Sometimes, but AI involvement alone does not decide coverage. A claim is more likely to be covered when it fits a policy’s insuring agreement, definitions, limits and conditions and is not removed by an exclusion or endorsement. A chatbot’s inaccurate answer, an AI-assisted ransomware attack, a deepfake payment scam and physical damage caused by an autonomous system are different insurance problems.
Coverage depends on what happened, who alleges harm, whether your company built or merely used the AI, and the exact wording in force when the event occurred. This U.S.-leaning guide explains which policy lines to examine, how 2026 exclusions may affect commercial general liability coverage, and how to conduct a wording-based review before a claim or renewal.

What decides whether an AI-related loss is covered?
The starting point is the loss and the allegation, not the label “AI.” Write down the event in concrete terms: what the system did, what harm followed, who suffered it, and what the claimant says your business did wrong. Then compare those facts with the policy’s insuring agreement, definitions, exclusions, endorsements, limits, deductibles and notice conditions.
The same AI tool can create claims under several lines. A customer may allege that an automated recommendation caused financial harm; a regulator may investigate discriminatory decisions; an attacker may use generative AI to breach a network; or a deepfake may persuade an employee to send money. Each scenario has a different coverage trigger and may involve more than one policy without guaranteeing that any policy will pay.

Identify the AI’s role
- Internal tool: Employees use a third-party model for drafting, analysis or support.
- Customer-facing output: Your business gives clients answers, recommendations or content generated or assisted by AI.
- Technology product or service: You develop, integrate, host or sell an AI-enabled system.
- Decision support: The system influences hiring, credit, pricing, safety or another consequential decision.
- Autonomous action: Software can approve transactions, alter systems or control equipment without a person reviewing every step.
Insurers may analyze these roles differently. A company supplying technology can face a professional-negligence allegation that is materially different from a retailer that used a vendor’s chatbot in customer service.
Which business insurance policies might respond?
Several policy lines may be relevant, but each has a different grant of coverage. The table is a screening tool, not a prediction about a particular policy.

| Policy line | Situations to examine | Key limitation to check |
|---|---|---|
| Cyber and privacy | A covered data breach, network compromise, ransomware event or other security incident in which AI was used by the attacker or affected the response. | AI involvement does not itself create a security event. An inaccurate output, defamation allegation or intellectual-property dispute may fall outside a breach-based trigger. |
| Technology errors and omissions (E&O) or professional liability | A customer alleges that a technology product or professional service was defective, inaccurate or performed negligently. | Older wording may not clearly address probabilistic outputs, hallucinations or autonomous actions. Exclusions, service definitions and the insured’s role control the result. |
| Commercial general liability (CGL) | Alleged bodily injury, property damage, or personal and advertising injury, depending on the form and endorsements. | AI exclusions may apply, and treatment of products, completed operations and advertising injury varies by form. |
| Product liability | Physical injury or property damage allegedly caused by an AI-enabled product, including a device that acts on model output. | Products-completed-operations wording and any AI endorsement can narrow or remove the grant. |
| Property and business interruption | Physical loss or damage and covered time-element loss after an AI-controlled system, cyber event or other peril causes damage. | Electronic-data exclusions and “silent cyber” wording can complicate causation and the definition of physical damage. |
| Crime and social engineering | A fraudulent transfer or similar financial loss caused by a deepfake voice, video or impersonation. | Traditional wording may assume compromised email or network access. A deepfake may require a specific social-engineering or impersonation endorsement. |
| Directors and officers (D&O), management liability and employment practices liability (EPLI) | Board decisions, investor disclosures, regulatory investigations, employment or discrimination allegations involving AI deployment. | The actual coverage grant, conduct exclusions, insured-versus-insured provisions and investigation language matter; there is no universal AI-specific rule. |
A Gallagher Re industry overview describes cybersecurity events as generally associated with cyber coverage, while output liability such as hallucinations or defamation as only partly addressed under technology E&O or CGL and often not triggered by cyber coverage. Those categories describe market tendencies, not a promise under your contract.
Will cyber insurance cover an AI mistake?
Usually only if the mistake is tied to a covered security or privacy event. Cyber policies commonly respond to breaches, system compromises, ransomware and related incident expenses. An AI model that gives an incorrect answer, copies protected material or produces a defamatory statement may cause serious loss without being a security incident or data breach.
Read the policy’s definitions of “security failure,” “privacy event,” “computer attack,” “network” and “data.” Then examine exclusions for professional services, intellectual property, media liability, intentional acts and contractual liability. If an AI-enabled attack caused the loss, the attack may satisfy a cyber trigger, but the policy can still limit payment through sublimits, waiting periods, exclusions or a requirement to use approved vendors.

