GST Appeal Pre-Deposit vs. Rule 86A ITC Blocking: What Each Covers

They are different GST mechanisms with different purposes. A section 107 appeal pre-deposit is a payment condition for challenging an adjudicating authority’s order before the Appellate Authority: pay the admitted tax in full plus 10% of the remaining disputed tax, and recovery of the balance is deemed stayed. Rule 86A is an administrative restriction on debiting a specified amount from the electronic credit ledger when an empowered officer has the rule’s prescribed reasons to believe that input tax credit (ITC) was fraudulently availed or is ineligible.

Paying the section 107 amount does not, on the sources considered here, automatically remove a Rule 86A restriction. Conversely, a ledger restriction is not an appeal pre-deposit. The correct response depends on the order, the credit involved, the authority that acted, the applicable Central, State or Union Territory GST law, and the current portal procedure.

The distinction in one table

Question Section 107 appeal pre-deposit Rule 86A ITC restriction
What is it? A statutory payment condition for an appeal to the GST Appellate Authority. A restriction on debiting a specified amount from the electronic credit ledger.
What triggers it? An aggrieved person challenges an adjudicating authority’s decision or order. An empowered officer records reasons to believe that credit in the ledger was fraudulently availed or is ineligible, on a ground specified in Rule 86A.
What amount is involved? The admitted amount in full, plus 10% of the remaining disputed tax for a section 107 appeal. An amount equivalent to the credit considered fraudulent or ineligible; CBIC guidance says the restriction should not exceed that implicated credit.
Immediate legal effect After the statutory payment, recovery proceedings for the balance are deemed stayed. The restricted ledger amount cannot be debited for covered uses while the restriction operates.
Does it release the other mechanism? No automatic release of a Rule 86A restriction is established merely by making this payment. No automatic satisfaction of a section 107 pre-deposit is established merely because a ledger restriction exists or ends.
How long? The Act sets an appeal-filing period; the pre-deposit itself is linked to the appeal and stay provisions. The restriction ceases after one year under Rule 86A, or earlier if the conditions for disallowance no longer exist.

This distinction follows the Central Goods and Services Tax Act, 2017 (CGST Act), the CGST appeal rules, Rule 86A of the CGST Rules and CBIC’s GST Policy Wing guideline CBEC-20/16/05/2021-GST dated 2 November 2021.

What the GST appeal pre-deposit covers

It is the gateway to a section 107 appeal

Section 107 is the first statutory appeal route from a decision or order made by an adjudicating authority. A person aggrieved by that decision may appeal to the Appellate Authority. The appeal rules identify GST APL-01 as the form for this appeal, although the portal’s current screens and filing requirements should be checked when a real filing is made.

The Act generally allows three months from the date on which the order is communicated. The Appellate Authority may allow a further one month when sufficient cause prevented filing within the original period. The extra month is discretionary; it is not an automatic extension. A taxpayer should therefore calculate the deadline from the communication date shown in the record, not from a later internal review date.

How to calculate the section 107 amount

Section 107(6) requires two components:

  1. The admitted amount: pay the full amount of tax, interest, penalty or other amount that the appellant admits as payable, to the extent the statutory provision and order make it part of the payment condition.
  2. The disputed-tax component: pay 10% of the remaining amount of tax in dispute.

The 10% figure applies to the remaining disputed tax, not automatically to every line item in the order. Separate treatment may apply to interest, penalty, late fee or other amounts. Read the order and the applicable provision carefully before calculating the amount.

Worked example

Assume an order contains ₹1,00,000 of tax that the taxpayer admits and ₹4,00,000 of tax that the taxpayer disputes. The section 107 payment condition would be the admitted ₹1,00,000 plus 10% of the disputed tax, or ₹40,000. The statutory pre-deposit portion in that example is therefore ₹1,40,000. The calculation does not mean the disputed tax has been finally accepted; it is a condition for the appeal and the associated stay of recovery.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What payment changes

Once the payment required by section 107(6) is made, section 107(7) provides that recovery proceedings for the balance amount are deemed to be stayed. The stay relates to recovery of the balance covered by the statutory provision. It does not decide the merits of the tax dispute, cancel the order, or guarantee that the appeal will succeed.

Keep the payment challan, electronic liability or cash-ledger record, appeal acknowledgement and order together. If the portal does not reflect the payment or the appeal, resolve that administrative mismatch promptly rather than assuming that a bank debit alone proves that the statutory condition has been met.

What it does not cover

  • It is not a finding that the disputed ITC was fraudulent or ineligible.
  • It is not permission to debit a blocked electronic credit ledger.
  • It does not, on the cited sources, automatically lift a Rule 86A restriction.
  • It is not the deposit required for an appeal to the Appellate Tribunal under section 112.

The separate section 112 Tribunal deposit

Section 112 deals with an appeal to the Appellate Tribunal. The Act specifies an additional 20% of the remaining disputed tax, in addition to the amount paid under section 107(6), for the Tribunal appeal. That is a separate statutory stage and should not be confused with the 10% first-appeal amount. Check the current commencement and procedural position for Tribunal filings before relying on a section 112 timetable or portal workflow.

