Does Car Insurance Cover Injuries in a Construction-Zone Accident?

Often, yes—but not because the crash happened in a construction zone. A construction-zone collision is generally handled under the same auto-insurance coverages as any other crash. Payment depends on who was injured, who was legally at fault, which coverages appear on the policy, the policy limits and exclusions, and the law of the state where the collision occurred.

Your own medical bills may fall under personal injury protection (PIP) or medical-payments coverage (MedPay), while bodily-injury liability usually applies when you injure someone else and are legally responsible. Uninsured/underinsured-motorist (UM/UIM) coverage can help when the at-fault driver has no insurance or not enough. This is general U.S. consumer guidance, not a prediction about an individual claim.

Why a work zone does not create a separate insurance rule

Neither the orange barrels nor the presence of a contractor automatically makes a crash covered or excluded. Insurers first apply the ordinary policy language to the collision: the identity of the injured person, the vehicles involved, the insured’s legal responsibility, the selected limits, and any exclusions. State insurance and tort law then affect what must be offered, what is mandatory, and how a claim proceeds. Consumer guides from the California Department of Insurance and the Ohio Department of Insurance describe these ordinary coverage categories rather than a nationwide construction-zone exception.

A work-zone setting can still matter to the facts. Lane shifts, temporary signals, narrowed shoulders, missing signs, construction vehicles, or a driver’s failure to follow reduced-speed directions may affect fault. Those facts do not change the basic purpose of each coverage, and a traffic citation or crash report is not by itself a final insurance or legal decision.

Which coverage may pay for an injured person?

Coverage What it generally does Important limits
Bodily-injury liability Pays covered damages for bodily injury the insured causes to other people when the insured is legally responsible. It is third-party coverage, not automatic medical coverage for the policyholder’s own injuries. Limits, state minimums and liability rules differ. See the California guide and Texas Office of Public Insurance Counsel.
Personal injury protection (PIP) Where offered, can pay first-party injury benefits, often without regard to fault. Depending on the policy and state, benefits may include medical and hospital costs, lost wages, replacement services or funeral costs. Availability, eligible people, exclusions, limits and claim procedures are state- and policy-specific. Washington’s description is a Washington example, not a national standard: Washington OIC.
Medical payments (MedPay) May pay reasonable medical or funeral expenses for covered people, commonly without regard to fault and up to the selected limit. It is optional in some jurisdictions, and the policy controls who is covered. Ohio explains that MedPay is not health insurance: Ohio DOI.
Uninsured/underinsured-motorist bodily injury (UM/UIM) May pay covered people injured by a driver with no insurance or insufficient liability limits. Whether it is included, who qualifies and how it interacts with other benefits depend on the declarations page, endorsements and state law. California’s consumer guide discusses UM/UIM separately from liability: California DOI.
Collision Repairs or replaces the insured vehicle after a collision with another vehicle or object, subject to the deductible and policy terms. Collision is property-damage coverage. It does not pay bodily-injury medical bills.

Who may pay your medical bills after the crash?

You were injured and another driver appears at fault

The other driver’s bodily-injury liability coverage may ultimately pay covered damages if that driver is legally responsible and has adequate limits. You may also have first-party PIP or MedPay that can address eligible bills while fault is investigated. Do not assume the liability insurer will immediately pay every provider invoice; ask each insurer how bills should be submitted and whether reimbursement or coordination rules apply.

You caused the collision and were injured

Your own bodily-injury liability does not insure your injuries. PIP or MedPay, if purchased and applicable, are the coverages most directly aimed at your own medical expenses. Their limits, deductibles, exclusions and covered-person definitions control. If neither coverage applies, payment may involve health insurance or another available source, but the auto policy and state coordination rules must be checked rather than guessed.

The at-fault driver has no insurance or too little

UM/UIM bodily-injury coverage may fill some of the gap for an insured person, subject to its limit and legal requirements. Confirm that the declarations page shows the coverage and ask the insurer how it defines an uninsured or underinsured vehicle, household member and passenger. A policy can have UM/UIM for bodily injury even when the vehicle also has collision coverage; the two address different losses.

You were a passenger

Potential sources can include the vehicle’s PIP or MedPay, your own policy if it extends to you, the at-fault driver’s liability coverage, or UM/UIM. Which source applies first is fact- and state-dependent. Tell every relevant insurer where you were sitting, whose vehicle you occupied and whether you have another auto policy.

State examples show why geography matters

California

California’s Department of Insurance describes bodily-injury liability as payment for bodily injury caused to other people and separately explains MedPay and UM/UIM. Those descriptions explain California policy concepts; they should not be treated as a national statement about required limits or benefits. Read the California Automobile Insurance guide alongside your declarations page.

Washington

The Washington Office of the Insurance Commissioner describes PIP as optional and explains that it can include medical and hospital costs, lost wages, services and funeral costs, subject to eligibility rules, exclusions and selected limits. The page’s terms apply to Washington policies; they do not establish what a policy in another state must provide. See Washington’s PIP guidance.

Ohio

Ohio’s consumer guide says optional MedPay can pay the insured or passengers up to the selected amount regardless of fault. It also notes that the handling of medical bills depends on the circumstances, available coverages and the insurer’s instructions. Ask the adjuster which coverage should receive each bill instead of sending the same invoice everywhere. Source: Ohio Department of Insurance.