When are technology E&O or professional liability policies more relevant?
Technology E&O is generally more aligned with an allegation that a technology supplier’s product or service failed to perform as promised. A developer whose model produces materially wrong outputs, or an integrator whose automation misroutes transactions, may need to analyze that line before looking only to cyber insurance.
Existing forms may not expressly address probabilistic results, training-data issues, autonomous decisions or a customer’s reliance on generated content. Look for the definition of “professional services,” performance warranties, contractual-liability exclusions, intellectual-property exclusions and any wording that limits coverage to a listed service. A business that merely uses another company’s AI product may not fit the intended insured profile for technology E&O.
How could CGL and product liability apply?
CGL can be relevant when a claimant alleges bodily injury, property damage, or personal and advertising injury, but the particular coverage part and endorsements determine whether the allegation fits. For example, a physical injury claim involving an AI-controlled machine raises a different question from a claim that generated marketing content defamed someone.
Product liability analysis adds the product’s design, manufacturing, warnings and completed operations. An AI component can be one cause among several, so read wording such as “arising out of,” “involving” and “based upon.” Broad causal language may reach a claim in which AI was only one contributing factor, while a specific endorsement may remove the exposure entirely.
What changed in U.S. AI exclusions in 2026?
Business Insurance reported on April 7, 2026, that optional ISO forms became available in January 2026 for some U.S. CGL exposures. The forms reported were:

Availability does not mean an insurer adopted a form, attached it at renewal or used the same wording in every state or policy. Confirm the actual endorsement number, edition, schedule and text in your policy. A July 2026 analysis by Ropes & Gray also noted that insurers can file exclusions without implementing them immediately, and that disputes can arise from existing language even without a new AI endorsement.
At each renewal, ask what forms changed, whether an AI exclusion was added or broadened, and whether a sublimit or deductible changed. Compare the expiring and renewal declarations and endorsements rather than relying on a summary from a vendor or application.
How should a business review its AI coverage?
Use a written, scenario-based review. The objective is to connect each realistic loss to exact policy language and identify gaps before deployment or renewal.
- Inventory every use. Record internal tools, customer-facing systems, AI-enabled products, decision-support models and autonomous agents. Include pilots and systems operated by contractors.
- Describe plausible losses. Consider a breach, inaccurate advice, defamation, an intellectual-property allegation, discrimination, physical injury, property damage, a wrongful payment and a regulatory claim.
- Identify the claimant. Note whether the potential claimant is a customer, employee, investor, business partner, regulator or stranger, and whether your company developed the system or deployed a third-party service.
- Map each scenario to a policy line. For every loss, ask which insuring agreement might respond and list the exact definition, exclusion, endorsement, sublimit and deductible that affect it.
- Search for causal wording. Review “arising out of,” “involving” and “based upon” language, along with AI, cyber, data, intellectual-property, professional-services and autonomous-system provisions.
- Check claim economics. Confirm whether defense costs erode the limit, whether related claims are aggregated, what retention applies and whether consent is required before incurring expense or settling.
- Verify reporting duties. Ask when circumstances must be reported, who receives notice and whether a change in AI deployment must be disclosed during the policy period.
- Get the answer in writing. Ask a broker or coverage lawyer to identify the operative wording, explain exclusions and flag uninsured scenarios before a material launch or renewal.
What common AI-loss scenarios look like
An AI assistant gives a customer incorrect financial guidance
This is primarily an errors-and-omissions or professional-liability question if the customer alleges negligent advice. Cyber coverage may not respond unless a covered security or privacy event is also present. Contractual promises, regulated advice exclusions and the definition of professional services deserve close review.
A model produces defamatory or infringing marketing copy
Personal and advertising injury, media liability, technology E&O and intellectual-property exclusions may all matter. CGL coverage can be narrowed by an AI endorsement or by exclusions for knowing publication, intellectual-property infringement or media activities. Preserve prompts, approvals and the final publication because the policy and defense analysis may depend on what the business knew and authorized.

