Coal GST vs royalty: what’s the difference and who receives the money?

Royalty and GST are different charges. Coal royalty is a payment for the right to extract coal under a mining lease and is reported as revenue for coal-producing states. GST is an indirect tax on a taxable supply. Under CBIC’s sectoral FAQ (answer 24), the recipient of a state mining lease must pay GST on the royalty under the reverse-charge mechanism and may claim eligible input tax credit. The GST payment is therefore tax on the royalty transaction; it does not turn the royalty itself into GST.

Coal-related money is also reported under separate headings for District Mineral Foundation (DMF), National Mineral Exploration Trust (NMET), central GST, state GST, IGST and coal cess. The recipient depends on the legal category and accounting channel, not simply on where the mine is located.

Royalty and GST answer different legal questions

The quickest way to avoid confusion is to ask what the payment is buying. Royalty is linked to the mineral right: a mining lessee pays it for extracting coal under the terms of a government lease and the applicable legal schedule. GST is a tax on a taxable supply. In the mining-lease situation described by the Central Board of Indirect Taxes and Customs (CBIC), the supply is treated under reverse charge, so the lease recipient—not the government lessor—pays the GST.

That creates two connected but separate entries. A lessee can owe royalty because it extracted coal, and it can separately owe GST on the royalty transaction because CBIC guidance treats the government’s lease-related supply as taxable under reverse charge. The existence of the second payment does not change the legal nature of the first.

Any comparison should label the period and geography. A state-level monthly return, an individual lease invoice and the all-India figures in the Ministry of Coal’s Coal Directory of India 2024–25 are different kinds of evidence.

What coal royalty is and why it is paid

A payment attached to the mining right

Royalty is a consideration associated with the permission to remove a mineral from the ground. For coal, the amount and calculation basis come from the applicable law, lease terms and operative schedule. Depending on the rule in force, the basis can involve the quantity or value of production, but no single rate should be treated as universally current without checking the schedule that applies to the mine, date and transaction.

Royalty is therefore not a sales tax added to a customer’s coal invoice. It arises from the mining right and is reported as a revenue stream of the coal-producing state. A producer may also have other obligations—such as DMF and NMET contributions—without those obligations becoming part of the royalty line.

Who pays royalty?

The holder of the mining lease or the entity responsible under the lease pays royalty to the government authority specified by the legal and administrative framework. In practical records, the payer is generally the coal company or other mining lessee, while the amount is determined by the operative schedule rather than by the GST rate used on a separate tax document.

How to treat the often-quoted 14% statement

A Ministry of Coal statement published by the Press Information Bureau on 1 March 2024 said that state governments are entitled to receive “14% of Royalty on sale price of coal, DMF @30% of royalty, 2 % of NMET from the coal produced by the coal companies and also the private sector.” This is a dated statement describing the position cited at that time. It is not a universal instruction to apply 14% to every coal transaction today. Before using that figure for a current liability, verify the operative royalty schedule, the mine’s category and the relevant date.

What GST is in the mining-lease context

GST is a tax on a supply

GST applies to taxable supplies under the GST framework. It is accounted for through GST channels rather than as a state’s mineral royalty ledger. Depending on the transaction and place-of-supply rules, the tax may be recorded as central GST (CGST), state GST (SGST) or integrated GST (IGST).

Reverse charge changes who remits the tax

CBIC’s Sectoral FAQs, answer 24, state: “Yes, on royalty GST will apply under reverse charge mechanism. Further, such payment of GST under reverse charge mechanism would be eligible as ITC in the hands of the recipient of supply for payment of GST.” Under reverse charge, the recipient of the supply is responsible for paying the GST rather than receiving a tax invoice with GST collected by the supplier in the ordinary way.

For a mining lessee, that means the accounting trail can show a royalty obligation to the government and a separate GST liability paid under reverse charge. The lessee should follow the registration, return, self-invoicing or documentation and payment requirements that apply to its facts. The CBIC wording also describes eligibility for input tax credit (ITC) in the recipient’s hands, subject to the normal statutory conditions. “Eligible” is important: the FAQ does not eliminate requirements such as use in the course of business, valid records, payment and return compliance, or restrictions elsewhere in the GST law.

Why GST on royalty does not make royalty a tax

Two payments can arise from one commercial relationship while having different legal bases. Royalty compensates the state for the mineral extraction right. GST taxes the taxable supply represented by the lease-related service or right. Recording both does not mean that royalty has been replaced by GST, and it does not justify adding the two figures together as if they were one rate.

