John Curtis’s “TikTok on steroids” remark was a political comparison—not proof that DeepSeek and TikTok operate identically. Curtis made the comment on January 29, 2025, as lawmakers questioned DeepSeek’s data practices and Chinese legal environment. The subsequent proposals targeted government technology and, later, certain intelligence-community systems; the available legislative record does not establish a nationwide ban on ordinary Americans using DeepSeek.
What John Curtis meant by “TikTok on steroids”
At a Senate Commerce Committee hearing on January 29, 2025, Sen. John Curtis, Republican of Utah, questioned Howard Lutnick, then President Donald Trump’s nominee for commerce secretary, about DeepSeek’s relationship to China and the risks of its rapid adoption.

Curtis asked whether China had genuinely produced a cheaper and better AI model or whether DeepSeek had benefited improperly from other companies’ work. Lutnick replied, “It’s easy to be cheaper if you steal it,” referring to allegations that DeepSeek had improperly obtained or used outputs from other AI systems. Those allegations should not be treated as an adjudicated finding.

Lutnick responded with a broader argument for reciprocity in U.S.-China relations, not with an announcement of a specific DeepSeek policy. Curtis’s account of the exchange and the hearing transcript document the remarks.

The phrase was therefore an analogy about influence, jurisdiction and data exposure. It was not a technical conclusion that DeepSeek and TikTok collect data in the same way, have the same corporate structures or present identical risks.
Why DeepSeek was compared with TikTok
The comparison drew on several similarities:
- Both are widely used consumer-facing services associated with Chinese companies.
- U.S. officials raised concerns that information collected by such services could be subject to Chinese legal or governmental pressure.
- Both became symbols of a broader debate about foreign-adversary technology, personal data and influence operations.
But the differences matter. TikTok primarily records viewing behavior and social interactions. A chatbot can receive a user’s words directly, along with files, code and detailed descriptions of personal or professional problems. That does not prove that a provider or government accessed every submission. It does mean the consequences of careless disclosure can be different.
A useful risk question is not simply, “Is the app Chinese?” It is: What information does the service receive, where is it processed, who can administer or legally compel access to it, how long is it retained, and what controls does the user have?
What DeepSeek’s privacy policy says
DeepSeek’s privacy policy describes collection of account information, prompts and conversation content, uploaded files, device and log information, usage data, and information collected through cookies or similar technologies. The policy also addresses storage and processing locations and possible disclosure to legal authorities when required. Readers should check the current policy because the applicable text and product practices can change. DeepSeek’s privacy policy is the primary reference.
Government materials available from the period described DeepSeek data as being stored or processed on servers in the People’s Republic of China. That is a material consideration for organizations handling regulated or confidential information. It is not, by itself, proof that Chinese authorities accessed a particular person’s prompts or received every user’s data. Congressional materials and a Montana Department of Justice memorandum discussed the location and associated risks.

What technical evidence was reported
Security researchers examining a version of the mobile application reported code and data-transfer capabilities involving China Mobile or infrastructure associated with China Mobile. That reporting helped drive calls for restrictions, but it needs to be described precisely:
- A discovered code path or capability is not proof that it was exercised against every user.
- Transmission to a server in China is not the same as proof that the Chinese government received every prompt.
- DeepSeek’s corporate relationships, hosting arrangements, telecommunications connections and legal obligations are separate questions.
- Application behavior can change with updates, so the tested version and platform matter.
Contemporary technical reporting also noted that the Federal Communications Commission denied China Mobile’s application to provide U.S. telecommunications service in 2019 on national-security grounds. That historical FCC action does not establish that DeepSeek is controlled by China Mobile.

What ban was proposed?
S. 765: the No DeepSeek on Government Devices Act
Senators Jacky Rosen, John Husted and Pete Ricketts introduced the bipartisan No DeepSeek on Government Devices Act, S. 765, on February 27, 2025.
The bill would have required executive agencies to remove DeepSeek and successor services from executive-agency information technology within a specified implementation period. Its text included exceptions for law-enforcement activities, national-security interests and security research, with risk-mitigation requirements for authorized use.
Congress.gov lists referral to the Senate Homeland Security and Governmental Affairs Committee on February 27, 2025, as the latest action in the record supplied for this article. That means the bill was introduced and referred to committee; the record does not show it as enacted. It is inaccurate to describe S. 765 alone as a completed government-wide ban.

