Cross-Examination in Indian Income-Tax Proceedings: Taxpayer Rights, Notice Deadlines and Evidence

In India, a taxpayer does not have an automatic right to cross-examine every person mentioned by an Assessing Officer. But when an assessment relies materially on an adverse statement or testimony from a third party, fairness generally requires that the taxpayer receive the statement and supporting material and a real opportunity to test it. Refusing a material request without an effective alternative can vitiate an assessment, although refusal does not automatically cancel every assessment.

Notice deadlines are section-specific. A section 143(2) notice has a six-month service cut-off under the official consolidated text, measured from the end of the financial year in which the return was furnished. A section 148A(b) reassessment show-cause notice must ordinarily allow at least seven and no more than 30 days to reply, unless time is extended. The assessment year, service date, statutory version and any special search or faceless-proceeding rules must be checked before relying on a deadline.

What cross-examination means in an income-tax case

Cross-examination is the opportunity to question a witness whose statement is being used against you. In tax proceedings, the “witness” may be a supplier, customer, employee, broker, accommodation-entry provider, investigator, bank official or another person whose statement is cited to support an addition or disallowance.

Income-tax proceedings are not governed by the strict trial rules of the Indian Evidence Act in the same way as a criminal prosecution. The department can use information gathered during investigation and can rely on material that would not be admitted in a conventional civil trial. That flexibility does not remove procedural fairness. The reported judgment in Prakash Chand Nahta v. Commissioner of Income-Tax states: “There is no doubt that even if the strict rules of evidence may not apply, the basic principles of natural justice would apply to the facts of the case.”

The practical test is materiality. If the officer is relying on a third-party statement as a significant reason for an addition, you should normally be shown the statement and given a meaningful chance to challenge it. If the reference is merely background information, is not relied upon in the proposed order, or has no bearing on the disputed issue, a request directed at that person may not succeed.

When a taxpayer can legitimately demand cross-examination

A statement is used materially against you

Identify the exact paragraph, annexure or finding in which the officer relies on the third party. A request is strongest where the statement supplies an essential link—for example, the assertion that an invoice was accommodation-only, that cash was paid back, that goods were never delivered, or that a transaction was controlled by you.

The adverse material was not fully disclosed

Ask for the complete statement, every annexure, investigative report, relied-upon document and source record. A summary or selective extract may not reveal qualifications, retractions or answers that undermine the department’s theory. You cannot meaningfully test evidence that you have not seen.

You identify concrete prejudice

Explain what factual issue the questioning would address and why it could change the proposed addition. State the specific assertions you dispute, the documents that contradict them and the way a refusal would prevent an effective reply. Courts and tribunals examine whether the evidence was the sole or decisive basis and whether the taxpayer demonstrated prejudice; a bare demand with no explanation is weaker.

The request is made before the order

Put the request on the record while the assessment or reassessment is pending. Waiting until the appeal may preserve the ground, but it makes it easier for the department to argue that no timely opportunity was sought or that the defect caused no prejudice.

How to make a cross-examination request

  1. Record the notice details. Save the notice, its issue date, the date and mode of service, the assessment year, the statutory section and the response deadline.
  2. Ask for the complete relied-upon record. Request the original statement, recorded answers, reports, electronic material, exhibits, annexures and the identity and role of each person whose evidence is proposed to be used.
  3. List the disputed assertions. Quote or accurately identify each statement you contest and explain its relevance to the proposed addition, disallowance or reopening.
  4. Request production of the witness. Ask the Assessing Officer to produce each material witness for examination and cross-examination. Refer to the officer’s power under section 131 to enforce attendance and examine a person on oath.
  5. Request adequate time. Ask for enough time to review the disclosure, prepare questions and file documents. If the notice period is too short, seek an adjournment in writing before the deadline.
  6. Ask for a speaking decision. If the request is refused or limited, ask the officer to give reasons identifying whether the evidence is being relied upon and why cross-examination is considered unnecessary.
  7. File a substantive rebuttal. Submit contracts, invoices, transport records, bank statements, stock registers, confirmations, correspondence and expert explanations that address the disputed facts. Do not rely on the procedural objection alone.
  8. Preserve proof. Keep portal acknowledgements, email headers, uploaded files, hearing links, minutes, adjournment requests and any written refusal. These records matter in an appeal or an exceptional writ petition.

The department’s powers to obtain evidence

Provision What the authority can do What it means for the taxpayer
Section 131 Specified income-tax authorities have civil-court-like powers for discovery and inspection, enforcing attendance, examining a person on oath, and compelling production of books and documents. Comply with a valid summons or direction, while seeking a copy of material later relied upon and recording objections to relevance, authenticity or reliability.
Section 142(1) The Assessing Officer may require accounts, documents, explanations and other information needed to make an assessment. Give a complete, organised response within the stated time, identify unavailable records honestly, and preserve delivery proof. The power to ask for evidence does not authorise undisclosed material to be used without a fair chance to answer.

A section 142(1) notice can be broad, but the response should still be issue-based. Map each question to a document or explanation, flag duplicate requests, and ask for clarification where a demand is unclear. Never ignore the notice: non-compliance can lead to adverse inferences and separate consequences.

Notice deadlines you must check by section

Section 143(2): scrutiny notice

The official consolidated section 143 text states that a notice calling for evidence supporting the return cannot be served after six months from the end of the financial year in which the return was furnished. The date is a service cut-off, not simply the date printed on a letter. Check when the notice was actually made available or served under the applicable electronic or physical-service rules.