What Rule 86A ITC blocking covers

The electronic credit ledger, not the appeal file

ITC that is credited to a taxpayer’s electronic credit ledger can ordinarily be used toward eligible GST liabilities and, where the law permits, for an unutilised-credit refund. Rule 86A addresses the use of that ledger. It allows the specified authority, when the rule’s conditions are met, to disallow debit of an amount equivalent to credit believed to have been fraudulently availed or to be ineligible.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The restriction therefore affects access to credit already reflected in the ledger. It is not a demand for the section 107 percentage and is not itself an order deciding the entire tax dispute. A taxpayer may still need to deal separately with a demand order, an audit or investigation, a refund application, or an appeal.

When the power may be used

Rule 86A requires an empowered officer to have reasons to believe, based on the grounds specified in the rule, that the credit was fraudulently availed or is ineligible. The rule’s grounds address situations such as credit linked to invoices from a non-existent or non-operating supplier, credit where the required receipt of goods or services is not established, or other prescribed indications that the credit should not be available. The exact ground relied on must be read in the officer’s record and the relevant version of the rule.

A mere numerical mismatch or a generic suspicion is not a substitute for the rule’s conditions. CBIC’s guideline instructs officers to apply their minds to the facts, the amount involved and whether restricting debit is necessary to prevent use or passing on of ineligible or fraudulently availed credit.

Authority, reasons and portal action

The power is not intended to be exercised mechanically. The CBIC GST Policy Wing guideline dated 2 November 2021 says reasons should be recorded in writing, officer details should be entered on the portal, and the taxpayer should be informed through the portal. The guideline also calls for consideration of the evidence and the amount actually implicated.

“The remedy of disallowing debit of amount from electronic credit ledger being, by its very nature, extraordinary, has to be resorted to with utmost circumspection and with maximum care and caution.”

This is institutional guidance from the Central Board of Indirect Taxes and Customs, not a quotation attributed to an individual officer. It signals that the restriction should be proportionate and supported by material rather than imposed as a routine collection step.

How much credit can be restricted

CBIC’s guideline says the amount blocked should not exceed the credit believed to have been fraudulently availed or to be ineligible. The restriction is therefore tied to the implicated credit, not automatically to the taxpayer’s entire ledger balance or the total tax demand in an order.

For example, if the officer’s recorded reasons concern ₹2,00,000 of specific ITC while the electronic credit ledger contains ₹8,00,000, the guidance points to a restriction no greater than the implicated ₹2,00,000. The figures in a live matter must be reconciled with invoices, returns, supplier data and the officer’s recorded reasons; the example does not determine the lawful amount in any particular case.

What the restriction prevents

While the restriction operates, the specified amount cannot be debited from the electronic credit ledger for covered uses. This can affect payment of an eligible liability through the ledger and can also affect a claim for refund of unutilised credit. The restriction does not necessarily mean that the entire ledger disappears or that every future credit is automatically blocked; the scope should be checked in the portal record and order.

Duration and earlier release

Rule 86A states that the restriction ceases after one year from the date it was imposed. The rule also permits earlier release when the conditions for disallowance no longer exist. CBIC’s guideline describes a fresh examination of the case and release of the debit facility when the relevant conditions are no longer present.

The one-year period is a maximum period under the rule’s text reproduced in the guideline, not a promise that a taxpayer will regain use of the credit on a particular portal date without administrative action. Record the imposition date, monitor the ledger and retain evidence showing why the conditions have ended.

Why the two mechanisms are often confused

Both mechanisms can appear during a dispute involving the same return period or suppliers, and both can affect cash flow. Their legal functions remain different:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • The appeal pre-deposit is calculated from the tax order and the amount admitted or disputed.
  • The Rule 86A restriction is calculated from credit considered fraudulent or ineligible and the amount placed under debit restriction.
  • The appeal payment produces the statutory stay of recovery for the balance.
  • The Rule 86A action limits use of ledger credit; it does not itself produce the section 107 stay.

There is no basis in the cited Act, rules or guideline to treat one as a substitute for the other. A taxpayer that needs to appeal and also needs to use blocked credit may have two parallel issues to document and address.

