A GST audit objection is an observation raised while an audit is still being examined. A DRC-01 is the prescribed electronic summary that accompanies a show-cause notice (SCN) in a separate demand proceeding. They are therefore different stages and documents: an objection can be answered before the audit findings are finalized, while a DRC-01 signals that the tax officer has issued, or is issuing, a demand-related SCN that requires a formal response.
An audit may provide facts for later demand action, but an audit objection is not automatically a demand notice, and DRC-01 is not the audit report. The exact legal section, tax period, deadlines and portal instructions in the notice control your response.

The difference at a glance
| Point | GST audit objection or discrepancy | DRC-01 show-cause notice summary |
|---|---|---|
| Stage | Raised during a section 65 audit, before the audit findings are finalized | Issued with an SCN in demand proceedings |
| Purpose | Communicates an audit observation and gives the registered person an opportunity to explain it | Summarizes the SCN’s period, legal provision, facts, grounds and claimed dues |
| Related forms | ADT-01 is the audit notice; final findings are communicated in ADT-02 | DRC-01 is the summary; DRC-06 is the prescribed reply form |
| Typical response | Submit records and an explanation addressing each discrepancy to the audit officer | Read the complete SCN and annexures, then answer every ground and calculation through the prescribed process |
| Possible outcome | Clarification, correction, accepted finding or referral for separate action | Confirmation, modification or dropping of a demand after considering the reply and hearing rights |
| Legal relationship | May become evidence for later proceedings under an applicable demand provision | A later procedural step; it is not another name for an audit objection |
This distinction follows the Central Goods and Services Tax (CGST) Act and Rules administered through the CBIC framework. Forms and portal workflows can change, so use the version and instructions applicable to the relevant tax period.
Where an audit objection fits in the GST process
1. Notice before the audit
Section 65 requires at least 15 working days’ prior notice before a GST audit. The notice is issued in ADT-01. It identifies the registered person and the period or records selected for examination, and it starts the audit process; it is not itself a demand notice.

2. Examination of books, returns and supporting records
The officer can examine the books and documents supporting them, GST returns and statements, turnover, exemptions and deductions, tax rates applied, input tax credit (ITC), refunds and other matters relevant to compliance. Keep the records organized by financial year, return period and issue so that each figure can be traced to a ledger, invoice, return or payment proof.
3. Communication of discrepancies
If the officer notices a mismatch or possible short payment, erroneous refund or ITC problem, the registered person may be informed of the discrepancy during the audit. The communication is an opportunity to explain the facts before the officer finalizes the audit findings. It does not, by itself, establish a payable demand or a penalty.
4. Reply and final findings
Your reply should deal with each observation separately and attach the records that support it. The officer must consider the response before finalizing findings. The audit concludes with findings communicated in ADT-02. If those findings disclose a specified tax or ITC issue, the proper officer may initiate separate action under the demand provisions that apply to the facts and period.

Section 65 timing rules—and what they do not mean
| Event | Statutory timing described for a section 65 audit | What it is not |
|---|---|---|
| Advance notice | At least 15 working days before the audit | Not the response period for an individual discrepancy |
| Ordinary completion period | Three months from commencement of the audit | Not a deadline for paying a DRC-01 amount |
| Extension | Up to a further six months when reasons are recorded in writing | Not an automatic extension of every taxpayer deadline |
| Communication of findings | Within 30 days after the audit is concluded | Not the deadline for replying to a later SCN |
These periods govern the audit framework. They do not replace the response deadline printed in an audit communication, an SCN or the GST portal. Treat each notice’s date and instructions as a separate compliance event.
What DRC-01 is—and what it is not
Rule 142 provides for a DRC-01 summary to accompany a show-cause notice. The form is an electronic synopsis of the demand proceeding, not the complete reasoning document. The underlying SCN, calculations and annexures remain essential because the summary may not contain every factual detail or supporting worksheet.
Particulars to locate in the summary
- GSTIN and the registered person’s legal name.
- The financial year, return period or other tax period covered.
- The SCN reference number and issue date.
- The section and subsection invoked by the officer.
- The stated facts and grounds for proposing tax.
- Tax, interest, penalty and any other dues shown in the calculation.
- References to annexures, statements, invoices, return comparisons or other evidence.
DRC-01 should be read alongside the SCN, not instead of it. If a figure in the summary differs from the notice or an annexure, identify the difference in your reply and request a corrected calculation or clarification.

