Usually, no. A borrower generally cannot require a mortgage servicer to be replaced simply because the company is difficult to reach, mishandles an account, or provides poor service. The loan owner or the companies involved in servicing normally decide whether servicing rights are transferred.
You do have enforceable ways to challenge payment errors, request account information, protect your payment history during a transfer, and complain to regulators. Refinancing can let you choose a new lender and potentially a different servicing arrangement, but it is a new loan—not a simple servicer switch.

What a mortgage servicer does
The servicer is the company that handles the day-to-day administration of your mortgage. It usually collects principal and interest, manages escrow for items such as taxes and insurance, sends statements, processes payment changes, and responds to servicing questions. The servicer may not be the company that originally lent you the money or the company that owns the loan.

| Role | What it means for the borrower |
|---|---|
| Lender | The company that originally provided the mortgage funds. |
| Loan owner | The entity that holds the mortgage loan and can arrange for servicing rights to be transferred. |
| Servicer | The company that receives payments, sends statements, administers escrow, and handles servicing inquiries. |
One company can perform more than one role. However, it is common for a borrower to make payments to a different company after the loan is originated. The Consumer Financial Protection Bureau explains the distinction between lenders and servicers.

Can you demand a different servicer?
In most cases, you cannot choose a replacement servicer for an existing mortgage. Servicing rights may be sold or assigned, or the loan owner may hire a subservicer. Those business decisions generally occur without the borrower’s approval. CFPB guidance states that consumers ordinarily have no choice over a servicing transfer; the agency has emphasized that compliance is especially important because borrowers cannot select the transferee.
Your dissatisfaction does not, by itself, create a right to terminate the servicing relationship. Instead, use the federal error-resolution and information-request procedures described below. They create a documented path to obtain an explanation or correction even when the servicer will not change.
A servicer may change for reasons unrelated to a complaint, such as a sale of servicing rights or a change in the loan owner’s servicing contract. If that happens, you receive transfer notices and payment protections; you do not negotiate the identity of the new company.
A loan sale and a servicing transfer are different
When a mortgage is sold, ownership of the loan changes. The company collecting your payments may remain exactly the same. A sale does not automatically alter your interest rate, balance, maturity date, or other loan terms. You should receive an ownership-transfer notice, while a separate servicing-transfer notice applies if the payment-collection company changes.
The CFPB’s explanation of mortgage sales describes why the two events should not be confused: a loan can be sold without changing the servicer or the loan terms.
What happens when servicing is transferred
Federal Regulation X generally requires advance and follow-up notices. The old servicer usually sends its notice at least 15 days before the effective date. The new servicer generally sends its notice no more than 15 days after the transfer. The two companies may combine the information into one notice sent at least 15 days before the effective date.

There are defined exceptions. For example, when a servicing contract ends for cause, or in certain bankruptcy, Federal Deposit Insurance Corporation, or National Credit Union Administration proceedings, a notice may be delayed for as long as 30 days after the transfer. The governing rule is 12 CFR § 1024.33.

The 60-day payment protection
For the first 60 days after a servicing transfer, a payment sent to the old servicer on or before its due date—including an allowed grace period—cannot be treated as late for any purpose. This protection applies when the old servicer receives the payment during that 60-day window. It does not mean you can stop paying, and it does not eliminate the need to update automatic debits or bill-pay instructions.
Use the new servicer’s directions for payments due after the transition period. Keep bank records, canceled checks, confirmation numbers, and copies of both notices in case the payment is later misapplied.
What to do when the servicer mishandles your account
1. Define the problem and preserve evidence
Write down the date, amount, and type of error. Examples include a payment credited to the wrong month, an escrow amount that changed without an understandable explanation, a payoff figure that appears incorrect, or a pending loss-mitigation application that disappears during a transfer.

- Record the names or identification numbers of representatives, the date and time of each call, and what the representative promised.
- Check a recent statement for the servicer’s designated address for written notices of error and requests for information. That address may differ from the ordinary payment address.
2. Send a formal written notice of error or information request
A formal notice should identify the borrower and account, describe the specific error or information needed, and explain why the account appears wrong. Send it using the address and submission method the servicer specifies. Keep a complete copy and proof of delivery.

