Yes, an unregistered home buyer may be able to recover the GST actually paid and borne on a cancelled flat-construction agreement. The correct route depends first on whether the builder can still issue a GST section 34 credit note. If that period has expired, CBIC Circular No. 188/20/2022-GST allows a direct claim by the buyer through temporary GST registration and FORM GST RFD-01. That tax claim is separate from recovery of booking money or a challenge to cancellation deductions, which may require the project’s state or union-territory RERA process.

Can I get GST back if I cancel my flat booking?

Cancellation does not automatically create a GST refund. The refund route applies when all of the following are established:

As an Amazon Associate I earn from qualifying purchases.

  • You are an unregistered buyer who paid GST on the flat-construction supply.
  • You bore the tax yourself and did not pass its incidence to another person.
  • The agreement or contract was cancelled and the supplier has refunded, or is required to refund, the underlying amount to the extent relevant to the claim.
  • The claim is filed within the statutory period and is supported by invoices, payment records, cancellation evidence and the supplier’s certification.
  • The amount claimed does not exceed the GST shown on the relevant invoices and is not below the ₹1,000 threshold described by CBIC for this category.

CBIC Circular No. 188/20/2022-GST, dated 27 December 2022, addresses cancelled long-term flat-construction agreements. It explains that an unregistered applicant who paid and bore the tax can seek a refund under section 54 of the Central Goods and Services Tax Act when the supplier’s section 34 credit-note period had already expired at cancellation. The circular does not turn every booking cancellation into an automatic recovery of all GST, the entire booking amount or every cancellation deduction.

The tax question and the contract question must therefore be handled separately. A GST refund concerns the tax component that meets the statutory conditions. Whether the builder may retain a booking amount, charge cancellation fees, deduct interest or withhold another sum depends on the signed documents, applicable state real-estate rules and the facts of the cancellation.

Check the credit-note route before filing with the government

The first practical question is whether the builder can still issue a GST credit note under section 34. If it can, CBIC says the supplier should issue the credit note and return the corresponding tax. In that situation, the buyer normally does not file the direct unregistered-person refund application. The direct route is intended for a cancellation where the credit-note period had already expired.

Question Supplier credit note Buyer’s direct GST claim
When used The section 34 credit-note period remains open when the contract is cancelled. The credit-note period had expired when the supplier cancelled the agreement.
Who files The registered builder or other supplier issues the credit note and repays the tax. The unregistered buyer obtains temporary registration and files FORM GST RFD-01.
Where money comes from The supplier returns the tax after adjusting its GST records as permitted. The buyer seeks the eligible tax refund from the tax authority.
Key proof Cancellation documentation and the supplier’s credit-note records. Invoices, payment proof, cancellation letter, supplier certificate, Statement 8 and evidence that the buyer bore the tax.
Practical result No direct buyer refund application is needed if the credit-note route is available and used. The claim is examined under the section 54 refund process and can be sanctioned, found deficient or proposed for rejection.

Ask the builder in writing to confirm whether a section 34 credit note is still legally available for each invoice. Keep the response. If the builder simply refuses to cooperate but the credit-note period is still open, that refusal is a builder-dispute issue; it does not by itself prove that the direct government-refund route is available.

GST refund process for a cancelled flat: step-by-step

1. Establish the cancellation date and the correct route

Obtain a written cancellation letter from the supplier or a written acceptance of your cancellation request. For the long-term flat-construction situation covered by CBIC Circular 188/20/2022-GST, the supplier’s cancellation-letter date is treated as the relevant date for the two-year section 54 filing period. Do not calculate the deadline from the date on which you merely emailed a cancellation request unless the supplier’s formal cancellation letter is the same document and date.

At the same time, determine whether the supplier can still issue a section 34 credit note. Record the invoice numbers, invoice dates, tax amounts, date of cancellation and amount the supplier will actually return. Those facts control whether you should pursue a supplier repayment or a direct application.

2. Gather the evidence before creating a temporary registration

Prepare a file containing:

  • The signed booking form, allotment letter, agreement for sale or construction agreement.
  • Every GST tax invoice and a schedule matching each invoice to the amount paid.
  • Bank statements, payment receipts or other proof showing that you paid the builder, including the GST component.
  • Your cancellation request, the supplier’s cancellation letter or acceptance, and the builder’s calculation of any refund or deduction.
  • A written statement identifying the GST retained or refunded and any cancellation charge, interest or other deduction.
  • The supplier certificate required for the refund rules and Statement 8 for the RFD-01 filing.
  • Copies of correspondence in which you asked for a credit note, tax repayment, itemized calculation or confirmation of the relevant date.