Other proposals addressed federal contractors, procurement and intelligence-community systems. For example, S. 1638 proposed restricting contractors’ use of DeepSeek in performing or supporting federal contracts, subject to a possible national-security waiver. A proposal is not the same as an operative prohibition; contractors must examine the final law, applicable contract clauses and effective dates.

A narrower restriction was enacted in the Intelligence Authorization Act for Fiscal Year 2026, signed as part of the National Defense Authorization Act on December 18, 2025.
The provision required the intelligence community to develop standards and guidelines for removing covered applications—including DeepSeek or successor applications—from national-security systems operated by intelligence agencies, contractors or entities acting on their behalf. It also recognized exceptions for national-security and research purposes, subject to risk mitigation.
That enacted framework is narrower than all of the following:
- a prohibition on DeepSeek across every executive agency;
- a ban on use by every federal contractor;
- a ban on state and local government devices; or
- a nationwide consumer ban.
A further FY2027 intelligence authorization measure was reported by the Senate Intelligence Committee on May 20, 2026. It would broaden the covered-application concept to DeepSeek successors and certain products or services from designated Chinese entities. The committee page identifies it as legislation “as reported,” so it should be treated as a proposal unless a later enactment record establishes otherwise. See the committee’s description.

What this means for different users
Federal employees
Follow the policy for the device and agency, not a headline. If an agency’s acceptable-use or mobile-device policy prohibits DeepSeek, do not install or access it on government-managed equipment. A government-device rule also does not automatically answer whether use on a personal phone is permitted; separate agency rules, employment obligations and information-handling requirements may apply.
Federal contractors
Check the contract, incorporated clauses, agency instructions and any applicable statute or regulation. Do not assume that a proposed contractor restriction is already effective, and do not use a public chatbot for contract information unless the contract and security officer permit it.
Businesses
Before approving use, evaluate:
- Where prompts, files and logs are stored and processed.
- Provider ownership, jurisdiction and legal obligations.
- Retention periods, deletion controls and whether submissions may train or improve models.
- Single sign-on, role-based access, audit logs, upload controls and administrative policies.
- Network endpoints and whether traffic can be monitored.
- Enterprise contractual protections, security commitments and incident-notification terms.
- Whether a locally hosted or domestically managed model can meet the use case.
A low price or free access does not make a service appropriate for confidential information. The same caution applies to other hosted AI providers: switching services may change the risk profile, but it does not eliminate cloud retention, access or supply-chain risk.
Researchers
Research and defensive testing may fall under exceptions in particular government frameworks, but authorization and mitigation requirements matter. Use approved test data, isolate systems, document the model and application version, and follow institutional security rules.

People considering local models
Running an open-weight model locally through a tool such as Ollama or LM Studio changes the data-flow model because prompts may remain on the local computer or organization’s server. It does not automatically make the setup safe. Operators must secure the host, validate model files and dependencies, patch the software, restrict access, manage logs and monitor for unauthorized network activity.
Hosted chatbot versus downloadable model
DeepSeek’s consumer chatbot and a downloadable model are not the same exposure. With a hosted chatbot, prompts and files are sent to a provider’s infrastructure under the provider’s service terms. With a local deployment, inference can occur on infrastructure controlled by the user, but the operator assumes responsibility for security, updates, model provenance and access.
“Open weight” also does not mean “independently governed,” and local hosting does not guarantee that an application, plugin or dependency makes no network connection. The relevant question is the complete data path—not just the name of the model.

The most defensible summary is this: Curtis used “TikTok on steroids” to describe his concern that a Chinese-associated AI service could combine influence and data-security risks with unusually intimate user disclosures. Lawmakers subsequently proposed restrictions on government technology, while an enacted FY2026 intelligence provision addressed covered applications on intelligence-community national-security systems. Those developments do not, on the evidence cited here, amount to a nationwide ban on DeepSeek for ordinary consumers.
The practical decision should be risk-based. For sensitive information, choose a deployment whose data residency, retention, access controls, contractual protections and legal environment your organization can verify and accept. For ordinary experimentation, avoid confidential inputs and review the current privacy policy and account settings before use.
