The answer depends on whether the special agent is asking for a voluntary interview or has served a formal summons. A voluntary request is different from compulsory process. In most interview situations, you may ask to consult an authorized representative and the IRS must suspend the interview while you do so. A summons generally requires the named person to appear, and a representative cannot appear in that person’s place. If Criminal Investigation is involved, or if a question could incriminate you, contact a qualified tax controversy or criminal tax attorney before answering or producing records.
This is general information about the U.S. federal tax process, not a determination of your legal obligations. Read the exact notice you received, identify the deadline and your stated role, and have counsel review it before you make substantive statements.

Start by identifying what the agent is asking you to do
“IRS special agent” usually means an investigator in IRS Criminal Investigation. The title alone does not tell you whether you must answer questions. The legal effect comes from the process the agent is using and, in some cases, whether you are being treated as a subject or a witness.

| Voluntary interview request | The agent is asking to meet or ask questions without serving compulsory process. | In most situations, requesting an authorized representative requires the IRS to suspend the interview while you consult that person. | Ask for the request in writing, clarify its purpose and deadline, and arrange counsel before discussing facts. |
| Formal summons | A legal demand that can require personal appearance, testimony and/or production of specified records. | The summoned person generally must appear. A representative cannot simply attend instead of the summoned person, and the normal interview-suspension rule does not eliminate the appearance requirement. | Do not ignore it. Have a lawyer review service, scope, deadline, objections and possible privilege issues immediately. |
| Unclear contact | You do not yet know whether the request is voluntary, whether a summons exists or whether you are a subject or witness. | Do not guess about your status or assume that an informal call has no consequences. | Ask those questions through counsel and preserve every letter, voicemail, email and attachment. |
A voluntary request is not the same thing as permission to disregard the agent. Respond promptly, but channel the response through counsel when possible. A summons is not an invitation; IRS procedures allow the government to seek judicial remedies when a person fails or refuses to comply.

What to do when the request is voluntary
- Do not provide a substantive answer on the first call. You can acknowledge receipt and say that you are obtaining advice. Avoid guessing, speculating or trying to “clear things up” before you understand the subject of the inquiry.
- Confirm the process. Ask whether the meeting is voluntary, whether any summons or other compulsory document has been issued, what period and tax matters are at issue, and whether the agent considers you a subject or a witness. If you ask these questions yourself, keep them procedural; counsel can obtain clarification for you.
- Retain an authorized representative. The IRS recognizes attorneys, certified public accountants, enrolled agents and other people authorized to practice before the IRS, subject to their practice restrictions. A representative can communicate with the agent and help determine whether a criminal tax lawyer is needed.
- Request a consultation pause. The IRS Taxpayer Bill of Rights guidance states: “In most situations, the IRS must suspend an interview if you request to consult with a representative, such as an attorney, CPA or enrolled agent.” This is a rule about suspending the interview, not a guarantee that every contact will be canceled or that a representative can answer in your place.
- Prepare only after counsel sets the scope. Gather tax returns, books, emails and other records without altering or deleting anything. Your lawyer can determine what should be produced, what needs explanation and whether a document request is actually compulsory.
The available IRS materials do not establish that every initial contact must include a particular warning that it is voluntary. Ask directly rather than relying on the agent’s tone, a telephone number or the absence of a formal-looking letter.
What changes when you receive a summons
An IRS summons can require you to appear at a stated time and place, answer questions and produce identified records. The summons manual distinguishes your personal appearance from the separate obligation to produce documents. Even if a lawyer attends, you ordinarily remain the person who must appear and respond.
Read every part of the document
- Check the name of the person summoned, the issuing office and the date and place of appearance.
- List each category of testimony or record requested, including tax years, accounts, entities and electronic data.
- Note service details and every deadline. A short deadline can affect how counsel challenges scope or seeks additional time.
- Keep the original and make a complete working copy for your lawyer.
Do not treat a representative as a substitute
IRS guidance says a summoned taxpayer or witness must appear; the representative generally cannot appear instead. A request to consult counsel therefore does not, by itself, excuse you from the scheduled appearance. Your lawyer can contact the IRS about timing, scope, objections, accommodations and how the interview will proceed.

Understand the consequence of ignoring it
Failure or refusal to comply may lead the IRS to seek judicial enforcement. That is why “I will just not show up” is not a safe strategy. If you believe the summons is defective, overbroad or calls for protected material, raise the issue through counsel and follow the applicable process rather than silently disregarding the document.
Are you a subject or a witness?
Your status affects the warnings you receive and the privilege questions that arise, but an initial contact may not make the distinction clear.
Subject of the investigation
A subject is the person whose conduct is under investigation. The IRS Criminal Investigation manual’s sample advisement tells a subject that answers and submitted documents may be used in a criminal proceeding and includes this sentence: “I advise you further that you may, if you wish, seek the assistance of an attorney before responding.” The language is sample procedure in Internal Revenue Manual section 9.4.5.3.4.3, “Role of Special Agent”; it is not a promise that every agent will use identical words or that a warning will occur before every contact.

Witness or third party
A witness may be asked for information about another taxpayer, a business, an employee or a transaction. IRS procedures state that a witness must comply with lawful and reasonable requests, but may decline a particular answer that would tend to incriminate the witness. The privilege cannot be invoked solely because an answer might incriminate someone else. Your formal status and the wording of each question matter, so do not decide that you are “only a witness” and proceed without advice.
How the Fifth Amendment applies
The Fifth Amendment privilege against self-incrimination is specific, not a blanket right to refuse every IRS question. It generally concerns an answer that could tend to incriminate the person asserting it. Whether a particular question qualifies depends on the facts, the wording and the surrounding evidence.