An attacker uses generative AI in a ransomware campaign
The relevant question is whether there was a covered security incident, not whether the attacker used AI. Cyber coverage may address investigation, notification, restoration and interruption subject to its definitions, waiting period, sublimits and cooperation requirements.
A deepfake persuades an employee to wire money
Examine crime and social-engineering coverage, including how the policy defines fraudulent instruction, impersonation, verification procedures and computer fraud. A policy written around compromised email or network access may not clearly include a synthetic voice or video without an appropriate endorsement.
An autonomous system damages equipment or injures someone
Property, CGL, product liability and workers’ compensation may be implicated depending on who was injured, what was damaged and whether the event arose from a covered peril. Causation, maintenance, design, warnings and any autonomous-system exclusion can change the analysis.
What gaps and pitfalls should businesses look for?
- Assuming one policy follows the technology: A single AI deployment can create cyber, professional, liability, crime and management exposures that do not share the same trigger.
- Treating a vendor contract as insurance: Indemnity language may shift responsibility between companies but does not expand your insurer’s grant of coverage.
- Ignoring “silent” restrictions: Electronic-data, software, professional-services and intellectual-property exclusions can affect an AI claim even when the policy never says “AI.”
- Overlooking defense mechanics: A defense obligation, if triggered, can still be subject to a self-insured retention, consent requirement or defense-cost erosion of limits.
- Failing to update underwriting information: A material change from internal experimentation to customer-facing or autonomous use may affect representations, conditions or renewal terms.
- Expecting a standardized AI policy: Specialty AI liability products are an emerging category, not a uniform replacement for established lines. Terms, availability and insurer appetite vary.
When should you involve a broker or coverage lawyer?
Seek a wording-based review when AI affects customers, regulated decisions, physical operations, payment approvals or a product you sell; when a renewal adds an exclusion; after a serious incident; or when a contract requires you to insure an AI-related risk. Ask the adviser to quote the exact clause, identify the factual assumptions and distinguish a likely defense obligation from an indemnity payment.
The National Association of Insurance Commissioners cautions that AI systems “do not truly understand context and meaning the way humans do and may generate information that sounds accurate but is incorrect.” That warning is also an insurance-control issue: document human review, approval thresholds, testing, access controls and incident escalation so you can show how the business managed foreseeable risk.

Does geography affect the answer?
Yes. Insurance forms, endorsements, regulatory requirements and court interpretations differ by jurisdiction. The 2026 ISO developments discussed here concern U.S. commercial forms; they do not establish coverage rules in another country. Even within the United States, the policy’s governing law, issuing state, admitted form and applicable statutes can affect interpretation.
For a disputed claim, preserve the policy, schedules, endorsements, applications, underwriting communications, system logs and relevant prompts or outputs. Give notice according to the policy and avoid making admissions before receiving advice on the contract and the underlying allegation.

Frequently Asked Questions
Does using a third-party AI tool automatically void my business insurance?
No. Using outside software is not, by itself, a universal cancellation or exclusion trigger. The practical issue is whether the claim fits the policy and whether your application, contract, security controls or notice obligations contained facts that have changed.
Can an insurer deny an AI claim if the policy never mentions artificial intelligence?
It may still rely on a pre-existing exclusion or a failure to satisfy the insuring agreement; an AI-specific word is not required for every limitation. Conversely, silence about AI is not proof that coverage exists, so the complete form and applicable law must be read together.
What records should I keep after an AI-related incident?
Retain the relevant policy versions, system and access logs, prompts and outputs, human approvals, vendor communications, incident timeline and costs. Those records help establish what happened, when it happened and whether notice, cooperation and loss-calculation requirements were met.
Can one AI incident trigger more than one insurance policy?
Yes, a single event can involve several potentially relevant lines, such as cyber for a breach, crime for a fraudulent transfer and liability coverage for a third-party injury. The policies may contain other-insurance clauses, related-claim rules or allocation provisions that determine how they interact.
