Form 161 under India’s Income-tax Act, 2025: filing, deadlines, corrections and records to keep (2026 guide)

Form 161 is India’s section 440(2) application for seeking a waiver of penalty. The Central Board of Direct Taxes (CBDT) substituted the form on 8 October 2026. Earlier Income Tax Department guidance described a closely related application for immunity from penalty and prosecution. Because the replacement form is new, confirm its deadline, filing screen and processing instructions in the current e-Filing portal before submitting.

The earlier official FAQ says an eligible taxpayer must have received an assessment or reassessment order, paid the full tax and interest demand, filed no appeal, and undertaken not to appeal during the period specified in section 440(5). It also says the application is optional, must be filed online, and is not automatically accepted merely because it was submitted.

What Form 161 is now

Form 161 is the application made under section 440(2) of the Income-tax Act, 2025. The 8 October 2026 amendment replaced the earlier version with a form titled Application for seeking waiver of penalty under section 440(2). Older Department FAQs and guidance use the language of “immunity from penalty and prosecution,” so a page or PDF using that wording may describe the previous form rather than the current one.

The application follows an assessment or reassessment order. It is a request for the statutory waiver route, not an appeal against the order and not an automatic cancellation of the demand. The Assessing Officer examines whether the statutory conditions are met and communicates an outcome. Filing therefore preserves neither a guaranteed waiver nor a guaranteed result.

This article concerns the Indian income-tax form under section 440(2). Other government or legal forms numbered 161 are unrelated.

Who may use it

The earlier Department FAQ identifies individuals, companies, limited liability partnerships and trusts as possible applicants, provided they satisfy the conditions. The revised form’s verification continues to require a declaration that no appeal has been filed and an undertaking not to file one before the section 440(5) period expires. Check the current instructions for your taxpayer type before relying on the older FAQ.

Eligibility conditions to check before filing

Use this checklist before opening the form. If any item is uncertain, obtain current professional advice before choosing the waiver route.

1. You have the relevant order

You must have received an assessment or reassessment order to which the application relates. Keep both the order and proof of when it was served. The revised form expressly asks for the tax year, the section under which the order was made, its Document Identification Number (DIN), the order date and the service date.

2. The demand has been paid in full

The earlier official guidance requires payment of the full tax and interest shown in the notice of demand. Partial payment does not satisfy that earlier condition. Reconcile the demand, interest calculation and every payment before filing; do not treat a payment plan, an unallocated challan or a disputed amount as proof of full payment without confirming how the Department has credited it.

3. No appeal has been filed

The earlier FAQ says Form 161 cannot be filed after an appeal against the order. The substituted form repeats the no-appeal declaration and asks the applicant to undertake not to appeal before the period in section 440(5) expires. This is a significant rights decision: filing the application is not a way to keep an appeal open while waiting for a waiver.

4. The application is otherwise eligible under current law

The Department’s older material refers to the prescribed conditions in section 440 and Rule 231. The October 2026 substitution does not, by itself, establish that every operational detail in the older FAQ remains unchanged. Check the current form notes and any updated departmental instructions for exclusions, calculations and deadlines.

What is the Form 161 deadline?

The earlier Income Tax Department FAQ states that the application must be filed within one month from the end of the month in which the assessment or reassessment order is received. For example, under that earlier wording, an order received on 12 March would produce a one-month period counted from the end of March.

That timing should not be treated as confirmed for every filing made after 8 October 2026. The CBDT substituted Form 161 on that date, and the amendment text available with the notification does not restate the earlier FAQ’s deadline or expressly say that the FAQ remains current. Before relying on the one-month rule, check the current Form 161 instructions displayed by the e-Filing portal or obtain confirmation from the Income Tax Department. Record the service date and the source of the deadline you used.

How the filing route works

The older official instructions describe an online process only; they do not provide an offline filing route. The current portal announcement confirms the revised form notification but does not, on its own, publish a complete revised click path. Use the following as the earlier route, and stop if the current portal labels differ.

  1. Prepare the order and payment data. Have the assessment or reassessment order, demand notice, payment challans or receipts, PAN details and your calculations ready.
  2. Sign in to the Income Tax e-Filing portal. Use the taxpayer account or authorised representative account applicable to the case.
  3. Open the forms area. Earlier guidance directed users to the income-tax forms service and selection of Form 161. Select the current section 440(2) waiver form, not an older downloaded copy.
  4. Enter order and demand information. Transcribe the tax year, order section, DIN, order and service dates, demand due date, assessed income and the relevant under-reported-income figures from the order and computation.
  5. Enter each payment. Add the BSR code, challan serial number, payment date and amount for every challan requested by the form. Check that the total agrees with the demand and the form’s calculation.
  6. Complete the verification. Confirm the no-appeal statement and the undertaking relating to section 440(5), then submit using the portal’s current verification method.
  7. Save the acknowledgement. Earlier guidance says system validation generated an acknowledgement number. Download or print the submitted form and acknowledgement immediately.

