Start with the penalty, tax period, return type and notice. If the return is in the IRS’s 2026 transition group and your account shows the required history of timely filing and payment, First Time Abate (FTA) may be the appropriate request. If your return is eligible for the IRS’s new automatic penalty elimination process (AEP), the relief should be applied during processing without a separate request. If you do not qualify through your compliance history, or the penalty is outside the applicable automatic or FTA rules, reasonable cause may be the stronger route when documented circumstances prevented timely compliance despite ordinary business care and prudence.
These are not simply two labels to choose at random. FTA is an administrative waiver based mainly on your IRS account history; reasonable cause is a fact-specific explanation supported by evidence. The notice controls the practical next step, and the IRS may apply FTA when a taxpayer asks for reasonable-cause relief but the account actually qualifies for FTA.

The short answer: check AEP first, then FTA, then reasonable cause
The IRS is phasing in AEP during 2026 for eligible original returns. AEP is automatic: the IRS checks the return and account while processing and sends a notice if it applies. It prevents assessment of specified failure-to-file, failure-to-pay and failure-to-deposit penalties, but it does not cover every penalty and does not erase the underlying tax.

Under the IRS’s 2026 guidance, FTA can still apply to eligible 2024 tax-year returns, 2025 quarterly returns, prior eligible returns, and certain eligible 2025 tax-year and 2026 quarterly original returns processed before AEP began and not considered for AEP. The IRS says FTA will no longer be available for original returns with due dates on or after January 1, 2027.

Reasonable cause is separate. You must show that circumstances beyond your control prevented timely filing, payment or deposit even though you exercised ordinary business care and prudence. A clean compliance history can help your overall case, but it is not the legal test for reasonable cause.
What changed in 2026: AEP and the end of new FTA eligibility
How AEP works
AEP begins in summer 2026 and is applied during processing of an eligible original return. The qualifying history generally is timely filing and payment for the prior three years. For quarterly filers, the IRS uses 12 consecutive quarters. Eligible return series identified by the IRS include Forms 1040, 1065, 1120, 940, 941, 943, 944, 945 and CT-1.
AEP is limited to the penalties and return situations specified by the IRS. It does not automatically eliminate every civil penalty, and it does not forgive the tax shown on the return. Not every return, penalty or account qualifies, so compare the notice with the current IRS rules for your return series.

The transition rules preserve FTA for the eligible periods listed by the IRS. That includes eligible 2024 annual returns and 2025 quarterly returns, as well as prior eligible returns. Some eligible 2025 annual and 2026 quarterly original returns may also remain in the FTA pool when they were processed before AEP started and were not considered for AEP.
For original returns with due dates on or after January 1, 2027, the IRS states that FTA will be replaced by AEP. That statement concerns the original-return relief program; it does not mean every penalty on every return will disappear automatically.

