Short answer: The Earned Income Tax Credit (EITC) rewards eligible workers with low or moderate earned income and may be available with or without a qualifying child. The Additional Child Tax Credit (ACTC) is the potentially refundable part of the child tax credit and depends on qualifying-child and annual child-tax-credit rules. They are separate credits: meeting one credit’s tests does not automatically qualify you for the other, but one household can claim both.
For tax year 2025, the IRS requires different forms and identity-number conditions for each credit. If either credit is claimed on a federal return, the law requires the IRS to hold the entire refund until at least mid-February. The dates discussed below—February 21 and March 2, 2026—are conditional estimates for the 2026 filing season, not guarantees for every return.

EITC and ACTC at a glance
| Question | EITC | ACTC |
|---|---|---|
| What is it based on? | Earned income, filing status and household facts, plus the EITC qualifying-child or childless rules | The child tax credit calculation and qualifying-child rules |
| Is a qualifying child required? | No. A separate, smaller self-only credit may be available when the childless rules are met | Yes. The credit is tied to a qualifying child for the child tax credit |
| Key 2025 child conditions | Relationship, age, residency and joint-return tests; the child generally must live with you in the United States for more than half the year | The child must be your dependent, under age 17 at the end of 2025, and meet the applicable dependent tests |
| Identity-number rules | Valid SSNs are required for eligible filer(s). An ITIN does not qualify a taxpayer for EITC | A valid SSN is required for the child; taxpayer SSN/ITIN rules and a joint-return rule apply under the 2025 instructions |
| Federal forms | Form 1040 or 1040-SR; attach Schedule EIC when claiming with a qualifying child | Use Schedule 8812 with the federal return and follow that year’s Form 1040 instructions |
| Refund hold | The IRS must hold the entire refund when either EITC or ACTC is claimed, including the portion unrelated to the credit | |
Income thresholds and maximum EITC amounts change by tax year, filing status and qualifying-child count. Because those figures are not permanent, use the IRS publication for the exact year rather than carrying an old number into a new return.

The EITC is a refundable federal credit for eligible workers with low or moderate income. “Refundable” means the credit can produce a payment after it has reduced any federal income tax you owe, subject to the credit’s rules. Eligibility is determined from several facts together: earned income, filing status, investment income, valid Social Security numbers and whether you claim a qualifying child.

EITC with a qualifying child
A child-based EITC claim uses four core tests:
- Relationship: the child must have an IRS-recognized relationship to you.
- Age: the child must fall within the applicable EITC age test for the tax year.
- Residency: the child generally must have lived with you in the United States for more than half the year.
- Joint return: the child generally cannot file a joint return with a spouse unless an IRS exception applies.
You also cannot use a child who is treated as another person’s qualifying child under the IRS tiebreaker rules. When more than one taxpayer could claim the same child, the tiebreaker rules determine who may use that child for the EITC; an informal family agreement does not override them.
Publication 596 for tax year 2025 contains the detailed relationship, age, residency and joint-return rules, including special situations. Check that publication when a child lived in more than one household, when parents are separated, or when another relative may claim the child.
EITC without a qualifying child
You may qualify for the self-only EITC even when no child meets the qualifying-child tests. This route has its own age, dependency and U.S.-residency requirements in addition to the general earned-income, filing-status, investment-income and Social Security number rules. It is not simply the child-based credit with the child removed, and it is generally a smaller benefit.

An ITIN cannot replace the taxpayer’s valid SSN for EITC purposes. Publication 596 describes limited situations in which a person whose child lacks a qualifying SSN may still qualify for the self-only EITC if every other requirement is met. That exception does not turn the child into a qualifying child for the higher child-based EITC.
Income and filing facts still matter
Having wages or self-employment income does not by itself guarantee EITC eligibility. The IRS also checks filing status and investment-income limits, and the applicable income ranges vary each year. Use the current-year IRS worksheet or eligibility guidance instead of relying on a prior return’s result.
What the ACTC is and who may qualify
The ACTC is the potentially refundable portion of the child tax credit. It is calculated through the child tax credit rules; it is not a second EITC and does not use the EITC’s earned-income eligibility framework.

Tax-year 2025 conditions
For tax year 2025, the IRS Schedule 8812 instructions require the child to be your dependent, under age 17 at the end of 2025, and to meet the applicable dependent tests. The instructions set the maximum ACTC at $1,700 per qualifying child for 2025. That amount is specific to tax year 2025; do not apply it automatically to another year.
The 2025 instructions also require a valid SSN for the child and set taxpayer SSN or ITIN conditions, including a rule affecting joint returns. Identity-number requirements can change, so use the Schedule 8812 instructions for the year on your return.
How ACTC differs from the regular child tax credit
The child tax credit calculation first determines the credit allowed under the annual rules. The ACTC is the portion that may be refundable when the calculation permits it. A taxpayer may therefore need to complete Schedule 8812 even when the final refundable amount is less than the annual maximum or zero. Follow the current Form 1040 instructions for how the nonrefundable and refundable portions flow through the return.
Can you claim EITC and ACTC on the same return?
Yes, if you independently satisfy both sets of rules. For example, a household might have earned income that supports an EITC claim and also have a dependent child under the 2025 child tax credit rules. The child’s status for ACTC does not automatically establish EITC eligibility: EITC adds its own relationship, age, residency and joint-return tests, and the two credits have different identity-number requirements.
Evaluate each credit separately before filing:
- Apply the EITC earned-income, filing-status, investment-income and SSN rules.
- If using a child for EITC, apply all four qualifying-child tests and the tiebreaker rules.
- Apply the child tax credit and ACTC rules for each dependent child, including the 2025 age and SSN conditions.
- Complete every schedule triggered by the credits and make sure names, dates of birth, dependency status and SSNs match across the return.
How to claim the EITC
Step 1: File a federal income-tax return
File Form 1040 or Form 1040-SR even if your income is below the normal filing threshold. The IRS cannot calculate and pay the EITC without a return. If you are not otherwise required to file, filing may still be necessary to claim the refundable credit.