Scan documents clearly and keep the original files. The officer may ask how the tax was paid, who bore it and why the amount claimed is refundable.

3. Obtain temporary GST registration

An unregistered buyer uses a temporary registration on the common GST Portal for this refund application. The practical sequence described by CBIC is:

  1. Use your PAN to start the temporary-registration process.
  2. Select the same state or union territory in which the supplier is registered.
  3. Complete Aadhaar authentication when prompted.
  4. Enter a bank account in your own name, linked to the PAN used for the application.
  5. Retain the temporary-registration credentials and the acknowledgement generated by the portal.

This registration is a procedural gateway for the refund; it does not mean you have become a normal taxable business or that you must charge GST on unrelated activities. If invoices come from suppliers registered in different states or union territories, CBIC says you need a separate temporary registration in each concerned state or union territory and a separate claim for each supplier.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

4. File FORM GST RFD-01 under the unregistered-person category

After registration, select the refund category labelled “Refund for unregistered person.” File separately for invoices from different suppliers. Enter the invoice-level figures accurately. The amount claimed cannot exceed the tax declared on the relevant invoices, and the calculation must reflect the amount the builder actually repaid or is refunding under the cancellation.

Upload Statement 8, the supplier certificate required under the rules and the supporting evidence showing that you paid and bore the tax. Include the cancellation letter, invoice list, payment proof and the builder’s refund calculation even if the portal’s mandatory fields do not describe every document in those words. A concise covering explanation can connect each invoice to the cancellation and explain how the claimed GST was calculated.

5. Calculate only the eligible proportion

If the supplier returns less than the amount you originally paid, CBIC’s guidance limits the GST refund to the proportionate tax associated with the amount actually returned. For example, if the contract documents show ₹10,00,000 of eligible consideration plus ₹1,80,000 GST, but the builder returns only 60% of the eligible consideration after a permitted deduction, the claim cannot automatically seek the full ₹1,80,000. The refundable tax must be worked out proportionately from the amount repaid and the tax attributable to it. Keep the calculation transparent and tied to the invoices and the supplier’s written statement.

6. Submit the application and preserve the acknowledgement

Submit RFD-01 electronically and download the acknowledgement, ARN, uploaded Statement 8 and all attachments. Save screenshots or exported PDFs showing the filed figures. The filing date matters for the limitation period and for any later question about processing time.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

7. Respond to a deficiency memo or proposed rejection

Under the refund procedure, the officer may issue FORM GST RFD-03 if the application is deficient. Read the deficiency communication carefully, correct the identified issue and follow the portal’s instructions for a fresh or amended filing where required. Do not assume that uploading the same documents again without addressing the stated deficiency will preserve the original claim.

If the officer proposes rejection, the rules provide for a notice in FORM GST RFD-08. A reply is filed in FORM GST RFD-09 within 15 days of receipt, and the applicant is entitled to a reasonable opportunity of hearing before rejection. Use the reply to answer each proposed ground with invoice references, payment evidence, the cancellation letter, the supplier certificate and the proportionate calculation. Keep proof of submission and attendance at any hearing.

8. Track the final order and payment

A sanctioned refund is issued through FORM GST RFD-06. Check the sanctioned amount against your invoice schedule and bank details. If the order differs from your claim, read the reasons and note any appeal or review option advised in the order. A rejected or partly sanctioned tax claim does not decide whether the builder owes you the remaining booking money; that is a separate dispute.

How long do I have to claim GST after cancellation?

Section 54 generally gives two years from the relevant date to apply. For the cancelled long-term flat-construction agreements addressed in Circular 188/20/2022-GST, CBIC identifies the supplier’s cancellation-letter date as the relevant date. The circular states that the date of issuance of the supplier’s cancellation letter is treated as the date of receipt of the services by the applicant for this purpose.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Make a deadline calculation for every supplier and keep the cancellation letter that supports it. If a builder sends multiple letters, use the document that formally cancels the relevant agreement or invoices and obtain clarification in writing rather than choosing the most convenient date. A claim below ₹1,000 should not be filed under this route because the circular explains the section 54(14) minimum threshold.

The two-year limit is not a two-year period from your first cancellation email, from the date you vacated a site or from the date of a later negotiation unless that event is also the supplier’s formal cancellation date. Filing early avoids disputes over whether a later replacement letter changed the relevant date.

What happens after an RFD-01 filing?