FTA and reasonable cause compared
| Question | First Time Abate (FTA) | Reasonable cause |
|---|---|---|
| Eligibility basis | Account history showing timely filing and payment, plus the IRS’s other FTA criteria | Facts showing that circumstances prevented compliance despite ordinary business care and prudence |
| Who initiates it | The taxpayer requests it for returns that remain in the FTA transition rules | The taxpayer explains the circumstances and requests relief; some requests can begin by phone |
| Records normally used | The IRS reviews its account history; supporting documents are generally not required just to make an FTA request | Evidence of the event, its dates, its effect on compliance and the taxpayer’s efforts to comply |
| Scope | Only eligible penalties, returns and taxpayers under the FTA rules | Depends on the penalty type and the facts; the same event does not guarantee relief |
| If the request is denied | Review the notice and any denial explanation; correct account errors or pursue available appeal rights | Review the denial letter and generally request an Independent Office of Appeals conference or hearing within the deadline stated in the letter |
The IRS says that a taxpayer who asks for reasonable-cause relief but qualifies for FTA will have FTA applied. You therefore do not necessarily have to treat the grounds as mutually exclusive. Give an accurate explanation, identify the penalty, and allow the IRS to check the account history.
Use this decision process before contacting the IRS
- Read the notice completely. Identify the form, tax period, penalty code or description, amount, payment status and response deadline. Follow the phone number, mailing address and response method printed on that notice.
- Check whether the notice reflects the correct facts. Confirm that the return was filed, the tax was paid or deposited, and the dates shown by the IRS match your records. An incorrect underlying assessment may need correction rather than abatement.
- Ask whether AEP should have applied. For an eligible original return processed during the 2026 phase-in, AEP is automatic. If an eligible notice still shows a specified penalty, contact the IRS using the notice instructions and ask for the account to be reviewed.
- Test the FTA history. For the transition-period returns, review whether the required prior three years of timely filing and payment are present. Quarterly filers should consider the IRS’s 12-consecutive-quarter standard. Businesses may have additional FTA conditions.
- Identify the penalty type. FTA and AEP do not cover every penalty. A failure-to-file, failure-to-pay or failure-to-deposit penalty may be treated differently from an accuracy-related penalty or another civil penalty.
- Document reasonable cause if history or scope does not fit. Build a timeline showing what happened, when it happened, why it prevented compliance and what you did before and after the deadline.
- Choose the response method shown on the notice. Some cases can be handled by telephone. If the IRS cannot approve relief by phone, use a written request such as Form 843 when the current instructions direct you to do so.
How to request First Time Abate
Confirm that the return is in the FTA transition window
FTA is request-based for the returns that remain eligible during the transition. The IRS’s 2026 guidance covers eligible 2024 annual returns, 2025 quarterly returns, prior eligible returns and certain eligible 2025 annual and 2026 quarterly original returns that were processed before AEP began and were not considered for AEP. If the original return’s due date is on or after January 1, 2027, the IRS says FTA is no longer available for that original return.
Check the compliance history
The IRS describes FTA as its most common administrative waiver for taxpayers with a history of timely compliance. The relevant history is generally three prior years of timely filing and payment; quarterly filers use 12 consecutive quarters. The account also must satisfy the other FTA conditions for the return and taxpayer. Do not assume that one timely return, a paid balance or a generally good record is enough without checking the specific periods.
Make the request through the notice instructions
Call the number on the IRS notice and ask the representative to review the penalty for First Time Abate. The IRS says you do not have to use the words “First Time Abate” or send supporting documents merely to make the request, although the representative may ask for information to verify the account.
If the notice or IRS representative directs you to make the request in writing, follow the current Form 843 instructions or the written-statement procedure provided. Include the notice number, tax period, form, penalty and a clear request for the applicable administrative waiver. Keep a copy of everything sent and proof of delivery.

How to build a reasonable-cause request
Explain the event and the timeline
Start with dates, not conclusions. State the filing, payment or deposit deadline; the event that interfered with compliance; when the event began and ended; and the date you filed or paid. Explain the direct connection between the event and the missed deadline. “I was unable to comply” is weaker than a documented timeline showing why compliance was not realistically possible.
Show ordinary business care and prudence
The IRS evaluates whether you took reasonable steps before, during and after the problem. Describe actions such as maintaining filing procedures, arranging payment, attempting to obtain records, contacting a preparer, requesting extensions when available, or correcting the problem promptly. The standard is not perfection; it is whether the response was reasonable under the circumstances.
Attach evidence that proves the critical facts
The IRS identifies records that can support a reasonable-cause explanation, including:
- Hospital, medical or court records.
- A doctor’s letter stating the illness or incapacity and the relevant dates.
- Disaster or casualty documentation.
- Correspondence showing attempts to obtain information or resolve the problem.
- Receipts, confirmations and other records establishing dates and actions.
- Relevant tax forms and account records.
Organize attachments in the same order as your narrative. Mark the date and purpose of each document so the reviewer can connect it to the missed obligation.
Common circumstances the IRS may consider
IRS appeal guidance identifies circumstances such as death; serious illness or unavoidable absence; fire, casualty, natural disaster or other disturbances; inability to obtain necessary records; a mistake; and erroneous advice or reliance. These categories are not automatic approvals. The IRS still weighs the penalty rule, the duration and severity of the event, your actions and the evidence.

