Easement vs. right-of-way: what property owners need to know

Short answer: An easement is a limited, nonpossessory right to use someone else’s land. A right-of-way usually means a right to pass over or through land and is often an easement created for access. The terms are not interchangeable in every document: a right-of-way may describe the physical corridor or may arise from a permit or license instead. The recorded instrument and the law where the property is located determine what can be done, by whom, for how long, and at whose expense.

What is the difference between an easement and a right-of-way?

In U.S. property law, the broad distinction is purpose and scope. Cornell Legal Information Institute defines an easement as “the grant of a nonpossessory property interest that provides the easement holder permission to use another person’s land.” The owner of the land keeps title and possession, subject to the limited rights granted.

A right-of-way generally concerns passage. Cornell’s Wex definition says, “Right of way is the right to pass over or through real property owned by someone else, usually based upon an easement.” A driveway access strip, a path to a landlocked parcel, and a utility or transportation corridor can all be described as rights-of-way. In some documents, “right-of-way” means the strip of land itself rather than the legal right to use it.

Government materials use the terms in overlapping but not identical ways. Bureau of Land Management training notes that “right-of-way” is sometimes used interchangeably with “easement,” while also recognizing that a right-of-way can be established through another instrument. The Bureau of Indian Affairs describes a right-of-way as permission to pass “over, under, or through another person’s property or leasehold interest for a specific reason.” That wording highlights why the document matters: an access right in a recorded easement is not necessarily the same as a revocable permission in a license.

This article uses the property-law meanings. Traffic rules also use “right of way” to decide which driver proceeds first; that driving concept does not create an interest in real estate.

Does a right-of-way mean someone owns part of my property?

Usually, no. An easement-based right-of-way gives its holder a defined use right, not general ownership or unrestricted possession. The underlying owner typically remains the title holder of the burdened parcel, sometimes called the servient estate. The parcel or person receiving the benefit may be called the dominant estate or dominant owner when the right is tied to land.

Ownership and use rights can be separated. A county may own a public road while a private owner holds the surrounding land. A utility company may have a corridor easement without owning the fee title. A neighbor may have a driveway easement across your parcel while you continue to own and use the land outside the granted route.

Do not infer ownership from a survey label, fence line, tax-map notation, or the words “right-of-way” alone. Check the deed, plat, recorded easement, condemnation order, permit, license, or other grant. The instrument may reserve ownership to the landowner, convey a temporary right, or create a broader property interest under local law.

How easements and rights-of-way are created

Express easement in a deed or separate agreement

An owner can grant an easement in a deed or a stand-alone agreement. The writing commonly identifies the route, purpose, width, duration, and maintenance obligations. Recording puts later purchasers and title professionals on notice, although recording rules and the effect of an unrecorded interest vary by jurisdiction.

Public acquisition or condemnation

A government agency may obtain a transportation, drainage, utility, or access corridor by agreement or through condemnation authority. The resulting document and applicable statutes control the public’s and agency’s rights. A public right-of-way can therefore involve different procedures and protections than a private driveway easement.

Permit or license

BLM land-title training explains that rights-of-way may be granted through easements, permits, or licenses. A permit or license commonly grants permission for a stated activity without creating the same enduring interest in land as an easement. It may be personal to the holder, limited to a term, subject to agency conditions, or revocable under its language.

Implied, prescriptive, or necessity-based rights

Some jurisdictions recognize access rights that arise from circumstances or long use, such as an easement by necessity or a prescriptive easement. The required facts, time periods, notice standards, and defenses differ substantially by state. A neighbor’s long-standing use is not automatically a legal right, and a newly placed obstruction is not automatically lawful. A local property lawyer can assess these fact-specific theories.

What the grant should tell you

The Bureau of Indian Affairs identifies core attributes of a right-of-way grant, including purpose, type, extent, use, width, length, and duration. Read those terms together rather than relying on a heading.