Questions are evaluated one at a time
You may need to assert the privilege for a particular question while answering others. A lawyer can help you avoid both extremes: volunteering damaging information and making an unsupported blanket refusal that creates additional legal problems.
Records and the act of producing them are separate issues
Pre-existing documents are not automatically protected merely because their contents are incriminating. In some circumstances, the act of producing records can itself communicate facts, such as their existence, location or control. The IRS summons manual treats those as distinct, fact-specific questions. Do not assume that labeling a file “privileged” or refusing an entire document request resolves the issue.

Do not destroy or alter material
Preserve records, messages and devices exactly as they are. A privilege analysis concerns whether and how the government may compel information; it does not authorize deletion, concealment or alteration.

Choosing someone to represent you
| Option | What the IRS recognizes | When to consider it | Important limitation |
|---|---|---|---|
| Tax controversy or criminal tax attorney | An attorney authorized to practice before the IRS can represent you and advise on constitutional and criminal exposure. | Best fit when Criminal Investigation is involved, a summons has been served, or answers could be incriminating. | Tax experience is not identical to criminal-defense experience; ask specifically about investigations, summons enforcement and interviews. |
| Certified public accountant or enrolled agent | These professionals may be authorized to practice before the IRS within their applicable scope. | Useful for return preparation, accounting records and many civil tax matters. | Do not assume every CPA or enrolled agent handles criminal investigations or can provide the same legal advice as an attorney. |
| Low Income Taxpayer Clinic | Taxpayer Advocate Service guidance says eligible individuals generally include those at or below 250% of the federal poverty level, subject to clinic and case rules. | Appropriate when private counsel is unaffordable and a participating local clinic accepts the matter. | Availability, income limits, case type and capacity vary by clinic. Services may be free or low cost, not guaranteed. |
When contacting a lawyer or clinic, provide the summons or letter, all deadlines, the agent’s name and office, your tax years, and a concise timeline. Do not send an argumentative narrative or omit unfavorable facts; counsel needs an accurate record to advise you.
Confidentiality is not automatically attorney-client privilege
IRC section 7525 can extend attorney-client-like confidentiality to certain communications with federally authorized tax practitioners. IRS Taxpayer Bill of Rights guidance limits that protection to qualifying confidential communications in noncriminal tax matters before the IRS and in noncriminal federal tax proceedings.
That limitation matters when Criminal Investigation is involved. Do not promise yourself that conversations with an accountant, enrolled agent or other practitioner will remain privileged in a criminal tax matter. Ask counsel what communications are protected, who should receive them and how to preserve confidentiality.

A practical response plan
- Secure the contact. Save letters, envelopes, emails, voicemails and attachments. Write down the date, time, telephone number and exact words used by the agent.
- Classify the process. Determine whether the request is voluntary or accompanied by a summons. Identify the appearance date and production categories if a summons exists.
- Get advice before substance. Contact a tax controversy or criminal tax attorney, or a suitable authorized representative. If cost is a barrier, contact a Low Income Taxpayer Clinic promptly and ask about eligibility and conflicts.
- Preserve information. Stop routine deletion of relevant emails, files and messages. Do not edit, backdate or “clean up” records.
- Communicate through counsel where possible. Counsel can request clarification, seek a reasonable scheduling arrangement, address scope and explain how you will comply without making unnecessary statements.
- Attend when required. If a summons remains in effect, appear as directed unless your lawyer obtains a different arrangement or court relief. Bring only what counsel has reviewed and organize productions so you can identify what was provided.
- Answer accurately. Never guess. If you do not know, say so. If a question may incriminate you, pause and let counsel address the privilege issue rather than improvising a refusal or explanation.
Common mistakes to avoid
- Assuming every special-agent contact is compulsory. Ask whether there is a summons and read the document instead of inferring the answer from the agent’s title.
- Assuming every contact is voluntary. A request can become compulsory when a summons is served, and ignoring compulsory process can lead to judicial enforcement.
- Believing a lawyer can replace you at a summonsed interview. Representation helps, but the summoned person generally still must appear.
- Invoking the Fifth Amendment for every question. The privilege is evaluated question by question and does not ordinarily cover an answer that would incriminate only another person.
- Treating all records as protected. Existing documents and the act of producing them involve different analyses.
- Assuming an accountant’s files are always confidential. Section 7525 has a limited, noncriminal scope.
- Trying to explain before obtaining advice. An offhand statement, corrected later, can create inconsistencies. Preserve accuracy by slowing the process and using counsel.
How current IRS guidance fits together
IRS Tax Tip 2026-68, dated September 9, 2026, is the most recent taxpayer-facing representation guidance identified here. Internal Revenue Manual 9.4.5 contains Criminal Investigation interview procedures, including witness guidance revised April 1, 2026 and a special-agent role paragraph showing an August 5, 2024 revision date. Internal Revenue Manual 25.5.5 addresses summonses, appearance, production and privilege. Older Publication 556 interview language is dated September 2013; the more specific, newer manual provisions are the better reference for the distinctions discussed above.
Because notices, summonses and investigative roles differ, the document in your hands controls the immediate next step. A prompt, informed consultation is safer than either volunteering a narrative or ignoring an IRS demand.