Step 3: Check the return before submitting
- Confirm that every filer who needs a valid SSN has one. An ITIN does not make a taxpayer eligible for EITC.
- Recheck the child’s relationship, age, U.S. residency and joint-return status.
- Make sure no other person’s qualifying-child claim controls under the IRS tiebreaker rules.
- Use the correct tax-year income and investment-income limits rather than figures from an older return.
If the IRS later asks for information, respond with the documents and explanations requested. A return can be mathematically correct yet delayed while the IRS verifies eligibility.
How to claim the ACTC
Step 1: Determine the child tax credit amount
Start with the current-year child tax credit rules for each dependent child. For 2025, the child must be your dependent, under age 17 at year-end and satisfy the other dependent tests. The amount that can be refundable is determined through the annual calculation; the $1,700 maximum applies per qualifying child for tax year 2025.
Step 2: Complete Schedule 8812
Use Schedule 8812 with Form 1040 or Form 1040-SR. Follow the applicable Form 1040 instructions for transferring the schedule’s results to the return. Enter the child’s name, relationship and SSN consistently with the dependency information elsewhere on the return.

The child needs a valid SSN under the 2025 instructions. The taxpayer’s SSN or ITIN rules also apply, including a joint-return condition. Because these requirements are year-specific, replace an old Schedule 8812 or software worksheet with the version for the tax year being filed.
When will a refund arrive?
The refund timetable is the same whether the return claims EITC, ACTC or both. The law prohibits the IRS from issuing the refund before mid-February when either credit is claimed. The hold applies to the entire refund, not only the dollars generated by EITC or ACTC.

2026 filing-season estimates
| Milestone | What the IRS guidance says | Who it applies to |
|---|---|---|
| February 21, 2026 | Where’s My Refund should show an updated status for most early EITC/ACTC filers | Most early filers; status timing can vary when a return needs review |
| March 2, 2026 | Expected refund date | Early filers who file online, choose direct deposit and have no return issues |
These are conditional 2026 filing-season estimates, not a promise of an individual payment date. The IRS must still process the return, and a financial institution may need additional time to post a direct deposit. Weekends and holidays can also affect when funds appear.

Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What if you missed EITC in an earlier year?
If you believe you qualified for EITC but did not claim it, IRS guidance allows you to file a return for the prior year. If you already filed that year’s return, you may need an amended Form 1040-X. The deadline to claim a credit is year-specific, so check the instructions for that particular tax year before assuming the claim is still open.
Use the forms and schedules for the earlier year, not the current-year versions. A child’s age, residency, filing status, income limits and SSN status must be tested under the law that applied to that year.
Common mistakes and how to correct them
Using an ITIN as if it were an EITC-qualifying SSN
An ITIN does not qualify the taxpayer for EITC. Review the identity-number rules before filing and do not claim a child-based EITC when the child lacks the required qualifying SSN. The limited self-only exception described in Publication 596 is narrower than a child-based claim.

Assuming the same child automatically works for both credits
ACTC and EITC use overlapping family information but different tests. Recheck EITC residency, relationship, age, joint-return and tiebreaker rules separately from the ACTC dependent, age and SSN requirements.

Carrying forward an old ACTC amount
The $1,700 maximum is for each qualifying child in tax year 2025. Annual limits and identity-number rules can change. Always use the Schedule 8812 instructions for the tax year shown on the return.
Expecting only the credit portion to be delayed
The statutory mid-February hold covers the whole refund. If your return includes withholding or another refundable amount, that money is held with the EITC or ACTC-related refund until the IRS can issue the payment.
Reading a seasonal estimate as a guarantee
March 2, 2026 applies only to a defined group of early, electronic, direct-deposit filers whose returns have no issues. A review, correction, paper filing, bank posting delay, weekend or holiday can move the actual date.
A practical filing decision path
- Identify the tax year. Use 2025 rules only for a 2025 return; use the current annual publications for another year.
- Test EITC eligibility. Confirm earned income, filing status, investment-income limits, SSNs and either the qualifying-child tests or the separate childless rules.
- Test ACTC eligibility. Confirm dependency, the applicable child age and SSN requirements, and the child tax credit calculation.
- Prepare the required schedules. Add Schedule EIC for a qualifying-child EITC claim and Schedule 8812 for ACTC.
- File once and monitor. Submit the complete federal return, then use Where’s My Refund instead of sending duplicates.
Tax-year rules and filing-season dates are different
Eligibility belongs to a tax year. The 2025 EITC details come from IRS Publication 596, and the 2025 ACTC details come from the Schedule 8812 instructions for that year. Refund estimates belong to a filing season: the February 21 and March 2 dates above describe the 2026 season. When filing in a later season, refresh annual amounts, thresholds, SSN rules and IRS processing dates before using this guide.
This is U.S. federal guidance, not a determination of any individual taxpayer’s eligibility. State credits, nonresident rules and personal circumstances may require separate review or help from a qualified tax professional.
