GST Audit vs GST Assessment: What Taxpayers Need to Know

GST audit and GST assessment are different statutory functions under India’s Central GST framework. An audit is a structured examination of a registered person’s books, returns, input tax credit and other tax positions. An assessment is the wider legal process used for a particular situation—such as scrutiny of a return, provisional treatment, a non-filer, an unregistered person or a summary determination. Audit findings can trigger separate demand proceedings, but an audit finding is not automatically a demand order.

The difference in one view

The first task when you receive a GST communication is to identify its statutory section and form. The word assessment is used broadly in the Central Goods and Services Tax Act, while a departmental audit has its own process under section 65. Treating every notice as an audit, or every audit observation as a final tax demand, can lead to missed deadlines and an incorrect response.

Point of comparison Departmental audit Assessment or scrutiny
Statutory location Chapter XIII, section 65 of the CGST Act; a special audit is addressed separately in section 66. Assessment provisions include sections 60–64; scrutiny of returns is section 61.
Main function Examine records, returns, statements and reported tax positions for discrepancies. Apply the procedure relevant to the case: review a return, settle provisional treatment, or determine liability in specified circumstances.
Typical documents FORM GST ADT-01 for the audit notice and FORM GST ADT-02 for communicating findings. Forms depend on the procedure; the Rules use the ASMT series for several assessment and scrutiny steps.
Usual outcome Audit findings, followed where appropriate by separate proceedings under the applicable demand provisions. An order or conclusion under the specific assessment procedure.
Taxpayer response The Rules allow a reply to discrepancies before findings are finalised. Response rights, forms and deadlines depend on the exact assessment or scrutiny process.

This comparison does not cover every GST process, state or Union-territory variation, or every notice that may be issued under the Act. The section and form printed on your communication control the next step.

What a section 65 GST audit is

Section 65 permits the Commissioner or an authorised officer to audit a registered person. The examination may take place at the taxpayer’s business premises or at the tax office. It is a verification exercise: the officer tests whether the books, returns and tax positions agree with the underlying transactions and the GST law.

Notice and minimum notice period

The registered person must be informed by notice at least 15 working days before the audit. The Rules identify FORM GST ADT-01 as the departmental audit notice. The notice should be read for the tax periods covered, the officer or team conducting the work, the place of audit and the records requested.

When the audit starts and how long it may run

The statutory completion period is three months from commencement. For this purpose, commencement is tied to the later of the date on which the required records are made available or the date on which the audit is actually instituted at the business place. The Commissioner may extend the period by up to a further six months when reasons are recorded in writing. These are legal periods, not a promise that every audit will use the full allowance.

What officers may examine

The Rules describe a broad review rather than a single invoice test. The audit can cover:

  • Underlying books of account and supporting documents.
  • GST returns and statements filed for the period.
  • Turnover reported and the completeness of supplies recorded.
  • Exemptions and deductions claimed.
  • Tax rates applied to different supplies.
  • Input tax credit availed and the credit actually used.
  • Refunds claimed and the records supporting them.
  • Other issues relevant to the taxpayer’s tax position.

In practice, prepare reconciliations between the general ledger, sales and purchase registers, e-invoice or e-way-bill data where relevant, returns, bank records and the input-tax-credit records. A reconciliation does not replace source documents, but it lets you identify and explain differences before the officer does.

Discrepancies and the taxpayer’s reply

An officer may communicate discrepancies during the verification. The taxpayer can submit a reply and supporting evidence. The Rules require the officer to consider that reply before finalising the audit findings. Use this stage to distinguish a genuine tax shortfall from a timing difference, classification issue, duplicate entry, credit reversal already made, or a transaction outside the audit period.

Findings communication within 30 days

On conclusion of the audit, the proper officer must communicate the findings, the registered person’s rights and obligations, and the reasons for those findings within 30 days. The Rules identify FORM GST ADT-02 for this communication. The Central Goods and Services Tax Act, 2017 states:

“On conclusion of audit, the proper officer shall, within thirty days, inform the registered person, whose records are audited, about the findings, his rights and obligations and the reasons for such findings.”

ADT-02 is therefore an audit-outcome communication. Read its observations, legal basis, period and computation carefully; do not assume that the form itself is the same as an adjudicated demand order.

What GST assessment means

Assessment is not one uniform event. Under the CGST Act, the assessment provisions cover different situations, each with its own trigger, forms, response opportunity and order. The relevant type must be identified before you calculate a deadline or decide what evidence to send.

