a composition supply.
  3. Use the correct customer document: The seller issues a bill of supply and does not add GST as a separately collected tax.
  4. Follow platform reporting: The operator must be able to process the special procedure and its reporting obligations, including the GSTR-8 reporting described by the Council.
  5. Keep evidence: Retain onboarding approvals, order-level State data, bills of supply, turnover records and communications showing how the platform handles composition orders.

Marketplace acceptance is therefore only one part of eligibility. A platform may technically offer a composition setting while the seller remains disqualified because of inter-State dispatches, a restricted product, a PAN-wide issue or an exceeded turnover ceiling.

Eligibility: check these conditions before choosing

1. Aggregate turnover, not one marketplace’s sales

Eligibility is tested using aggregate turnover under the GST law, generally across the PAN, rather than sales on a single marketplace account. Include the seller’s direct website, social-commerce orders, physical shop and other registrations when assembling the turnover picture. Confirm both the preceding financial year’s turnover and the applicable current ceiling for the seller’s State and category. Official material contains historic references to ₹75 lakh and ₹1.5 crore, but the sources available here do not establish a complete current state-by-state table. Do not treat either figure as a universal national limit. Verify the operative notification for the relevant State and activity using the CGST Act text and current CBIC guidance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Turnover monitoring should be cumulative, not an end-of-year exercise. A seller can be below the ceiling when opting in and later lose eligibility as sales grow or another channel is added. Set a monthly internal warning level below the statutory ceiling and reconcile marketplace settlements to the seller’s own order records.

2. Intra-State geography

Composition generally excludes inter-State outward supplies of goods. The special ECO procedure likewise does not turn cross-border State shipments into permitted composition sales. Map the dispatch State, registration State and customer delivery State for every channel. A seller shipping from one State to customers in another should assume regular GST is the route to investigate unless a tax professional confirms a specific statutory exception.

Do not infer the tax location from the customer’s billing address alone. A warehouse, third-party fulfilment location or stock transfer can change where an order is dispatched. Ask the marketplace which fulfilment locations it may use, whether it can block out-of-State orders, and how returns or replacements are recorded. A return shipment does not cure an originally impermissible outward supply; the original transaction still needs correct treatment.

3. Nature of supplies

The ordinary scheme restricts or excludes specified suppliers, including suppliers of non-taxable goods, specified manufacturers and most service providers. Section 10 contains a limited allowance for certain service supplies subject to statutory conditions. A goods-trader conclusion cannot simply be applied to a business that also provides services, manufactures restricted products or sells a mixed basket. Read section 10 and the CBIC Composition Rules against the actual product catalogue.

Classify each significant stock-keeping unit and service line before opting. Keep a written list of exempt, non-taxable, restricted and taxable items. If the catalogue changes, repeat the review rather than assuming a new product inherits the eligibility of an old one.

4. One PAN, consistent election

Where several registered persons share a PAN, the statutory condition generally requires a consistent choice by all of them. Composition is not a store-by-store toggle if the same PAN has other registrations that do not meet or do not choose the conditions. Review every registration, branch and business vertical before filing the option.

Include registrations used for a separate warehouse, a legacy offline business or a second marketplace account. A decision memo should list each GSTIN, its State, activity, turnover and proposed status, with an explanation for any registration that is not eligible.

5. Registration and ECO procedure are separate issues

Composition is an option for registered persons. Separate 2023 provisions address when some unregistered sellers may supply goods through an ECO; that route is not the same as opting into composition. Do not use an unregistered-seller provision as evidence that a registered composition taxpayer can ignore the scheme’s limits. The GST Council’s notification index and the Notification 36/2023 record should be checked for the applicable procedure.

Composition versus regular GST: the practical differences

Decision axis Composition Regular GST
Tax calculation Prescribed composition levy rates apply to the relevant turnover base; category and State matter. Tax follows normal GST classification and the applicable rate for each supply.
Input tax credit ITC on purchases cannot be claimed. Eligible ITC may be claimed when statutory conditions and documentation are met.
Customer document Issue a bill of supply and do not collect GST separately as tax from the customer. Issue a tax invoice where required and show GST separately.
Geography Inter-State outward goods supplies are a central restriction; the ECO goods procedure is intra-State according to the Council summary. Inter-State taxable supplies can be made under ordinary registration and compliance rules.
Compliance Simplified compared with regular GST, but payment, forms, records and eligibility monitoring remain necessary. More involved returns and ITC reconciliation, with support for the normal credit chain.
Economic effect A low levy can be outweighed by GST embedded in purchases and by the inability to present a tax invoice. Higher gross tax reporting can produce a lower net cost when eligible purchase credits are significant.

