Does Texas Have a State Income Tax? What Residents Pay Instead

No. Texas does not levy a state or local individual income tax on wages or other personal income. Texans still pay federal income tax, and they may owe sales taxes on taxable purchases, local property taxes when they own taxable property, and business taxes when they operate a covered entity.

Texas does not replace income tax with one single charge. The amount a household pays depends on what it buys, where it lives, whether it owns taxable property, and whether it operates a business.

The short answer: no Texas individual income tax

The Texas Comptroller’s fiscal 2025 tax guide distinguishes federal income tax from state and local taxes: Texans pay federal income tax, but Texas does not impose a state or local individual income tax. That means an employee’s Texas paycheck does not have a Texas individual income-tax withholding line comparable to the state income-tax withholding used in many other states.

The absence of an individual income tax does not mean residents are tax-free. Texas finances public services through a combination of consumption taxes, local property taxes, taxes on certain businesses and activities, and other state and local charges. Those taxes use different bases and apply to different people.

Which taxes can replace an income-tax payment in practice?

The most useful way to understand the system is to separate the tax base, the government collecting it, and the person or entity legally responsible for it.

Tax What it is based on Government level Who may pay What varies
Federal income tax Federal taxable income under federal law Federal Individuals with federal tax liability Income, deductions, credits, filing status and other federal rules
Texas sales and use tax Taxable purchases of goods and selected services State plus local components Consumers making taxable purchases, with collection handled by sellers in many transactions Whether an item or service is taxable, exemptions and the local jurisdiction
Property tax Taxable value of real and personal property Local taxing units Owners of taxable property Appraised value, exemptions and the rates set by each taxing unit
Franchise tax A taxable entity’s taxable margin or other amount calculated under Texas franchise-tax rules State Certain entities formed or organized in Texas or doing business in Texas Entity type, revenue, deductions, report year and applicable threshold

This table is not a list of taxes every resident pays. For example, a person who does not own taxable property will not receive a property-tax bill in the owner’s name, while someone who owns a qualifying business entity may have franchise-tax filing obligations. The Comptroller says it oversees about 100 taxes, fees, assessments and program applications, and collects local sales taxes for more than 1,800 governments; that administrative scope is not the number of taxes a typical household pays.

Sales and use tax: the main state consumption tax

The 6.25% figure is only the state component

The Texas Comptroller’s 2026–27 Biennial Revenue Estimate, published in January 2025, identifies limited sales and use tax as the state’s largest tax revenue source and lists a 6.25% state rate. It applies broadly to taxable goods and to selected services, subject to exemptions.

Do not treat 6.25% as the total rate at every checkout. Local jurisdictions can add sales taxes, so the combined rate depends on the place where the transaction is sourced. The cited state estimate establishes the state component, not one uniform statewide total. Check the current rate for the specific city, county or other jurisdiction before calculating a purchase price.

Why the bill differs from one purchase to another

  • Some goods and services are exempt, while others are taxable.
  • The tax may be collected at the time of sale, and use-tax rules can apply to taxable purchases when the appropriate tax was not collected.
  • Local sales-tax additions mean two otherwise identical purchases can have different totals in different Texas locations.

Sales tax is therefore a tax on consumption, not a percentage of a person’s wages. A household’s annual sales-tax amount depends on its taxable spending and location rather than simply on its salary.

Property tax: no state levy, but substantial local variation

Who sets and collects it

Texas has no state property tax. Cities, counties, school districts and special-purpose districts may levy local property taxes to fund services such as schools, roads, police and fire protection. The Comptroller does not set local property-tax rates or collect these bills.

The Comptroller reports that more than 4,796 local taxing units assess property tax. That number explains why a property owner’s bill can differ sharply from a bill elsewhere in Texas; it is not a count of separate bills paid by one resident.

How a property-tax bill is determined

  1. Appraisal: The local appraisal district appraises the property and determines its appraised value under Texas property-tax procedures.
  2. Taxable value: Exemptions and other adjustments reduce the value that is subject to tax when the owner qualifies for them.
  3. Local rates: Each taxing unit with jurisdiction over the property sets its own rate.
  4. Collection: The local tax assessor-collector or another designated authority sends and collects the bill for the applicable taxing units.

Because value, exemptions and the combination of taxing units differ, there is no single Texas property-tax rate that can be applied to every home or parcel. A property owner who needs the current appraisal, exemption status or payment information should contact the local appraisal district or tax assessor-collector identified for the property.