Provisional assessment — section 60

A provisional assessment procedure is used where a taxpayer cannot determine the value of a supply or the applicable tax rate and seeks permission to pay tax provisionally. The resulting order and later finalisation follow that specific procedure; it is not a departmental audit of all books.

Scrutiny of returns — section 61

Scrutiny is a targeted review of information reported in a return. The officer may seek an explanation for a discrepancy, such as a mismatch between return fields or an unusual credit claim. The notice and response steps are governed by the applicable ASMT forms and rules. A satisfactory explanation can close the scrutiny; an unresolved issue can lead to further action under the Act.

Assessment of non-filers — section 62

Where a registered person fails to furnish a required return, the officer can use the non-filer assessment mechanism. This is not the same as an audit of a cooperative taxpayer’s records. The notice, opportunity to file and consequences are controlled by section 62 and the corresponding rules in force for the period.

Assessment of unregistered persons — section 63

Section 63 provides a route for assessing a person who should have been registered but was not. The procedure is directed at determining liability in that specified circumstance, rather than reviewing an existing registered person through section 65.

Summary assessment in special cases — section 64

Summary assessment is an exceptional mechanism for protecting the revenue in certain special cases where delay would adversely affect the interest of revenue. It is not the default form of assessment and should not be assumed merely because a notice uses the word assessment.

The Rules prescribe forms and response windows for these procedures. Because they differ, copy the section, form number, issue date and response deadline from the notice before preparing your reply. A generic “assessment reply” may address the wrong legal test.

How an audit can lead to tax demand proceedings

Section 65(7) provides that when an audit detects tax not paid or short paid, an erroneous refund, or input tax credit wrongly availed or used, the proper officer may initiate action under section 73 or section 74. That wording creates a sequence, not an automatic conversion:

  1. The audit team examines records and reported positions.
  2. Discrepancies are communicated and the taxpayer may respond.
  3. Findings are finalised and communicated, normally through ADT-02.
  4. If the statutory conditions are met, the proper officer may begin separate proceedings under the applicable demand section.
  5. The demand process then has its own notice, reply opportunity, adjudication and order.

Whether section 73 or section 74 is applicable depends on the grounds, tax period and facts established by the officer. The consequences, including interest and penalty exposure, cannot be inferred solely from the existence of an audit finding. A finding that an invoice was classified incorrectly, for example, is not the same factual allegation as deliberate fraud or suppression.

What to do when FORM GST ADT-01 arrives

Use the notice period to build an evidence trail rather than sending unstructured files. The following sequence works for most departmental audits, subject to the exact instructions in the notice.

  1. Verify the notice. Check the GSTIN, legal name, issuing authority, tax periods, date, venue and the section 65 reference. Confirm that ADT-01 is the form being used and record the 15-working-day minimum notice requirement.
  2. Nominate a response team. Assign one person to control submissions and include the finance, indirect-tax and operations owners who can explain sales, purchases, exports, exemptions, refunds and credit reversals.
  3. Freeze the period and create an index. List every month or financial year covered. Number the ledgers, returns, reconciliations, invoices, credit notes, contracts, payment records and correspondence that you provide.
  4. Reconcile reported figures. Tie turnover and tax in the returns to the trial balance and sales registers. Reconcile input tax credit to purchase records and the electronic credit ledger, and identify reversals, blocked credits, amendments and credit notes.
  5. Test high-risk areas. Review rate changes, exemptions and deductions, place-of-supply questions, related-party or branch transactions, refund calculations and differences between books and return data.
  6. Prepare explanations with evidence. For each potential discrepancy, state the transaction, tax period, legal position, amount, calculation and document that supports it. Separate a correction you accept from a difference you dispute.
  7. Attend and document the audit. Keep a log of documents handed over, questions asked, answers given and any additional request. Give copies or controlled electronic access rather than losing the only original record.
  8. Reply to interim discrepancies. Submit the response within the time stated by the officer, with a schedule linking every answer to an indexed document. Ask for an acknowledgement.
  9. Review ADT-02 promptly. Compare the final findings with your submissions. Note which explanations were accepted, which were rejected and whether the computation contains a period, rate, credit or arithmetic error.

Your practical rights and obligations during an audit

Obligations

  • Make the books, returns, statements and other requested records available in the form and place required by the officer.
  • Provide a truthful explanation of transactions and preserve the underlying records.
  • Cooperate with reasonable requests while keeping a record of what was supplied.
  • Meet the response dates stated in the notice or subsequent written communication.