The scheme flyer describes composition suppliers as unable to claim ITC and required to issue a bill of supply. If a flyer and a later law or notification differ, the Act and rules control. See the GST Council Composition Levy Scheme flyer and the CGST Act.

What the customer sees

A consumer may prefer a simple all-in price, and composition can make that presentation straightforward because GST is not separately collected. A registered business buyer may take the opposite view: it may want a regular tax invoice and eligible credit. Ask your largest customers which document they require before treating a lower levy as a commercial advantage.

Do not print a GST amount on a composition bill of supply as though it were tax collected. Keep the document wording, invoice series and marketplace template aligned with the scheme. If a platform automatically generates a regular GST tax invoice, resolve that configuration issue before accepting orders.

Published composition rates: useful reference, not a universal current quote

The GST Council’s composition flyer, published or crawled in 2023, reports these commonly described rates:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Eligible category in the flyer Total rate CGST SGST/UTGST
Eligible manufacturers and traders 1% 0.5% 0.5%
Eligible restaurant service 5% 2.5% 2.5%
Separate eligible service-provider route 6% 3% 3%

These are figures in that older Council flyer, not a guarantee that every seller, State, turnover base or later amendment uses the same rate. Confirm the current notified rate, category and turnover base before calculating liability. No reliable conclusion follows from saying “composition is 1%” without identifying the taxpayer and the legal base.

How to compare the real cost

Compare net economics rather than the percentage printed in a brochure. Build a month-by-month or annual model containing:

  • Taxable sales split by State and channel.
  • The composition levy on the legally relevant turnover base.
  • Normal-scheme output GST by product classification and rate.
  • GST paid on inventory, packaging, equipment, logistics and other purchases that could qualify as ITC under regular GST.
  • Marketplace commissions and charges, including whether the platform’s tax invoice can support ITC under the normal scheme.
  • Customer mix: final consumers, resellers and other GST-registered businesses.
  • Refunds, cancellations, returns and replacements, with a consistent method for matching them to the underlying sale.
  • The administrative cost of returns, records, reconciliations and professional help.

Under composition, purchase GST becomes part of the seller’s cost because ITC is unavailable. The seller also cannot add GST separately to the customer’s bill. Under regular GST, eligible ITC can offset output liability and a registered business customer may value a valid tax invoice. Consumer-facing pricing can produce a different result: a composition seller may show a single price, but cannot label part of it as GST collected from the buyer.

Use two views in the model. The first is the seller’s cash cost: levy or net regular liability, embedded purchase GST, marketplace charges and professional fees. The second is the selling-price effect: whether the seller can keep the same customer-facing price, must absorb tax in its margin, or can show GST separately to a business buyer. The route with the lower tax percentage can still leave less cash profit after these adjustments.

Illustrative questions for the model

  • If most inventory is bought from GST-registered suppliers and the input tax is substantial, how much of that amount would be unavailable under composition?
  • If sales are mostly to households, would customers actually pay more when GST is shown separately under regular GST, or would the seller absorb it?
  • If a marketplace’s commission invoice is not usable for ITC, does regular GST still provide enough credit from inventory, packaging and equipment to justify the extra administration?
  • If one new State or fulfilment centre is added, would the resulting inter-State orders force a change of scheme?

When each route usually fits

Composition is more plausible when

  • The seller stays below the applicable turnover ceiling and meets the activity conditions.
  • All outward goods supplies remain within the permitted State geography, including the special ECO procedure.
  • Most buyers are final consumers who do not need ITC.
  • Eligible purchase GST is modest compared with the composition levy and the seller’s margin can absorb embedded tax.
  • The marketplace can onboard and report composition supplies under the current procedure.
  • The catalogue is stable enough to monitor classification and eligibility without frequent product exceptions.

