Yes, some workers can claim a federal income-tax deduction for qualified tips received in tax years 2025 through 2028. The deduction was created by the One Big Beautiful Bill Act and is claimed against taxable income. It does not make all tips tax-free: qualified tips generally remain income and are still subject to Social Security and Medicare taxes.
Eligibility depends on your occupation, whether customers paid the money voluntarily, how the tips were reported, your income and filing status, and the records you can substantiate. The maximum annual deduction is $25,000, subject to income phaseouts and an additional net-income limit for self-employed workers.

What the federal tip deduction actually does
The new rule lets an eligible taxpayer subtract qualified tip income from taxable income on a federal Form 1040. It is available for tax years 2025, 2026, 2027 and 2028. You may use the deduction whether you itemize deductions or claim the standard deduction.
This is an income-tax deduction, not an exemption from every tax connected with a tip. Tips are generally included in gross income. For employees, reported tips generally remain subject to Social Security and Medicare taxes, and employers continue to handle payroll reporting under the usual rules. The deduction can reduce the amount on which federal income tax is calculated, but it does not guarantee a refund or a particular dollar amount of tax savings.
#1 Best Overall
The 2025 Form 1040 instructions describe tips as generally taxable income and subject to Social Security and Medicare tax. The new deduction is therefore best understood as a targeted adjustment to federal taxable income rather than a blanket “no tax on tips” rule.
Who may be eligible
Both employees and self-employed individuals can qualify if they perform work in an occupation on Treasury’s final list of occupations that receive tips and satisfy the other requirements. Receiving money described as a tip is not, by itself, enough. The occupation must be checked against the official list rather than inferred from a job title.
The final regulations group more than 70 occupations into eight broad categories:

The IRS announcement of the final regulations specifically identified visual artists, floral designers and gas pump attendants as additions to the final list. Those additions do not mean every worker with a similar-sounding job qualifies; verify the precise occupation and the duties performed.
About 6 million workers report tipped wages, according to an IRS 2025 figure. That number is a count of workers reporting tipped wages, not a count of people who qualify for or claim this deduction.

Occupation is only the first test
A listed occupation does not override the other conditions. You must also have qualified tips, report them in an allowed way, satisfy the Social Security number and filing rules, and remain within the income and dollar limits.
What counts as a qualified tip
The final regulations require a qualified tip to meet all of the following characteristics:

- Voluntary payment: A customer must choose to pay the amount. The customer must be able to disregard or modify it.
- Cash or cash equivalent: Physical cash, card payments and electronic settlements can qualify as cash-equivalent forms.
- Required reporting: The amount must appear on an applicable information return or be reported directly by an employee using Form 4137.
Tip pools and tip sharing
For employees, tips received through a tip-sharing arrangement, including a tip pool, may qualify. Keep the employer’s allocation records and your own contemporaneous records so the amount you claim can be tied to the work and reporting documents.
Mandatory service charges are different
A mandatory service charge generally is not a qualified tip when the customer cannot disregard or change it. Calling a charge a “gratuity” on a receipt does not make it a qualified tip if the customer had no choice. Review how the charge was imposed and whether the customer could alter it, not merely the label used by the business.
How tips must be reported
Qualified tips must be included on one of the reporting documents specified by the regulations, or reported directly by an employee on Form 4137. The possible documents differ by worker and payer:
Rank #3
| Worker or reporting situation | Potential reporting document | What to verify |
|---|---|---|
| Employee whose employer reports tips | Form W-2 | Compare the tip amount with payroll and employer records. |
| Independent contractor or other nonemployee recipient | Form 1099-NEC or Form 1099-MISC | Confirm that the payment relates to a listed occupation and was voluntarily paid. |
| Payment-card or platform settlement reporting | Form 1099-K | Reconcile the form with settlement statements, receipts and tip records. |
| Employee reporting tips not shown on an information return | Form 4137 | Use the amount that was reported directly under the applicable IRS instructions. |
The form does not turn an ineligible payment into a qualified tip. It is evidence of the amount and reporting; the occupation and voluntary-payment tests still apply.
Deduction limits and income phaseouts
| Limit | Rule |
|---|---|
| Annual maximum | Up to $25,000 of qualified tips per taxpayer per year. |
| Self-employed income cap | A self-employed worker cannot deduct more than the net income from the trade or business in which the tips were earned, before this deduction. |
| Phaseout threshold | Phaseout begins when modified adjusted gross income (MAGI) exceeds $150,000, or $300,000 for married taxpayers filing jointly. |
| Filing status for married taxpayers | Married taxpayers must file a joint return to claim the deduction. |
The $25,000 figure is a ceiling, not an automatic deduction. A taxpayer with $8,000 of qualified tips may be limited to $8,000 before applying the income phaseout and any self-employment limitation. A self-employed worker with $20,000 of qualified tips but only $12,000 of net income from the relevant business cannot deduct more than $12,000 before other limits.
The phaseout is based on modified adjusted gross income, not simply the amount of tips. If your MAGI is above the applicable threshold, the allowable deduction is reduced under the IRS calculation. The materials establishing the rule do not support a universal percentage or a typical tax saving, so do not estimate your result from the threshold alone.
Social Security numbers and filing requirements
A valid Social Security number is required for the taxpayer or spouse who received the tips. Married taxpayers must file jointly; a married-filing-separately return does not meet the stated requirement. Eligible taxpayers may claim the deduction while taking either the standard deduction or itemized deductions.
The deduction is claimed on Schedule 1-A filed with Form 1040. Use the instructions for the tax year being filed, because form lines and reporting procedures can change even while the underlying four-year availability period remains the same.