The section page includes amendment history. Therefore, tie the six-month calculation to the relevant assessment year and the version of the law then applicable. Search assessments, faceless proceedings and transitional provisions can affect procedure. If you believe service was late, raise the objection promptly and retain the portal or delivery record.

Section 148A: pre-reassessment show-cause notice

Before issuing a section 148 reassessment notice, the Assessing Officer may conduct an inquiry and must ordinarily give a section 148A(b) show-cause notice. The statutory wording requires an opportunity “to show cause within such time … being not less than seven days and but not exceeding thirty days” from the date of the notice, subject to an extension.

The officer must consider the reply and decide whether the case is fit for issuing a section 148 notice. The section describes a one-month period for that decision in the circumstances covered by the provision. Ask for the information suggesting escaped income, identify defects in the allegation, and attach the evidence that resolves the issue rather than waiting for a later reassessment stage.

Section 148 limitation: do not rely on an old four-year rule without checking

Older case discussions reproduce a structure of four years generally and four to six years for qualifying escaped income. That passage is historical. Finance Act amendments, the assessment year and transitional provisions determine the current limitation. Treat a reported older period as context only and verify the version applicable to the notice you received.

What evidence can the Assessing Officer demand?

Under section 142(1), the officer can require books of account, ledgers, invoices, agreements, bank records, confirmations, stock details, explanations of credits or expenses, and other information needed for assessment. A demand may also seek information from third parties through section 131 powers.

Respond in a way that lets the officer verify the transaction:

  • Provide indexed files with a short explanation for each document.
  • Reconcile invoices to payments, bank entries, delivery records and accounting ledgers.
  • Explain gaps, destroyed records, changed addresses or unavailable witnesses instead of silently omitting them.
  • Distinguish documents you admit from documents whose authenticity, context or interpretation you dispute.
  • Object specifically when an allegation depends on an undisclosed report or an unsigned, incomplete or contradictory statement.

The officer may reject an explanation, but an adverse conclusion should be based on material that you were allowed to inspect and answer. A general statement that “natural justice was violated” is less persuasive than a schedule showing the missing document, the disputed assertion and the resulting prejudice.

Can an assessment survive refusal of cross-examination?

Sometimes, but not automatically. Refusal is potentially fatal where the officer relies materially on the witness, does not provide an effective alternative, and the taxpayer shows that the inability to question the witness affected the result. The assessment is more likely to survive where the statement is peripheral, independently corroborated, withdrawn from reliance, or not shown to have caused prejudice.

Ask the officer to state whether the disputed statement will be relied upon. If the officer says it will not be used, request that the final order omit it. If the order nevertheless relies on it, identify the contradiction precisely in the appeal. If the officer allows a limited procedure—such as written questions—explain why that does or does not address the disputed credibility issue.

Remedies when disclosure or questioning is refused

Statutory appeal

The ordinary remedy is the statutory appeal against the assessment or reassessment order. Include the denial of disclosure, the unanswered cross-examination request, the materiality of the witness, the documents you sought, and the prejudice suffered. Attach the request, proof of filing, refusal, final order and your substantive rebuttal.

Exceptional writ review

High Courts exercise writ jurisdiction discretionarily. A writ may be considered where there is a serious natural-justice failure, such as an order founded on undisclosed evidence or refusal of a material cross-examination opportunity, particularly when the defect cannot be effectively corrected later. It is not a substitute for every disputed fact or a routine alternative to the appeal route. Obtain case-specific advice promptly because limitation and procedural posture matter.

Assessment versus reassessment: choosing the procedural response

Question Scrutiny assessment Reassessment
Typical notice Section 143(2), followed by information requests such as section 142(1). Section 148A(b) show-cause notice, then potentially section 148 notice.
First priority Check service timing, identify the proposed issues and answer each evidence request. Challenge the information suggesting escaped income and use the pre-notice opportunity fully.
Third-party statement Request the complete statement and cross-examination if materially relied upon. Make the same request at the section 148A stage and again if the reassessment proceeds.
Record to preserve Notice, portal service record, submissions, hearing records and final order. Show-cause notice, relied-upon information, reply, order under section 148A and later notice.
Challenge after order Statutory appeal; exceptional writ only where circumstances justify it. Statutory appeal and, where appropriate, review of jurisdictional or natural-justice defects.

Common mistakes and practical fixes

  • Asking for “all witnesses” without identifying relevance: name each person and connect the testimony to the proposed addition.
  • Requesting cross-examination for the first time in appeal: make the request before the order and explain the prejudice immediately.
  • Submitting only a procedural objection: file the documents and factual rebuttal as well.
  • Confusing issue date with service date: preserve the actual portal timestamp, email delivery or physical-service evidence.
  • Assuming a deadline from another assessment year: verify the statutory text, amendment history and any special regime.
  • Ignoring a section 142(1) notice: seek a written extension or clarification; do not let the deadline pass silently.
  • Overstating the remedy: refusal does not automatically nullify every assessment; material reliance and demonstrable prejudice are central.

A concise record-building checklist

  1. Download every notice and record issue and service dates.
  2. Mark the assessment year and exact statutory section.
  3. Obtain every statement, report, annexure and source document relied upon.
  4. Prepare a table of disputed assertions, contrary evidence and requested witnesses.
  5. Request production and cross-examination in writing and ask for reasons if refused.
  6. Submit the factual rebuttal and supporting documents within the notice period.
  7. Preserve acknowledgements, hearing records and extension requests.
  8. Raise the defect in the statutory appeal and obtain advice on exceptional writ relief where the order rests on undisclosed or untested material.
