Yes—Google really sued SerpApi. Google LLC filed Google LLC v. SerpApi, LLC in the U.S. District Court for the Northern District of California on December 19, 2025, accusing the search-data company of bypassing Google’s anti-automation system and reselling search-result data.
But the July 20, 2026 ruling was not a blanket ruling that scraping is legal. Chief Judge Yvonne Gonzalez Rogers dismissed Google’s two Digital Millennium Copyright Act (DMCA) claims. Claims involving search results without copyrighted content were dismissed without permission to amend; claims involving copyrighted or licensed material were dismissed with leave to amend.

What is SerpApi?
SerpApi sells programmatic access to search-engine results. Instead of manually viewing a search page, customers such as SEO platforms, researchers, developers, AI companies and businesses can request structured data about rankings, links, snippets and other search features.

What Google alleged
According to Google’s public account and complaint, SerpApi circumvented a Google anti-automation system called SearchGuard. Google alleged that SerpApi used large bot networks, rotated or disguised crawler identities, presented automated requests as ordinary browser traffic and reused successful challenge responses.
Google also alleged that SerpApi retrieved and resold search-result material that included content Google licensed from third parties. These remain allegations, not final factual findings. Google described the lawsuit and its claims in its announcement of the case.

Why Google used the DMCA
The DMCA’s anti-circumvention provisions address more than ordinary copying. Section 1201 generally prohibits bypassing a technological measure that effectively controls access to a copyrighted work. It also addresses trafficking in tools or services primarily designed or marketed for that circumvention.
Google’s theory was therefore not simply that SerpApi copied a Google page. Google argued that SerpApi bypassed a technological access control and then commercialized the resulting access.
That distinction matters:
- Copyright infringement generally concerns unauthorized copying, distribution or display of protected expression.
- Anti-circumvention concerns bypassing a qualifying technological measure controlling access to a copyrighted work, or providing tools for that bypass.
Google’s complaint is available through a publicly posted copy at this document link.
What SerpApi argued
SerpApi’s motion to dismiss argued that Google was trying to turn the DMCA into a general anti-scraping law. Its arguments included:
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- Google does not own the copyright in much of the material displayed in search results.
- Search results are publicly viewable by human users.
- Mimicking a browser or solving a JavaScript challenge is not automatically circumvention under the statute.
- Google should not gain control over publicly accessible information through copyright law.
SerpApi’s public explanation of its position is available here. Those were litigation arguments, and the judge did not accept every categorical version of them.
What the judge decided
The ruling drew a content-by-content distinction rather than treating every search result the same way.
| Issue | Result |
|---|---|
| Search output without copyrighted content | DMCA claims dismissed without leave to amend. |
| Results containing copyrighted or licensed material | Claims dismissed with leave to amend. |
| Alleged circumvention | Google’s allegations were sufficient at the pleading stage to support an inference that circumvention may have occurred. |
| SerpApi’s categorical objection to Google suing | Rejected; the court did not hold that Google could never bring the claims. |
| Discovery | Stayed while amendment and related motion practice were addressed. |
For ordinary search output containing links, facts or other material without a protected work, the court concluded that SearchGuard could not qualify as a technological measure controlling access to a copyrighted work in the way required by Section 1201.
Rank #3
The analysis was different where results could include copyrighted material, such as potentially licensed images in Knowledge Panels. Google had not adequately alleged that SearchGuard operated with authorization from the relevant copyright owners, but the court gave Google 21 days to try to amend that theory.
In short, SerpApi obtained a significant dismissal, but not a final ruling that every aspect of its service was lawful.
Does this mean scraping is legal?
No. The decision was narrow and concerned Google’s DMCA pleading. It did not create a universal license to scrape websites or search engines.
The ruling did not resolve potential claims involving:
- Website terms of service or contract
- Computer-access laws
- State-law theories
- Trade secrets
- Privacy and data-protection rules
- Copyright claims involving protected expression
- Claims by the owners of underlying content
- Credential misuse, CAPTCHA circumvention or other forms of unauthorized access
A page can be visible to human users while automated collection still raises contractual, technical or legal questions. Public visibility alone does not answer every issue.

A search page may combine links, titles, facts, snippets, structured data, images, maps information, shopping listings and Knowledge Panel material. A tool collecting only rankings and links presents a different legal and operational profile from one returning image thumbnails, original text, prices or licensed data.
The same vendor may therefore face different questions depending on:
- What content it collects
- How it accesses that content
- Whether it bypasses a technical measure
- Who owns or licenses the material
- How customers use the output
What this means for SERP-data buyers
Companies evaluating a search-result API should not treat this ruling as a guarantee that any provider is legally safe. Before signing up, review:
- Data scope: Does the service return rankings and links, or also images, snippets, shopping data, maps and Knowledge Panels?
- Collection model: Does the provider explain its access methods and compliance policies?
- Contract protections: Check indemnity limits, complaint handling, takedown procedures and customer responsibilities.
- Continuity: Ask what happens if a search engine changes its anti-bot systems or the provider becomes unavailable.
- Pricing: Check whether charges vary by geography, device, proxy use, challenge handling, result type, latency or volume.
- Portability: Confirm that results can be exported and that switching providers will not disrupt the business.
SerpApi may reduce the engineering burden of proxies, browser rendering, geographic targeting and result parsing. But the lawsuit shows why lower development effort does not eliminate legal, contractual or continuity risk.

Official APIs
Google’s developer ecosystem is documented at developers.google.com. Official products may offer a clearer compliance framework, but they are not necessarily interchangeable with a complete consumer Google results page. Coverage can vary by product, geography, query type and result feature.

Other SERP providers
Companies may compare providers such as DataForSEO, Bright Data’s SERP API or ScraperAPI. Switching vendors does not remove the underlying questions about access methods, search-engine rules, copyrighted content or permitted use.
In-house collection
Building internally provides control over scheduling, parsing, retention and security. It also transfers the burden of infrastructure, proxy management, anti-bot changes, compliance analysis and maintenance to the buyer.
Licensed feeds
For product data, prices, local listings or market intelligence, a direct license or partner feed may provide clearer provenance and permitted-use terms. It may cost more and offer less flexibility, but it can reduce dependence on search-page collection.
Is the lawsuit over?
It is too broad to describe the litigation as completely over based on the July ruling alone. The claims involving ordinary results were dismissed without leave to amend. Google was permitted to amend the claims involving copyrighted or licensed material, and the court stayed discovery during that process.
The ruling was a motion-to-dismiss decision, not a trial verdict. It did not decide whether SerpApi actually used every method Google alleged, whether Google suffered all claimed losses, or whether any separate legal theory succeeds. It also does not decide the separate litigation brought by Reddit against SerpApi and other defendants; that is a different case and legal posture. Background on that proceeding is available from The Associated Press.
The bottom line for readers
Google did sue SerpApi over alleged circumvention of SearchGuard and the resale of search-result data. On July 20, 2026, SerpApi won dismissal of Google’s DMCA claims, but the result was split: claims involving search output without copyrighted content ended, while claims involving copyrighted material could be repleaded.
The practical lesson is not that scraping is now risk-free. It is that DMCA Section 1201 may not support a claim based solely on blocking automated access to uncopyrighted search output. Businesses buying or building search-data infrastructure should still assess content type, collection methods, contracts, data provenance, operating costs and backup options.
