CVS Pharmacy reaches $315 million Justice Department settlement over controlled-substance prescriptions

CVS Pharmacy Inc. and related entities agreed to pay $315 million to resolve the U.S. Justice Department’s allegations that CVS pharmacies unlawfully filled opioid and other controlled-substance prescriptions and sought reimbursement for many of them from Medicare and other federal health-care programs. The settlement was announced October 13, 2026.

The agreement resolves a civil case, not a court finding that CVS violated the law. The Justice Department says the underlying claims remain allegations, and CVS has said it strongly disagrees with them and admitted no wrongdoing.

What the $315 million settlement covers

The Justice Department said the alleged conduct occurred from October 17, 2013, through December 2, 2025. Prosecutors invoked the Controlled Substances Act (CSA), which governs lawful dispensing of drugs such as opioids, and the False Claims Act (FCA), which can impose liability when a company seeks federal payment for claims that are legally ineligible for reimbursement.

What prosecutors alleged CVS pharmacies did

Excessive, early and otherwise questionable opioid fills

According to the Justice Department, prosecutors alleged that CVS filled prescriptions for dangerous or excessive opioid quantities and filled opioid prescriptions too early. The allegations concern whether pharmacists should have recognized warning signs and declined, delayed or escalated particular prescriptions under professional and legal requirements.

“Trinity” prescriptions

The complaint also alleged that CVS filled “trinity” combinations. In this context, a trinity prescription combines an opioid, a benzodiazepine and a muscle relaxant—three drug categories that can be abused together and can increase the risk of serious harm. The settlement does not establish that every prescription fitting that description was unlawful; the government alleged that CVS filled combinations lacking a legitimate medical basis in circumstances that should have triggered action.

Prescriptions linked to alleged pill mills

DOJ further alleged that CVS filled large quantities of controlled-substance prescriptions written by “pill mill” prescribers. The term generally refers to prescribers alleged to issue controlled-substance prescriptions without a legitimate medical purpose. In this case, whether any individual prescription was unlawful remains part of the disputed allegations rather than a finding in a trial verdict.

Alleged workplace and information barriers

The 2024 complaint alleged that corporate performance metrics, incentive compensation and staffing policies made it difficult for pharmacists to meet production expectations while also carrying out required controlled-substance checks. It also alleged that pharmacists were prevented from sharing some warning information about problematic prescribers. The complaint alleged that some prescriptions were billed to federal programs and that, in some instances, patients died after overdosing soon after filling prescriptions the government characterized as unlawful. Those staffing, incentive and patient-harm statements are allegations in the complaint, not established findings.

How the False Claims Act applies to a pharmacy

The False Claims Act can apply when a provider or supplier asks a federal health-care program to pay a claim while failing to meet a legal condition of payment. DOJ alleged that prescriptions unlawfully dispensed under the Controlled Substances Act were then submitted for reimbursement to Medicare and other federal programs. The government’s theory was that those reimbursement requests were false or legally ineligible because the underlying dispensing did not satisfy federal requirements.

The case began as a qui tam action by former CVS employee Hillary Estright. A private whistleblower can file an FCA case on the government’s behalf; the Justice Department may intervene and take over the litigation. DOJ intervened in this matter. The department said the amount of any recovery owed to Estright had not yet been determined, so no whistleblower payment can be inferred from the $315 million figure.

What CVS must change under the DEA agreement

Alongside the monetary settlement, CVS entered a memorandum of agreement with the Drug Enforcement Administration. DOJ described the measures as safeguards intended to help ensure controlled substances are dispensed only when medically appropriate.

  • Reporting hotline: CVS must establish a hotline for employees and members of the public to report suspected illegal dispensing.
  • Proactive dispensing monitoring: The company must monitor pharmacy dispensing patterns for warning signs involving controlled substances.
  • Prescriber review: CVS must create a process to evaluate prescribers suspected of illegal prescribing.
  • Compliance response: The safeguards are intended to help pharmacies identify warning signs and respond to prescriptions that may be unlawful or medically unnecessary.

The announcement does not provide a public dollar-by-dollar breakdown of the $315 million or state that every CVS location will use identical operational procedures beyond the requirements described in the DEA memorandum.

Timeline of the CVS controlled-substance case

  1. October 17, 2013: DOJ’s alleged-conduct period begins.
  2. December 13, 2024: The United States files its civil complaint in Rhode Island after the former employee’s qui tam filing.
  3. December 2, 2025: DOJ’s alleged-conduct period ends.
  4. October 13, 2026: DOJ announces the $315 million settlement and the DEA memorandum of agreement.

Did CVS admit wrongdoing, and is the case over?

CVS has publicly said it strongly disagrees with the claims and that the settlement admits no wrongdoing. DOJ likewise states that the settlement resolves allegations and that there has been no determination of liability. In practical terms, the civil action described in the announcement is resolved through the agreement rather than a trial verdict. The company’s continuing obligations are the compliance measures in the DEA memorandum, and the whistleblower’s potential recovery had not yet been determined when DOJ announced the settlement.

Why the settlement matters

The case illustrates how pharmacy conduct can create two related forms of federal exposure: dispensing a controlled substance without the safeguards required by the CSA, and submitting a reimbursement claim to a federal program for that dispensing. It also shows why regulators focus on systems—not only individual prescriptions—including staffing, production targets, escalation channels, prescriber surveillance and ways for employees or the public to report concerns.

For patients, the settlement is not a finding that all opioid prescriptions filled by CVS were improper, nor does the announcement create a general refund program. It addresses the government’s allegations about particular dispensing practices and federal reimbursement claims during the stated period. For taxpayers and federal programs, the payment resolves the government’s civil demand without a public allocation of the settlement amount among Medicare, other programs or individual allegations.
