Form 161 is now the prescribed application for seeking waiver of penalty under section 440(2) of the Income-tax Act, 2025. The revised form was substituted by CBDT Notification No. 134/2026, dated 8 October 2026, under the Income-tax (Sixth Amendment) Rules, 2026. It is intended for an assessee whose assessment or reassessment and penalty circumstances fall within section 440, who pays the required tax, interest and additional income-tax within the demand deadline, and who has not appealed the relevant orders.

The filing deadline is a separate clock: the application must be made within one month from the end of the month in which the relevant order is received. Because the revised form asks for order, service, demand and challan details, preserve those records before deciding whether to apply.

What Form 161 does under the 2026 rules

Rule 231 of the Income-tax Rules, 2026 now covers an application for “waiver” as well as the earlier wording associated with immunity. Notification No. 134/2026 substituted Form 161 with the title: “Application for seeking waiver of penalty under section 440(2) of the Income-tax Act, 2025.” The notification came into force on publication on 8 October 2026.

This is not a general request to cancel any tax penalty. It is a statutory route tied to section 440. The applicant must first establish that the assessment or reassessment order, the penalty circumstances and the payment conditions fit that section. The form then records the computation and the declarations needed for the waiver request.

The revised form should be read with the current enacted section 440 and the notification, rather than with older descriptions that call Form 161 an immunity application. The Income Tax Department’s older FAQ and guidance remain useful for seeing the historical questions taxpayers ask, but they do not describe the revised form’s additional-income-tax calculations and waiver language.

Who should use Form 161?

Use Form 161 only after checking every part of the statutory route. The following checklist is a practical screening tool; the exact legal position comes from the assessment or reassessment order, penalty order and current section 440 text.

  • There is a relevant assessment or reassessment order. The form requires the tax year, statutory section, Document Identification Number (DIN), order date and service date.
  • The penalty circumstances fall within section 440. A routine disagreement with a penalty, or a penalty outside the specified statutory categories, does not automatically qualify.
  • The required tax and interest can be paid. Section 440’s payment condition refers to payment within the period stated in the notice of demand.
  • The required additional income-tax can be paid. This amount is paid in lieu of the specified penalty and is calculated by the category set out in the law and form.
  • No appeal has been filed against the relevant order. The form’s verification expressly states: “I further declare that no appeal has been filed in respect of the order mentioned in Part-B above.”
  • The application is still within time. The one-month period is calculated from the end of the month in which the relevant order was received, not as a simple 30-day period.

If any item is uncertain, do not treat filing the form as a way to cure the uncertainty. First reconcile the order, demand notice, penalty category and appeal record with the current section 440 and Rule 231.

How the payment condition works

Section 440 links waiver to payment of the tax and interest demanded within the notice-of-demand period, plus additional income-tax in lieu of the specified penalty. The revised form separates the underlying figures so that the department can test the calculation.

Form or statutory item What it represents Important qualification
Tax and interest Amounts arising from the relevant assessment or reassessment Payment must be made within the due period stated in the notice of demand.
Additional income-tax, line 14(i) 100% of the tax payable on the relevant under-reported income for the first listed statutory category The category must be confirmed from the order and current law; 100% is a prescribed computation, not a general tax rate.
Additional income-tax, line 14(ii) 120% of the tax payable on the relevant under-reported income for the category identified with section 439(11)(g) The 120% figure applies only where that statutory category is established.
Total amount payable The form’s combined amount for the waiver route The notification’s note ties payment to the notice-of-demand due date.

The percentages are legal computation figures prescribed in Notification No. 134/2026, not rates that can be applied to every penalty. The order must show, or support, the relevant under-reported-income category. If the order uses different terminology, compare it with the consolidated section 440 and the provision cited for the penalty before entering a figure.

The form distinguishes under-reported income in the specified misreporting categories from under-reported income that is not in consequence of misreporting. Do not combine those amounts merely because they appear in the same order. The tax attributable to each category is needed for the correct line 14 calculation.

Two different deadlines: payment and filing

Form 161 creates two deadlines that are easy to confuse.

Clock How it is calculated What to check
Payment clock By the due date in the notice of demand Confirm the demand notice, amount payable and challan date. The revised form asks for payment details.
Application clock Within one month from the end of the month in which the relevant order is received Identify the actual receipt or service month and count from that month-end; this is not simply 30 days from the order date.

Example of the month-end rule

If the relevant order is received on 17 November, the triggering month ends on 30 November. The one-month period runs from that month-end, so the practical deadline falls in December, subject to the exact statutory counting rule and any applicable holiday or portal rule. If an order is received in January, the period runs from the end of January into February; use the applicable calendar and leap-year date when checking the final day.

The date printed on an order and the date it was served may differ. Form 161 asks for both, so retain the email, portal record, physical delivery proof or other evidence that establishes when the order was received.

What information the revised form asks for

Part A identifies the applicant. Part B records the order, demand, income and payment information. Prepare the following before opening the filing utility:

  • Name, PAN, address, mobile number and email address.
  • Tax year and the statutory section involved.
  • Document Identification Number of the assessment or reassessment order.
  • Date of the order and date on which it was served or received.
  • Due date shown in the notice of demand.
  • Assessed income and the amount of under-reported income, split between the listed misreporting categories and the amount not in consequence of misreporting.
  • Tax and interest figures used in the demand.
  • Additional-income-tax calculations for the applicable category or categories.
  • Total amount payable under the waiver route.
  • Payment or challan details, including BSR code, deposit date, challan serial number and amount.

Some values may be prefilled. Treat prefilled data as a starting point, not as proof that the correct order or category has been selected. The form says amounts are to be stated in rupees unless otherwise specified.

