Federal vs. private student loans: eligibility, protections, and repayment options

For most students who still need to borrow after grants, scholarships, work-study, savings and other aid, federal loans are the safer starting point. Federal programs use standardized eligibility rules and offer repayment, deferment, and possible forgiveness or discharge pathways that private loans generally do not. Private loans can fill a remaining funding gap, but approval, pricing, payment schedules and hardship relief depend on the lender, your credit and the contract you sign.

The right comparison is not simply the lowest advertised interest rate. Check the loan type, disbursement date, total cost, payment flexibility, cosigner obligations and the protections you would give up if you refinance federal debt privately.

Federal and private student loans are different products

The company sending your bill does not by itself tell you whether a loan is federal or private. Confirm the type in your StudentAid.gov dashboard, the promissory note and your servicer’s records. Federal Direct loans are made under federal program rules. Private education loans are contracts with banks, credit unions or other private lenders, each with its own underwriting and servicing terms.

The Consumer Financial Protection Bureau (CFPB) advises borrowers to “max out” available federal student-loan options before borrowing private loans. That is general guidance, not an individualized recommendation: your school, loan type, income, credit and future plans still matter.

Who qualifies for federal versus private student loans?

Federal eligibility follows program rules

Federal eligibility depends on factors such as the type of federal program, enrollment and school requirements, annual and aggregate borrowing limits, and information on your federal aid application. A federal Direct Loan generally does not require a credit check or a cosigner. Direct PLUS loans are an important exception: credit-history rules apply, and a parent PLUS borrower is legally responsible for repayment.

Your federal repayment choices later depend on the specific loan type and when it was disbursed. Two borrowers who both describe their debt as “federal” may therefore see different plans in their accounts.

Private lenders underwrite the borrower

Private lenders commonly review credit history, income, debt and other risk factors. A student with limited credit may need a cosigner. The cosigner is contractually responsible for the debt if the student does not pay, and the cosigner’s credit can be harmed by missed payments. Release is not automatic; it is available only if the lender’s agreement includes a release program and the borrower meets its conditions.

A lender may also require the school to certify the requested amount so total aid does not exceed the school’s certified cost of attendance. Each lender sets its own criteria, and a “from” rate may be reserved for applicants with the strongest credit. Obtain an actual written disclosure before comparing offers.

Confirm the gap before borrowing

Ask the school’s financial-aid office to calculate the remaining cost after grants, scholarships, work-study, savings and available federal aid. Borrow only the amount needed for that gap. A private loan is not a substitute for checking whether a federal annual limit, an institutional grant or a payment plan can reduce the amount you need to finance.

Federal and private loans compared

Comparison Federal loans Private loans
Interest rate Federal Student Aid publishes fixed rates for the applicable loan year and loan type. The rate that applies to you depends on when and what you borrowed. May be fixed or variable. The actual rate, APR and fees depend on the lender and your credit profile. A variable rate can change over time.
Credit check and cosigner Most federal Direct loans do not require a credit check or cosigner. PLUS loans have separate credit rules. Credit underwriting is common, and a cosigner may be required. The cosigner remains liable unless released under the contract.
Repayment plans Multiple plans may be available, including income-driven options when the loan and borrower qualify. Eligibility is now tied closely to loan type and disbursement date. Only the choices in the lender’s contract apply. Options may include immediate, interest-only, in-school or deferred payments.
Deferment and forbearance Federal deferment and forbearance categories exist, subject to qualifying conditions. Whether interest accrues depends on the loan and circumstance. Relief is lender-specific and may be limited or unavailable. Read the agreement and ask what documentation is required.
Forgiveness or discharge Eligible borrowers may have access to programs such as Public Service Loan Forgiveness (PSLF), disability discharge or borrower-defense discharge, subject to detailed rules. Private debt generally is not eligible for federal forgiveness programs. A state or lender program could be an exception, but it must be stated in the applicable rules.
Default consequences Federal collection tools are established by statute and regulation. Contact the servicer quickly to discuss options. A private collector may sue to collect, and a cosigner’s credit may be affected. The CFPB notes that private collectors cannot intercept a federal tax refund.

Do not assume federal rates are always lower. Federal rates depend on the loan year and type; a highly qualified private borrower might receive a lower initial rate, while a borrower with weaker credit could receive a much higher one. Compare the complete cost and the value of federal protections, not one headline number.

What protections come with federal loans?

Standardized relief when circumstances change

Federal programs provide defined deferment and forbearance pathways for qualifying situations. Interest treatment varies: some periods add unpaid interest to the balance, while other circumstances may receive different treatment. Check your specific loan and the current federal rules before assuming a pause is cost-free.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Potential forgiveness and discharge

Some federal borrowers can qualify for statutory programs. PSLF generally requires 120 qualifying payments while working for an eligible public-service employer and meeting other requirements. Disability discharge and borrower-defense discharge have separate eligibility tests. None is automatic, and simply having a federal loan does not guarantee forgiveness.

Federal collection rules

Once a federal loan is in default, federal collection remedies can apply. The practical response is to contact the servicer as soon as payments become difficult, before a missed payment grows into a default. Ask for the available repayment, deferment, forbearance or rehabilitation options for that loan.

How private-loan terms differ

When payments begin

A private contract may require full payments while you are enrolled, interest-only payments during school, or no scheduled payments until after a grace period. The length of any grace period and whether interest capitalizes are lender-specific. “Deferred” does not necessarily mean interest-free: unpaid interest can accumulate and be added to principal when repayment starts.

Rate structure and fees

Compare the annual percentage rate, not only the nominal interest rate. Check origination, late, returned-payment and other fees; the index and margin for a variable rate; the frequency of rate changes; and whether there is a rate cap. Ask for the total amount paid under the proposed schedule.