  • Holder and benefited parcel: Identify the person, company, agency, or parcel that receives the right. Determine whether the right is appurtenant (attached to land) or personal to a named holder.
  • Burdened land and route: Locate the servient parcel, centerline, endpoints, bearings, landmarks, and any attached survey or plat. A metes-and-bounds description may control over a rough sketch.
  • Purpose and permitted users: Look for language such as ingress and egress, driveway access, utilities, agricultural use, emergency access, or construction traffic. A right granted for one purpose may not authorize unrelated uses.
  • Width and extent: Confirm the stated width, travel surface, shoulders, turning areas, vertical clearance, and whether the right covers the entire described strip or only a path.
  • Duration and termination: Check for a fixed expiration date, a condition that ends the right, abandonment language, renewal terms, or termination on a specified event.
  • Construction and alteration: Determine who may build, pave, grade, place gates, install utilities, or relocate the route, and whether advance consent is required.
  • Repair and maintenance: Find clauses allocating snow removal, grading, paving, vegetation control, drainage, gates, and casualty repairs.
  • Costs and insurance: Review cost-sharing formulas, indemnity, damage responsibility, and insurance requirements. These provisions can matter as much as the route itself.
  • Transfer and recording: See whether the right runs with the land, may be assigned, is limited to a named user, and appears in the public record. Check for later amendments, releases, or partial releases.

Easement-based right-of-way versus permit or license

When a document uses “right-of-way,” compare the legal instrument rather than assuming the label determines the result.

Issue Easement-based right-of-way Permit or license right-of-way
Legal instrument Deed, easement agreement, plat, court order, or similar property instrument. Permit, license, agency authorization, or other permission document.
Nature of interest Usually a nonpossessory interest in land; the servient owner retains title. Permission to perform a stated activity; it may not create an interest that binds successors.
Holder or beneficiary May benefit a parcel (appurtenant) or a named person or entity. Often issued to a named holder and subject to agency or grantor conditions.
Purpose and use Defined by the grant; passage is common, but utilities, drainage, or other uses may be included. Defined by permit terms and conditions; use outside those terms can be unauthorized.
Route and extent Established by legal description, survey, plat, or stated width and location. Set by the authorization, map, approved plan, or agency conditions.
Duration and termination May continue with the land until released, merged, abandoned under applicable law, or ended by a stated condition. Often expires, can be renewed, or may be revocable under the document and governing law.
Transfer An appurtenant easement generally passes with the benefited parcel; personal easements may not. Assignment or transfer usually requires the document’s permission and may be prohibited.
Maintenance and costs Set by the grant and local law; do not assume the user or owner automatically pays everything. Set by permit conditions, regulations, or a separate agreement.
Recording and title Often recorded and reviewed in a title search, though recording effects vary by jurisdiction. May appear in agency files or a recorded document, but a permit’s title effect is not the same as an easement’s.

This comparison is a framework, not a nationwide rule. A particular state may classify an instrument differently, and the exact wording can alter every row.

Appurtenant, personal, affirmative, and negative easements

Appurtenant versus personal

An appurtenant easement benefits one parcel and burdens another. The right is connected to the land, so it generally passes when the benefited parcel is sold, subject to the instrument and local law. The benefited parcel is the dominant estate; the burdened parcel is the servient estate.

A personal easement benefits a person or entity rather than a parcel. Its transferability, duration, and termination depend on the grant and governing law. A utility or conservation right may have specialized statutory treatment. Never assume a buyer receives an access right merely because a prior owner used it.

Affirmative versus negative

An affirmative easement authorizes an act on or through another’s land, such as travel, drainage, or utility installation. A negative easement restricts what the burdened owner may do, such as blocking a specified view or using land in a prohibited way. A right-of-way is typically affirmative, but “easement” is the broader category.

Can I block or fence a right-of-way?

Do not place a gate, fence, vehicle, landscaping, locked chain, or other obstruction based only on your belief that the route is inconvenient or unused. If a valid right exists, interference can lead to an injunction, damages, removal costs, or attorney-fee exposure under applicable law. Conversely, the holder usually must stay within the granted route and purpose; use beyond the grant can also be challenged.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before changing the route or installing a gate:

  1. Obtain the recorded easement, deed, plat, permit, license, and any amendments or releases.
  2. Compare the written route and width with a current survey or professional location of the boundaries.
  3. Check clauses on gates, security, seasonal access, emergency access, relocation, and consent.
  4. Ask the other party in writing about the proposed change and preserve responses, photographs, and dates.
  5. Have a lawyer licensed where the property is located review the documents before construction or obstruction.

A gate may be permissible if the instrument expressly allows it and it does not unreasonably interfere with authorized use. That is a document-and-facts question, not a general permission to block access.

