The treatment depends on what you supplied—goods, software, services or something else—whether a prescribed export declaration applies, how the money was routed, and what your authorised dealer (AD) bank requires. A service export may be made without a declaration when none of the prescribed forms applies, but the foreign exchange due still has to be realised and repatriated to India. A bank’s reporting in systems such as EDPMS is also different from you filing a separate report for each receipt.
Start with the transaction, not the country of the payer
An overseas payer does not, by itself, determine your FEMA filing duty. First identify the underlying transaction:
As an Amazon Associate I earn from qualifying purchases.
- Goods: physical products exported from India.
- Software: software supplied under the export procedures that use SOFTEX or another prescribed route.
- Services: consulting, design, development, writing, support, agency work and other services supplied to a person outside India.
- Other receipts: a foreign transfer that is not payment for an export may fall under a different FEMA rule altogether.
The export provisions distinguish these categories. They do not create a single “foreign payment report” that every freelancer or small exporter must submit. Your contract, invoice, work delivered, payment path and bank records establish what the receipt represents.
Keep three ideas separate throughout the process:
- Export declaration: a form or electronic filing describing an export where the rules prescribe one.
- Realisation and repatriation: receiving the foreign exchange that is due and bringing it to India in the manner required by FEMA and its regulations.
- Bank reporting and monitoring: your AD bank’s entries, follow-up and reporting in systems such as the Export Data Processing and Monitoring System (EDPMS).
These steps can involve the same invoice, but they are not interchangeable. A transaction can require you to preserve evidence and receive the money without requiring a separate declaration for every credit.

Service exports: when no prescribed declaration applies
The key clarification for many freelancers is in the FEMA export regulation. It says:
“For the removal of doubt, it is clarified that, in respect of export of services to which none of the Forms specified in these Regulations apply, the exporter may export such services without furnishing any declaration, but shall be liable to realise the amount of foreign exchange which becomes due or accrues on account of such export, and to repatriate the same to India in accordance with the provisions of the Act, and these Regulations, as also other rules and regulations made under the Act.”
In practical terms, if your particular service export does not fit a prescribed declaration form, the regulation permits export without furnishing that declaration. It does not say that service income is outside FEMA, that every service is automatically exempt from filing, or that you can leave export proceeds outstanding indefinitely.
There is no simple official rule in the material reviewed that classifies every freelance activity or every platform-mediated payment. A developer’s custom project, a remote design engagement, a digital marketing retainer and a platform sale may be handled differently depending on the service description, invoicing structure and bank procedure. Ask your AD bank whether a form or electronic process applies to your exact activity before assuming that “service” ends the analysis.
What a service exporter should retain
- Signed contract, purchase order or engagement letter.
- Invoice identifying the customer, service, currency and amount.
- Proof that the service was delivered, such as acceptance correspondence or completion records.
- Payment advice, remittance reference and the bank credit entry.
- Platform statements and settlement reports where an intermediary collected the money.
- Correspondence explaining deductions, refunds, chargebacks or net settlement amounts.
These records let the bank map a credit to the underlying export if it asks for clarification, even where no separate declaration was required.

Goods exports: a declaration and bank-document process
Goods exporters generally have a prescribed declaration process, subject to the exemptions and procedures in the applicable rules. The RBI’s described goods workflow involves export documents being lodged with the AD bank. In the specified process, the exporter submits the relevant documents to the bank within 21 days of export. The bank then reports the covered transaction through EDPMS and follows up on overdue export bills.
The 21-day period is a procedural requirement for the described goods process, not a universal deadline for every type of service receipt or every export route. Customs documentation, shipping bills and the exact electronic workflow can vary. A small exporter should therefore ask the bank which document set and submission channel apply to the shipment before dispatch.

Why this is not “report every payment”
For a goods shipment, you may provide an export declaration and supporting documents, while the bank performs the EDPMS reporting. That is different from filing a new FEMA report personally every time a foreign buyer’s transfer appears in your account. The exporter supplies transaction evidence; the bank records and monitors the export in its regulatory systems.
Software exports and SOFTEX
Software exports can have a distinct SOFTEX procedure. RBI directions describe both single and bulk SOFTEX forms. The bulk statement includes invoice information even for invoices below USD 25,000. That detail is important because it rules out treating USD 25,000 as a universal “no filing” threshold for all software exports.
The amount, delivery model, customer, invoicing arrangement and whether the transaction falls within the SOFTEX framework all matter. A small invoice may still need to appear in a bulk statement where that procedure applies. Conversely, a freelancer supplying a service that is not a software export under the relevant process should not automatically be pushed into SOFTEX merely because the work was delivered online.