Academic-progress and enrollment conditions

Some agreements condition in-school status or deferment on satisfactory academic progress, half-time enrollment or timely school certification. Find out what happens if you drop below the required enrollment level, transfer, take a leave or graduate early.

Cosigner release

Release requirements can include a specified number of consecutive on-time payments, a new credit review, income thresholds or completion of school. Get the conditions in writing and do not treat a lender’s general statement that release is “possible” as a promise.

Federal repayment changes borrowers must check in 2026

Federal repayment rules are changing. The following points reflect Federal Student Aid information available on October 13, 2026; verify your current account and the official eligibility tools before choosing a plan.

Disbursement date controls eligibility

Current federal guidance states that loans disbursed on or after July 1, 2026 have the Repayment Assistance Plan (RAP) as the available income-driven repayment plan. Parent Direct PLUS loans are excluded, and fixed-plan choices differ by loan type. The exact plan list for an older loan can be different, so use the loan-level information in your StudentAid.gov record rather than an old chart.

PAYE and ICR sunset date

Federal Student Aid says the Pay As You Earn (PAYE) and Income-Contingent Repayment (ICR) plans are scheduled to end no later than July 1, 2028. A borrower pursuing forgiveness should compare how any required transition affects qualifying-payment progress and the expected timeline.

Twenty- and twenty-five-year discharge periods are conditional

Federal guidance describes income-driven repayment discharge after 20 or 25 years for applicable borrowers and loans. The period depends on the plan and loan details; the current discussion is qualified for loans without disbursements on or after July 1, 2026. It is not a universal promise that every federal borrower will pay for exactly 20 or 25 years or receive a discharge at that point.

Temporary autopay reduction

Federal Student Aid states that borrowers enrolled in autopay beginning July 1, 2026 can receive a 1% interest-rate reduction through June 30, 2028, subject to the program’s enrollment-timing conditions. This is a limited, qualified benefit, not an automatic reduction for every federal borrower. Confirm that the reduction appears in your account.

How to compare repayment costs and flexibility

Use the official federal calculator for eligible plans

The Federal Student Aid Repayment Calculator estimates monthly payment, total payment, principal and interest, possible discharge and payoff date. Results are estimates; your servicer’s final calculation and the terms of your promissory note control. Enter accurate balances, interest rates, loan types, income and family information, then save the results and assumptions used.

Compare a private offer on the same measures

Request a disclosure showing the amount borrowed, APR, fixed or variable rate, term, required payment, total scheduled payments, fees, in-school payment rule, grace period and consequences of late payment. Compare that schedule with each eligible federal plan. A lower monthly payment can result from a longer term and substantially higher total interest.

Evaluate flexibility as a financial value

Federal income-driven plans can adjust payment based on qualifying income and family circumstances. A private loan generally follows the contract even if your income falls. Price the ability to pause or change payments alongside the interest savings; it is not visible in an advertised rate.

What if you cannot afford payments?

Federal loans

  1. Check the servicer named in your StudentAid.gov account and contact it before missing a payment.
  2. Ask which income-driven, deferment, forbearance or other options apply to the exact loan and your current circumstances.
  3. Request the eligibility criteria, interest treatment, effective date and payment amount in writing.
  4. Submit required documentation and continue making the scheduled payment until the servicer confirms a change.

Private loans

  1. Call the lender or servicer as soon as a payment problem is foreseeable; do not wait for default.
  2. Ask specifically about temporary forbearance, interest-only payments, term changes, settlement or other hardship programs.
  3. Confirm whether interest continues, whether it capitalizes, how the arrangement affects credit reporting and whether a cosigner must participate.
  4. Keep written confirmation of every agreement and the next payment due date.

Private hardship policies are not standardized. A lender may offer a short pause, while another may offer no comparable relief. Never assume a federal option applies to a private loan.

Should you refinance federal loans privately?

Refinancing can replace one or more federal loans with a private loan, potentially changing the interest rate or term. Once completed, the refinanced balance is private debt. Federal Student Aid warns that you can lose federal deferment and forbearance, income-driven repayment, qualifying-payment credit and federal discharge pathways tied to the original loans. Parent-loan and other loan-specific protections can also disappear.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A disciplined refinancing test

  1. List every federal benefit you currently use or might need, including the applicable repayment plan, PSLF progress, deferment categories and discharge possibilities.
  2. Obtain the private lender’s written rate, APR, term, fees, payment, variable-rate formula and hardship provisions.
  3. Calculate the guaranteed interest and payment savings under the actual offer, not an advertised “as low as” rate.
  4. Stress-test the private payment against unemployment, reduced hours, illness and higher variable rates.
  5. Refinance only after deciding that the certain savings outweigh the federal protections you would permanently surrender.

A practical borrowing and repayment checklist

  • Identify each loan type, balance, servicer and disbursement date in official records.
  • Ask the school to confirm your remaining cost after all grants, scholarships, work-study, savings and federal aid.
  • Apply for eligible federal aid before seeking private credit.
  • Request written private disclosures from multiple lenders and compare APR, fees, rate type, term, total payments and payment start date.
  • Read cosigner liability, release conditions, academic-progress clauses and default remedies.
  • Use the current Federal Student Aid calculator for federal-plan estimates and record the assumptions.
  • Recheck plan eligibility whenever federal rules or your income changes.
  • Contact the servicer or lender early if affordability becomes a problem, and preserve written agreements.

Bottom line

Federal loans usually offer the broadest repayment flexibility and the most important statutory protections, so they are generally the first borrowing option to evaluate. Private loans can be appropriate for a documented remaining gap when their complete written terms fit your circumstances. Compare total cost, payment risk and lost protections together, and verify eligibility using your current loan records rather than an outdated plan chart.