A routine email, web-chat message, or telephone call may not satisfy the formal process. Follow the instructions on the statement or the servicer’s written communications so the notice reaches the correct department.
CFPB guidance describes a general 30-business-day period for the servicer to respond or resolve the issue. The servicer may have an additional 15 business days if it gives advance notice explaining the reason for the extension. The agency’s overview of these procedures is available in Your mortgage servicer must comply with federal rules.
3. Keep paying undisputed amounts
Continue making payments required by your loan documents for amounts you do not genuinely dispute. A servicing complaint is not a general payment holiday. If a transfer is involved, use the 60-day protection only for the specific situation it covers and still follow the new servicer’s instructions for later payments.

This is tied to the qualifying notice and payment error; it is not a pause on all credit reporting or a guarantee that every account issue will be removed.
4. Escalate if the response is inadequate
If the servicer does not correct the account or explain its position, submit a complaint through the CFPB’s complaint channel. You can also consider your state’s financial regulator and, where appropriate, a HUD-approved housing counselor. A complaint can prompt a response, but no agency can promise a particular outcome in an individual dispute.
5. Protect a pending loss-mitigation application
If you are applying for a modification, repayment plan, or other loss-mitigation option when servicing changes, verify that the new servicer has the complete application and knows every deadline. CFPB transfer guidance specifically identifies a pending application that the new servicer is not handling as a reason to contact both companies with a written request or notice of error. Attach delivery proof and copies of the application materials rather than relying on a verbal handoff.

Can refinancing solve a servicing problem?
Refinancing is the only common way to choose a new lender after a servicing dispute, but it is a separate transaction. The new lender must approve you, the new loan has its own interest rate and fees, and the replacement term and features can change your monthly payment and total interest.
Evaluate a refinance on its complete economics, not only on your frustration with the current servicer:
- Compare the offered interest rate, closing costs, points, and other fees.
- Estimate total cost over the period you expect to keep the home, including the effect of resetting the loan term.
- Check eligibility requirements, including credit, income, equity, and debt-to-income criteria.
- Review whether the new lender states that it will retain servicing or may transfer it later. A stated plan is not a guarantee.
- Consider loan features such as fixed or adjustable rates, prepayment terms, and escrow handling.
Do not treat an approval or a servicing promise as certain until the new loan documents are final. A refinance can also be unavailable or uneconomical if your credit, income, equity, or current market rates do not support it.
Important limits and timing issues
The protections above are general U.S. consumer rules for covered loans. Regulation X has exceptions, and the right response can depend on the loan type, the servicer’s status, state law, foreclosure posture, and the facts of the account. A foreclosure deadline or a time-sensitive loss-mitigation decision calls for prompt advice from a qualified attorney or housing counselor.
Keep following your current loan documents while a dispute is pending. Read every transfer notice, confirm the effective date, and send written correspondence to the designated address. These habits protect your records even when the servicer ultimately remains the same.

Frequently asked questions
Can I choose who services my mortgage at closing?
You can ask a lender about its servicing practices before closing, but the company may later sell servicing rights or appoint a subservicer. Your mortgage documents and disclosures should explain the arrangement; they do not create a permanent right to select a future servicer.

Does a servicing transfer change my interest rate?
No. A transfer changes the company administering the loan, not the contractual terms. An ownership sale likewise does not by itself change the rate, balance, or maturity date.
What if the old and new servicers give different payment instructions?
Compare the notices and effective date, then contact both companies in writing. During the first 60 days after the transfer, a timely payment received by the old servicer cannot be treated as late. Keep proof of the payment and the notices.
Can I stop automatic payments during a transfer?
Do not cancel or redirect an automatic debit without confirming the effective date and the new servicer’s instructions. Update the account promptly, but continue making every required payment and retain confirmation of each change.
Should I hire a company that promises to force a servicer change?
There is no general borrower right to compel a replacement merely because service is poor. Start with the formal notice-of-error process, regulator complaint options, and qualified housing or legal advice before paying anyone who promises a guaranteed transfer or loan outcome.
Frequently Asked Questions
Can a mortgage servicer refuse to correct an error?
A servicer must follow applicable federal error-resolution procedures, but the result depends on the facts and whether the loan is covered. Send a properly addressed written notice and preserve delivery proof.
Will filing a CFPB complaint stop foreclosure?
A complaint does not automatically stop foreclosure or extend a deadline. Continue following the loan documents and obtain prompt legal or housing-counseling advice for a foreclosure matter.
