Yes, an unregistered buyer in India may be able to recover GST paid on a cancelled flat-construction agreement, but the route depends on the cancellation date, the builder’s credit-note window, the amount actually returned, and the evidence you can produce. Check first whether the builder can issue a credit note under section 34 of the Central Goods and Services Tax Act. If that period has expired, CBIC Circular 188/20/2022-GST provides a refund route for an unregistered person using temporary GST registration and FORM GST RFD-01.

This guidance concerns GST charged on an agreement for construction of a flat or building before completion of the service. It is not an automatic refund for every booking deposit, cancellation fee, resale, or completed-property transaction. Keep the agreement, invoices, payment trail, cancellation letter and refund calculation together, and separate the contractual dispute over deductions from the GST refund procedure.

Decide which GST route applies before collecting forms

There are two possible procedures. The builder’s credit-note route is the normal first check. The special refund route is available to an unregistered buyer only where the section 34 period for issuing a credit note has expired and the other conditions in Circular 188 are met.

Question Builder credit note Refund claim by unregistered buyer
When it applies The section 34 credit-note period is still open when the agreement is cancelled. The credit-note period has expired and the buyer can prove payment, tax incidence, cancellation and entitlement.
Main action The builder issues a credit note and returns the adjusted GST. The buyer takes temporary GST registration and files FORM GST RFD-01 under “Refund for unregistered person.”
Core evidence Relevant invoice, cancellation letter, credit note and proof of repayment. Statement 8 in PDF, the supplier certificate under rule 89(2)(kb), invoice and tax records, payment proof, cancellation letter and other supporting evidence.
Timing Check the invoice dates and the financial-year details used by the builder when determining whether section 34 is still available. For the specified cancelled long-term construction agreement, the two-year period runs from the date the supplier issues the cancellation letter.
Amount Depends on the builder’s tax adjustment and the amount it actually returns. Capped by GST declared on the relevant invoices and proportionate to the amount refunded by the builder; Circular 188 says not to claim less than ₹1,000.

Ask the builder to state in writing which route it believes applies. Circular 188 says the special claim is for cases in which the time limit for a section 34 credit note had already expired when the contract was cancelled. If the credit-note period remains open, the circular indicates that the builder can issue the credit note and return the tax instead of making you use the special procedure. Read the circular on the CBIC website and compare its wording with your invoice and cancellation dates.

Confirm that your transaction is within the guidance

The circular addresses a supply of construction service that was cancelled before the service was completed. A booking may involve an agreement for construction, an agreement to sell immovable property, an advance payment, or a combination of documents. Those distinctions can affect both the builder’s contractual deductions and the GST document that should be issued.

Review whether GST was actually shown on tax invoices or other supplier records, whether the builder received and retained the tax, and whether the transaction was cancelled rather than completed or transferred to another purchaser. A general booking receipt without an identified GST charge may not establish the tax amount claimed. The GST mechanism also does not decide whether a builder was entitled to retain a particular cancellation amount under the agreement or other law.

Documents to keep from the first booking through repayment

Make a dated electronic and paper file. Keep originals where possible and preserve clear scans. The following records support different parts of the claim; no single document proves the entire chain.

  • Contract documents: booking form, allotment letter, agreement for sale or construction, amendments, payment schedule, unit details and cancellation clauses. These establish the parties, property, promised service and deductions.
  • Payment evidence: bank statements, transfer confirmations, receipts and payment acknowledgements showing each amount paid to the builder.
  • GST records: every tax invoice, receipt or supplier document identifying the GST charged on the amounts concerned. Match invoice numbers and dates to your payment ledger.
  • Cancellation correspondence: your written cancellation request, delivery or acknowledgement evidence, emails and the builder’s formal cancellation letter.
  • Cancellation-letter date: retain the letter exactly as issued and proof of when it was received. For this type of cancelled long-term construction contract, CBIC uses the supplier’s issuance date as the relevant date for the refund limitation calculation.
  • Refund calculation: obtain a written statement showing gross amounts paid, every deduction, the net amount returned and the GST component the builder says is being repaid or withheld.
  • Adjustment document: keep any credit note, refund voucher or other written tax adjustment. Section 31(3)(e) describes a refund voucher where an advance was received, no supply was made and no tax invoice was issued in pursuance of that advance. Ask the builder which document fits your facts.
  • Prescribed refund evidence: the supplier certificate required by rule 89(2)(kb), Statement 8 in PDF and supporting material showing that you paid and bore the tax and that the amount is refundable. Circular 188 does not reproduce every field, so check the current portal instructions before uploading.
  • Identity and banking: PAN, readiness for Aadhaar authentication and proof of a bank account in your own name linked to PAN. These details are required for the temporary-registration and refund process.
  • Builder communications: retain requests and replies about the credit-note period, invoice references, cancellation date, GST calculation, adjustment filing and repayment status.

