Cross-objection or separate tax appeal: Which ITAT remedy should you use?

Use a cross-objection only when the other party has already filed an appeal before the Income Tax Appellate Tribunal (ITAT) and the Tribunal has served you with notice. Under the familiar section 253(4) procedure, you normally have 30 days from receiving that notice to file a verified memorandum. It can challenge another part of the same order and is disposed of as if it were an appeal.

File a separate appeal when you need to start the ITAT proceedings yourself, when no opposing appeal exists, or when waiting could cause your own limitation period to expire. Because the Income-tax Act, 2025 and Income-tax (Appellate Tribunal) Rules, 2026 introduce corresponding section 362 and Form 116 references, confirm which Act, form and limitation table govern your proceeding before filing.

The short decision

Ask four questions in order:

  1. Has the opposite party filed an ITAT appeal? If not, a cross-objection is unavailable.
  2. Have you received the Tribunal’s notice of that appeal? The cross-objection period starts on receipt of the notice, not merely when you hear that an appeal may have been filed.
  3. Are you challenging another part of the same order? A cross-objection is tied to the impugned order and the pending appeal.
  4. Could your own appeal limitation expire first? If yes, file your separate appeal within its independent deadline rather than waiting for an opponent.

A cross-objection is therefore a reactive remedy. A separate appeal is the initiating remedy. They are not interchangeable safety nets.

What a cross-objection does

It responds to an existing ITAT appeal

Section 253(4) of the Income-tax Act, 1961 permits an assessee or Assessing Officer, after receiving notice of the other party’s appeal, to file a verified memorandum of cross-objections. The 2026 framework describes the same concept under section 362: a memorandum may be filed only in relation to an appeal already before the Tribunal and after the Tribunal’s notice of appeal has been received. Filing is optional.

It can attack another part of the order

Your objections do not have to duplicate the grounds in the main appeal. The statute allows a challenge to any part of the impugned order. For example, if the Assessing Officer appeals a relief granted on one addition, the assessee may use a cross-objection to contest a separate addition that the Commissioner (Appeals) sustained. The grounds still need to arise from the order under challenge and must be drafted so the Tribunal can identify the precise error.

It is treated like an appeal for disposal

Section 253(4) says the memorandum “shall be disposed of by the Appellate Tribunal as if it were an appeal.” Rule 22 of the Income-tax (Appellate Tribunal) Rules provides for registration and numbering of a cross-objection as an appeal and applies the appeal rules as far as possible. That appeal-like treatment affects listing, records and hearing, but it does not remove the requirement that an opposite-party appeal and notice exist.

When the 30-day cross-objection clock starts

The ordinary period is 30 days from receipt of the notice of filing the appeal. Keep evidence of the actual receipt date: the Tribunal’s electronic communication, portal record, email delivery or physical service record. The date you discovered the appeal through a client, tax representative or public listing is not a substitute for the notice date when calculating the statutory period.

Late filing and condonation

The Department’s procedural guidance recognizes that the Tribunal may condone delay when sufficient cause is shown. A late memorandum should therefore include a clear condonation request, the number of delayed days and a chronological explanation supported by documents. Illness, service problems or an objectively documented event may be relevant; a bare statement that the deadline was overlooked is risky. Condonation is discretionary, not automatic.

Do not confuse this clock with your appeal deadline

The 30-day period belongs to the cross-objection. A separate appeal has its own limitation period under the Act and rules governing the order and assessment year. Those periods can run at the same time. Waiting for an opposing appeal can leave you unable to start your own challenge even though a later notice gives you a cross-objection opportunity on different grounds.

