Possibly. Being 57 does not, by itself, eliminate the federal 10% early-distribution tax. The key exception can apply when you separated from service with the employer sponsoring your 401(k) during or after the calendar year in which you reached age 55, and you take the distribution from that employer’s qualified plan.
The plan must permit the withdrawal, and avoiding the 10% additional tax does not make the payment tax-free. The taxable portion may still be included in ordinary income. A rollover to an IRA also changes the account type, so do not assume the employer-plan exception will follow the money.

The short answer for someone who is 57
At 57, you may be able to withdraw money from a 401(k) without the federal 10% additional tax if all of these conditions line up:
Recommended Free Tools
- You separated from service with the employer that sponsored the plan during or after the calendar year you reached age 55.
- The money is distributed from that qualifying employer plan, rather than from an IRA to which you later rolled the money.
- The plan’s written terms allow the distribution you are requesting.
If you left that employer before the calendar year in which you turned 55, simply waiting until 57 generally does not make the age-55 exception available. If you are still working for the sponsoring employer, reaching 57 also does not automatically create a withdrawal right or an exception.

The normal age threshold is 59½. Before that age, the 10% additional tax can apply to the taxable part of an early distribution unless an exception applies. The Internal Revenue Service calls this charge an “additional tax”; “early-withdrawal penalty” is the common shorthand.
How the age-55 exception works
It is a calendar-year test
The rule is tied to the calendar year in which you reach 55, not merely to whether you have had a 55th birthday by the day you leave. Separation from service in that year or any later year can satisfy the age requirement. For example, someone who reaches 55 during 2024 and leaves the sponsoring employer at any point in 2024 or later can meet the timing part of the exception, assuming the distribution comes from that employer’s qualifying plan.
The rule is not a general “age 55 account” rule. It follows the employment separation and the plan connected to that employer. A person who left at 54 in an earlier calendar year should not expect a withdrawal at 57 to qualify merely because the person is now older.
“Separated from service” matters
A job change, retirement, or other end of employment can be a separation from service, but the relevant facts are specific to your employment and plan. Taking a leave, reducing hours, or changing roles may not have the same result. Your plan administrator can confirm how the plan records your separation date and whether the distribution is treated as occurring after that separation.
The distribution must come from the qualifying employer plan
The exception is described for a distribution from a qualified retirement plan after separation from service. If you have several old 401(k) accounts, the date you left one employer does not automatically qualify distributions from a different employer’s plan. Keep the employment separation and account source matched when you evaluate the rule.

Situations compared at a glance
| Situation at age 57 | Age-55 exception | What controls the result |
|---|---|---|
| Left the sponsoring employer during or after the calendar year you turned 55; withdrawing from that employer’s 401(k) | May apply | Plan terms, qualifying separation, and the distribution’s taxable portion |
| Left the sponsoring employer before the calendar year you turned 55; withdrawing at 57 | Generally does not apply | Waiting until 57 does not change the earlier separation year |
| Still employed by the sponsoring employer at 57 | Not based on the age-55 separation rule | Whether the plan permits another type of in-service distribution or an exception |
| Rolled the employer-plan money to an IRA before withdrawing | Do not assume it applies | IRA rules and the account’s tax treatment are different from the former employer plan |
The plan can limit access even when the tax exception fits
The tax law and the plan’s access rules are separate questions. The age-55 exception can remove the 10% additional tax, but it does not require a plan to offer a distribution whenever a participant asks.

- Does the plan recognize my separation date as a separation from service?
- Does the plan allow a post-separation lump-sum or installment distribution at my age?
- Are hardship withdrawals, in-service withdrawals, or loans available, and which rules apply to each?
- What paperwork, approval, and timing apply before money is released?
- Will the plan identify the payment as an eligible rollover distribution, and can it be paid directly to another retirement account?
A hardship withdrawal, loan, or other special distribution may have different tax and documentation rules from a standard post-separation withdrawal. Do not assume that a plan feature described in a general benefits summary is available for your particular account or reason for taking money.
Avoiding the 10% tax is not the same as avoiding income tax
The 10% charge is separate from regular federal income tax. IRS guidance says the additional tax applies to the portion of an early distribution that is includible in gross income. Thus, a distribution that qualifies for the age-55 exception can still increase your taxable income for the year.
The amount subject to ordinary income tax depends on the distribution’s tax character and account composition. Do not describe every dollar as automatically taxable without checking whether any part represents previously taxed amounts or another form of basis. Your plan statement and tax adviser can help identify the taxable portion.