Do not assume that a successful upload means the waiver has been granted. Earlier guidance says the Assessing Officer examines eligibility after system validation.

Information and records to assemble

The revised form expands or expressly lists several fields. Prepare the source documents first so that transcription errors do not create an avoidable mismatch.

Record or field What to capture Why it matters
Assessment or reassessment order Tax year, statutory section, DIN, order date and service date Identifies the order and establishes the relevant receipt date
Notice of demand Tax and interest amounts, demand payment due date and the accompanying computation Supports the amount that had to be paid
Income figures Assessed income, under-reported-income categories and tax payable on that income Feeds the revised form’s penalty-waiver calculation
Payment evidence BSR code, challan serial number, payment date and amount for each challan Allows the Department to match payments to the demand
Taxpayer identification PAN and the applicant’s legal name and contact details Prevents identity and account mismatches
Submission file Completed form, acknowledgement number and any portal confirmation Creates an audit trail for status enquiries or later disputes

The revised form states that amounts are in Indian rupees unless otherwise specified. Retain the original order, demand notice, detailed computation, bank or tax-payment receipts, PAN record, submitted form and acknowledgement for the period required under your tax-record obligations.

Payment details, additional tax and partial-payment risk

Do not enter only the grand total when the form requests challan-level data. Match every payment to its BSR code, challan serial number, date and amount, and retain evidence showing the payment was actually made and credited. If the demand notice contains interest or an additional amount payable in lieu of penalty, include the figures required by the revised form rather than substituting a rounded estimate.

The substituted form expressly includes the total amount payable for waiver of penalty and an instruction tied to payment by the due date in the notice of demand. That wording makes the demand notice and its due date essential records. If the account reflects only part-payment, an uncredited challan or a payment made after the relevant due date, obtain clarification before submitting; the earlier FAQ says partial payment was insufficient.

Form 161 or an appeal: the decision to make first

The waiver application and an appeal serve different purposes. Compare them before filing because the no-appeal declaration affects your future options.

There is no official acceptance-rate, processing-time or outcome statistic in the available form materials. If the disputed tax, under-reported-income calculation or lost appeal right is material, have an Indian chartered accountant or tax lawyer review both routes before you sign the declaration.

What happens after submission?

Earlier Department guidance says system validation generates an acknowledgement, the Assessing Officer examines eligibility and the decision is communicated electronically. It also says status can be viewed under e-File → Income Tax Forms → View Filed Forms. The current revised-form announcement does not independently confirm that every label or processing step is unchanged. Save the acknowledgement and use the current portal’s status function if it displays a different menu.

An acknowledgement proves submission, not approval. Keep checking the portal for a communication and preserve copies of any acceptance, rejection or request for information.

Can you correct Form 161 after submitting it?

No correction, withdrawal or revised-filing procedure is established in the official materials identified for the revised form. The older FAQ explains acknowledgement and status tracking but does not explain how to amend a submitted application. Do not assume that a second submission, an informal email or a portal “revise” button will replace the first form.

If you discover an error, record the acknowledgement number and the exact field affected, then consult the current e-Filing portal help for Form 161 or contact the Income Tax Department through its published support channels. Ask specifically whether a correction, withdrawal or resubmission facility exists for the revised section 440(2) form, and retain the response. If the error concerns payment, an order DIN, the service date or the no-appeal declaration, seek professional advice before taking any further step.

Common mistakes to avoid

  • Using an old Form 161 labelled for immunity from penalty and prosecution instead of the October 2026 waiver form.
  • Counting the deadline from the order date rather than checking the earlier FAQ’s “end of the month of receipt” wording and then confirming the post-substitution rule.
  • Submitting with only part of the tax and interest demand paid.
  • Entering one combined payment figure when the form requires separate BSR and challan details.
  • Filing after an appeal or signing the no-appeal undertaking without understanding its effect.
  • Deleting the demand notice, payment receipts, submitted form or acknowledgement after upload.
  • Treating portal validation or an acknowledgement number as a grant of waiver.

A practical pre-submission checklist

  • Confirm that the form is the current section 440(2) version notified on 8 October 2026.
  • Verify the taxpayer type, PAN, tax year, order section, DIN, order date and service date.
  • Reconcile the notice of demand, interest and the amount payable for waiver of penalty.
  • Confirm how every payment was credited and collect BSR codes, challan serial numbers, dates and amounts.
  • Check whether an appeal has already been filed and understand the undertaking under section 440(5).
  • Confirm the filing deadline in current official instructions rather than relying automatically on the older FAQ.
  • Save the final form, acknowledgement number and all supporting records.

These checks address the facts established in the Department’s earlier FAQ and guidance and the fields expressly listed in the substituted form. Where the 2026 form instructions differ, follow the current official instruction displayed for your filing.
