GST Annual Return Late Fees, Penalties and Consequences for Missing the GSTR-9 Deadline

If you miss the GST annual-return deadline, the general statutory late fee for GSTR-9 is ₹100 for each day of delay, capped at 0.25% of turnover in the relevant State or Union territory under section 47(2) of the CGST Act. That is only the default rule. A year-specific notification may extend the due date, waive the return for a class of taxpayers or prescribe a lower amount, so the liability shown for your financial year on the GST portal may differ.

The ordinary due date is 31 December following the end of the financial year. A covered taxpayer with aggregate turnover above ₹5 crore must also furnish a self-certified GSTR-9C reconciliation statement. Missing the return can lead to a section 46 notice and, eventually, a statutory three-year filing limit, but a missing GSTR-9 does not automatically trigger a best-judgment assessment under section 62.

The ordinary deadline—and who actually has to file

Rule 80 of the CGST Rules sets 31 December after the close of the financial year as the ordinary due date for GSTR-9. For example, a return for the financial year ending 31 March 2025 would ordinarily be due on 31 December 2025. The date is not immutable: the government can extend it or alter the filing requirement through a notification for a particular year or class of taxpayers.

GSTR-9 is the annual return for covered registered persons. Rule 80 excludes specified categories, including:

  • Input Service Distributors;
  • persons paying tax under section 51 (tax deducted at source) or section 52 (tax collected at source);
  • casual taxable persons; and
  • non-resident taxable persons.

Check your registration type and the notification for the financial year before treating a missed date as a default. An exemption for one year does not automatically continue into the next year.

A year-specific exemption can change the result

CBIC Notification No. 14/2024-Central Tax, dated 10 July 2024, exempted registered persons with aggregate turnover up to ₹2 crore from furnishing the annual return for FY 2023-24. That relief applies to the year and class described in the notification; it should not be carried forward to another financial year without checking the applicable notification.

What is the late fee for filing GSTR-9 late?

Section 47(2) provides the general calculation: ₹100 for every day the annual return remains unfiled, subject to a maximum of 0.25% of turnover in the relevant State or Union territory. The fee is a late fee, not a tax assessment and not, by itself, a separate penalty for fraud or wrongdoing.

Both parts of the formula matter. Count the days from the applicable due date (or an extended date) through the date the relevant return is furnished, then compare the result with the statutory cap. The cap is based on turnover in the State or Union territory, not automatically on all-India turnover.

Illustrative calculation under the general rule

Suppose a hypothetical taxpayer has ₹10 lakh of turnover in one State and files 40 days late. The daily calculation is ₹4,000 (40 × ₹100). The 0.25% cap for that State is ₹2,500 (₹10 lakh × 0.25%), so the general statutory maximum would limit the fee to ₹2,500. This example is only an application of the default formula; a notification or portal calculation for the relevant year can produce a different payable amount.

Why the amount on the portal may not equal ₹100 per day

Notifications can provide a waiver, an extended deadline or a concessional amount for a specified financial year, turnover band or taxpayer class. The available material does not establish one universal reduced slab that applies to every year. Before paying, verify the notification effective for your year and compare it with the liability displayed in the GST portal. Do not use a concessional figure from an older year as a current rule.

Is there a penalty for not filing the GST annual return?

Missing the deadline ordinarily creates the section 47(2) late fee described above. It is inaccurate to describe that fee as an automatic standalone penalty simply because 31 December passed. A separate penalty, interest or additional tax can arise only from separate facts and proceedings—for example, an annual reconciliation may disclose tax that was short-paid, unpaid, or input tax credit that was wrongly availed or utilised.

The annual-return late fee does not itself prove that tax is due. Conversely, filing GSTR-9 does not erase an underlying liability. If your reconciliation identifies an error, address the tax, interest and penalty provisions that apply to that error rather than adding those amounts automatically to the late fee.

What each key provision does

Provision Subject Practical effect
Section 44 of the CGST Act Annual-return obligation and filing limit Sets the annual-return framework and generally bars filing after three years from the due date unless later filing is permitted by notification.
Rule 80 of the CGST Rules Forms, due date and GSTR-9C threshold Provides the ordinary 31 December deadline, identifies excluded classes and requires GSTR-9C for covered persons above the ₹5 crore aggregate-turnover threshold.
Section 47(2) of the CGST Act Late fee ₹100 per day, subject to 0.25% of turnover in the relevant State or Union territory, unless a notification changes the amount or obligation.
Section 46 of the CGST Act Notice for a missing return Allows a notice requiring a person who failed to furnish a section 44 annual return to file within 15 days.
Section 62 of the CGST Act Best-judgment assessment Its stated notice-and-assessment mechanism concerns failures to file section 39 or section 45 returns; it is not an automatic assessment solely because GSTR-9 was missed.

Do I have to file GSTR-9C too?

Rule 80 requires a covered registered person whose aggregate turnover during the financial year exceeds ₹5 crore to furnish a self-certified reconciliation statement in GSTR-9C in addition to GSTR-9. Determine the threshold using the aggregate turnover rule for that financial year, then check whether a notification changes the requirement.

The GST portal’s FY 2024-25 FAQ describes late fee as applying to the complete annual return, including GSTR-9 and GSTR-9C where GSTR-9C is required. It describes the GSTR-9 component as running from the annual-return due date until GSTR-9 is filed. For GSTR-9C, it describes the period as beginning on the later of the GSTR-9 filing date or the applicable due date and ending when GSTR-9C is filed.