Florida

Florida’s Department of Financial Services describes Florida PIP and MedPay benefits and conditions. Florida rules are particularly poor examples for a nationwide assumption: use the state’s current requirements and your policy language, not a friend’s experience in another state. Source: Florida DFS.

Can you claim against the construction company or road agency?

Possibly, but the crash location alone does not establish contractor, traffic-control-provider or government liability. A separate claim would require evidence about what happened at the site, who controlled the roadway, what warnings or protections were required, whether a duty was breached, how that breach caused the injury, and which state or local immunity rules apply. Federal work-zone guidance explains safety requirements and responsibilities, but it does not decide liability in a particular collision: Federal Highway Administration work-zone rule guidance.

Preserve evidence before temporary conditions change: photographs or video of signs, cones, lane markings, barriers, lighting and traffic queues; the names of witnesses; the police report; and information identifying the contractor or agency shown on signs or project documents. If a serious injury, death, disputed lane control or possible public-entity claim is involved, consult a qualified attorney in the state where the crash occurred. Do not promise yourself that a contractor or government agency will pay simply because the roadway was under construction.

What to do after an injury crash in a construction zone

  1. Get emergency help and report the collision. Follow medical advice, call 911 when appropriate and obtain the incident or police-report number. Do not argue fault at the scene; describe what you observed accurately.
  2. Document the temporary roadway. If safe, photograph vehicle positions, impact damage, lane shifts, signs, cones, barriers, signal timing, lighting, weather and any obstruction. Note whether traffic-control devices were visible or moved after the crash.
  3. Identify every person and vehicle. Record drivers, passengers, witnesses, insurers, plate numbers, work vehicles and the project or agency named on nearby signs. Write down which vehicle each injured person occupied.
  4. Notify the relevant insurers promptly. Report the loss to your insurer and provide the other driver’s information. Give a factual account and follow instructions about recorded statements, examinations and repair estimates. Reporting is not an admission of fault.
  5. Read the declarations page and endorsements. Look specifically for PIP, MedPay, UM/UIM bodily injury, bodily-injury liability limits, deductibles, exclusions and household-member definitions. A policy booklet may describe a coverage that you did not purchase; the declarations page shows what was selected.
  6. Ask where bills should go. Tell the adjuster and medical providers about applicable auto coverages and health insurance, then ask which payer should receive each bill. Keep copies of invoices, explanations of benefits, prescriptions, mileage, wage-loss records and out-of-pocket payments.
  7. Track treatment and losses. Keep a dated symptom and appointment log, follow prescribed care, and save proof of missed work or paid services. Gaps or undocumented expenses can make a claim harder to evaluate, although they do not automatically defeat it.
  8. Protect deadlines. State notice, claim, lawsuit and government-entity deadlines vary. Check the policy and state rules immediately, especially if a public road agency may be involved; an insurer’s investigation does not necessarily extend a legal deadline.
  9. Escalate disputes in writing. Ask for the coverage position and the policy provision supporting a denial or limitation. You can contact your state insurance department for consumer assistance and obtain local legal advice for serious injury or contested responsibility.

Common mistakes that can reduce clarity or delay payment

  • Assuming “construction zone” means automatic coverage. The ordinary coverage, fault and limit analysis still applies.
  • Using liability coverage as if it were your own medical plan. Bodily-injury liability generally addresses injuries to others when the insured is legally responsible; check PIP or MedPay for first-party benefits.
  • Confusing collision with injury coverage. Collision can repair the car while a separate medical or liability coverage addresses people.
  • Applying another state’s rule. PIP availability, mandatory limits, UM/UIM options and claim procedures differ by jurisdiction.
  • Sending bills without asking for routing instructions. Ohio’s regulator specifically notes that bill handling depends on circumstances, coverages and insurer directions.
  • Discarding temporary-site evidence. Cones, signs and lane arrangements can be moved or removed, so preserve lawful photographs and witness details promptly.
  • Declaring a contractor liable before investigating. A work-zone claim needs evidence, applicable duties and an analysis of state or governmental-liability rules.

Why careful work-zone documentation matters

Work-zone crashes are a significant safety issue, but national statistics do not predict whether an individual claim will be covered. The Federal Highway Administration’s 2026 National Work Zone Awareness Week factsheet reports 850 work-zone fatalities in 2024, based on NHTSA Fatality Analysis Reporting System files; FHWA says the figures reflect an April 2026 snapshot and may be updated intermittently. An FHWA 2025 awareness-week publication estimated 37,000 work-zone injuries in 2022 and listed 891 work-zone fatalities that year. Those are historical national figures, not a current-year estimate or an individual driver’s risk: FHWA 2025 publication. FHWA also cautions that work-zone crash statistics come from law-enforcement reports and are only as accurate as the information recorded in them: FHWA facts and statistics.

As FHWA Administrator Sean McMaster put it, “Work zone safety is every driver’s responsibility.” That reminder supports slowing down, leaving space and following temporary controls; it does not determine who is legally at fault or which policy pays. The quotation appears in the FHWA newsroom release.

Bottom line for an injured driver

Start with the policy, not the construction label. PIP or MedPay may provide first-party medical benefits; another driver’s bodily-injury liability may apply when that driver is legally responsible; UM/UIM may help when insurance is missing or inadequate; and collision addresses the vehicle rather than the injury. Review the declarations page, report the crash, preserve the work-zone evidence and obtain state-specific advice before assuming an insurer, contractor or public agency must pay.