Questions to ask before choosing a software route
- Is the deliverable software, a licence, hosted access, implementation work or a broader service?
- Does the bank classify the transaction under SOFTEX, a service-export route or another procedure?
- Should invoices be filed individually or in a bulk statement?
- What technical, invoice and customer details must appear in the bank’s records?
Realisation and repatriation are separate from declaration
Even when no declaration form applies, export proceeds still have to be realised and repatriated as required by FEMA. The RBI Master Direction on Export of Goods and Services states that proceeds for goods, software and services must be realised and repatriated within nine months from the export date, “until further notice.”
That wording is important. The nine-month period appears in the inspected Master Direction text, but procedural directions can change and the consolidated page contains legacy material. Treat nine months as the period stated there, not as a timeless rule. Confirm the currently applicable period, any category-specific treatment and the route for an extension with your AD bank.
Realisation means the export receivable is paid. Repatriation concerns bringing the foreign exchange to India in accordance with the Act and regulations. An invoice that remains unpaid, a payment held by an intermediary, a refund or a disputed amount may need separate explanation and follow-up. Do not assume that the absence of a declaration removes the bank’s ability to ask why proceeds are outstanding.
Direct buyers, platforms and third-party payers
The payment route can change the evidence your bank expects. RBI provisions allow certain third-party payments subject to conditions. The Master Direction states that a third-party export payment must move through banking channels and that the exporter declares the third-party remittance in the Export Declaration Form when that form applies.
Do not label every payment processor as a “third-party payer” in the legal sense. A platform may collect funds, deduct its fee and remit the balance; another provider may merely process a card transaction; a marketplace may be the contractual buyer. The bank needs to know how that provider is structured and how the money relates to your invoice.

Evidence for an intermediary settlement
- Keep the customer order or contract showing who bought the service or goods.
- Keep the platform invoice or settlement statement showing the gross amount, fees, taxes or adjustments.
- Match the net bank credit to the settlement reference and payment date.
- Ask the AD bank how to describe the payer and intermediary in its records.
- If a declaration form applies, disclose the third-party remittance in the manner the bank specifies.
Using a recognised payment channel does not automatically settle the classification question. Nor does a direct bank transfer guarantee that no documentation is needed.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.What your AD bank may do
Your AD bank is the operational point for many export controls. Depending on the transaction, it may:
- review your contract, invoice, shipping or software documents;
- confirm whether a declaration form or electronic filing applies;
- credit and identify the inward remittance;
- record or report covered exports in EDPMS;
- follow up on export bills that remain outstanding;
- request clarification about a payer, intermediary, currency, refund or short receipt.
This bank-side work is not proof that you personally had to file a separate report for every payment. It is the bank’s monitoring and regulatory reporting obligation connected with the export records it handles.
A practical decision process for freelancers and small exporters
- Describe what you supplied. Write down whether the transaction was goods, software, a service or something else. Avoid relying only on a payment app’s category.
- Identify the export date and customer. Keep the order, contract and invoice together, including the agreed currency and amount.
- Ask whether a prescribed form applies. For services, ask specifically whether any FEMA export declaration applies to your activity. For software, ask whether SOFTEX is required and whether single or bulk filing is appropriate. For goods, confirm the customs and bank-document path.
- Map the payment route. Record whether the buyer paid directly, through an intermediary or through a platform that settled the funds after deductions.
- Retain the banking trail. Save the remittance advice, bank credit details, settlement statement and any correspondence about fees or adjustments.
- Track the receivable. Maintain a schedule of invoices paid, partly paid and unpaid. Ask the bank about the applicable realisation deadline and any extension procedure before an invoice becomes overdue.
- Resolve exceptions early. Contact the AD bank if the payer name differs from the customer, the amount is short, the money is refunded, or a platform holds the balance.
Common mistakes and how to correct them
“Every overseas credit needs its own FEMA report.”
This confuses a foreign payment with an export declaration. Classify the underlying transaction first, then ask whether a prescribed form applies.

“No declaration means I can ignore the proceeds.”
The same clarification preserves the duty to realise and repatriate foreign exchange due or accruing from the service export.
“Invoices under USD 25,000 are automatically outside SOFTEX.”
The RBI direction says bulk SOFTEX statements include invoice information below USD 25,000. The amount alone does not decide the process.
“The bank’s EDPMS entry is my personal filing.”
For the described goods process, the exporter lodges documents and the bank reports through EDPMS. Those are separate roles.
“A payment platform removes all compliance work.”
An intermediary can make the payer, invoice amount and settlement trail less obvious. Preserve the platform statement and obtain the bank’s instructions for third-party or net-settlement receipts.
FEMA is not the only rule set
This answer concerns FEMA export declarations, realisation and repatriation, and bank handling. Income-tax, GST, accounting, anti-money-laundering checks, customer-contract rules and platform terms can impose separate obligations. A receipt that needs no FEMA export declaration may still need treatment under another regime. Address those questions separately with the relevant authority or a qualified adviser.
When to get individual advice
Ask the AD bank or a qualified professional before relying on a general explanation if the work combines software and services, the customer pays through a different legal entity, a third party receives the money, proceeds are held outside India, invoices are overdue, or a refund and replacement payment are involved. Give the adviser the contract, invoice, payment trail and a plain-language description of what you delivered. Those facts, rather than the label “freelancer,” determine the practical route.
Bottom line
Freelancers and small exporters do not have to file one separate FEMA report for every foreign payment merely because the payer is overseas. Goods and software can have prescribed declaration procedures; a service export for which no prescribed form applies may be exported without that declaration. In every case, keep evidence, use the required banking channel, realise and repatriate export proceeds, and confirm the current procedure with your AD bank—especially for third-party payments, software filings and deadline-sensitive transactions.