Sections 73, 74 and the need to check the period
Sections 73 and 74 address different grounds for demand proceedings. In broad terms, section 73 concerns tax not paid, short-paid, erroneously refunded or ITC wrongly availed or utilized for reasons other than fraud, wilful misstatement or suppression of facts. Section 74 deals with allegations involving those more serious grounds. The consequences and statutory timelines differ.

Do not select a response strategy from the section number alone. Check the exact subsection, the tax period, the date of the alleged conduct and the law in force for that period. Amendments and transition rules can change which provision applies. The current consolidated Act and the notice itself must be checked before making admissions or relying on a limitation argument.
Some current discussions also refer to section 74A. Its application to every tax period is not settled merely by seeing that label in a secondary summary. Verify the effective date, transitional provisions and the consolidated legislation applicable to your notice. If the notice cites a provision that appears inconsistent with the period, raise that issue precisely and obtain case-specific advice.

Can an audit objection become a demand notice?
Yes, an audit can lead to further action, but the steps are not interchangeable. The officer may use an audit finding to support a later proceeding when the records indicate a short payment, erroneous refund or ITC issue. A separate SCN must then be issued under the applicable demand provision, with its own legal grounds, calculation and opportunity to respond. DRC-01 summarizes that SCN.
An audit objection that is answered satisfactorily may be closed or modified in the final findings. Conversely, an objection left unanswered can become part of the factual basis for later action. Receiving an audit discrepancy therefore deserves a prompt, evidence-based response, but it does not mean a demand has already been confirmed.
How to reply to a GST audit objection
- Record the receipt and deadline. Save the communication, note when it was delivered through the portal or otherwise, and identify the response date stated by the officer. The section 65 completion periods do not supply this deadline.
- Build an issue-by-issue schedule. Copy the officer’s description, period, tax head, amount and alleged reason into a working table. Keep separate rows for turnover, rate, exemption, refund and each ITC allegation.
- Reconcile the numbers. Compare the allegation with returns, general ledger, sales and purchase registers, e-invoices or e-way records where relevant, payment challans and prior correspondence. Explain whether a difference is timing, classification, duplication, amendment or an actual error.
- Attach primary evidence. Use readable, indexed files. For ITC, that may include invoices, receipt or service evidence, supplier details, payment proof and reconciliation to the relevant returns. For turnover or rate issues, show the invoice population and the calculation that leads to your conclusion.
- State the requested treatment. Say whether the discrepancy should be dropped, corrected to a lower amount, or accepted in whole or part. If tax has already been paid, identify the return, challan and date rather than merely asserting payment.
- Ask focused clarification questions. Where the officer has not supplied the transaction list or calculation, request the missing particulars and explain why they are needed to give a complete response.
- Submit through the instructed channel and retain proof. Save the acknowledgment, uploaded files and a final copy of the response. Keep the same index and file names if a later demand proceeding refers back to the audit.
Use measured language. An audit reply should correct facts and law without making a broader admission than the records support. If the issue could involve fraud, wilful misstatement, suppression, significant ITC exposure or several tax periods, obtain advice from a qualified GST practitioner or tax lawyer before filing.