The refund officer examines the application and supporting records. The main issues are whether you were unregistered, whether you paid and bore the tax, whether the cancellation is proved, whether the amount is within the invoice tax, whether the claim is timely and whether the amount is proportionate to the supplier’s repayment.

  • Deficiency: RFD-03 may identify missing or defective information. Follow the communication rather than treating it as a final rejection.
  • Proposed rejection: RFD-08 gives the grounds. Reply in RFD-09 within 15 days of receipt and use the hearing opportunity.
  • Sanction: RFD-06 records the amount approved. Verify that the bank account is in your own PAN-linked name.
  • Partial sanction: Compare the approved figure with the proportionate calculation and the reasons stated in the order.

Section 56 provides for interest on a qualifying refund that is not paid within 60 days of receipt of the section 54 application, at the notified rate and subject to the statutory conditions. Treat this as a possible statutory entitlement, not an assured additional payment in every delayed case. The applicable rate, exclusions and computation should be checked against the order and current law.

GST refund versus recovery of your booking money

These claims have different subjects, evidence and decision-makers. Mixing them in one undifferentiated demand can make the issue harder to resolve.

Issue GST refund Booking-money or deduction dispute
What you seek Eligible GST that you paid and bore on the cancelled supply. Principal booking amount, interest, cancellation charge, brokerage, damages or another contractual sum.
Primary question Does section 54 and CBIC’s procedure permit a refund, and is the claim proved and timely? Does the agreement and applicable real-estate law permit the builder’s retention or deduction?
Typical evidence Tax invoices, payment proof, cancellation letter, supplier certificate, Statement 8 and RFD filings. Booking form, agreement, payment receipts, cancellation calculation, correspondence and demand for an itemized account.
Potential forum GST portal and the jurisdictional tax officer. Negotiation, the applicable state or union-territory RERA Authority or adjudicating officer, and other remedies advised for the facts.
Outcome A tax refund may be sanctioned in whole, in part or not at all. A forum may grant a remedy only if the alleged conduct falls within its jurisdiction and violates the agreement, RERA Act, rules or regulations.

A tax officer deciding your RFD-01 does not determine whether the builder’s cancellation clause is fair. Conversely, a RERA complaint about a deduction does not automatically order the GST department to refund tax.

Can the builder deduct GST or cancellation charges from my refund?

The builder may show separate figures for GST, a cancellation charge, interest, administrative costs or another deduction. Ask for an itemized calculation that identifies:

  • The gross amount paid against each invoice.
  • The GST component collected and the tax amount being returned.
  • The contractual clause relied on for every non-tax deduction.
  • The date and method by which the builder calculated the deduction.
  • The net amount actually transferred to you and the date of payment.

GST rules do not by themselves validate every contractual deduction. They govern the tax adjustment and refund mechanism. Whether a cancellation charge is enforceable, disproportionate or contrary to a state RERA rule depends on the agreement, project jurisdiction, regulatory facts and the applicable law. Do not describe a deduction as unlawful solely because the builder withheld it, and do not accept a statement that GST is “non-refundable” without checking whether the credit-note period or direct-refund conditions apply.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If the builder returns the booking amount net of GST because the section 34 period expired, retain the settlement statement. The direct GST claim is limited to the proportionate tax connected with the amount refunded; it is not a device to recover a separate cancellation fee.

What to do when the builder refuses to refund or provide documents

Send a precise written demand

Write to the builder’s designated grievance or legal contact and request, in one document, the cancellation confirmation, invoice list, GST amounts, credit-note position, refund calculation, deduction clauses and payment date. Give a reasonable response period stated in the letter and send it through a channel that preserves delivery evidence. Keep the builder’s reply, including a refusal or silence.

Separate the two demands

Label one section “GST tax treatment” and another “contractual refund and deductions.” In the first, ask whether a section 34 credit note is available or, if expired, request the supplier certificate and records needed for RFD-01. In the second, challenge or reserve your rights regarding the booking balance and deductions. This prevents a disagreement about cancellation charges from obscuring the tax documentation needed for the refund.

Escalate the tax filing if the builder does not cooperate

A supplier’s refusal to issue a certificate or explain its figures does not extend the two-year filing period. File with the evidence you have, explain the missing document, and attach proof of your requests. The tax officer may seek clarification or additional records. Never create or alter a supplier certificate yourself.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Escalate the contractual dispute through the appropriate forum

If the amount withheld is substantial or the agreement’s cancellation terms are contested, obtain advice from a lawyer familiar with the project state’s RERA rules and property contracts. The correct forum can depend on whether the allegation is a violation of the Real Estate (Regulation and Development) Act, 2016, a rule or regulation, a pure contractual claim or another legal issue.

