SK hynix is seeking Washington’s approval to ship additional U.S.-origin chipmaking equipment to its China operations, and two people familiar with the matter told Reuters on October 14, 2026 that approval is a condition the company is using for a planned U.S. factory. Neither the U.S. government nor SK hynix has publicly confirmed a factory-for-equipment agreement, and the company has not made a final public commitment beyond its announced Indiana project.
What happened
The reported linkage is between a request for export authorization and SK hynix’s proposed advanced-packaging facility in West Lafayette, Indiana. Reuters attributed the condition to two unnamed people familiar with the matter. That makes the report significant, but it does not establish that Washington has approved the licenses, that negotiations have concluded, or that SK hynix has legally conditioned construction on a government decision.

The issue sits inside a broader change in U.S. export-control policy. The Bureau of Industry and Security (BIS) said in an August 29, 2025 release that it had closed the Validated End-User (VEU) loophole that had allowed certain foreign companies to send semiconductor manufacturing equipment and technology to China without individual licenses.
Why does SK hynix need U.S. permission to ship chip equipment to China?
Under the former VEU arrangement, qualifying foreign-owned semiconductor facilities in China could seek general authorizations for certain U.S.-controlled items after national-security review. BIS had identified Samsung and SK hynix China facilities as VEU participants. The August 2025 policy ended that license-free treatment: former participants must now obtain licenses for covered exports.
#1 Best Overall
BIS said it intended to support the continued operation of existing fabs, while not intending to grant licenses to expand capacity or upgrade technology at fabs in China. That distinction is central to SK hynix’s request. Routine maintenance or replacement needed to keep an existing line running is a different policy question from equipment that would add output or improve a facility’s capabilities.
Is SK hynix trading a U.S. factory for permission to expand its China fab?
That is the reported negotiating position, not a confirmed transaction. The available account shows SK hynix seeking approval and linking the approval to its decision-making on a U.S. investment. It does not show a signed agreement, a license grant, a public commitment by the company to build only if the license is issued, or a promise by Washington to authorize expansion in China.

What is the Indiana SK hynix factory?
SK hynix has announced an advanced-packaging facility for high-bandwidth memory (HBM) in West Lafayette, Indiana. The company says the project will involve more than $4 billion in investment, employ more than 100 partners across its ecosystem, and create about 7,000 direct and indirect jobs. SK hynix targets its first U.S. HBM mass production in the second half of 2029.
“SK hynix’s investment in Indiana is not merely an investment in semiconductor manufacturing facilities, but the establishment of the first AI memory production facility and R&D center in the United States, creating a unique model for nurturing semiconductor talent and strengthening collaboration with the government and external organizations,” South Korea’s ambassador to the United States, Kang Kyung-wha, said in a statement included with the company’s announcement.
HBM is stacked memory used alongside advanced processors, particularly in artificial-intelligence systems. The Indiana project is an advanced-packaging operation, while the China asset at the center of the export question is a NAND memory manufacturing facility. Those are related parts of SK hynix’s memory business but not interchangeable production lines.
How Dalian and Solidigm fit into the story
SK hynix bought Intel’s NAND and SSD business, including the Dalian NAND manufacturing facility, in a transaction valued at $9 billion. Its U.S. subsidiary Solidigm was created to manage the SSD business associated with that transaction.

On October 1, 2026, SK hynix said no matters had been determined regarding Solidigm’s capital plans. The company said any financing approach would be evaluated according to its effect on long-term corporate and shareholder value. That clarification does not confirm new investment in Dalian, Solidigm, or the Indiana project, and it does not resolve the export-license question.

Case-by-case licensing replaces broad VEU access
The practical change is procedural as well as substantive. A foreign-owned fab that previously relied on a general VEU authorization must now present covered export requests for individual review. Each application can be assessed against the item, end use, facility, and national-security concerns identified by U.S. regulators.

Existing output versus added capacity
BIS’s stated policy creates a line between keeping an established China fab operating and using U.S. equipment to increase its output or modernize its technology. The classification of SK hynix’s requested tools will therefore matter as much as the company’s ownership or the location of the facility.
Investment announcements carry different certainty levels
The Indiana project has public specifications and a production target, but the reported condition is based on unnamed sources. Readers should treat the equipment request, any U.S. approval, and a final construction commitment as three separate milestones rather than one completed deal.
Quick Recap
What to watch next
- A BIS licensing decision or public statement describing the scope of any authorization.
- A formal SK hynix filing or announcement confirming whether Indiana construction is contingent on export approval.
- Details identifying whether the requested equipment is for maintenance, capacity expansion, or a technology upgrade at a China facility.
- Further disclosures about Solidigm’s capital structure or financing, since SK hynix said on October 1 that no plan had been determined.
- Updates to the Indiana schedule, including construction, partner participation, and the target of first HBM mass production in the second half of 2029.