Regular GST is more plausible when

  • The seller makes inter-State outward supplies or expects to expand across State borders.
  • Purchases carry substantial eligible GST, making ITC economically important.
  • Customers are registered businesses that expect tax invoices and credit.
  • The business has mixed supplies, restricted product categories or service activity that complicates composition eligibility.
  • Turnover may exceed the applicable ceiling, or monitoring a PAN-wide limit is difficult.
  • Multiple fulfilment centres or marketplace logistics make order-level State control unreliable.

These are decision signals, not an automatic tax conclusion. A seller can meet the headline turnover condition and still be a poor fit because of geography, customers or input costs.

A decision workflow for an online seller

  1. Map the legal person. List every GST registration under the PAN, the State of each registration, all marketplaces and direct channels, and the products or services sold.
  2. Classify the supplies. Separate goods, restaurant service, other services, exempt or non-taxable items and any specified manufacturer or product restriction.
  3. Trace delivery locations. Record where each order is dispatched and delivered. Flag any inter-State outward supply before considering composition.
  4. Verify the current ceiling and rate. Use the operative notification for the seller’s State and category rather than relying on historic ₹75 lakh or ₹1.5 crore references.
  5. Model both tax results. Calculate composition levy and embedded purchase GST, then calculate regular output GST less eligible ITC. Add marketplace and professional-compliance costs.
  6. Test customer requirements. Ask whether important buyers need a tax invoice or will compare GST-inclusive prices as consumers.
  7. Confirm marketplace readiness. Obtain written onboarding and reporting instructions showing that the platform supports composition goods under Notification 36/2023 and the intra-State procedure.
  8. Document the election. Keep the turnover model, product classification, State map and PAN-wide decision with the GST records. Recheck eligibility whenever a new State, product or channel is added.
  9. Set a change trigger. Decide who reviews the position when turnover approaches the ceiling, a new fulfilment location opens, the product mix changes or a business customer requests a tax invoice.

Election, forms and what happens if eligibility is lost

For an existing registered taxpayer, the CBIC Composition Rules generally require electronic filing of FORM GST CMP-02 before the financial year for which the option is to apply. The rules also refer to filing FORM GST ITC-3 within 60 days from the start of that financial year. Entry situations, stock disclosures and other details can have separate requirements, so verify the live GST portal and current rule text before filing.

The option remains valid only while its conditions continue to be met. When a taxpayer ceases to qualify, the rules require a move to the regular levy, issuance of tax invoices thereafter and filing CMP-04 within seven days. A transition may allow stock-related ITC subject to statutory conditions and inventory records; leaving the scheme does not automatically create a fixed credit amount. CBIC’s FAQ material discusses exit and potential stock credit, but the current law and evidence for the actual stock determine the claim.

Plan the changeover operationally, not just on the portal. Update marketplace tax settings, invoice templates, price displays, purchase-credit records and customer communications. Reconcile stock on the transition date and preserve invoices and other evidence supporting any credit claim. If eligibility is lost because of a new order or activity, obtain advice promptly on the effective date of regular-tax obligations rather than waiting for an annual review.

Common mistakes to avoid

  • Relying on an old FAQ: Date marketplace guidance. The pre-2023 statement that all ECO goods sellers were barred is not the current blanket rule.
  • Confusing marketplace access with geographic permission: Platform acceptance does not authorize inter-State composition supplies.
  • Using one marketplace’s turnover: Aggregate turnover and PAN-wide registrations matter.
  • Calling composition “no compliance”: Payment, returns or statements, invoices, records and eligibility checks still apply.
  • Quoting 1% without a base: The rate category, State, turnover base and later notifications must be identified.
  • Issuing the wrong document: A composition supplier uses a bill of supply and cannot separately collect GST as tax.
  • Ignoring purchase tax: Unavailable ITC can exceed the apparent saving from a low composition levy.
  • Changing mid-year casually: Election and withdrawal forms have timing rules; plan a transition before crossing a limit or adding a new business line.
  • Assuming every platform is ready: A seller must confirm the marketplace’s live process for composition orders, State restrictions and reporting.
  • Overlooking fulfilment arrangements: Third-party warehouses and platform logistics can affect the dispatch State and therefore the legality of an order under the ECO procedure.