Cross-objection versus separate appeal

Decision point Cross-objection Separate appeal
Trigger Another party has filed an ITAT appeal and the Tribunal has served notice. You decide to initiate an ITAT challenge; no opposing appeal is required.
Limitation clock Normally 30 days from receipt of the appeal notice, subject to possible condonation for sufficient cause. The independent period prescribed by the governing Act, rules and limitation table for your order; it is not replaced by the 30-day cross-objection period.
Who can start it Only a party responding to the pending appeal and notice. The party whose grievance requires an appeal can start the proceeding.
Scope May challenge any part of the impugned order, but remains procedurally connected to the pending appeal. Allows you to frame your own grounds and pursue the issues that require adjudication, subject to ordinary appeal rules.
Form under the 1961 framework Form 36A, with a verified memorandum. The prescribed appeal form under the applicable 1961 Act procedure.
Form under the 2025 Act/2026 Rules framework Form 116 under the section 362 transition mapping. The corresponding appeal form under the 2025 Act and 2026 Rules.
Fee and administration Registration and numbering follow appeal treatment under Rule 22. The applicable fee treatment must be checked in the current tariff and portal. Normal appeal filing, fee and registration requirements apply under the governing framework.
Protection if the other appeal changes Do not assume your objections remain unaffected if the main appeal is withdrawn, dismissed or otherwise terminated; the result is jurisdiction- and precedent-sensitive. Your proceeding does not depend on an opponent continuing its appeal.
Risk of missing an issue Waiting for a notice can cause your independent appeal limitation period to lapse. Filing on time preserves your own initiating remedy even if the other party never appeals.

Choose a cross-objection when these conditions are met

  • The other party has actually filed an appeal before the ITAT.
  • You have received the Tribunal’s notice of that appeal.
  • Your proposed grounds challenge another part of the same order.
  • The 30-day notice-based period is still open, or you have a supportable basis to seek condonation.

Typical use: an assessee receives notice that the Assessing Officer has appealed an appellate order. The assessee wants the Tribunal to examine a different disallowance that the appellate authority left standing. A cross-objection can place that issue before the Tribunal without pretending that the assessee initiated the original appeal.

Choose a separate appeal when waiting is unsafe

  • You need to start the ITAT challenge and no opposing appeal has been filed.
  • The other side has not filed an appeal, or you have not received a Tribunal notice.
  • Your grounds require an independent presentation rather than a response to the pending appeal.
  • The limitation period for your own appeal could expire before an opponent files.

The practical rule is simple: calculate the separate-appeal deadline on its own. Do not assume an opponent will appeal, that a cross-objection will later be available, or that a cross-objection can replace an appeal that only you can initiate.

How to file a cross-objection

  1. Identify the governing law. Check the order date, assessment year, date of service, and whether the proceeding is governed by the Income-tax Act, 1961 or the transition provisions leading to the Income-tax Act, 2025 and 2026 Rules.
  2. Verify the trigger document. Locate the ITAT notice showing that the opposite party’s appeal was filed and record when you received it.
  3. Calculate day 30. Use the receipt date and preserve the calculation. If the period has passed, prepare a condonation application rather than silently filing late.
  4. Select the prescribed form. The established 1961 procedure uses Form 36A. The 2026 transition guidance maps the corresponding filing to Form 116 under section 362. Confirm the current portal label and filing instructions.
  5. Draft concise, numbered objections. Form 36A requires concise, separately numbered objections without argument or narrative. State the specific part of the order challenged and the relief sought; put detailed submissions in the written arguments or hearing process, not in argumentative grounds.
  6. Verify and sign. The memorandum must be verified by the authorized person in the manner required by the applicable form and rules.
  7. File through the current channel and retain proof. Keep the acknowledgement, filing number, uploaded memorandum, notice and service records. Rule 22 contemplates registration and numbering as an appeal, so check the Tribunal record after filing.
  8. Prepare for the hearing. Organize the impugned order, grounds, relevant lower-authority orders and documents supporting each objection. The cross-objection is heard and disposed of through appeal-like procedure.

How to protect yourself when both sides have grievances

Run two limitation calculations

Create one deadline for your separate appeal under the applicable appeal provision and a second deadline for a possible cross-objection measured from the opponent’s notice. The second date cannot extend the first. If the separate-appeal deadline is approaching, file the appeal rather than speculating about the opponent’s intentions.

Map each issue to the correct vehicle

  • Your initiating challenge: place it in the separate appeal.
  • A response to the opponent’s pending appeal: place it in the cross-objection.
  • Issues common to both: coordinate the grounds and records, while observing the distinct form and limitation requirements.