How to respond when you receive DRC-01
- Download the complete record. Save DRC-01, the SCN, every annexure, calculation sheet and portal acknowledgment. The summary alone is insufficient for a reliable response.
- Verify identity and scope. Check the GSTIN, legal name, tax period, tax head, place of supply where relevant, SCN reference and issuing officer. A mismatch should be raised immediately.
- Test the legal provision. Read the cited section and subsection against the facts alleged and the law applicable to that period. Note whether the notice alleges fraud, wilful misstatement or suppression, and whether the allegation is supported by specific facts rather than a conclusion.
- Reperform the calculation. Recalculate taxable value, tax rate, tax, interest and penalty from the source transactions. Check credit for tax already paid, amendments, payments made during investigation and any arithmetic or period duplication.
- Answer each ground separately. Use headings that mirror the SCN. For every allegation, state the fact, the legal response, the evidence and the amount, if any, that remains disputed.
- Upload the prescribed reply. Rule 142 prescribes DRC-06 for the reply. The form includes a reply field, document uploads and a choice regarding a personal hearing. Follow the current portal workflow and the deadline in the actual notice.
- Request a personal hearing when useful. Select the hearing option in DRC-06 where oral clarification is needed, the calculation is complex or the notice relies on disputed records. Prepare a short agenda and bring the indexed evidence.
- Preserve the filing trail. Retain the submitted DRC-06, attachments, acknowledgment number, hearing request and any subsequent order or communication.
DRC-01 review checklist
- Period: Does the notice cover the correct financial year, month or quarter, and only the transactions within that period?
- Provision: Is the cited section and subsection consistent with the alleged conduct and the law effective on the relevant dates?
- Facts: Can each factual assertion be traced to a return, invoice, statement, audit record or other disclosed material?
- Grounds: Are the reasons for proposing tax explained, or are serious allegations stated without particulars?
- Amounts: Do the tax, interest and penalty figures add up and distinguish tax heads and periods?
- Credits: Has the calculation allowed tax already paid, reversals, amendments, refunds repaid or other lawful adjustments?
- Annexures: Are all referenced schedules and transaction lists available and legible?
- Procedural details: Is the SCN reference clear, and does the portal show the same document and deadline as the communication?
- Hearing: Is a personal hearing requested where written evidence alone may not resolve the dispute?
Timing, payment and hearing decisions
Do not infer a payment or reply deadline from the three-month audit period, the possible six-month extension or the 30-day communication period for findings. Those are section 65 audit rules. A DRC-01 response follows the SCN and the portal’s stated deadline, while any payment option or consequence depends on the demand provision and the notice’s instructions.
If you accept all or part of the amount, document exactly what is being paid, for which period and under which head. If you dispute it, avoid an unexplained partial payment that could be characterized as an admission. Ask a professional to assess any statutory settlement or reduced-penalty option available for the cited provision and date.
Illustrative examples
Example 1: ITC reconciliation during audit
An auditor identifies an apparent ITC excess by comparing a return with a supplier-related statement. The taxpayer produces invoices, receipt records, payment evidence and a reconciliation showing that the difference is caused by a timing mismatch and a later amendment. The taxpayer replies to the discrepancy with the transaction schedule. The officer considers that explanation in the audit findings. At this stage, there is no DRC-01 unless a separate demand SCN is subsequently issued.

An audit finding alleges that a group of supplies was taxed at an incorrect rate and records a proposed short payment. The proper officer later issues an SCN under the demand provision cited for that period and attaches DRC-01. The taxpayer must now answer the legal classification, the transaction list and the calculation through DRC-06, even if the issue originated in the audit.
Common mistakes to avoid
- Calling an audit discrepancy a confirmed demand or treating DRC-01 as the audit report.
- Replying to only the summary while ignoring the SCN’s grounds and annexures.
- Sending a narrative without a transaction-level reconciliation when the allegation is numerical.
- Using the current section or form instructions without checking the tax period and amendment dates.
- Assuming the audit’s statutory completion periods extend the deadline in a DRC-01 notice.
- Uploading unindexed or unreadable documents and failing to save the acknowledgment.
- Making a fraud or suppression admission without reviewing the evidence and legal consequences.
- Relying on a portal screenshot instead of retaining the filed form and supporting files.
When professional advice is warranted
Consider qualified GST advice when the notice alleges fraud, wilful misstatement or suppression; spans multiple years or registrations; involves material ITC, refund or rate disputes; cites a provision that may not apply to the period; or contains a calculation that cannot be reproduced. A practitioner can also check limitation, transition rules, evidence standards, hearing strategy and the consequences of accepting part of a demand.
For any notice, verify the current consolidated CGST Act, Rules, prescribed forms and GST portal instructions applicable to the taxpayer’s period. CBIC-hosted PDFs dated 2022 remain useful for the form language described here, but a later amendment or portal change may govern the actual proceeding.