Understand the special rule for lack of funds
Lack of money by itself is not reasonable cause for a failure-to-pay or failure-to-deposit penalty. Other facts may matter when they show that you exercised reasonable care and made an effort to comply. For example, explain the documented events that caused the cash-flow problem and the steps taken to arrange payment, rather than relying only on an account balance.
Accuracy-related penalties require a different showing
For an accuracy-related penalty, the IRS considers good faith and factors such as your efforts to report correctly, the complexity of the issue, your knowledge and experience, whether you sought tax advice, whether you supplied the adviser with needed information and the adviser’s competence. A late-filing explanation does not automatically address an accuracy-related penalty; tailor the facts to the error the notice identifies.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Contacting the IRS and using Form 843
Have the notice, the penalty amount, the affected form and tax period, payment or filing confirmations, and your factual explanation available before calling. Ask what relief is available for the specific penalty and whether the account shows AEP or FTA eligibility. Record the representative’s name or identification information if provided, the date of the call and any confirmation number.
If the IRS cannot approve the request by phone, the agency’s guidance identifies Form 843 as one written route. Use the current form and instructions, including the address specified for your situation. A written request should identify the taxpayer, tax period, form, penalty and requested relief; explain the facts in chronological order; and list the attached evidence. Do not send original records that you cannot replace.
Continue to follow the notice’s payment and response instructions while the request is pending. Penalty relief is separate from the underlying tax liability. Reducing or removing a penalty does not by itself cancel unpaid tax.

What happens to interest and other penalties
When the IRS reduces or removes a penalty, related interest is automatically reduced or removed to the extent it arose from that penalty, according to IRS guidance. Interest attributable to unpaid tax can still remain. AEP also has a defined scope; penalties outside the specified failure-to-file, failure-to-pay and failure-to-deposit categories are not automatically covered.
If the IRS denies your request
Read the denial letter, not just the account balance
The denial letter explains the reason for the decision and identifies the next response step. Check whether the IRS concluded that the account did not meet the FTA history, the penalty was excluded, the evidence did not establish reasonable cause, or the request missed a procedural requirement.
Request an appeal when available
IRS guidance says an eligible taxpayer may generally request an Independent Office of Appeals conference or hearing after a written denial. The appeal period is generally 30 days from the rejection letter, but the date printed in your letter controls. Submit the appeal exactly as instructed and keep proof that it was timely.
Recommended Free Tools
Strengthen the record without changing the facts
An appeal should address the stated reason for denial. Add missing dates, records or explanations; correct an account error; and distinguish the penalty type if the initial request addressed the wrong rule. Do not recast a lack-of-funds explanation as reasonable cause without evidence of the events and efforts that accompanied it.
When professional help is sensible
Consider consulting a qualified tax professional when several periods or entities are involved, the penalty is accuracy-related, the records are incomplete, the amount is substantial, or the IRS has issued a denial. Ask about credentials, fees, scope of representation and whether the professional can communicate with the IRS. IRS guidance is not an endorsement of any provider.
Practical checklist
- IRS notice and response deadline.
- Return form, tax period and penalty description.
- Filing, payment or deposit confirmations.
- Prior three years of annual compliance, or 12 consecutive quarters for quarterly filing history.
- Evidence of illness, death, disaster, records access problems, advice, mistake or other event.
- Chronology connecting the event to the missed deadline.
- Proof of corrective action and payment arrangements.
- Current Form 843 instructions if a written request is required.
- Denial letter and appeal deadline, if the request is rejected.
The key distinction to remember
FTA asks, in practical terms, “Does this account have the qualifying compliance history for an administrative waiver during the period when FTA is available?” Reasonable cause asks, “What prevented compliance, and can the taxpayer prove that reasonable care was exercised despite that obstacle?” AEP may answer the first question automatically for eligible original returns during the 2026 phase-in. For every other case, the notice, penalty type, tax period and documented facts determine the route.