Franchise tax is a business-entity tax, not a personal income tax

Texas franchise tax is often confused with an income tax because it involves a business’s financial information. The Comptroller describes it as a privilege tax on taxable entities formed or organized in Texas or doing business in Texas. It is not a tax on an employee’s wages and does not apply to every Texas resident.

2026 and 2027 no-tax-due threshold

For franchise-tax report years 2026 and 2027, the Comptroller lists a $2,650,000 no-tax-due threshold. The threshold means an entity below the applicable threshold may owe no franchise tax for that report year; it does not automatically eliminate every filing or information-report requirement.

Franchise-tax rates and calculation methods differ for retail and wholesale entities versus other entities, and the applicable rules can change by report year. Use the Comptroller’s current instructions for the entity’s classification rather than treating the threshold as a blanket exemption for all businesses or owners.

Filing date

The annual franchise-tax report is generally due May 15 for the applicable report year. If May 15 falls on a weekend or holiday, the next-business-day rule can move the deadline. An entity that expects no tax due should still verify whether an information report or another filing is required.

Texans still pay federal income tax

Texas’s no-income-tax status applies only to state and local individual income taxes. Federal income-tax rules continue to apply to residents who have federal tax liability. Employers and individuals therefore still follow federal withholding, estimated-payment and filing rules even though a Texas income-tax return is not required.

Your federal result depends on federal law, including filing status, income sources, deductions, credits and other adjustments. The Texas Comptroller’s statement that Texans pay federal income taxes should not be read as a promise that every individual owes a particular amount; federal liability is personal and fact-specific.

What “paying instead” looks like for different residents

An employee who rents

This person may have federal income-tax withholding from wages and may pay sales tax on taxable purchases. The person does not owe a Texas individual income tax simply because the wages were earned in Texas. A property-tax bill is generally tied to ownership of taxable property, so the employee’s direct tax mix differs from that of a property owner.

A homeowner

In addition to federal income tax and sales tax on taxable purchases, a homeowner may receive a local property-tax bill. The amount depends on the appraised taxable value, qualifying exemptions and the rates of the city, county, school district and any special-purpose districts that tax the property.

An owner of a business entity

The owner may have personal federal income-tax responsibilities and may also need to address Texas franchise-tax rules at the entity level. Whether the entity owes tax depends on its structure, activities, report year and calculations under the Comptroller’s rules. The $2,650,000 no-tax-due threshold for 2026 and 2027 is not a personal-income-tax exemption.

How to estimate your own Texas tax mix

  1. Start with federal tax. Estimate federal income-tax liability using your filing status, income, deductions, credits and withholding information. Texas does not replace this federal calculation.
  2. List taxable spending. Review a representative month or year of purchases and separate taxable goods and selected services from exempt items. Apply the state 6.25% component and then check the current local component for each purchasing location.
  3. Check property ownership. If you own taxable property, identify the appraisal district, current appraised value, exemptions and every taxing unit on the statement. Do not use a statewide property-tax rate because none exists.
  4. Check business status. If you own or operate an entity formed or organized in Texas or doing business there, determine whether it falls within the Comptroller’s franchise-tax rules and whether a report is required for the relevant year.
  5. Verify current local details. Sales-tax jurisdictions, property-tax rates, exemptions and filing instructions can change. Confirm the current figures with the responsible local office or the Texas Comptroller before making a payment or projection.

Common mistakes to avoid

  • “Texans pay no income tax.” The accurate statement is that Texas has no state or local individual income tax; federal income tax still applies.
  • “Sales tax is 6.25% everywhere.” That is the state component. Local additions and exemptions affect the total transaction amount.
  • “Texas has no property tax.” Texas has no state property tax, but local taxing units impose and collect property taxes.
  • “Franchise tax is a personal income tax.” It is a tax on certain taxable entities, with separate filing and calculation rules.
  • “No-tax-due means no filing.” The 2026–27 threshold can eliminate tax due for a qualifying entity, but information-report obligations may still apply.
  • “No income tax always means a lower total burden.” The official sources establish the taxes and their bases, not a universal household-by-household comparison. A fair comparison requires income, spending, property, exemptions, business status and location.

Bottom line for Texas residents

Texas does not charge a state or local individual income tax. Residents instead encounter a mix of federal income tax, a 6.25% state sales-tax component plus applicable local sales taxes, locally determined property taxes on taxable property, and business-entity taxes such as franchise tax when the rules apply. The right amount for any household cannot be inferred from the absence of an income tax alone; it must be calculated from that household’s purchases, property, location and business circumstances.