What to do when both issues arise

  1. Identify every operative document. Obtain the adjudication order, demand summary, appeal communication, Rule 86A portal notice or restriction details, relevant returns and ledger extracts. Do not rely on a screenshot that omits the order date or officer details.
  2. Separate the calculations. Prepare one worksheet for the section 107 amount: admitted dues and 10% of remaining disputed tax. Prepare a second worksheet identifying each credit entry covered by the Rule 86A restriction and the corresponding invoice, supplier and return period.
  3. Check the appeal deadline. Count three months from communication of the order and assess whether a further month for sufficient cause may be available. A request for more time should not be treated as granted until the authority accepts it.
  4. Use an accepted payment route. Confirm the current GST portal and payment rules for the section 107 amount. Do not assume that a restricted credit ledger can be used to satisfy the pre-deposit; the restriction specifically concerns debit of the affected amount.
  5. File the appeal correctly. Use GST APL-01 for the Appellate Authority appeal under the current rules and retain the acknowledgement, grounds of appeal, order, payment proof and annexures.
  6. Review the Rule 86A record. Check whether the portal communication identifies the officer, date, amount, written reasons and rule ground. Compare the blocked amount with the specific credit said to be ineligible or fraudulent.
  7. Submit evidence for release where appropriate. Organise invoices, e-way bills, goods-receipt or service records, payment trails, supplier correspondence, return reconciliations and proof of tax treatment. Ask the competent authority to examine whether the conditions still exist; do not describe the request as payment of the appeal pre-deposit.
  8. Plan liquidity separately. If blocked credit cannot be debited, model the permitted cash payment or other lawful funding needed for current liabilities. A section 107 stay of recovery does not necessarily restore day-to-day access to the ledger.
  9. Escalate legal questions on the actual record. The appropriate representation, review or court remedy can depend on jurisdiction, the order, the officer’s authority, amendments and later judgments. Obtain advice on the current law rather than assuming that a general Rule 86A argument will succeed.

Common scenarios and the correct reading

Scenario Correct analysis
An order demands tax and the taxpayer wants to appeal. Calculate the section 107 admitted amount and 10% disputed-tax component, observe the filing period and submit the appeal in GST APL-01.
The taxpayer has paid the section 107 amount but the ledger still shows a Rule 86A block. That result is not inconsistent with the cited sources. The payment satisfies the appeal condition and triggers the recovery stay; it does not automatically release the separate ledger restriction.
The ledger is blocked but no section 107 appeal has been filed. The Rule 86A action does not itself create an appeal or satisfy an appeal pre-deposit. Review the underlying order and any applicable appeal deadline independently.
The block is larger than the credit identified in the officer’s reasons. Compare the amount with the rule record and CBIC proportionality guidance. Seek clarification or release through the competent channel and preserve evidence of the discrepancy.
The one-year period is approaching. Record the imposition date, monitor whether the restriction ceases and request administrative confirmation if the portal does not update. Earlier release may be sought if the conditions have already ended.
The taxpayer wants a refund of unutilised credit. Check whether the affected credit is under Rule 86A, because the restriction can prevent debit for a covered refund use. The refund question is separate from any appeal deposit.

Documents and checks before taking a position

For the section 107 appeal

  • The complete adjudication order and proof of the date it was communicated.
  • A reconciliation separating admitted tax, disputed tax, interest, penalty and other amounts.
  • The section 107(6) payment calculation and proof of payment.
  • GST APL-01 acknowledgement and the filed grounds and documents.
  • A calendar reminder for the appeal deadline and any hearing or deficiency communication.

For the Rule 86A restriction

  • The portal communication showing the restriction date, amount and officer details.
  • The written reasons and the particular Rule 86A ground cited.
  • Ledger extracts before and after the restriction.
  • Invoice, supplier, receipt, transport, payment and return records for the implicated ITC.
  • A calculation showing whether the blocked amount exceeds the credit identified as ineligible or fraudulent.
  • The one-year cessation date and evidence supporting any request for earlier release.

Pitfalls that can create avoidable exposure

Calling every payment a “pre-deposit”

A payment made against a demand, a voluntary payment, a reversal of ITC and the section 107 statutory amount can have different legal effects. Label the transaction by its statutory purpose and retain the relevant form or challan.

Assuming the 10% applies to the entire order

The section 107 percentage is tied to the remaining disputed tax. Including admitted tax, interest or penalty in the percentage calculation without checking the order can produce an incorrect amount.

Treating a ledger restriction as a final ITC reversal

Rule 86A restricts debit of the specified amount. It does not, by itself, establish every element of a final demand or replace the adjudication process. The taxpayer still needs to respond to the underlying proceedings and preserve substantive ITC evidence.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ignoring the communication date

Both appeal planning and Rule 86A monitoring depend on dates. Store the communication record, not just the date an employee first opened an email or saw a portal alert.

Waiting for the one-year expiry without documenting the case

Expiry is not a substitute for a reasoned response. Evidence that the relevant conditions no longer exist can support an earlier release request and may be important if the portal record remains inaccurate.

Central, State and Union Territory GST considerations

The comparison above is framed in the CGST context. State GST and Union Territory GST enactments, notifications, orders and portal workflows can also apply to a transaction or demand. Confirm whether the order is under CGST, SGST, UTGST or a combination, which authority issued it, and which appellate route is available. The wording of a state or Union Territory provision may track the CGST Act while still requiring a separate procedural check.

For a live dispute, verify amendments, the current appeal rules, portal instructions, the actual order and later judicial decisions. The materials supporting this comparison do not establish the current judicial position on every challenge to Rule 86A, so no outcome should be promised from the distinction alone.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Bottom-line decision rule

Use the section 107 framework when the immediate question is, “What must be paid to file a first GST appeal, and what recovery stay follows?” Use the Rule 86A framework when the question is, “Why can’t this amount in my electronic credit ledger be debited, and when should that restriction end?” If both questions arise, calculate and document them separately, meet the appeal deadline, and address the ledger restriction with evidence directed to the rule’s stated grounds and the officer’s recorded reasons.