Special documentation rules for tax year 2025
For 2025, Forms W-2 and the various Forms 1099 were not redesigned to separately identify the new qualified-tip amounts. IRS Notice 2025-69 supplies transition rules for determining the amount to use. The acceptable evidence depends on how you earned and reported the tips.
Employees
An employee may use tips reported on Form W-2, contemporaneous employer records, or amounts reported on Form 4137. Preserve payroll statements, tip-pool allocations, point-of-sale summaries and any written employer records that explain how the reported amount was calculated.
Self-employed workers
A self-employed worker may need to assemble records such as earnings statements, receipts, point-of-sale reports, daily tip logs and third-party settlement records. The records should corroborate both the amount received and the connection to the listed occupation and business that generated the income.
Keep a contemporaneous log
A daily log should record the date, service or job, customer payments identified as tips, payment method, tip-pool allocation if applicable, and the related settlement or receipt number. Reconcile the log to bank deposits, platform statements and year-end information returns. Keep the records with your tax files for the period required by the general tax record-retention rules.
Recommended Free Tools
IRS 2025 guidance gives examples involving employee W-2 reporting, Form 4137 and self-employed workers documenting amounts reported on Form 1099-K with daily logs. Those examples illustrate the transition; they do not eliminate the need to apply the rules to your own occupation and records.

How to claim the deduction
- Identify the occupation. Check Treasury’s final list and match the listed occupation to the work that generated the tips.
- Separate qualified payments. Exclude mandatory, unmodifiable service charges and payments that were not voluntary customer tips.
- Reconcile the amount. Match W-2, 1099-NEC, 1099-MISC, 1099-K or Form 4137 amounts to payroll, settlement and daily-log records.
- Apply the limits. Start with qualified tips, cap the amount at $25,000, apply the self-employed net-income cap when relevant, and calculate any MAGI phaseout.
- Check filing conditions. Confirm the required valid Social Security number and, if married, a joint return.
- Complete Schedule 1-A. Enter the allowable amount on Schedule 1-A and file it with Form 1040, following that year’s instructions.
- Retain support. Keep the information returns and underlying records that substantiate the occupation, voluntary nature and amount of the tips.
Examples of how eligibility can differ
Employee with reported card tips
An employee in a listed food-service occupation receives customer-selected card tips, participates in a tip pool and sees the allocated amount on the employer’s payroll records. The amount may qualify if it is included on the employee’s W-2 or properly reported on Form 4137 and the employee satisfies the income, Social Security number and filing requirements.
Self-employed service provider
A self-employed worker in a listed personal-service occupation receives voluntary electronic tips. The worker must document the tips with settlement statements, receipts or logs and cannot deduct more than the net income from the business that earned them, before this deduction.
Customer cannot change the charge
A business adds a compulsory service charge that every customer must pay. Even if the business distributes some of that money to staff, the charge generally is not a qualified tip when customers cannot disregard or modify it.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsIncome above the threshold
A taxpayer in a listed occupation may have properly reported voluntary tips but still receive a reduced deduction if MAGI exceeds $150,000, or $300,000 for a married couple filing jointly. The threshold is a phaseout starting point, not a promise that the entire deduction disappears at one specific income.
Common mistakes that can disqualify or reduce a claim
- Assuming every tipped job qualifies: The occupation must appear on the final Treasury list.
- Treating all service charges as tips: A mandatory charge that customers cannot change generally fails the voluntary-payment test.
- Ignoring payroll taxes: The deduction does not generally remove Social Security and Medicare tax from reported tips.
- Claiming the gross amount on a 1099-K without reconciliation: Use settlement records and logs to identify the qualified portion.
- Overlooking the self-employment cap: Qualified tips cannot produce a deduction larger than net income from the business that earned them.
- Using the wrong filing status: Married taxpayers must file jointly, and a valid Social Security number is required for the taxpayer or spouse who received the tips.
- Using 2025 forms as though they had new tip fields: The 2025 transition rules require supporting records because W-2 and 1099 forms were not changed to separately report qualified tips.
- Expecting a guaranteed refund: The deduction changes taxable income; the final tax result depends on the complete return.
Federal deduction does not automatically control your state return
The rule described here is federal income-tax treatment. IRS materials do not establish that every state adopts the same deduction. Before preparing a state return, check the tax authority for your state or ask a tax professional whether the federal amount must be added back, modified or otherwise reported.
What to verify for each tax year
Because the deduction is available only through tax year 2028 and reporting forms can change, check the IRS Form 1040 instructions, Schedule 1-A instructions and any current transition or reporting notices for the year you are filing. Reconfirm the occupation list, the information-return requirements, the MAGI calculation and the documentation standard rather than carrying a prior-year assumption forward.
IRS Chief Executive Officer Frank J. Bisignano summarized the purpose of the final regulations in the agency’s April 10, 2026, release: “Given the wide variety of workers who receive tips, these final regulations help implement an important tax benefit for American workers.” The benefit remains limited to the workers, payments and records that satisfy the rules above.
