Do You Pay Taxes When You Inherit a House?

For a U.S. beneficiary, generally no federal income tax is due simply because a house is inherited. The inheritance establishes a tax basis; it is not treated like wages or ordinary income. Tax questions usually arise if the home is later sold, if the estate has a federal estate-tax obligation, or if the state where the property or estate is located imposes its own tax.

The result depends on the home’s valuation, ownership structure, estate documents and state law. Keep the beneficiary’s income-tax question separate from taxes that may be owed by the estate.

Which tax applies, and when?

Receiving a house and selling a house are different tax events. The federal income-tax rules generally do not require a beneficiary to report the home’s value as income when title passes from the decedent. The federal income-tax issue usually becomes relevant when the beneficiary disposes of the property. The estate may have a separate filing or payment obligation, and state taxes follow their own rules.

Event Potential taxpayer What generally happens
House passes to a beneficiary Beneficiary Generally no federal income tax merely for receiving the property; the beneficiary obtains a basis for future tax calculations.
Estate administration Estate A federal estate-tax return or payment may be required depending on the estate and the applicable year’s rules.
Inherited house is sold Beneficiary or other owner Taxable capital gain may result if the amount realized exceeds the correct basis, after relevant adjustments.
State inheritance, estate or transmission tax Beneficiary, estate or another responsible party under state law Outcome depends on the state connected to the property and estate; no nationwide rule resolves it.

The Internal Revenue Service’s Publication 530 explains inherited-home basis and related reporting, while the IRS estate-tax guidance addresses the estate-level question.

What is the tax basis of an inherited house?

Basis is the tax value used to measure gain or loss when property is sold. Under the general inherited-property rule, basis is the home’s fair market value on the decedent’s date of death. That valuation is not necessarily the amount the decedent originally paid and may differ from the home’s later listing price or sale price.

Date-of-death valuation

The personal representative normally obtains an appraisal or another supportable valuation for the date of death. Ask for that valuation and keep the appraisal, valuation statement and closing documents with your tax records. The date-of-death figure is the starting point even when the beneficiary keeps the home rather than selling immediately; it becomes important if a later taxable disposition occurs.

Alternate valuation elected by the estate

An estate-tax personal representative may elect an alternate valuation date when the estate qualifies and the election is made under the applicable estate-tax rules. If that election applies, the basis may be tied to the alternate valuation rather than the date-of-death value. Do not assume the date-of-death appraisal is the operative basis until the executor confirms whether an election was made. The IRS describes these rules in Publication 551, Basis of Assets.

Consistent basis and Schedule A to Form 8971

When a federal estate-tax return is filed in a covered case, a beneficiary may receive Schedule A to Form 8971. The consistent-basis rules can require the beneficiary’s reported basis to align with the estate-tax value reported for the property. In that situation, the beneficiary may not be free to claim an initial basis higher than the value reported on the schedule. Request the schedule from the personal representative and compare it with the appraisal and other estate records.

Special rules that can change the general result

The date-of-death rule is a starting point, not a promise that every ownership arrangement receives the same treatment. IRS Publication 551 discusses specialized basis provisions, including special-use valuation for qualifying real property and property subject to conservation-easement rules. Most ordinary inherited residences will not use those provisions, but they matter when the home has unusual qualifications.

A specific anti-abuse rule can apply when the beneficiary or the beneficiary’s spouse transferred appreciated property to the decedent within the one-year period ending at death and the same property is later reacquired from the estate by that donor or spouse. In that circumstance, basis may be the decedent’s adjusted basis immediately before death rather than the property’s date-of-death fair market value.

Joint ownership and community-property status can also produce a different basis calculation for a surviving owner than for a person who inherits a house alone. The result depends on the title arrangement and the law of the relevant state. Obtain the deed, ownership agreement and estate documents before calculating a surviving owner’s basis.

Do you pay capital-gains tax if you sell the inherited house?

A later sale can create taxable gain. Compare the amount realized on the sale with the property’s applicable basis, taking account of permitted adjustments. If the amount realized is greater, the difference may be taxable capital gain. The IRS states: “If you sell the property for more than your basis, you have a taxable gain.” That statement addresses a sale above basis; it does not impose income tax merely because the house was inherited. The IRS discusses this distinction in its Gifts and inheritances FAQ.

Sales close to the inherited value

A sale soon after inheritance may produce little gain when the contract price is close to the established basis. A small difference can still matter, and a loss is not automatically deductible in every personal-use situation. The tax result depends on how the home was used, the ownership history and the records supporting the basis.