Questions to ask your builder in writing

  1. What is the formal cancellation date, and when will you issue the cancellation letter? Ask for the date on the document, not merely the date of a phone call, because CBIC identifies the supplier’s issuance date as the relevant date for this refund claim.
  2. Can you still issue a section 34 credit note for the GST? Request a written answer that identifies the affected invoice numbers, invoice dates and financial year used to determine the credit-note period.
  3. If you say the credit-note period has expired, will you provide the rule 89(2)(kb) supplier certificate and invoice details? You will need those records, along with Statement 8 and other evidence, for an RFD-01 application.
  4. How much will you return, what deductions will you make and how did you calculate the GST portion? Ask for separate figures for the contractual amount retained, the net repayment and the tax component. The special refund can be proportionate when the builder returns less than the amount originally paid.
  5. Which cancellation or forfeiture clause are you applying? Ask what the retained sum represents and what GST treatment the builder has applied to it. Do not accept a generic label such as “cancellation charge” as a complete tax explanation.
  6. Will you issue a credit note, refund voucher or another written adjustment document? The suitable document depends on whether an advance was invoiced and whether any supply was made.
  7. Have you made a GST adjustment connected with this cancellation? Request document references relevant to your claim without assuming that you are entitled to inspect the builder’s entire GST return.

How to file when the credit-note period has expired

Use the following sequence after assembling the records and confirming that the builder will not issue an available section 34 credit note.

  1. Identify the supplier jurisdiction. Note the state or union territory in which the relevant builder is registered. Circular 188 directs an unregistered claimant to use that jurisdiction for temporary registration.
  2. Obtain temporary GST registration. Apply on the GST common portal using your PAN. Complete the Aadhaar authentication process requested by the portal and retain the registration details.
  3. Prepare a PAN-linked bank account. Use an account in your own name and ensure the account and PAN information agree. Keep the bank proof ready for upload or verification.
  4. Organise the claim by supplier. Circular 188 calls for a separate refund application for invoices from different suppliers. If relevant suppliers are registered in different states or union territories, obtain temporary registration in each applicable jurisdiction.
  5. Complete FORM GST RFD-01. Select the category labelled “Refund for unregistered person.” Enter the supplier, invoice and tax information exactly as shown on the builder’s records.
  6. Upload Statement 8 and evidence. Attach Statement 8 in PDF, the supplier’s rule 89(2)(kb) certificate, cancellation letter, payment and invoice evidence, the refund calculation and other documents that demonstrate payment, tax incidence and entitlement. Follow the portal’s current file-size, format and authentication requirements.
  7. Check the claim ceiling. Do not request more than the GST declared on the invoices covered by the application. Reconcile the requested amount with the net money the builder actually returned.
  8. Submit and monitor the application. Save the acknowledgement, application reference and uploaded files. Respond promptly if the proper officer requests clarification or additional records.

For this category of cancelled construction contract, calculate the two-year filing period from the date printed as the supplier’s issuance date on the cancellation letter. Circular 188 also states that a claim below ₹1,000 should not be made. Confirm the current limitation calculation and portal workflow before submission, particularly if the cancellation letter was reissued or corrected.

How the refundable amount is calculated

The GST claim is not automatically equal to every rupee paid at booking. First identify the GST shown on the invoices included in the application. That figure is the upper limit. Then determine how much the builder actually returned after contractual deductions. Where the repayment is lower than the original amount paid, Circular 188 limits the refund to the proportionate GST connected with the returned amount.

Keep two reconciliations: one for the contract (gross payment, retained amount and net repayment) and one for tax (invoice value, GST charged, GST adjusted and GST requested). A builder’s description of a deduction as “GST” does not by itself make that amount refundable. The officer examines completeness and eligibility and issues a sanction order if the claim is approved.

Why a retained cancellation amount needs separate analysis

CBIC Circular 178/10/2022-GST discusses cancellation fees for contracted services and, separately, earnest money forfeited after breach of an agreement to sell immovable property. In the specific earnest-money example, the circular says the payment is compensation for loss rather than consideration for a supply and therefore is not taxable. It also makes clear that taxability depends on the facts.

That example should not be applied automatically to every flat-booking deduction. Compare the wording of your agreement with the actual transaction: determine whether it is an agreement to sell immovable property, a construction-service contract, an advance arrangement or another structure. Ask the builder to identify the legal and contractual basis for each retained sum and the GST treatment used. The circular is available as CBIC Circular 178/10/2022-GST.

Common problems and practical responses

The builder refuses to give a cancellation letter

Send a dated written request that identifies the unit, agreement and requested cancellation date. Preserve delivery evidence. Explain that the supplier’s issuance date is relevant to the special refund period and ask for a formal document rather than relying on an informal email.

The builder says the GST is refundable but gives no calculation

Request an invoice-by-invoice schedule showing tax charged, amount returned, deductions and the proposed adjustment document. Do not file a claim based solely on a rounded verbal figure.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Your name and the bank account do not match

Resolve the mismatch before filing. Circular 188 specifies a PAN-linked bank account in the applicant’s own name; an account belonging to another person can create an eligibility or verification problem.

Several builders or projects are involved

Separate invoices by supplier and registration jurisdiction. Prepare a distinct application for each supplier rather than combining unrelated invoices in one claim.

The portal’s Statement 8 fields differ from an old checklist

Use the current GST portal instructions and retain a copy of the version filed. The circular requires Statement 8 and the supplier certificate but does not set out every field in its text, so an old third-party checklist may omit a current requirement.

Relevant official provisions and sources

Section 34 governs adjustment through credit notes; section 31 includes the refund-voucher provision for specified advance-payment situations; and section 54 contains the statutory refund framework. Read the Central Goods and Services Tax Act, 2017 on the CBIC site.