Coal cess, DMF and NMET are separate categories

Coal cess

Coal cess is not the same as royalty or GST on a mining lease. CBIC’s general Frequently Asked Questions, answer 51, states: “Clean Environmental Cess on coal will be replaced by GST Compensation Cess.” That statement explains the GST transition position; it is not a current rate quotation. The Ministry of Coal’s FY 2024–25 table reports coal cess in its own column, separately from royalty and each GST category.

District Mineral Foundation (DMF)

DMF is a mining-related contribution reported separately from royalty. It is intended for the benefit of people and areas affected by mining, and the Ministry’s coal statements identify it as a distinct state-government revenue flow. Do not describe a DMF payment as GST or fold it into a quoted royalty rate.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

National Mineral Exploration Trust (NMET)

NMET is another separate mining payment. The Ministry of Coal reports NMET independently of royalty, DMF and GST. Its separate line reflects a different statutory purpose and accounting channel.

Auction revenue share

The Ministry of Coal’s 2024 statement also says state governments receive the revenue share offered by auction holders for captive or commercial mines. That share is not automatically royalty, DMF, NMET or GST. When reviewing a state receipt or a mine’s cost ledger, keep auction revenue share under its own heading unless the governing document expressly combines it with another category.

Who receives each kind of coal-related payment?

The phrase “the government gets the money” is too imprecise for coal accounting. The recipient depends on the payment’s legal category and, for GST, on the tax channel reported for the particular transaction.

Payment category Primary recipient or accounting channel What the category represents
Royalty Coal-producing state governments, as state mining revenue Payment linked to the right to extract coal under a lease
DMF Reported by the Ministry as a separate state-government mining revenue stream Contribution for mining-affected districts and communities
NMET Reported separately from royalty and DMF Contribution to the national mineral-exploration trust
Auction revenue share State governments, where the auction terms provide for it Share offered by holders of captive or commercial mine auctions
CGST Central GST account for the transaction Central component of GST
SGST State GST account for the transaction State component of GST
IGST Integrated GST account, with later settlement under GST rules Integrated tax category used for the relevant inter-State or specified supply
Coal cess Separate cess accounting channel Cess reported independently from royalty and GST

This structure is why it is inaccurate to say that all money paid by a coal company goes to the coal-producing state. Royalty and several mining-related receipts are state-linked, while GST is split into the channel shown for the transaction. A particular state may receive SGST or a settled share of IGST under the GST system, but that is not the same legal flow as royalty.

What the FY 2024–25 all-India figures show

The Ministry of Coal’s Coal Directory of India 2024–25 lists all-India coal payments for that fiscal year in separate columns. These are reported payments for FY 2024–25—not rates, statutory percentages or a forecast of what a particular mine must pay.

Category FY 2024–25 all-India payment How to read it
Royalty ₹22,333.98 crore Total reported coal royalty for the fiscal year
DMF ₹6,209.50 crore Separate mining-related contribution
NMET ₹379.77 crore Separate exploration-trust contribution
Central GST ₹3,153.19 crore CGST category reported for coal payments
State GST ₹3,147.49 crore SGST category reported for coal payments
IGST ₹1,232.10 crore IGST category reported for coal payments
Coal cess ₹39,624.41 crore Separate cess category, not royalty or GST

The table supports a category-by-category comparison, not a single “coal tax” number. For example, adding royalty and coal cess would produce a combined figure whose meaning depends on the question being asked; it would not become a rate, and it would not show what one state received. Any total should state exactly which columns, fiscal year and geography it includes.

Longer-term context: 2014–2023 state mining revenue

A Ministry of Coal statement reported by the Press Information Bureau in 2024 said coal-producing states received ₹152,696 crore in combined royalty, DMF and NMET revenue during 2014–2023. The same statement reported a 13.80% compound annual growth rate in coal-mining revenue over that period.

Those figures combine three specified mining-revenue categories across the stated years. They are not a measure of GST collections, do not include every GST channel by implication and should not be compared directly with the single-year FY 2024–25 royalty or cess figures without aligning categories, period and geography.

How a coal company should map the entries

A practical ledger or reconciliation should preserve the legal identity of each payment. The following sequence prevents the most common classification errors.

  1. Identify the underlying event. Decide whether the entry arises from the mining lease, extraction and sale of coal, a statutory fund contribution, an auction term or a GST return.
  2. Check the operative document and date. Use the lease, applicable royalty schedule, auction terms, government demand or tax document that governed the transaction. Do not import a rate from a different year or mine category.
  3. Book royalty separately. Record the mining-lease payment as royalty and identify the state or authority to which it is payable.
  4. Assess GST independently. For a state mining-lease royalty transaction, apply the CBIC reverse-charge treatment described in Sectoral FAQ answer 24 and determine the applicable GST channel for the transaction.
  5. Test ITC eligibility. If GST is paid under reverse charge, evaluate whether the recipient meets the statutory conditions to claim ITC. Keep the supporting records with the GST return and payment trail.
  6. Post DMF and NMET to their own accounts. Do not bury either contribution in royalty or GST.
  7. Keep cess separate. A coal cess entry should remain distinct from both royalty and GST, even when all three appear in the same government table.
  8. Reconcile by period and geography. Match the mine, state, fiscal year and payment category before comparing an internal ledger with a Ministry table.