Should I complain to RERA if my builder is not refunding my money?

Section 31 of the Real Estate (Regulation and Development) Act, 2016 allows an aggrieved person to complain to the Authority or adjudicating officer for a violation of the Act, its rules or regulations. A RERA complaint may therefore be relevant where the builder’s conduct, disclosure, refund practice or deduction is alleged to breach an applicable RERA requirement.

The route is state or union-territory specific. The project location determines the regulator, and the local portal may prescribe its own form, fee, documents, limitation treatment and hearing process. The exact filing form, fee, deadline and remedy cannot be stated without the project’s jurisdiction and the agreement. Check the relevant authority’s current instructions before filing.

RERA is not an automatic substitute for the GST application. A complaint should identify the project, parties, agreement, payments, cancellation chronology, disputed deduction and relief requested. Attach the signed agreement, receipts, invoices, cancellation correspondence, the builder’s calculation and your written demand. Do not promise that RERA will order a full booking refund, invalidate every cancellation charge or direct a GST refund; the authority’s jurisdiction and decision depend on the facts and applicable law.

Common scenarios and the correct response

The builder says the credit-note period is over but gives no cancellation letter

Request a formal cancellation letter stating the agreement or invoices cancelled and the date of issuance. That date is central to the two-year period for the scenario covered by CBIC’s circular. Preserve your request and proceed with a documented RFD-01 filing strategy rather than waiting indefinitely for an informal email.

Several builders or suppliers issued invoices

Prepare an invoice-to-supplier schedule. File separately for each supplier. Where suppliers are registered in different states or union territories, obtain temporary registration in each concerned state or union territory as CBIC directs.

The builder refunded the principal but retained all GST

Ask whether the builder can issue a section 34 credit note. If the period had expired, calculate the direct claim using the amount actually returned and the tax attributable to it. Attach the settlement statement and explain why you bore the retained tax.

The refund is less than ₹1,000

CBIC’s circular states that no refund claim should be made where the amount is below ₹1,000. A small amount should not be combined with unrelated invoices or inflated beyond the tax shown on the relevant invoices.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The officer issues RFD-08

Calendar the 15-day reply period from receipt, answer every proposed ground in RFD-09 and request or attend the hearing. Supply a page-indexed explanation linking each assertion to an invoice, payment record, cancellation letter or supplier certificate.

The builder and the tax officer disagree about the amount

Keep the tax calculation limited to invoice GST and the proportionate amount repaid. Challenge a separate booking deduction in the appropriate contractual or RERA forum instead of adding that deduction to the GST number.

Document checklist before you file or complain

  • Signed booking form, allotment letter and agreement for sale or construction.
  • All GST invoices with invoice numbers, dates and tax amounts.
  • Bank statements and receipts proving payment.
  • Your cancellation request and the supplier’s formal cancellation letter.
  • Builder’s credit-note response, refund statement and itemized deductions.
  • Supplier certificate and Statement 8 for the RFD-01 application.
  • Temporary-registration acknowledgement, ARN and submitted application PDF.
  • Any RFD-03 deficiency memo, RFD-08 notice, RFD-09 reply and RFD-06 order.
  • Written demands, delivery proof and all builder responses.
  • For a RERA matter, the project details, jurisdiction, agreement, chronology and relief requested.

Use consistent names and figures across the invoice schedule, Statement 8, supplier certificate and application. A mismatch in the cancellation date, tax amount, bank-account name or supplier GST registration can delay scrutiny or trigger a deficiency notice.

A practical timeline

  1. At cancellation: obtain the supplier’s cancellation letter, ask about section 34 credit-note availability and request an itemized refund statement.
  2. Immediately after: collect invoices, payment records, the agreement and supplier certificate; calculate the tax proportion linked to the amount actually returned.
  3. Before two years from the cancellation-letter date: obtain the required temporary registration and file RFD-01 for each supplier and state or union territory as applicable.
  4. After filing: monitor the portal for RFD-03 or RFD-08, preserve every acknowledgement and answer notices within the stated time, including the 15-day RFD-09 period for a proposed rejection.
  5. Separately: pursue the booking-money or deduction dispute through written demand and, where the facts show a RERA violation, the relevant state or union-territory process.

The safest approach is to treat the GST application as a documented tax claim with its own deadline and the withheld booking balance as a separate contract or real-estate dispute. For a live matter involving a large payment, disputed clauses or multiple jurisdictions, a qualified Indian tax or property-law professional can assess the documents and forum before a deadline expires.