Check the fee and portal instructions at filing

The procedural materials establish appeal-style registration but do not create one universal fee amount for every transition situation. Use the current ITAT fee schedule, e-filing instructions and the form applicable to the assessment year and governing Act. A filing accepted by the portal should still be checked for correct registration, jurisdiction and completeness.

What if the main appeal is withdrawn or dismissed?

Do not rely on a blanket rule. Whether a cross-objection survives withdrawal, dismissal or another termination of the main appeal is fact-sensitive and depends on the governing jurisdiction and controlling High Court or ITAT precedents. The statutory statement that a cross-objection is disposed of as if it were an appeal does not, by itself, answer every consequence of the main appeal ending.

If the opponent seeks withdrawal or the appeal is dismissed for a procedural reason, identify the exact order, the stage of the cross-objection and the authorities binding on the relevant Bench. Ask for directions on whether the cross-objection will be heard, converted, restored or otherwise dealt with. Do not treat filing a cross-objection as a guaranteed independent proceeding.

1961 Act references and the 2025/2026 transition

Official Income-tax Department materials continue to describe the familiar section 253 and Form 36A process. Separate 2026 guidance maps that procedure to section 362 and Form 116 under the Income-tax Act, 2025 and Income-tax (Appellate Tribunal) Rules, 2026. The correct reference is not determined by the form name alone.

Before filing, confirm:

  • the assessment year;
  • the date and type of the order;
  • when the order and appeal notice were served;
  • which Act and transition rule govern the proceeding;
  • the current ITAT form and electronic filing route; and
  • the limitation and fee entries applicable to that proceeding.

Using Form 36A where Form 116 is required, or citing the wrong statutory section, can create avoidable defects even when the underlying objection is sound.

Common mistakes and fixes

Filing a cross-objection before any opposing appeal

Why it fails: the remedy is contingent on an appeal already filed and notice received. Fix: file your own appeal within its limitation period if you need to initiate proceedings.

Counting 30 days from the order date

Why it fails: the cross-objection period runs from receipt of the Tribunal’s appeal notice. Fix: preserve the notice and calculate from its actual receipt.

Assuming the cross-objection replaces a separate appeal

Why it fails: the two remedies have different triggers and limitation clocks. Fix: maintain an independent appeal deadline and use a cross-objection only after the statutory trigger occurs.

Writing argumentative grounds

Why it fails: Form 36A calls for concise, separately numbered objections without narrative or argument. Fix: state each error and requested relief briefly, then develop the evidence and law in submissions.

Assuming survival after withdrawal

Why it fails: the consequence varies with jurisdiction and precedent. Fix: obtain directions and apply the controlling High Court or ITAT authorities for the case.

Using a familiar form without checking transition rules

Why it fails: 2025 Act/2026 Rules proceedings may use the section 362/Form 116 mapping. Fix: match the form and section to the order, assessment year and transition provision before upload.

A practical filing checklist

  • Copy of the impugned order and the appellate order, if any.
  • Opposite party’s ITAT appeal number and the Tribunal’s notice.
  • Proof of notice receipt and a written 30-day calculation.
  • Separate limitation calculation for any appeal you may need to file.
  • Correct statutory framework: 1961 Act/Form 36A or 2025 Act/2026 Rules section 362/Form 116.
  • Concise, separately numbered and verified objections.
  • Condonation application and supporting chronology if late.
  • Current fee, portal, jurisdiction and authorization requirements.
  • Filing acknowledgement and subsequent registration or defect notices.

Bottom line for the decision

Use the cross-objection route to respond to an existing ITAT appeal after receiving the Tribunal’s notice, normally within 30 days. Use a separate appeal to preserve a challenge you need to initiate yourself. If both sides may contest the order, protect the separate-appeal deadline first; a later cross-objection is not a substitute for an appeal that was never filed. Because section and form references are changing during the 2025 Act/2026 Rules transition, verify the governing framework and current Tribunal procedure for the specific order before submission.