Illustrative payment flow without assuming a rate

Consider a company holding a state mining lease. The company extracts coal and becomes liable for royalty under the schedule and lease terms. It may also owe DMF and NMET contributions calculated under their respective rules. Separately, the lease-related royalty transaction is assessed for GST under the reverse-charge approach described by CBIC, so the company pays that GST through the applicable GST process. If the company satisfies the legal conditions, it may claim eligible ITC.

When the coal is subsequently supplied, that sale is a separate taxable event from the lease-related royalty transaction. The sale’s GST treatment, invoice and place-of-supply analysis should not be confused with the reverse-charge GST on royalty. The company’s records can therefore contain a royalty payable, a reverse-charge GST liability, fund contributions and GST on coal supplies, each supported by different documents.

Why state, central and integrated GST labels matter

Official coal tables list CGST, SGST and IGST separately because those labels describe different accounting channels. A state GST line does not mean the payment is royalty, and an IGST line does not mean the mine is outside the state’s revenue system. The correct interpretation depends on the transaction’s supply classification and the GST settlement rules.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For a reader comparing state receipts, the safe method is to ask which column is being measured and whether the number is a gross payment, a settled amount or another administrative measure. A state’s royalty receipt should be compared with royalty, not with a combined GST total. Likewise, a central GST figure should not be presented as money paid directly to the coal-producing state.

Current legal and policy cautions

Royalty schedules can change

The Ministry of Coal maintains a page titled “Revision of royalty rates on Coal and Lignite.” The page reviewed for this article did not provide a complete current schedule. Because royalty depends on the operative legal schedule and the relevant facts, a current filing or contract should use the latest applicable notification rather than a historical percentage.

GST treatment has had policy debate

GST Council meeting records contain historical discussion of a request to clarify that GST should not apply to royalty and a recommendation not to accept that request. That record is historical context, not a complete statement of every later court decision, notification or circular. CBIC’s sectoral FAQ answer 24 states the reverse-charge treatment and ITC position quoted above, but businesses facing a dispute or a changed fact pattern should verify the latest binding law and judicial position before taking a filing position.

Do not turn dated statistics into a forecast

The ₹22,333.98 crore royalty figure and the other Coal Directory amounts describe FY 2024–25. The ₹152,696 crore combined figure covers 2014–2023. Neither set establishes what a mine must pay in a later year, and neither supplies a universal royalty or GST rate.

Common mistakes and how to correct them

  • Calling royalty “coal GST.” Correct it by identifying royalty as the lease-related payment and GST as a separate tax treatment.
  • Assuming all GST goes to the mining state. Check whether the official figure is CGST, SGST or IGST and describe that channel.
  • Adding DMF and NMET to royalty without disclosure. Keep each category separate; if a combined total is useful, name every included category.
  • Using 14% as a timeless royalty rate. Cite the 1 March 2024 statement as dated and verify the current schedule for the transaction.
  • Treating coal cess as GST or royalty. The Ministry’s table gives coal cess its own column, and CBIC’s transition wording does not provide a current rate.
  • Assuming ITC is automatic. CBIC says eligible ITC may be available; the recipient must still satisfy the GST law’s conditions and restrictions.
  • Comparing unlike periods. Align fiscal year, state or all-India scope and payment category before drawing a conclusion.
  • Relying on a historical GST Council discussion as the current law. Use current legislation, notifications, circulars and applicable court decisions for a live compliance decision.

A reader’s checklist for any coal-payment figure

  • What is the legal category: royalty, DMF, NMET, auction revenue share, CGST, SGST, IGST or coal cess?
  • Who is the payer: mining lessee, coal seller, buyer or another recipient under reverse charge?
  • Which government account or fund receives the money?
  • What fiscal year and geography does the figure cover?
  • Is the number a payment total, a rate, a demand, a forecast or a settled amount?
  • Does the source identify the mine, lease, state and applicable schedule?
  • For GST on royalty, has reverse charge been considered and has ITC eligibility been tested separately?

Using that checklist keeps the central distinction intact: royalty pays for the mining right and is recorded as state mining revenue, while GST is a separate indirect-tax obligation routed through the GST system. DMF, NMET, auction revenue share and coal cess remain distinct unless an official statement expressly combines them.