Common GSTR-9C timing cases

  • GSTR-9 and GSTR-9C both late: expect the portal to apply the applicable fee treatment to the complete annual return, with the form-specific dates used for each component.
  • GSTR-9 filed on time, GSTR-9C filed later: the GSTR-9C delay can still generate a fee from the relevant starting date until GSTR-9C is furnished.
  • GSTR-9C not required: there is no GSTR-9C filing or GSTR-9C delay to calculate.

Because the portal treatment and any concessions can change by year, review the current liability screen after selecting the correct financial year and registration details.

What happens after the deadline?

A late fee begins under the applicable rule

Once the due date has passed, the daily fee can accrue until the relevant annual-return filing is completed, subject to the statutory cap and any year-specific relief. An extension or waiver changes the starting point or amount; it does not merely postpone payment of an unchanged figure.

You may receive a notice giving 15 days

Section 46 allows the proper officer to issue a notice to a person who has failed to furnish a section 44 annual return. The notice requires filing within 15 days. Treat the notice as a statutory deadline of its own: file the outstanding return and respond through the channel and within the period stated in the notice.

The law has an outer filing limit

Section 44 generally says that an annual return may not be furnished after three years from its due date. The government can permit filing after that point for a person or class by notification and subject to conditions. Therefore, a return that is still visible on the portal today is not necessarily available indefinitely. If your three-year date is approaching or has passed, check for a specific enabling notification and obtain professional advice on the available route rather than assuming the portal will remain open.

Best-judgment assessment is not automatic for a missing GSTR-9

Section 62’s best-judgment assessment provision refers to a failure to furnish returns under section 39 or section 45 after notice. It should not be presented as an automatic assessment solely because a section 44 annual return was not filed. Other enforcement provisions can still apply where separate defaults exist.

Underlying discrepancies can create separate exposure

GSTR-9 compares the year’s declared transactions, tax paid and input tax credit. If that exercise reveals unpaid or short-paid tax, or ineligible credit that was availed or used, the department may pursue the corresponding tax, interest and penalty under the provisions applicable to those facts. Those amounts are not automatic additions to the section 47(2) late fee.

How to fix a missed GSTR-9 deadline

  1. Identify the financial year. Note the year-end, the ordinary 31 December date and any extension or special filing notification for that year.
  2. Confirm that GSTR-9 applies. Check whether your registration falls within an excluded class under rule 80 and whether a year-specific exemption covers you.
  3. Check the turnover tests. Determine aggregate turnover for the year and turnover in each relevant State or Union territory. If aggregate turnover exceeds ₹5 crore and you are a covered person, plan for GSTR-9C as well.
  4. Record the actual filing dates. Keep the date GSTR-9 was or will be filed and, where applicable, the date GSTR-9C was or will be completed. These dates affect the portal’s fee calculation.
  5. Reconcile before submitting. Compare sales, output tax, reverse-charge transactions, exempt and non-GST supplies, input tax credit and tax paid with the books and filed periodic returns. Resolve differences before treating the annual return as complete.
  6. Open the annual-return workspace for the correct year. Sign in to the GST portal, select the financial year and the annual-return service, and review the system-generated liability. Portal labels can change, so use the current annual-return and payment screens rather than an old screenshot or third-party guide.
  7. File GSTR-9 and pay the displayed amount. Submit the form only after checking the figures, then save the acknowledgement, payment reference and filed return.
  8. File GSTR-9C when required. Complete the reconciliation statement after GSTR-9 where the rules require it, pay any additional amount shown for the applicable delay and retain the filing proof.
  9. Deal with a notice separately. If section 46 notice has been issued, satisfy the 15-day requirement and keep evidence of filing and payment with the notice response.

How to determine which rule applies to your case

Two taxpayers who miss the same calendar date can owe different amounts. Compare these facts before calculating:

  • the financial year and any notified extension or waiver;
  • your registration category and any exclusion under rule 80;
  • aggregate turnover for the year;
  • turnover in each relevant State or Union territory for the statutory cap;
  • whether GSTR-9C is required;
  • the filing date of GSTR-9;
  • the filing date of GSTR-9C, if applicable; and
  • the notification-based concession, if any, that was effective for your class and year.

Use the general ₹100-per-day and 0.25%-cap figures as a legal starting point, not as a promise of the final amount. The notification and the portal’s year-specific computation control the payment you actually make.

Common mistakes that increase risk

  • Using 31 December without checking notifications: an extension or exemption can change both the filing obligation and the first day of delay.
  • Applying an old concession to a new year: the FY 2023-24 exemption for turnover up to ₹2 crore does not establish relief for another year.
  • Ignoring GSTR-9C: filing GSTR-9 does not complete the annual-return requirement when rule 80 requires the reconciliation statement.
  • Calculating the cap on all-India turnover: section 47(2) refers to turnover in the relevant State or Union territory.
  • Calling every consequence a penalty: late fee, tax, interest and penalty arise under different provisions and on different facts.
  • Assuming a missing GSTR-9 automatically triggers section 62: the best-judgment provision cited there concerns section 39 or section 45 returns after notice.
  • Waiting until the three-year point: section 44 generally limits filing after three years unless a later-filing notification applies.

Can I file GSTR-9 after three years?

Usually, section 44 prevents furnishing the annual return after three years from its due date. The government may, however, issue a notification permitting later filing for a specified person or class and on stated conditions. Check the notification position for the exact financial year and registration before relying on a late filing route. If no permission applies, a portal error or an expired statutory window may require specialist advice and correspondence with the jurisdictional authority; do not assume that payment of a late fee alone revives the filing right.