Who maintains a private right-of-way?

There is no single nationwide rule. Start with the maintenance clause, then check applicable state statutes and recorded agreements.

Oregon provides a useful example, not a national default. Its statute requires easement holders to maintain the easement in repair. Cost sharing follows the parties’ agreement or recorded instrument; absent those provisions, the statute uses a proportionate-use approach. Another state may allocate costs differently, impose duties on the servient owner, or apply specific rules to public roads and shared driveways.

Maintenance questions include who must grade or pave the surface, clear snow and vegetation, repair drainage, replace culverts, maintain gates, and pay for damage caused by heavy equipment. Keep invoices, photographs, notices, and access records. If the route serves several parcels, a written maintenance agreement can reduce disputes over schedules and allocation.

How to review your property documents

Use this sequence before buying, selling, fencing, paving, or disputing access:

  1. Collect the chain of title. Obtain your deed, prior deeds, title commitment or policy, recorded easements, plats, surveys, releases, and amendments from the county recorder or land-record office.
  2. Identify every instrument. Separate easements from permits, licenses, leases, road dedications, homeowner-association documents, and court orders.
  3. Map the burden and benefit. Mark the servient parcel, dominant parcel, endpoints, width, and any alternate route. A surveyor may be needed when descriptions conflict with visible use.
  4. Parse the permitted use. Note who may travel, what vehicles or equipment are contemplated, whether utilities or construction are included, and whether commercial or guest use is addressed.
  5. Check time and transfer language. Look for expiration, renewal, termination, abandonment, assignment, and “runs with the land” wording.
  6. Read maintenance and cost provisions. Record duties for repair, snow, gates, drainage, vegetation, insurance, and reimbursement.
  7. Search for later changes. A relocation agreement, partial release, boundary adjustment, or new plat may change the original route.
  8. Get local advice for a consequential decision. An attorney licensed in the property’s jurisdiction can interpret conflicts, prescriptive-use claims, and remedies. A surveyor can locate the physical corridor; a title professional can help identify recorded interests.

Common mistakes property owners make

  • Treating every right-of-way as an easement: A permit or license may have different duration, transfer, and revocation rules.
  • Treating every easement as a right-of-way: Easements can restrict conduct or cover utilities, drainage, conservation, or other uses without allowing passage.
  • Assuming the visible road is the legal route: The traveled path may have shifted while the recorded description remained unchanged.
  • Assuming nonuse ends the right: Abandonment standards are jurisdiction-specific and often require more than occasional nonuse.
  • Expanding use without checking purpose: A residential access grant may not automatically authorize heavy construction traffic, parking, storage, or commercial deliveries.
  • Relying on a verbal promise: Oral understandings can be difficult to enforce and may not bind later owners.
  • Ignoring title and recording records: A survey note or neighbor’s statement is not a substitute for the recorded instrument and applicable law.
  • Assuming the maintenance bill is obvious: Cost allocation may be in a separate agreement or statute, not in the document’s heading.

Questions to ask before buying or selling

For a buyer

  • Does the parcel have legal access from a public road, and is the route recorded?
  • Is access appurtenant to the parcel or dependent on a personal permit?
  • What vehicles, utilities, guests, tenants, or contractors are allowed?
  • Who pays for repairs, snow removal, gates, drainage, and future upgrades?
  • Are there pending disputes, notices, releases, relocations, or unrecorded agreements?

For a seller or servient owner

  • Does the proposed sale disclose every recorded burden and access obligation?
  • Will a planned fence, addition, pool, driveway, or landscaping enter the corridor?
  • Does the grant allow relocation, and who must approve or pay for it?
  • Are maintenance records and cost-sharing agreements available to provide to the buyer?

When to obtain legal help

Consult a lawyer licensed where the land is located when the route is disputed, the document is ambiguous, a neighbor threatens self-help, a project could encroach on the corridor, or the value of the property depends on access. Bring the complete recorded documents, survey, photographs, correspondence, and a timeline of use. Utah’s Office of the Property Rights Ombudsman describes its public easement guidance as simplified and recommends licensed counsel for private civil matters; that caution is sensible elsewhere as well.

Do not obstruct, relocate, terminate, or materially expand a right-of-way based on a generic online definition. The instrument, later documents, actual use, and local law control the outcome.