If you roll eligible money directly to another retirement arrangement instead of receiving it personally, the rollover can defer current income tax on the rolled amount. A rollover is not the same as taking cash, and it can change which early-distribution rules apply later.

| Charge or treatment | When it can apply | What the age-55 exception changes |
|---|---|---|
| 10% additional tax on early distributions | Generally on the taxable portion of a distribution before age 59½, unless an exception applies | Can remove this additional tax when the qualifying separation and employer-plan conditions are met |
| Regular federal income tax | On the portion includible in gross income under the account’s tax character | Usually remains possible even when the 10% additional tax does not apply |
| Tax on a direct rollover | Eligible amounts transferred directly to another retirement account can generally remain tax-deferred | A rollover is governed by rollover rules and may place the money under different early-distribution rules later |
State income tax, withholding, and the final amount owed depend on your state, total income, account details, and the way the payment is processed. The federal age-55 exception does not determine those items by itself.
Why an IRA rollover can change the answer
The age-55 rule is framed around a distribution from a qualified employer plan after separation from service. An IRA is a different account type. If you move a 401(k) to an IRA and then withdraw at 57, do not assume that the former employer plan’s age-55 exception remains available.
Before requesting a rollover, tell the plan administrator and your tax professional that access before 59½ matters to you. Confirm whether keeping some or all of the money in the employer plan preserves a rule you may need. A rollover decision should account for investment choices and fees, but the distribution rules are an equally important part of the decision.
Other exceptions may exist, but each has conditions
The age-55 provision is not the only possible exception to the 10% additional tax. IRS Publication 575 discusses exceptions that can include substantially equal periodic payments and certain disability-related distributions. These are not general-purpose ways to withdraw whenever you want.

- Substantially equal periodic payments: A payment schedule must satisfy its own technical requirements. Changing or stopping the schedule incorrectly can create additional tax consequences.
- Disability-related distributions: The disability standard and supporting facts matter; ordinary unemployment or a financial setback is not automatically the same thing.
Other exceptions may apply in particular circumstances, but eligibility is fact-specific. Do not select an exception based only on a label in a tax form or a conversation with a call-center representative.

- Identify the exact account. Write down the employer that sponsored the 401(k), the plan name, and whether the money is still in that plan or has been rolled elsewhere.
- Establish your calendar-year milestone. Determine the calendar year in which you turned 55, then compare it with the year your employment with that plan’s sponsor ended.
- Document the separation. Keep the termination notice, retirement paperwork, or other employer record showing when service ended. Ask the administrator how the plan records that date.
- Request the plan’s distribution rules. Use the summary plan description and obtain written confirmation of available forms, minimum amounts, processing time, and any restrictions.
- Classify the payment. Ask how much of the proposed distribution is taxable, whether any amount can be rolled directly to another plan or IRA, and how the payment will be reported.
- Estimate the income effect. Consider the distribution’s ordinary-income impact, federal and state withholding, and whether taking the money in one year changes your overall tax situation.
- Check alternatives. If the plan does not offer the desired payment, ask whether a permitted installment arrangement, loan, hardship withdrawal, or another exception is relevant. Each option has separate rules.
- Get individualized advice. A tax professional can review your separation date, account composition, prior rollovers, and state tax position before you sign the distribution request.
Common mistakes that can trigger an unexpected bill
Relying on age 57 alone
The exception is not activated by your birthday alone. The separation year, employer plan, and distribution source all matter.
Using the wrong employer’s separation date
If you have multiple plans, applying the separation date from one employer to another employer’s 401(k) can produce the wrong result.
Assuming the plan must pay
Tax eligibility does not override the plan document. A plan may restrict in-service or post-separation distributions or require a particular request form.

Rolling everything to an IRA first
Moving the money can change the rules that govern a later withdrawal. Confirm the consequences before initiating a rollover.
Ignoring the taxable portion
Only the amount includible in gross income is the base for the 10% additional tax, but identifying that amount requires accurate account and distribution records.
What the IRS says
“If you are under age 59 ½ at the time of the distribution, any taxable portion not rolled over may be subject to a 10% additional tax on early distributions.”
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
“An employee who receives a distribution from a qualified plan after separation from service is not subject to the 10% additional tax on early distributions if the distribution occurs in the year of turning 55 or older.”
Those statements describe the federal tax framework. Your plan document and personal facts determine whether a requested payment fits it.
When professional review is especially important
Ask for individual tax advice before acting if your employment ended near the calendar year you turned 55, you have several former-employer plans, you have already rolled money to an IRA, you are considering a series of payments, or you are unsure which part of the account is taxable. Also ask about state tax treatment and withholding rather than assuming the federal result answers those questions.
Keep copies of the plan’s explanation, your separation records, distribution election, rollover instructions, and tax reporting forms. Those documents make it easier to correct an administrative mistake and to support your treatment when you prepare your return.