Adjustments that require records

Keep invoices and settlement statements for capital improvements, because qualifying improvements can increase basis. Retain broker commissions and other selling costs shown on the closing statement, since transaction costs can affect the amount realized. Damage claims, insurance proceeds, depreciation and a change from personal to rental or business use can introduce additional adjustments. Do not estimate these figures from memory; use the estate appraisal, closing statement and documented costs.

Federal reporting when a filing is required

The IRS notes that gross proceeds from a sale are considered when determining whether a return must be filed. When the taxpayer has a filing requirement for the transaction, the sale is reported on Form 8949 and Schedule D of Form 1040. The correct forms and entries depend on the taxpayer’s facts, including the basis supplied by the estate and whether the property was used as a residence, rental or business asset.

How is estate tax different from the beneficiary’s income tax?

Federal estate tax is imposed, if applicable, at the estate level. It is not automatically an income-tax bill issued to each beneficiary who receives an asset. The estate’s representative must determine whether a federal estate-tax return is required under the rules for the year of death and whether tax is due. The IRS explains that many relatively simple estates do not need to file, but the filing decision depends on the estate’s circumstances and the applicable year.

An estate-tax filing can still affect the beneficiary even when no beneficiary income tax is due at inheritance. The reported estate value may control the beneficiary’s basis under the consistent-basis rules, and the representative may need to provide Schedule A to Form 8971. Ask the representative whether a return was filed, whether the house was reported and which value was assigned to it.

What state taxes could apply?

States may impose inheritance, estate or transmission taxes, and their definitions, exemptions, filing duties and responsible parties differ. The state where the house is located is an important starting point, but the decedent’s domicile, the estate’s other assets and the beneficiary’s relationship to the decedent can also matter under a particular state’s law.

Do not assume that a state tax applies everywhere, and do not assume that no state tax applies because federal income tax was not due on receipt. The IRS publications refer to date-of-death appraisals for state inheritance or transmission-tax purposes, but a current answer requires checking the relevant state revenue agency’s rules for the year of death and the property’s jurisdiction.

Three common outcomes

Situation Federal income-tax focus Records or checks needed
Inherit and keep the house Generally no federal income tax simply from receiving it. Basis must still be established for a future sale or other disposition. Date-of-death appraisal, any alternate-valuation election, deed and ownership documents.
Sell near the established basis The sale may produce little gain, but the actual amount realized, basis adjustments and filing requirement control. Estate valuation, closing statement, improvement invoices and selling expenses.
Sell above the established basis The difference may be taxable capital gain and, when a return is required, is reported using Form 8949 and Schedule D. Basis documentation, sale proceeds, allowable adjustments and records of how the home was used.

What to do after inheriting a house

  1. Identify the ownership and location. Obtain the deed, trust or probate documents and confirm whether you inherited the entire home, a fractional interest or an interest jointly with a surviving owner. Note the state where the property sits and the decedent’s state of residence.
  2. Ask for the valuation. Request the date-of-death appraisal or other valuation used by the estate. Ask specifically whether the personal representative elected an alternate valuation date and whether special-use or other specialized valuation rules were used.
  3. Request estate-tax information. Find out whether a federal estate-tax return was filed. If the estate provided Schedule A to Form 8971, keep it and verify the property value shown there before reporting a basis on a later sale.
  4. Review ownership-specific rules. If the property was jointly owned, community property or transferred to the decedent within one year before death by the beneficiary or spouse, have the representative or a tax professional analyze the applicable exception instead of applying the ordinary date-of-death rule automatically.
  5. Build a basis file. Keep the appraisal, probate inventory, deeds, improvement receipts, insurance or casualty records, rental or business-use records and every sale-related settlement statement. These documents support both the starting basis and later adjustments.
  6. Before selling, calculate the transaction. Compare the amount realized with the documented basis after allowable adjustments. Determine whether a federal return is required and, if so, prepare Form 8949 and Schedule D with the supporting records.
  7. Check state requirements. Contact the revenue agency for the state tied to the property and estate. Ask about inheritance, estate or transmission taxes, required returns, deadlines and appraisal requirements for the year of death.

When professional tax help is warranted

Professional advice is especially useful for a large estate, a disputed appraisal, multiple beneficiaries, a recent gift to the decedent, joint or community-property ownership, a rental or business history, conservation restrictions or a planned sale. Those facts can change the basis, the person responsible for filing, or the state-tax analysis. A tax professional or estate-tax preparer can reconcile the appraisal with Schedule A to Form 8971, identify required federal forms and check the state rules before a deadline is missed.

For an ordinary inheritance with clear records, the key sequence is straightforward: receiving the house generally is not federal income, the estate establishes a defensible basis, and a later sale is measured against that basis. The documents supplied by the personal representative determine which version of the basis rules applies.