How to prepare and submit an application

The department’s older explanatory material describes Form 161 as an online filing. Because the form was substituted in October 2026, the exact current e-Filing portal route and utility should be confirmed on the live portal before submission. The following sequence avoids the most common preparation errors without assuming an unverified menu label.

  1. Obtain the controlling documents. Download the assessment or reassessment order, the related penalty order if separate, the notice of demand and proof of service or receipt.
  2. Identify the statutory route. Check the sections cited in the order and determine whether the circumstances fall within section 440 and the penalty category referenced by the revised form.
  3. Build a date sheet. Record the order date, service or receipt date, demand due date, payment date and the month-end-based Form 161 deadline.
  4. Check appeals. Search the taxpayer’s records and portal history for any appeal against the relevant assessment, reassessment or penalty order. The verification requires a no-appeal declaration and also contains an undertaking connected with the period specified in section 440(5).
  5. Recalculate the amounts. Separate tax, interest and each type of under-reported income. Apply the 100% or 120% additional-income-tax computation only to the statutory category that actually applies.
  6. Make the required payment. Pay within the notice-of-demand deadline and keep the bank or tax-payment confirmation. A late payment can defeat the statutory condition even if the Form 161 filing window remains open.
  7. Enter Part A and Part B. Compare every prefilled field with the order and demand notice. Enter the DIN, dates, income figures, tax, interest, additional income-tax, total and challan references exactly as supported by the records.
  8. Complete the verification carefully. Confirm the no-appeal statement and the undertaking required by section 440(5). Do not submit a declaration that is inconsistent with a pending or previously filed appeal.
  9. Submit through the current prescribed utility. Follow the portal’s live instructions for authentication, attachments or electronic verification. Save the acknowledgment, submitted form and payment evidence together.

If the portal displays a different form version, calculation field or validation message from the Gazette form, stop and confirm that the utility is the current one before changing the legal calculation to fit the software.

Can Form 161 be filed after an appeal?

The revised form is built around a no-appeal condition. Its verification says that no appeal has been filed in respect of the order identified in Part B, and it includes an undertaking not to file an appeal before the period specified in section 440(5) expires. Therefore, a taxpayer who has already appealed the relevant assessment, reassessment or penalty order should not assume that Form 161 remains available.

Do not withdraw or abandon an appeal solely to pursue the waiver without obtaining advice on the legal effect. The consequences depend on which order was appealed, when the appeal was filed, whether the appeal covers the penalty or the underlying assessment, and what section 440(5) requires in the particular case.

Why older online explanations can be misleading

Older Income Tax Department FAQ and guidance pages describe Form 161 as optional and frame it as an application for immunity from penalty and prosecution. They also describe full payment of tax and interest, no appeal and a one-month-from-month-end filing period. Those pages predate the 8 October 2026 substitution.

The revised form changes the description to waiver of penalty and adds the additional-income-tax calculations. It is unsafe to combine the older immunity explanation with the new form as though they were one unchanged procedure. For a current application, give priority to Notification No. 134/2026, the Gazette form and the consolidated section 440 text in force for the relevant assessment.

Common mistakes and how to correct them

Counting 30 days from the order date

This can produce an early or late deadline. Recalculate from the end of the month in which the order was received, then verify the result against the current statutory text and portal instructions.

Using the order date instead of the receipt date

Keep evidence of service. If the order was generated on one date and delivered through the portal or another channel later, the relevant month may be different.

Paying tax and interest but omitting additional income-tax

The revised route can require the additional amount in lieu of the specified penalty. Reconcile lines 14(i) and 14(ii), the under-reported-income split and the total before payment.

Applying 120% automatically

The 120% computation is tied to the category identified with section 439(11)(g). It is not a universal surcharge on every Form 161 application.

Ignoring a separate penalty order

Check whether the assessment or reassessment order and penalty order are separate documents. The no-appeal declaration must correspond to the relevant order or orders covered by section 440.

Relying on a prefilled value without checking it

Compare PAN, DIN, dates, income, demand and challan fields with the source documents. Correct a mismatch through the prescribed portal process before submission.

Submitting after payment but losing the evidence

Keep the demand notice, payment confirmation, challan details, submitted form and acknowledgment in one case file. These records establish both eligibility and the timing of the application.

When professional advice is sensible

Case-specific advice is particularly important when the order contains more than one under-reported-income category, when section 439(11)(g) may apply, when an appeal has been filed or withdrawn, when service of the order is disputed, or when the demand due date has passed. A chartered accountant or other qualified Indian tax professional can reconcile the order, computation, payment and appeal consequences. Verify the adviser’s credentials and current availability independently; Form 161 is a legal filing, not a form where a generic template can safely replace statutory analysis.

Practical decision checklist

  • Is the current document the Form 161 substituted on 8 October 2026?
  • Does the order and penalty situation fall within section 440(2)?
  • What is the exact notice-of-demand payment due date?
  • What date proves receipt or service, and what month-end follows it?
  • Which under-reported-income category applies?
  • Does the calculation require 100% of line 14(i), 120% of line 14(ii), or another amount established by the current form and law?
  • Has any appeal been filed against the relevant assessment, reassessment or penalty order?
  • Are the DIN, dates, demand, tax, interest and challan references supported by documents?
  • Has the current portal utility been confirmed rather than copied from an older FAQ?

Form 161 is therefore a time-sensitive waiver application, not a routine penalty response. The safest approach is to establish the statutory category first, pay every amount required by the demand deadline, calculate the month-end filing limit from documented receipt, and submit only with a truthful no-appeal declaration and complete payment records.