Questions to ask the marketplace and accountant

  • Can the platform onboard a registered composition taxpayer under the procedure associated with Notification 36/2023?
  • Can it restrict or flag inter-State orders for the relevant GST registration?
  • Which seller document is displayed to the buyer, and does the platform ever add a separate GST line?
  • How are cancellations, returns, replacements and marketplace commissions reflected in the seller’s records?
  • Which fulfilment centres may hold or dispatch the seller’s stock?
  • What reports will the operator provide for reconciliation with the seller’s turnover and records?

Get answers in writing and retain the version that applied when the seller opted in. Platform interfaces and instructions can change without changing the underlying statutory conditions.

What to verify before filing or advising

Rates, thresholds, forms, deadlines and ECO procedures can change. For a live decision, check the latest CGST Act and rules, the applicable notification for the seller’s State and category, the text of Notification 36/2023, and the marketplace’s current seller procedure. A chartered accountant or GST practitioner can test classification, aggregate turnover, stock credit and inter-State exposure for the specific business; this article is general information, not individualized tax advice.

Frequently Asked Questions

Can traders selling on ecommerce portals avail composition scheme if their turnover is less than ₹75 lakh?

That wording comes from older CBIC guidance and should not be treated as the current national rule. The 2023 amendment removed the blanket restriction on supplying goods through an ECO, and Notification 36/2023 created a special procedure. The seller must still meet the current State-and-category turnover ceiling, remain eligible under section 10, make only permitted supplies and follow the platform procedure. Verify the operative threshold rather than relying on the historic ₹75 lakh figure.

Can a composition taxpayer sell goods to customers in another State through a marketplace?

Generally no. Inter-State outward supplies of goods remain a central composition restriction, and the special ECO procedure is described as applying to intra-State goods supplies. Map dispatch and delivery States for each order and investigate regular GST before enabling cross-border shipping.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can a composition seller charge GST separately on the customer’s invoice?

No. A composition supplier issues a bill of supply and cannot collect GST separately as tax from the customer. Configure marketplace invoices and price displays accordingly.

Can a composition taxpayer claim GST paid on inventory, packaging or marketplace services?

No input tax credit is available under composition. GST paid on eligible purchases can therefore become an embedded cost. Under regular GST, eligible ITC may be claimed when statutory conditions and documentation are satisfied.

Do all GST registrations under one PAN have to choose the same scheme?

The statutory condition generally requires a consistent choice by registered persons sharing the PAN. Review every GSTIN, branch and business activity before filing; composition is not simply a store-by-store setting.

Which forms are relevant when an existing taxpayer opts for composition or loses eligibility?

The CBIC Composition Rules generally refer to electronic FORM GST CMP-02 before the financial year begins and FORM GST ITC-3 within 60 days from its start. When eligibility is lost, the rules refer to moving to the regular levy, issuing tax invoices and filing CMP-04 within seven days. Confirm current portal requirements and the facts of the transition.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Are the 2023 rules for some unregistered sellers using an ECO the same as composition?

No. The unregistered-seller route and the composition option are separate legal mechanisms. Do not use one as proof that the other removes registration, turnover, invoice or geographic conditions.

Is the composition rate always 1% for an online goods seller?

The GST Council flyer reports 1% for eligible manufacturers and traders, split between CGST and SGST/UTGST, but that flyer is an older reference. Confirm the current notified category, rate, State treatment and turnover base before calculating liability.

How should an online seller compare composition with regular GST?

Model sales by State and channel, the applicable composition levy, regular output GST, eligible purchase ITC, marketplace charges, customer type, pricing effects and professional-compliance costs. The lowest headline percentage is not necessarily the lowest net cost.

Can a seller switch casually during the financial year?

No. Election and withdrawal have timing and form requirements, and loss of eligibility can trigger regular-tax obligations. Plan the transition, update marketplace settings and invoices, reconcile stock and obtain advice on the effective date.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Bottom Line

Marketplace selling no longer automatically disqualifies an eligible goods seller from composition, but the scheme remains geographically restricted and gives up ITC and separate GST collection. Choose it only when the seller’s State-by-State sales, purchases, customer mix and marketplace procedure make the total operating cost lower than regular GST.