Rights

  • Receive the audit notice with at least 15 working days’ advance information under section 65.
  • Know the scope, period and documents being examined.
  • Submit a reply to discrepancies before findings are finalised.
  • Receive the findings, rights and obligations, and reasons within 30 days of audit conclusion.
  • Respond separately to any later demand notice under section 73 or 74 instead of treating the audit communication as the final adjudication.

These rights do not eliminate the need to comply with a valid request. If the requested records are unavailable, explain why in writing, identify substitutes and state when the missing material can be produced.

How to read an assessment or scrutiny notice

Start with the statutory label, not the allegation. A notice mentioning ASMT may concern scrutiny, provisional assessment or another assessment step. Ask four questions:

  1. Which section and rule are cited?
  2. Which form has been issued, and is it a notice, query, provisional order or final order?
  3. What tax period and return are covered?
  4. What is the response deadline and what happens if no reply is filed?

Then answer the exact issue raised. For scrutiny, provide a return-to-books reconciliation and documentary explanation. For provisional assessment, support the proposed value or rate and the basis for seeking provisional treatment. For a non-filer or unregistered-person assessment, establish the filing or registration facts and preserve proof of supplies, payments and communications. Do not attach an entire accounting archive when a focused, indexed response will answer the statutory question more clearly.

Common mistakes and how to avoid them

  • Calling ADT-02 a demand order. It communicates audit findings; a separate demand process may follow.
  • Using one deadline for every notice. Audit, scrutiny, non-filer assessment and other procedures have different statutory steps.
  • Ignoring the tax period. A reconciliation prepared for one financial year cannot automatically answer a notice covering another.
  • Explaining totals without transaction evidence. Provide invoice-level or ledger-level support where the issue requires it.
  • Assuming an audit covers only input tax credit. Turnover, exemptions, deductions, rates and refunds are also identified audit subjects.
  • Missing a later demand notice. Monitor the GST portal and registered contact details after ADT-02, because follow-on proceedings have their own deadlines.
  • Relying on an old form or law version. Confirm the form and provisions applicable to the financial year, tax period and jurisdiction before filing a substantive reply.

Section 128A relief: a limited, dated provision

CBIC Circular 238/32/2024-GST, dated 15 October 2024, describes section 128A as effective from 1 November 2024. It concerns a conditional waiver of interest or penalty, or both, for specified section 73 demands relating to financial years 2017–18, 2018–19 and 2019–20. Eligibility depends on the statutory requirements and the prescribed procedure. It is not a blanket waiver for every audit finding, every demand, or every taxpayer.

Before relying on section 128A, match the demand section, financial year, payment status and procedural conditions to the current law and notifications. The 54th GST Council press release is a policy source describing recommendations; a recommendation alone does not establish that a proposal is operative law. Because rules and forms can change, verify the latest notification and portal procedure for the relevant period.

A decision framework for taxpayers

Use the following classification before you respond:

If the document says… Most likely issue Immediate focus
Section 65 and ADT-01 Departmental audit of a registered person Confirm the 15-working-day notice, assemble records, reconcile the stated period and prepare for discrepancy queries.
ADT-02 Audit findings communication Check reasons and calculations, compare with your reply, and watch for a separate section 73 or 74 notice.
Section 61 or an ASMT scrutiny form Scrutiny of a filed return Answer the identified return discrepancy with a focused reconciliation and evidence by the stated deadline.
Section 60 Provisional assessment Support the proposed value or rate and follow the provisional-to-final assessment steps.
Section 62, 63 or 64 Non-filer, unregistered-person or summary assessment Identify the special statutory trigger and seek professional advice quickly if the notice could result in an ex parte or summary order.
Section 73 or 74 demand notice Separate determination of tax, interest or penalty Respond to the allegations, period, computation and legal basis; do not rely only on the earlier audit reply.

When professional help is sensible

A GST-qualified chartered accountant or tax professional can help when records do not reconcile, several registrations or states are involved, the notice alleges wrong input tax credit or erroneous refund, the tax period is old, or a section 73 or 74 demand has been issued. Give the adviser the complete notice history, not just the latest form: ADT-01, requests for information, your replies, ADT-02 and any subsequent demand notice should be reviewed together.

This is general information about the central framework. The applicable law, forms and deadlines can vary with amendments, the financial year, the tax period and the relevant state or Union-territory administration. For a live notice, verify the current consolidated Act, Rules, notifications and portal instructions before filing.
